Analytical Jurisprudence And The Concept Of Commercial Law, John Linarelli Jun 2009

Analytical Jurisprudence And The Concept Of Commercial Law, John Linarelli

Dickinson Law Review (1908-2003)

Commercial lawyers working across borders know that globalization has changed commercial law. To think of commercial law as only the law of states is to have an inadequate understanding of the norms governing commercial transactions. Legal comparativists have argued unpersuasively for a transnational conception of commercial law based on common content among national legal systems. Some have argued for a transnational conception of commercial law, but their grounds of justification have been unpersuasive, often grounded on claims about the common content among national legal systems. Legal positivism is a rich literature on the concept of a legal system and the …

Identifier Les Attitudes Des Étudiants En Géographie Après Leurs Études Secondaires, Burckin Dal

Comparative and International Education / Éducation Comparée et Internationale

‘Buried Beneath The Waves’: Using Gis To Examine The Physical And Social Impact Of A Historical Flood, Mathew Novak, Jason Gilliland Jun 2009

‘Buried Beneath The Waves’: Using Gis To Examine The Physical And Social Impact Of A Historical Flood, Mathew Novak, Jason Gilliland

Geography & Environment Publications

Natural disasters such as floods can periodically disturb and destroy the built and social fabric of communities. Despite their importance, specific ramifications of natural disasters can be overlooked in local histories due to a paucity of data. In this article we bring together several disparate sources of data within a historical geographic information system (HGIS) to study certain physical and social details of the flood which devastated the Town of London West, Canada on 11 July 1883. The integration of historical and contemporary data sources allow for the construction of a three-dimensional model of where the flood likely occurred. With …

The Determinants Of First Nation And Inuit Health: A Critical Population Health Approach, Chantelle A.M. Richmond, Nancy A. Ross

Aboriginal Policy Research Consortium International (APRCi)

Environmental dispossession disproportionately affects the health of Canada’s Aboriginal population, yet little is known about how its effects are sustained over time. We use a critical population health approach to explore the determinants of health in rural and remote First Nation and Inuit communities, and to conceptualize the pathways by which environmental dispossession affects these health determinants. We draw from narrative analysis of interviews with 26 Community Health Representa- tives (CHRs) from First Nation and Inuit communities across Canada. CHRs identified six health determinants: balance, life control, education, material resources, social resources, and environmental/ cultural connections. CHRs articulated the role …

The Handschin Foundation: Liquidation

Swiss American Historical Society Review

The Basel assets of Heinrich Handschin were speedily liquidated. Jakob Wirz renounced the right to buy the house at the Schtitzenmattstrasse, and the Handschin household was liquidated at an auction and the property was sold for the Foundation. Only the disbursing of the legacies of sfr. 25,000.00 to relatives who had not been mentioned in the will took until 1895 because these people also had to prove that they were indeed relatives.

Chinese Mine Warfare: A Pla Navy 'Assassin's Mace' Capability, Andrew S. Erickson, William S. Murray, Lyle J. Goldstein

CMSI Red Books

After a lengthy hiatus-lasting nearly six centuries—China is reemerging as a maritime power, this time with an emphasis on undersea warfare. Between 1996 and 2006, the Chinese navy took delivery of more than thirty submarines.

These vessels include two new classes of nuclear submarines-the advanced Song-class diesel submarines and the Yuan class of diesel boats which, according to some reports, was a surprise for U.S. intelligence. Above and beyond this ambitious naval construction program, the People's Republic of China (PRC) received during 2005-06 an additional eight formidable Kilo-class submarines (and associated weaponry), which were purchased in 2002, to …

Status Of Western Gray Whales Off Northeastern Sakhalin Island, Russia, In 2008, Alexander M. Burdin, Grigory A. Tsidulko, Maxim Sidorenko, Amanda L. Bradford, David W. Weller, Robert L. Brownell Jr.

United States Department of Commerce: Staff Publications

A collaborative Russia-U.S. research program on western gray whales (Eschrichtius robustus) summering off northeastern Sakhalin Island, Russia, has been ongoing since 1995 and has produced important information on the present day conservation status of this critically endangered population. This paper reviews findings from 2008 research activities and combines such with data from previous years, in some cases ranging back to an opportunistic survey in 1994. Photo-identification research conducted off Sakhalin Island in 2008 resulted in the identification of 45 whales, including three calves. No previously unidentified non-calves were observed. When combined with data from 1994-2007, a catalog of …

Birth-Intervals And Sex Composition Of Western Gray Whales Summering Off Sakhalin Island, Russia, David W. Weller, Amanda L. Bradford, Aimée R. Lang, Robert L. Brownell Jr., Alexander M. Burdin Jun 2009

Birth-Intervals And Sex Composition Of Western Gray Whales Summering Off Sakhalin Island, Russia, David W. Weller, Amanda L. Bradford, Aimée R. Lang, Robert L. Brownell Jr., Alexander M. Burdin

United States Department of Commerce: Staff Publications

Determining the birth-interval at which reproductive females produce calves is an indispensable component of studies on the population biology of large whales. In theory, shorter birth-intervals will result in a faster rate of population increase. Therefore, estimating this reproductive parameter is particularly important for modeling exercises designed to project the potential growth of a given population and, in the case of endangered populations, their ability to recover from a depleted state (e.g. Cooke et al., 2008). While a number of inherent biases exist with respect to determination of birth-intervals for baleen whales (Barlow and Clapham, 1997), dedicated sampling efforts and …

Subsidies For Fdi: Implications From A Model With Heterogeneous Firms, Davin Chor Jun 2009

Subsidies For Fdi: Implications From A Model With Heterogeneous Firms, Davin Chor

Research Collection School Of Economics

This paper analyzes the welfare effects of subsidies to attract multinational corporations when firms are heterogeneous in their productivity levels. I show that the use of a small subsidy raises welfare in the FDI host country, with the consumption gains from attracting more multinationals exceeding the direct cost of funding the subsidy program through a tax on labor income. This welfare gain stems from a selection effect, whereby the subsidy induces only the most productive exporters to switch to servicing the host's market via FDI. I further show that for the same total subsidy bill, a subsidy to variable costs …

The Language Of Law And The Practice Of Politics: Great Powers And The Rhetoric Of Self-Determination In The Cases Of Kosovo And South Ossetia, Christopher J. Borgen Jun 2009

The Language Of Law And The Practice Of Politics: Great Powers And The Rhetoric Of Self-Determination In The Cases Of Kosovo And South Ossetia, Christopher J. Borgen

Chicago Journal of International Law

I will use one topic area-arguments over self-determination-and two cases-Kosovo and South Ossetia-to explore this relationship between the language of law and the practice of politics. This Article begins by briefly setting the background of the Kosovar and South Ossetian conflicts. Section III is a quick primer on the evolution of the concept of self-determination and its at-times difficult coexistence with the concepts of sovereignty and territorial integrity. Section IV turns to the analysis of how legal argumentation was used by Russia, the US, and the EU in the cases of Kosovo and South Ossetia. Although I note the relative …

Forest Disturbance And Recovery: A General Review In The Context Of Spaceborne Remote Sensing Of Impacts On Aboveground Biomass And Canopy Structure, Steve Frolking, Michael W. Palace, D B. Clark, Jeffrey Q. Chambers, H H. Shugart, George C. Hurtt Jun 2009

Forest Disturbance And Recovery: A General Review In The Context Of Spaceborne Remote Sensing Of Impacts On Aboveground Biomass And Canopy Structure, Steve Frolking, Michael W. Palace, D B. Clark, Jeffrey Q. Chambers, H H. Shugart, George C. Hurtt

Earth Sciences

Abrupt forest disturbances generating gaps >0.001 km2 impact roughly 0.4–0.7 million km2a−1. Fire, windstorms, logging, and shifting cultivation are dominant disturbances; minor contributors are land conversion, flooding, landslides, and avalanches. All can have substantial impacts on canopy biomass and structure. Quantifying disturbance location, extent, severity, and the fate of disturbed biomass will improve carbon budget estimates and lead to better initialization, parameterization, and/or testing of forest carbon cycle models. Spaceborne remote sensing maps large-scale forest disturbance occurrence, location, and extent, particularly with moderate- and fine-scale resolution passive optical/near-infrared (NIR) instruments. High-resolution remote sensing (e.g., ∼1 …

Symmetry And Selectivity: What Happens In International Law When The World Changes, Paul B. Stephan Jun 2009

Symmetry And Selectivity: What Happens In International Law When The World Changes, Paul B. Stephan

Chicago Journal of International Law

This Article has a simple hypothesis: selectivity in international law increases as international relations become more symmetrical. Conversely, international law becomes more universal as asymmetry grows. This relationship holds true during the modern period. Its existence in turn supports the theoretical claim that the content of international law reflects the rational interests of those actors that make it.

Holocene Lake-Level Trends In The Rocky Mountains, Usa, Bryan Shuman, Anna K. Henderson, Steven M. Colman, Jeffery R. Stone, Sherilyn C. Fritz, Lora R. Stevens, Mitchell J. Power, Cathy Whitlock

Department of Earth and Atmospheric Sciences: Faculty Publications

The availability of water shapes life in the western United States, and much of the water in the region originates in the Rocky Mountains. Few studies, however, have explicitly examined the history of water levels in the Rocky Mountains during the Holocene. Here, we examine the past levels of three lakes near the Continental Divide in Montana and Colorado to reconstruct Holocene moisture trends. Using transects of sediment cores and sub-surface geophysical profiles from each lake, we find that mid-Holocene shorelines in the small lakes (4–110 ha) were as much as ~10 m below the modern lake surfaces. Our results …

Gis-Based Safety Bus Stops-Serdang And Seri Kembangan Case Study, Khaled Hazaymeh Jun 2009

Gis-Based Safety Bus Stops-Serdang And Seri Kembangan Case Study, Khaled Hazaymeh

Journal of Public Transportation

Enhancing a bus transit system is a possible solution to the growth of congestion in urban areas. Issues related to the safety of bus passengers, either on board or during their travel to a bus stop, should be considered. This article presents a GIS method to identify risky bus stops on a single bus route in the Serdang and Seri Kempangan area according to three attributes: location, characteristics, and surface. The aim is to improve the safety of bus stops in the area. Results show that GIS is a good tool to achieve the purpose of this study.

An Agenda For Teaching International Economic An Agenda For Teaching International Economic Law In Indian Law Schools, Seema Sapra Jun 2009

An Agenda For Teaching International Economic An Agenda For Teaching International Economic Law In Indian Law Schools, Seema Sapra

Indian Journal of International Economic Law

At this time of India’s ongoing ‘Great Transformation,’ legal educators and researchers in India need to pay greater attention to international economic law (IEL). New agendas for IEL teaching in India must derive from and support domestic ‘reform’ objectives. An important conceptual links between broad issues of reform in India and IEL teaching in the classroom relates to what reform means or should mean. It is suggested that IEL teaching in India more actively engage with domestic issues arising on account of the liberalisation of India’s external trade as well as the liberalisation of its domestic economy, and also bigger …

Household Attributes In A Transit-Oriented Development: Evidence From Taipei, Jen-Jia Lin, Ya-Chun Jen

Journal of Public Transportation

This empirical study of the Metro Danshui Line in Taipei analyzed the attributes of households residing in “areas with significant attributes of TOD built environment” (TOD+) by applying a questionnaire survey and binary logit model. The empirical results were the following: household income, household size, and floor space needs are negatively associated with TOD+; the presence of children or elderly family members and preference for dense development, mixed land use and public facilities are positively related to TOD+. Based on the empirical findings of this study and the objective of deploying TODs near metro stations, general strategic directions for land …

The Effects Of The Security Environment On Military Expenditures: Pooled Analyses Of 165 Countries, 1950-2000, William D. Nordhaus, John R. Oneal, Bruce Russett

Cowles Foundation Discussion Papers

Countries’ military expenditures differ greatly across both space and time. This study examines the determinants of military spending, with particular reference to the importance of the external security environment. Using the liberal-realist model of international relations, we first estimate the probability that two countries will be involved in a fatal militarized interstate dispute. We then aggregate these ex ante estimates of the likelihood of dyadic conflict, calculating the annual joint probability that a country will be involved in a fatal dispute. This is our measure of the external threat. We then estimate the level of military spending by country and …
