Symposium: Oiling The Schoolhouse Gate: After Forty Years Of Tinkering With Teachers' First Amendment Rights, Time For A New Beginning , Alexander Wohl

American University Law Review

This Article will examine how (and how far) we have fallen from the legal precedent and educational principles behind Tinker, specifically the increasingly remote standards courts have used to chip away (and sometimes sledgehammer) the speech rights of teachers. To this end, the Article will consider some of the unique and fundamental characteristics associated with a profession that has at its core the mission of encouraging speech, raising questions, and teaching the ability to think—in short, “expressive activities.” It will also look at how the increasingly restrictive standards do not reflect fully the challenges posed by the advent of new …

Out Of Jail... But Still Not Free To Litigate - Using Congressional Intent To Interpret 28 U.S.C. Sec. 1915(B)'S Application To Released Prisoners, Julia Colarusso Jan 2009

Out Of Jail... But Still Not Free To Litigate - Using Congressional Intent To Interpret 28 U.S.C. Sec. 1915(B)'S Application To Released Prisoners, Julia Colarusso

American University Law Review

This Comment argues that, based on the Prison Litigation Reform Act (PLRA)’s purpose and legislative history, prisoners who fulfilled the statute’s payment obligations while incarcerated should be entitled to apply for traditional in forma pauperis (IFP) status under § 1915(a)(1) upon release. Part I traces the historical development of prisoners’ right of access to the courts and its ties to the IFP doctrine. It then examines the PLRA’s many amendments to the federal IFP statute. Part II explains the divergent readings that circuit courts currently apply to § 1915(b). After analyzing the statute’s plain language and legislative history, Part III …

Adolescent Religiosity As A Protective Factor For Delinquency: Review Of Evidence And A Conceptual Framework For Future Research, Robert D. Laird, Matthew D. Marrero, Loren D. Marks

Faculty Publications

The first section of this chapter reviews evidence showing that although greater religiosity has been associated with less involvement in delinquent and analogous behaviors, the mechanisms and processes through which religiosity is linked too delinquent behavior are not well understood. In the second section of the chapter, a conceptual framework and theory for studying the religion-delinquency association will be presented. The framework adapts and builds on Gottfredson and Hirschi's (1990) General Theory of Crime. The third section of the chapter presents results off the initial study guided by the framework. Data are drawn from a longitudinal study of development during …

Religious Affiliation As A Correlate Of Linguistic Behavior, Wendy Baker-Smemoe, David Bowie Jan 2009

Religious Affiliation As A Correlate Of Linguistic Behavior, Wendy Baker-Smemoe, David Bowie

Faculty Publications

The current study examined whether religious affiliation in Utah County, Utah affected the production of several vowel mergers typical of the area (i.e., fell-fail, pool-pole-pull,card-cord). To do so, we asked selfidentified members of the Church of Jesus Christ of Latter-day Saints (Mormons) and self-identified non- Mormons to produce these vowel contrasts. Next, three naïve raters trained in phonetics but unfamiliar with how English is spoken in Utah were asked to judge which of the two vowels in a vowel pair contrast was produced by the speakers. Findings demonstrated clear evidence of differences based on selfdescribed religious affiliation for several of …

This research explored "aging in place" among women age 65 and older living in Newton, Massachusetts. Study goals were to understand: the "places" that comprise the environment of "aging in place"; the factors that enable "aging in place"; "aging in place" in a suburb; and to refine definitions of "aging in place" Interviews with women used open-ended questions about women‘s early years in Newton and the changes they experienced in personal status, and places over time. Themes emerged using modified grounded theory with inductive and deductive approaches, and which acknowledged "sensitizing concepts". Six places comprised the "aging in place" environment: …

Flame, Furnace, Fuel: Creating Kansas City In The Nineteenth Century, Twyla Dell Jan 2009

Flame, Furnace, Fuel: Creating Kansas City In The Nineteenth Century, Twyla Dell

Antioch University Dissertations & Theses

Though this work is a fuel and energy history of Kansas City from 1820 to 1920, it also provides a tool to describe and analyze fuel and energy transitions. The four parts follow the rise and fall of wood, coal and oil as their use grows to a peak and, in the case of wood, declines. The founding and growth of Kansas City as an “instant city” that grew from zero population to over three hundred twenty thousand in a hundred years embodies the increased use of fuels and energy in an urban setting and serves as a case study. …

Faculty, Staff and Student Publications

Human papilloma virus (HPV) infection of the uterine cervix is linked to the pathogenesis of cervical cancer. Preclinical in vitro and in vivo studies using HPV-containing human cervical carcinoma cell lines have shown that the mammalian target of rapamycin (mTOR) inhibitor, rapamycin, and epidermal growth factor receptor (EGFR)-tyrosine kinase inhibitor, erlotinib, can induce growth delay of xenografts. Activation of Akt and mTOR are also observed in cervical squamous cell carcinoma and, the expression of phosphorylated mTOR was reported to serve as a marker to predict response to chemotherapy and survival of cervical cancer patients. Therefore, we investigated: a) the expression …

A Comparison Of The Communal Lament Psalms And The Treaty-Covenant Formula, Dan Belnap, Daniel L. Belnap Jan 2009

A Comparison Of The Communal Lament Psalms And The Treaty-Covenant Formula, Dan Belnap, Daniel L. Belnap

Faculty Publications

Within the corpus of psalms in the Hebrew Bible is a group known as the communal laments. Characterized by their use of the first person common plural pronoun, some type of calamity experienced by the community, and a petition to God, these psalms incorporate similar imagery, terminology, and structure. This study explores these psalms and suggests that they relate closely to the Hittite treaty-covenant formula found elsewhere in the Hebrew Bible, yet differ in that they reflect an ongoing covenantal relationship rather than the establishment of such. Thus, these psalms emphasize Israel’s expectation that God, as the senior covenantal party, …

Cultural Power And Utopianism In Laurie Halse Anderson's Prom And M.T. Anderson's Feed, Leah Dinatale

College of Graduate Studies: Theses & Dissertations

Author's abstract: Resourcefully and responsibly obtaining a sense of power is central to quality young adult literature. Laurie Halse Anderson's Prom and M.T. Anderson's Feed show their adolescent protagonists' struggles with identity formation, consumerism, and the adult world. In order to address power relationships, the two novels address the rise of a global electronic and print media system that collapses traditional notions of time and space and the excessive consumption associated with the culture such a system creates. However, these two novels explore postmodern consumer culture from different perspectives. Prom functions as a utopian, revisionist fairy tale in which the …

Electrical and Computer Engineering Faculty Research & Creative Works

Analytical models for vias and traces are presented for simulation of multilayer interconnects at the package and printed circuit board levels. Vias are modeled using an analytical formulation for the parallel-plate impedance and capacitive elements, whereas the trace-via transitions are described by modal decomposition. It is shown that the models can be applied to efficiently simulate a wide range of structures. Different scenarios are analyzed including thru-hole and buried vias, power vias, and coupled traces routed into different layers. by virtue of the modal decomposition, the proposed method is general enough to handle structures with mixed reference planes. for the …

Role Of Inspiration In Increasing Situational Motivation In Male Team Athletes, Stephen Patrick Gonzalez Jan 2009

Role Of Inspiration In Increasing Situational Motivation In Male Team Athletes, Stephen Patrick Gonzalez

College of Graduate Studies: Theses & Dissertations

Motivation and inspiration are often used superficially and synonymously in media coverage of sport. Sportscasters and reporters speculate about athlete motivation cite inspirational locker room speeches from coaches as a motivational source. Research in and out of sport psychology has developed and verified theories to describe mechanisms of motivation change (Deci & Ryan, 1985; Vallerand, 1997), but there is little research on the role of inspiration (Thrash & Elliot; 2003, 2004). The current study aimed to determine if inspiration can be manipulated, and if so, how increased inspiration impacts situational motivation of athletes. A two-way repeated measures ANOVA revealed that …

New Techniques For Measuring Impedance Characteristics Of Three-Phase Ac Power Systems, Yakov A. Familiant, Keith Corzine Jan 2009

New Techniques For Measuring Impedance Characteristics Of Three-Phase Ac Power Systems, Yakov A. Familiant, Keith Corzine

Electrical and Computer Engineering Faculty Research & Creative Works

Naval ships as well as aerospace power systems are incorporating an increasing amount of power electronic switching sources and loads. Although these power-electronics-Based components provide exceptional performance, they are prone to instability due to their constant power characteristics that lead to negative impedance. When designing these systems, integrators must consider the impedance versus frequency at a power system interface (which designates source and load). Stability criteria have been developed in terms of source and load impedance for both dc and ac power systems, and it is often helpful to have techniques for impedance measurement. for dc power systems, the measurement …

In this paper, direct dynamic programming techniques are utilized to solve the Hamilton Jacobi-Bellman equation forward-in-time for the optimal tracking control of general affine nonlinear discrete-time systems using online approximators (OLA's). the proposed approach, referred as adaptive dynamic programming (ADP), is utilized to solve the infinite horizon optimal tracking control of affine nonlinear discrete-time systems in the presence of unknown internal dynamics and a known control coefficient matrix. the design is implemented using OLA's to realize the optimal feedback control signal and the associated cost function. the feedforward portion of the control input is derived and approximated using an additional …

Improved Frequency Domain Channel Estimation And Equalization For Mimo Wireless Communications, Jian Zhang, Yahong Rosa Zheng Jan 2009

Improved Frequency Domain Channel Estimation And Equalization For Mimo Wireless Communications, Jian Zhang, Yahong Rosa Zheng

Electrical and Computer Engineering Faculty Research & Creative Works

This paper introduces an improved frequency domain channel estimation method based on interpolation vectors for single carrier frequency domain equalization (SC-FDE) with the multiple-input multiple-output (MIMO) scheme. the proposed algorithm is derived by employing the least squares (LS) criterion, and a specified application for the wide sense stationary uncorrelated scattering (WSSUS) Rayleigh fading channel is presented. the channel frequency domain responses estimated at two adjacent pilot blocks are used to track the time-variant channel information, which can effectively improve the accuracy of channel estimation without significantly increasing complexity. Maximum mean square error (MMSE) frequency domain equalization based on the estimated …
