The Single-Purpose Container Exception: A Logical Extension Of The Plain View Doctrine Made Unworkable, Daniel Kegl Nov 2009

The Single-Purpose Container Exception: A Logical Extension Of The Plain View Doctrine Made Unworkable, Daniel Kegl

Northern Illinois University Law Review

This Comment examines the single-purpose container exception to the Fourth Amendment's warrant requirement. Since the exception was recognized in Arkansas v. Sanders and revisited in Robbins v. California, the federal circuits have not agreed as to what evidence courts can consider when deciding whether or not to apply the exception to a particular container. While some circuits allow specialized police knowledge and the circumstances surrounding the container's discovery to be considered, most disallow this evidence in making the same determination. As a result, the continued use of the single-purpose container exception results in an inconsistent application of the Fourth Amendment …

Comparison Of Gpa Between Students Involved And Uninvolved In A Relationship, Jessica M. Vaeth Nov 2009

Comparison Of Gpa Between Students Involved And Uninvolved In A Relationship, Jessica M. Vaeth

Undergraduate Psychology Research Methods Journal

College is a journey full of living, failing, learning and experiences that brings an individual a little bit further along life. In today’s society, relationships are existent in many universities, and some students may be faced with that exact same dilemma. I decided to do my research project on a comparison of GPA between students who are in a relationship and those we are not. A relationship is defined as follows: a romantic, committed bond between two people for a minimum of a month. I assessed this information by distributing a 10 question survey to 92 undergraduate college students. After …

Exploiting Multiple Sensory Modalities In Brain-Machine Interfaces, Aaron J. Suminski, Dennis C. Tkach, Nicholas G. Hatsopoulos

Biomedical Engineering Faculty Research and Publications

Recent improvements in cortically-controlled brain-machine interfaces (BMIs) have raised hopes that such technologies may improve the quality of life of severely motor-disabled patients. However, current generation BMIs do not perform up to their potential due to the neglect of the full range of sensory feedback in their strategies for training and control. Here we confirm that neurons in the primary motor cortex (MI) encode sensory information and demonstrate a significant heterogeneity in their responses with respect to the type of sensory modality available to the subject about a reaching task. We further show using mutual information and directional tuning analyses …

Nra V. City Of Chicago: Does The Second Amendment Bind Frank Easterbrook?, Richard A. Epstein Nov 2009

Nra V. City Of Chicago: Does The Second Amendment Bind Frank Easterbrook?, Richard A. Epstein

Coase-Sandor Institute for Law & Economics Research Paper Series

In NRA v. City of Chicago, Judge Easterbrook held that the Second Amendment, which protects the right to keep and bear arms, did not bind state governments. This article examines the reasoning that he uses to reach that result, which it contrasts with the style of argumentation that led to the opposite conclusion in Judge O'Scannlain's decision in Norkdye v. King. Easterbrook's approach emphasized the imperative need for lower court deference to the Supreme Court's explicit Reconstruction Era holdings that the Second Amendment does not bind the states, even after the Supreme Court's game-changing decision in District of Columbia V. …

Computer-Generated Global Map Of Valley Networks On Mars, W. Luo, T.F. Stepinski Nov 2009

Computer-Generated Global Map Of Valley Networks On Mars, W. Luo, T.F. Stepinski

Faculty Articles, Papers, and Other Scholarship

The presence of valley networks (VN) on Mars suggests that early Mars was warmer and wetter than present. However, detailed geomorphic analyses of individual networks have not led to a consensus regarding their origin. An additional line of evidence can be provided by the global pattern of dissection on Mars, but the currently available global map of VN, compiled from Viking images, is incomplete and outdated. We created an updated map of VN by using a computer algorithm that parses topographic data and recognizes valleys by their morphologic signature. This computer-generated map was visually inspected and edited to produce the …

Teaching Biblical Studies Online, Steve Delamarter, Sandra L. Gravett, Daniel W. Ulrich, Richard W. Nysse, Sandra Hack Polaski

Faculty Publications - Portland Seminary

In this edited transcript of a panel at the Society of Biblical Literature (November 23, 2009, Boston, Massachusetts), five Bible scholars give brief presentations on various challenges and opportunities encountered when teaching academic biblical studies courses online in both undergraduate and theological education contexts. Each presentation is followed by questions from the audience and discussion. Topics include: a typology of different approaches to online teaching, advantages and disadvantages of online compared to face-to-face classrooms (for both students and faculty), opportunities for imaginative exercises online, the advantages of online threaded discussions, and the joys and pitfalls of bringing your course into …

Sustainable Intermodal Freight Transportation: Applying The Geospatial Intermodal Freight Transport Model, Bryan Comer Nov 2009

Sustainable Intermodal Freight Transportation: Applying The Geospatial Intermodal Freight Transport Model, Bryan Comer

Theses

To study the energy and environmental impacts of emissions associated with freight transportation, the Geospatial Intermodal Freight Transport (GIFT) model was created as a joint research collaborative between the Rochester Institute of Technology (RIT) and the University of Delaware (UD). The GIFT model is a Geographic Information Systems (GIS) based model that links the U.S. and Canadian water, rail, and road transportation networks through intermodal transfer facilities to create an intermodal network. The purpose of my thesis is to apply the GIFT model to examine potential public policies related to intermodal freight transportation in the Great Lakes region of the …

Relevance And Simulation In Metaphor, L. David Ritchie Nov 2009

Relevance And Simulation In Metaphor, L. David Ritchie

Communication Faculty Publications and Presentations

Recent writings have done much to develop and extend Relevance Theory as an account of metaphors and other "loose" language use. However, it is argued in this essay that Relevance Theory still leaves important gaps in its explanation and does not adequately address the "circularity" issue that has been raised. It is proposed that Perceptual Simulation Theory usefully extends Relevance Theory by providing a detailed cognitive mechanism for the "broadening" and "narrowing" specified by Relevance Theory. Extending Relevance Theory to include the cognitive mechanisms posited by Perceptual Simulation Theory also extends the reach of Relevance theory and enhances its ability …

Activity-Aware Ecg-Based Patient Authentication For Remote Health Monitoring, Janani Sriram, Minho Shin, Tanzeem Choudhury, David Kotz Nov 2009

Activity-Aware Ecg-Based Patient Authentication For Remote Health Monitoring, Janani Sriram, Minho Shin, Tanzeem Choudhury, David Kotz

Dartmouth Scholarship

Mobile medical sensors promise to provide an efficient, accurate, and economic way to monitor patients' health outside the hospital. Patient authentication is a necessary security requirement in remote health monitoring scenarios. The monitoring system needs to make sure that the data is coming from the right person before any medical or financial decisions are made based on the data. Credential-based authentication methods (e.g., passwords, certificates) are not well-suited for remote healthcare as patients could hand over credentials to someone else. Furthermore, one-time authentication using credentials or trait-based biometrics (e.g., face, fingerprints, iris) do not cover the entire monitoring period and …

School of Science Faculty Works

The human genome, human endogenous retroviruses (HERV), of which HERV-K113 and HERV-K115 are the only known full-length proviruses that are insertionally polymorphic. Although a handful of previously published papers have documented their prevalence in the global population; to date, there has been no report on their prevalence in the United States population. Here, we studied the geographic distribution of K113 and K115 among 156 HIV-1+ subjects from the United States, including African Americans, Hispanics, and Caucasians. In the individuals studied, we found higher insertion frequencies of K113 (21%) and K115 (35%) in African Americans compared with Caucasians (K113 9% and …
