Reconstructing The Responsibility To Protect In The Wake Of Cyclones And Separatism, Jarrod Wong Jan 2009

Reconstructing The Responsibility To Protect In The Wake Of Cyclones And Separatism, Jarrod Wong

McGeorge School of Law Scholarly Articles

This Article reconceptualizes the doctrine of the responsibility to protect (R2P). R2P provides that when a government fails to protect its citizens from genocide, war crimes, ethnic cleansing or crimes against humanity (“mass atrocities”), that responsibility shifts to the international community acting through the United Nations.

The U.N.'s apparent failure to include natural disasters in the catalogue of harms potentially justifying R2P intervention generated considerable controversy following Myanmar's refusal of foreign aid following the devastation wrought by Cyclone Nargis. Those seeking to limit the scope of R2P considered it inapplicable in the case of Myanmar, reading the U.N.'s focus on …

Vico And Imagination: An Ingenious Approach To Educating Lawyers With Semiotic Sensibility, Francis J. Mootz Iii Jan 2009

Vico And Imagination: An Ingenious Approach To Educating Lawyers With Semiotic Sensibility, Francis J. Mootz Iii

McGeorge School of Law Scholarly Articles

Law is a specialized semiotic realm, but lawyers generally are ignorant of this fact. Lawyers may manage meaning, but they also are managed by meaning. Seemingly trapped by the weight of pre-existing signs, their attempts to manage these meanings generally are limited to technical interventions and instrumentalist strategies. Signs have power over lawyers because they are embedded in narratives, a semiotic economy that confronts the lawyer as ‘‘given’’ even though it is dynamic and constantly under construction. Most lawyers do not make meaning through legal narratives; rather, they parrot bits of the controlling narratives in response to certain problems. Because …

Deficiencies In The Practicum Phase Of Field-Based Education: Students’ Views, Edwin Ralph, Keith Walker, Randy Wimmer

Northwest Journal of Teacher Education

A supervised practical experience of on-the-job training forms an essential part of the pre-service preparation of professionals across disciplines. This article reports results from a recent study examining the views of 234 teacher candidates regarding the most negative aspects of their experiences in the 16-week extended-practicum. Four broad themes reflected the post-interns’ responses on the negative elements: (a) individual personal/professional challenges, (b) site-based interpersonal concerns, (c) university- related policy/procedural problems, and (d) practicum-office difficulties. Implications are discussed for the practicum leaders of this program and those from other institutions interested in preventing or reducing such limitations from hampering the effectiveness …

A Guided Neighborhood Search Applied To The Split Delivery Vehicle Routing Problem, Rafael E. Aleman Jan 2009

A Guided Neighborhood Search Applied To The Split Delivery Vehicle Routing Problem, Rafael E. Aleman

Browse all Theses and Dissertations

The classic vehicle routing problem considers the distribution of goods to geographically scattered customers from a central depot using a homogeneous fleet of vehicles with finite capacity. Each customer has a known demand and can be visited by exactly one vehicle. Each vehicle services the assigned customers in such a way that all customers are fully supplied and the total service does not exceed the vehicle capacity. In the split delivery vehicle routing problem, a customer can be visited by more than one vehicle, i.e., a customer demand can be split between various vehicles. Allowing split deliveries has been proven …

Due-B, A New Human Dna Replication Protein, Is The Functional Homolog Of S. Cerevisiae Sld3, Jianhong Yao Jan 2009

Due-B, A New Human Dna Replication Protein, Is The Functional Homolog Of S. Cerevisiae Sld3, Jianhong Yao

Browse all Theses and Dissertations

DNA unwinding elements (DUEs) are commonly found at DNA replication origins. The DUE binding protein (DUE-B) is crucial for the initiation of DNA replication in eukaryotes. The unique 59 amino acid C-terminal part of DUE-B shares nearly 50% similarity with yeast the C-terminus of Sld3. DUE-B plays a key role in eukaryotic DNA replication because it is required for the loading of Cdc45, the MCM helicase activator, on chromatin. Here we show that DUE-B, just like yeast Sld3, binds to Cdc45 and TopBP1 through its C-terminus in Sf9 cells and in vitro. We also show that DUE-B, Cdc45 and TopBP1 …

Electronic To Vibrational Energy Transfer From Cl* (2P1/2) To Ch4 And Cd4, Brian R. Munson Jan 2009

Electronic To Vibrational Energy Transfer From Cl* (2P1/2) To Ch4 And Cd4, Brian R. Munson

Browse all Theses and Dissertations

Electronic-to-vibrational (E-V) energy transfer is a significant kinetic channel in the collisional quenching of spin-orbit excited chlorine atoms, Cl* (2P1/2, 882 cm-1), by molecular collision partners. In the present study Cl* atoms are prepared in the presence of CH4 or CD4, under pseudo first-order conditions, by photolysis of ICl at 532 nm with a pulsed Nd:YAG laser. Quenching of Cl* by CH4 or CD4 results in E-V excitation of the ν4 asymmetric bending mode as observed by infrared (IR) fluorescence from the vibrationally excited products. Time-resolved …

Trusted Querying Over Wireless Sensor Networks And Network Security Visualization, Giovani Rimon Abuaitah

Browse all Theses and Dissertations

Wireless sensor networks (WSNs) as an emerging technology faces numerous challenges. Sensor nodes are usually resource constrained. Sensor nodes are also vulnerable to physical attacks or node compromises. Answering queries over data is one of the basic functionalities of WSNs. Both resource constraints and security issues make designing mechanisms for data aggregation particularly challenging. In this thesis, we first explore the various security techniques for data aggregation in WSNs then we design and demonstrate the feasibility of an innovative reputation-based framework rooted in rigorous statistical theory and belief theory to characterize the trustworthiness of individual nodes and data queries in …

Computational Analysis Of Metabolomic Toxicological Data Derived From Nmr Spectroscopy, Benjamin J. Kelly Jan 2009

Computational Analysis Of Metabolomic Toxicological Data Derived From Nmr Spectroscopy, Benjamin J. Kelly

Browse all Theses and Dissertations

Nuclear magnetic resonance (NMR) spectroscopy is a non-invasive method of acquiring metabolic profiles from biofluids. The most informative metabolomic features, or biomarkers, may provide keys to the early detection of changes within an organism such as those that result from exposure to a toxin. One major difficulty with typical NMR data, whether it come from a toxicological, medical or other source, is that it features a low sample size relative to the number of variables measured. Thus, traditional pattern recognition techniques are not always feasible. The "curse of dimensionality" is an important consideration in selecting appropriate statistical and pattern recognition …

Dose-Dependent Effects Of Oxygen On Metabolism In Rat Cortico-Hippocampal Brain Tissue Slices, Jennifer Lynne Hollyfield Jan 2009

Dose-Dependent Effects Of Oxygen On Metabolism In Rat Cortico-Hippocampal Brain Tissue Slices, Jennifer Lynne Hollyfield

Browse all Theses and Dissertations

Studies have shown that 95% oxygen increases neuronal excitability and ROS production. We wanted to investigate the dose-dependent effects of oxygen on brain slice metabolism. We exposed rat brain cortico-hippocampal tissue slices to 0.40, 0.95, and 4.50 ATA O2 for 60 minutes, made dual-phase tissue extracts, and used multi-nuclear NMR experiments to elucidate the slice metabolism. We found that low doses of oxygen may shift metabolism toward anaerobic glycolysis. Elevated lactate suggests this shift, along with elevated ratios of NAD+/NADH which may drive the reactions toward the production of lactate. The results also suggest that high doses of oxygen may …

Creating Safety In The Diagnostic Testing Processes Of Family Medical Practices, Timothy Ryan Mcewen Jan 2009

Creating Safety In The Diagnostic Testing Processes Of Family Medical Practices, Timothy Ryan Mcewen

Browse all Theses and Dissertations

Four mid-Western family practices were studied using three methods (observations, interviews, and an audit of patient records) in effort to discover the dynamics and constraints of their diagnostic testing processes. We have found further evidence that errors do occur at many of the steps in the processes, but that the patterns of those errors are not independent of each other and are a function of systemic factors unique to each practice. Furthermore, while many employees or steps in the process may be considered a source of error, they were also shown to be major sources of quality and safety in …

Dynamic Decision Making In Surgery, Lisa Marie Kervin Jan 2009

Dynamic Decision Making In Surgery, Lisa Marie Kervin

Following Dominguez (1997), we tested for differences among 10 resident surgeons' eye-scanning patterns during a laparoscopic cholecystectomy video. We measured time, number of fixations on anatomy and instruments, discomfort level ratings, notation of cystic artery, and conversion to open-incision. We expected our 10 residents would fall into two scanning strategies, proactive or reactive. Proactive strategists were defined as more skilled (year in residency, cases performed), anticipatory of danger (time and fixations on anatomy), observant of the pulsing cystic artery, and converting from laparoscopy to open when highly uncomfortable. Reactive strategists were expected to spend more time on instruments, have low …

A Predictive Model Of Cognitive Performance Under Acceleration Stress, Richard Andrew Mckinley Jan 2009

A Predictive Model Of Cognitive Performance Under Acceleration Stress, Richard Andrew Mckinley

Browse all Theses and Dissertations

Extreme acceleration maneuvers encountered in modern agile fighter aircraft can wreak havoc on human physiology thereby significantly influencing cognitive task performance. Increased acceleration causes a shift in local arterial blood pressure and profusion causing declines in regional cerebral oxygen saturation. As oxygen content continues to decline, activity of high order cortical tissue reduces to ensure sufficient metabolic resources are available for critical life-sustaining autonomic functions. Consequently, cognitive abilities reliant on these affected areas suffer significant performance degradations. This goal of this effort was to develop and validate a model capable of predicting human cognitive performance under acceleration stress. An Air …

Investigation And Quantification Of Codon Usage Bias Trends In Prokaryotes, Amanda L. Hanes Jan 2009

Investigation And Quantification Of Codon Usage Bias Trends In Prokaryotes, Amanda L. Hanes

Browse all Theses and Dissertations

Organisms construct proteins out of individual amino acids using instructions encoded in the nucleotide sequence of a DNA molecule. The genetic code associates combinations of three nucleotides, called codons, with every amino acid. Most amino acids are associated with multiple synonymous codons, but although they result in the same amino acid and thus have no effect on the final protein, synonymous codons are not present in equal amounts in the genomes of most organisms. This phenomenon is known as codon usage bias, and the literature has shown that all organisms display a unique pattern of codon usage. Research also suggests …

Case studies within state of Ohio (USA) and England and Wales were conducted to demonstrate a method proof-of-concept in the context of various …

Timing-Pulse Measurement And Detector Calibration Of The Osteoquant, Binu Eapen Enchakalody Jan 2009

Timing-Pulse Measurement And Detector Calibration Of The Osteoquant, Binu Eapen Enchakalody

Browse all Theses and Dissertations

The OsteoQuant is a second-generation pQCT scanner, which can provide precisedensity assessment of bone. The scanner is being upgraded with an x-ray tube radiation source and a semiconductor CZT detector. This thesis provides solutions for two issues: motion-detector timing and dead-time/beam-hardening corrections. During translation, the motion-control system of the scanner repositions the source and detector by small intervals. However, the detector collects photon counts asynchronously with respect to the motor-timing pulses and reads photon counts (frames) at regular intervals based on its own clock. Since there needs to be correspondence between source/detector location and detector readout, the first part of …

The purpose of this study was to explore the implications of perception and action coupling for the design of control and display interfaces in remotely piloted vehicles. Three experiments were conducted: spatial arrangement, path perception, and remote navigation. The results showed that panning independent of forward motion gives observers a greater sense of depth in a scene and aides in efficient navigation while rotation during forward motion results in ambiguities during passive observation. This research has implications for the design of control and visualization interfaces for remote navigation.

There is a growing concern about the effects of global warming that many believe is anthropogenically caused. As such, scientists are trying to uncover a viable alternative fuel source and establish a way to reduce atmospheric carbon dioxide levels. A potential solution that addresses both of these aspects would be to capture atmospheric carbon dioxide and convert it into a natural gas, in particular methane, which could be used as an energy source. A laboratory-scale experiment using 6 160 mL microcosms (3 with anaerobic wetland soil and 3 relatively soil free) and 2 7.2 L bioreactors was conducted to learn …

This study investigated an alternative training approach that would improve transfer performance scores above traditional training approaches. Specifically, error-management training was proposed to help trainees learn complex tasks, as opposed to error-avoidant training approaches, which sought to give trainees step-by-step protocols for learning that would minimize the occurrence of errors during training. This study was designed to examine the effects of training type on transfer performance and transfer errors, as well as the effects of meta-cognition, emotion control and cognitive appraisals as mediators of the training type-performance relationship. A third issue of this study investigated the personality-training type interactions from …
