Copyright Consultations Submissions, David Allsebrook

Osgoode Hall Review of Law and Policy

This submission details the reforms that the author believes are necessary in order to ―rationalize‖ the Copyright Act. It attempts to answer five questions which have been posed by the Ministers of Industry and Heritage in connection with the public consultation on the need to ―modernize‖ the Copyright Act. The author is concerned that the ‘modernization‘ that is called for may simply serve to protect powerful interest groups such as the MPAA. A variety of reforms are suggested, including: protection from any form of government censorship; a functional definition of ‘works‘ which focuses on originality, self-expression and fixation; minimum benefit …

Why Canada Should Not Adopt Fair Use: A Joint Submission To The Copyright Consultations, Barry Sookman, Dan Glover Nov 2009

Why Canada Should Not Adopt Fair Use: A Joint Submission To The Copyright Consultations, Barry Sookman, Dan Glover

Osgoode Hall Review of Law and Policy

This submission addresses the issue of fair use, in both the traditional sense, and in the sense of an expanded and more flexible fair dealing regime. Fair use should not be adopted as it leads to uncertainty, expensive litigation, and leaves important public policy decisions to be made by courts instead of Parliament. Further, fair use would reduce revenues available to creators, (which, in turn would reduce the capacity of creators to innovate), while potentially undermining legitimate collective licensing models. Fair use may also be inconsistent with Canada‘s international treaty obligations. Finally, in light of international experience rejecting the adoption …

Copyright Consultations Submission, Entertainment Software Association Of Canada, Jason J. Kee

Osgoode Hall Review of Law and Policy

The entertainment software industry is one of the fastest growing market segment in the global economy, with Canada rapidly establishing itself as a world leader in the multi-billion dollar global video game industry. The employment opportunities in this industry, as well as its investments in research and technology are also significant. These investments are not without risk – in the highly competitive industry of video game production the chance of a video game being a commercial failure outweighs the chances of its success. Internet piracy of video game software has also undergone explosive growth and represents a significant problem for …

“People Like Us” In Pursuit Of God And Rights: Islamic Feminist Discourse And Sisters In Islam In Malaysia, Yasmin Moll Nov 2009

“People Like Us” In Pursuit Of God And Rights: Islamic Feminist Discourse And Sisters In Islam In Malaysia, Yasmin Moll

Journal of International Women's Studies

This paper attempts to critically situate the discourse of Islamic feminism and its activist incarnations such as the Malaysian group Sisters in Islam within an analytical framework that seeks to look beyond the all-too-common trope of “multiple modernities.” The paper examines the conditions of possibility enabling such groups and discourses, looking in particular at the modern nation-state, and the imbrications of social discourses of rights and religious discourses of individual belief within this state. I argue that the repertoires of reasoning called forth by Sisters in Islam partake in the objectifying rationalities of the Malaysian state when it comes to …

Analysis Of Multifactor Experimental Designs, Phillip I. Good Nov 2009

Analysis Of Multifactor Experimental Designs, Phillip I. Good

Journal of Modern Applied Statistical Methods

In the one-factor case, Good and Lunneborg (2006) showed that the permutation test is superior to the analysis of variance. In the multi-factor case, simulations reveal the reverse is true. The analysis of variance is remarkably robust against departures from normality including instances in which data is drawn from mixtures of normal distributions or from Weibull distributions. The traditional permutation test based on all rearrangements of the data labels is not exact and is more powerful that the analysis of variance only for 2xC designs or when there is only a single significant effect. Permutation tests restricted to synchronized permutations …

Semi-Parametric Of Sample Selection Model Using Fuzzy Concepts, L. Muhamad Safiih, A. A. Kamil, M. T. Abu Osman Nov 2009

Semi-Parametric Of Sample Selection Model Using Fuzzy Concepts, L. Muhamad Safiih, A. A. Kamil, M. T. Abu Osman

Journal of Modern Applied Statistical Methods

The sample selection model has been studied in the context of semi-parametric methods. With the deficiencies of the parametric model, such as inconsistent estimators, semi-parametric estimation methods provide better alternatives. This article focuses on the context of fuzzy concepts as a hybrid to the semiparametric sample selection model. The better approach when confronted with uncertainty and ambiguity is to use the tools provided by the theory of fuzzy sets, which are appropriate for modeling vague concepts. A fuzzy membership function for solving uncertainty data of a semi-parametric sample selection model is introduced as a solution to the problem.

A Linear B-Spline Threshold Dose-Response Model With Dose-Specific Response Variation Applied To Developmental Toxicity Studies, Chin-Shang Li, Daniel L. Hunt Nov 2009

A Linear B-Spline Threshold Dose-Response Model With Dose-Specific Response Variation Applied To Developmental Toxicity Studies, Chin-Shang Li, Daniel L. Hunt

Journal of Modern Applied Statistical Methods

A linear B-spline function was modified to model dose-specific response variation in developmental toxicity studies. In this new model, response variation is assumed to differ across dose groups. The model was applied to a developmental toxicity study and proved to be significant over the previous model of singular response variation.

Adding Dental Therapists To The Health Care Team To Improve Access To Oral Health Care For Children, David A. Nash Nov 2009

Adding Dental Therapists To The Health Care Team To Improve Access To Oral Health Care For Children, David A. Nash

Oral Health Science Faculty Publications

Oral Health in America: A Report of the Surgeon General, and the subsequent National Call to Action to Promote Oral Health, contributed significantly to raising awareness regarding the lack of access to oral health care by many Americans, especially minority and low-income populations, with resulting disparities in oral health. The problem is particularly acute among children. The current dental workforce in the United States is inadequate to meet the oral health care needs of children. It is inadequate in terms of numbers of dentists, as well as their geographic distribution, ethnicity, education, and practice orientation. Dental therapists, paraprofessionals …

To Document Or Not To Document, That Is The Question? Use Of The Participatory Archive Model For A Residential Artist’S Centre, Yvonne Desmond

Conference papers

Men of genius really are doing most when they work least, as they are thinking out ideas and perfecting the conceptions which they will subsequently carry out with their hands.’ (Leonardo da Vinci) There is a romantic notion that regards all forms of Art as emanating from the gods and artists as the mere conduits for this divine inspiration. This research project disavows such notions and instead is predicated on the basis that all artists are skilled practitioners of their craft. Research into the areas of tacit knowledge and visual intelligence indicate that the making of art is an experiential …

Setting The Standard: A Critique Of Bonnie's Competency Standard And The Potential Of Problem-Solving Theory For Self-Representation At Trial, E. Lea Johnston Nov 2009

Setting The Standard: A Critique Of Bonnie's Competency Standard And The Potential Of Problem-Solving Theory For Self-Representation At Trial, E. Lea Johnston

UF Law Faculty Publications

In Indiana v. Edwards, the U.S. Supreme Court held that the Sixth Amendment permits a trial court to impose a higher competency standard for self-representation than to stand trial. The Court declined to specify the contents of a permissible representational competence standard, but cited with support the construct of adjudicative competence developed by Professor Richard Bonnie. While Bonnie's proposal may provide an appropriate framework for evaluating the competence of represented defendants' decisions, it is at most a starting point for defining the capacities needed for self-representation at trial. This Article begins by exposing three reasons why Bonnie's approach is …

Anonymity In Cyberspace: What Can We Learn From John Doe?, Lyrissa Barnett Lidsky Nov 2009

Anonymity In Cyberspace: What Can We Learn From John Doe?, Lyrissa Barnett Lidsky

UF Law Faculty Publications

This Article examines the evolution of the law governing libel suits against anonymous "John Doe" defendants based on Internet speech. Between 1999 and 2009, courts crafted new First Amendment doctrines to protect Internet speakers from having their anonymity automatically stripped away upon the filing of a libel action. Courts also adapted existing First Amendment protections for hyperbole, satire, and other nonfactual speech to protect the distinctive discourse of Internet message boards. Despite these positive developments, the current state of the law is unsatisfactory. Because the scope of protection for anonymous Internet speech varies greatly by jurisdiction, resourceful plaintiffs can make …

Imitation In Fragile X Syndrome: Implications For Autism, Marta Macedoni-Luksic, Laura Greiss Hess, Sally J. Rogers, David Gosar, Kerrie Lemons-Chitwood, Randi Hagerman Nov 2009

Imitation In Fragile X Syndrome: Implications For Autism, Marta Macedoni-Luksic, Laura Greiss Hess, Sally J. Rogers, David Gosar, Kerrie Lemons-Chitwood, Randi Hagerman

Occupational Therapy | Faculty Scholarship

To address the specific impairment of imitation in autism, the imitation abilities of 22 children with fragile X syndrome (FXS) with and without autism were compared. Based on previous research, we predicted that children with FXS and autism would have significantly more difficulty with non-meaningful imitation tasks. After controlling for full-scale IQ and age, the groups did not differ in their overall imitation accuracy scores, but analysis of error patterns revealed that children with FXS and autism made more groping errors and additional movements than the comparison group. These error patterns are consistent with the hypothesis that an action production …

Customer Satisfaction And Stock Returns Risk, Kapil R. Tuli, Sundar G. Bharadwaj Nov 2009

Customer Satisfaction And Stock Returns Risk, Kapil R. Tuli, Sundar G. Bharadwaj

Research Collection Lee Kong Chian School Of Business

Over the past decade, several studies have argued that customer satisfaction has high relevance for financial markets because it has a significant impact on stock returns. However, little attention has been given to understanding the impact of customer satisfaction on the risk of stock returns. The finance literature suggests that investors that judge performance only in terms of returns place more resources than warranted in risky opportunities, forgo profitable opportunities, and apply misguided performance evaluations. Accordingly, this study develops, tests, and finds empirical support for the hypotheses that positive changes (i.e., improvement) in customer satisfaction result in negative changes (i.e., …

Barriers To Representation For Detained Immigrants Facing Deportation: Varick Street Detention Facility, A Case Study, Peter L. Markowitz Nov 2009

Barriers To Representation For Detained Immigrants Facing Deportation: Varick Street Detention Facility, A Case Study, Peter L. Markowitz

Articles

There is an evolving crisis in the immigration courts and federal courts of appeals caused by the lack of quality representation for immigrants facing deportation. The problem is particularly acute for immigrants who are detained during their removal proceedings. As part of the Study Group on Immigrant Representation (Katzmann study group), the Subcommittee on Enhancing Mechanisms for Service Delivery undertook a case study of the institutional and legal barriers to quality legal representation for immigrants held at the Varick Street Detention Facility in New York City. Through this lens we hope to offer some useful insights into the core factors …

Openness, Dynamic Specialization, And The Disaggregated Future Of Higher Education, John L. Hilton Iii, David Wiley Nov 2009

Openness, Dynamic Specialization, And The Disaggregated Future Of Higher Education, John L. Hilton Iii, David Wiley

Faculty Publications

Openness is a fundamental value underlying significant changes in society and is a prerequisite to changes institutions of higher education need to make in order to remain relevant to the society in which they exist. There are a number of ways institutions can be more open, including programs of open sharing of educational materials. Individual faculty can also choose to be more open without waiting for institutional programs. Increasing degrees of openness in society coupled with innovations in business strategy like dynamic specialization are enabling radical experiments in higher education and exerting increasing competitive pressure on conventional higher education institutions. …

Mcc: A Runtime Verification Tool For Mcapi User Applications, Eric G. Mercer, Ganesh Gopalakrishnan, Jim Holt, Subodh Sharma

Faculty Publications

We present a dynamic verification tool MCC for Multicore Communication API applications – a new API for communication among cores. MCC systematically explores all relevant interleavings of an MCAPI application using a tailormade dynamic partial order reduction algorithm (DPOR). Our contributions are (i) a way to model the non-overtaking message matching relation underlying MCAPI calls with a high level algorithm to effect DPOR for MCAPI that controls the lower level details so that the intended executions happen at runtime; and (ii) a list of default safety properties that can be utilized in the process of verification. To our knowledge, this …

Patent Examination Priorities, Michael J. Meurer Nov 2009

Patent Examination Priorities, Michael J. Meurer

Faculty Scholarship

Measures that discourage excessive patenting and claiming, propose shared examination responsibilities, and increase staffing all have potential to raise examination quality and alleviate the patent application backlog. So far these measures have been too limited to have much impact, and there is insufficient evidence to reliably judge their effectiveness. In this Article, I consider a different approach to examination reform. I take as given a significant scarcity of examiner time, and I ask how the PTO should set examination priorities. In other words, how much of their eighteen hours should examiners devote to the various tasks they are expected to …

Social Networks, Personal Values, And Creativity: Evidence For Curvilinear And Interaction Effects, Jing Zhou, Shung Jae Shin, Daniel J. Brass, Jaepil Choi, Zhi-Xue Zhang Nov 2009

Social Networks, Personal Values, And Creativity: Evidence For Curvilinear And Interaction Effects, Jing Zhou, Shung Jae Shin, Daniel J. Brass, Jaepil Choi, Zhi-Xue Zhang

Research Collection Lee Kong Chian School Of Business

Taking an interactional perspective on creativity, the authors examined the influence of social networks and conformity value on employees' creativity. They theorized and found a curvilinear relationship between number of weak ties and creativity such that employees exhibited greater creativity when their number of weak ties was at intermediate levels rather than at lower or higher levels. In addition, employees' conformity value moderated the curvilinear relationship between number of weak ties and creativity such that employees exhibited greater creativity at intermediate levels of number of weak ties when conformity was low than when it was high. A proper match between …

Innovation And Commoditization: Asian Cross Border Sourcing Practices, Sudhi Seshadri Nov 2009

Innovation And Commoditization: Asian Cross Border Sourcing Practices, Sudhi Seshadri

Research Collection Lee Kong Chian School Of Business

What constitutes better sourcing performance? The question is gaining prominence from recent work in the resource based view of the firm where interest in functional performance is growing. The paper addresses this question by investigating several dimensions of sourcing practices. Two main performance priorities are captured by supply innovation and supply commoditization, and we develop several hypotheses involving these constructs. The paper reports on our survey research with Asian purchasing managers; scales that measure supply innovation and commoditization; and the estimates of a path analytic model to test our hypotheses and provide relative effect sizes. The results contribute to a …
