Cross Burning A Hate Speech Under The First Amendment To The United States Constitution, Wilson Huhn Jan 2009

Cross Burning A Hate Speech Under The First Amendment To The United States Constitution, Wilson Huhn

Akron Law Faculty Publications

Under the First Amendment of the Constitution of the United States, ‘hate speech’ is constitutionally protected unless the circumstances of the case indicate that the speaker intended to threaten violence or provoke an immediate act of violence. While a person may be removed from a classroom or fired from employment for engaging in ‘hate speech’, under the First Amendment a person may be charged with a crime only if their statements constitute a threat or provocation of immediate violence. Moreover, even in cases where it is clear that a person is threatening violence or that violence is imminent, the person …

Reforming Eyewitness Identification Law And Practices To Protect The Innocent, Margery Koosed Jan 2009

Reforming Eyewitness Identification Law And Practices To Protect The Innocent, Margery Koosed

Akron Law Faculty Publications

This article discusses varying eyewitness identification reform proposals that may help to finally achieve a greater level of reliability in this critical phase of the criminal justice process. The author concludes a comprehensive reform that includes tightening exclusionary rules, along with (minimally) corroboration requirements for death-sentencing, and more appropriately, for convictions in capital and non-capital cases, with a concomitant loosening of standards for relief on appeal, hold the most promise.

The article addresses adopting best practices; assuring compliance by means of exclusion; admitting expert testimony and educating juries; instructing on the vagaries of eyewitness identification; requiring corroboration with independent and …

Where Are The Victims? The Credibility Gap In Human Trafficking Research, Johnny E. Mcgaha, Amanda Evans Jan 2009

Where Are The Victims? The Credibility Gap In Human Trafficking Research, Johnny E. Mcgaha, Amanda Evans

Intercultural Human Rights Law Review

Nothing drives the passion and stirs the emotion, especially in the U.S., more than the horrendous stories of modem-day human slavery. Whether sexual, domestic, or labor, the terror and horror that human trafficking victims have endured defies the scope of our sensitivities. Most who work in human service fields have heard many stories of these survivors. The dedication of the practitioners and law enforcement officers who are involved in the apprehending and prosecution of offenders, and advocate for victims in these very complex cases, is evident in this symposium alone. As a nation, the stain of slavery has tarnished the …

Student Performance In Virtual Schooling: Looking Beyond The Numbers, Michael Barbour, Dennis Mulcahy Jan 2009

Student Performance In Virtual Schooling: Looking Beyond The Numbers, Michael Barbour, Dennis Mulcahy

Education Faculty Publications

Seven years ago the Centre for Distance Learning and Innovation began a virtual high school within the Canadian province of Newfoundland and Labrador. Designed primarily to provide courses in specialized areas to students in rural areas, where schools have difficulty in attracting these teachers, there is concern that the opportunities provided by this virtual school are “second rate.” The purpose of the study is to examine the student achievement in standardized public exams and final course scores in the province between different delivery models, geographic location and subject area to determine whether or not students are succeeding in the virtual …

Effects Of An Educational Intervention On Hospital Acquired Urinary Tract Infection Rates, Sharon Lanier Smith Jan 2009

Effects Of An Educational Intervention On Hospital Acquired Urinary Tract Infection Rates, Sharon Lanier Smith

UNF Graduate Theses and Dissertations

In today's hospital environment, good care has become synonymous with positive patient outcomes. Marring this landscape is the alarming rate of hospital acquired (nosocomial) infections. Urinary tract infection (UTI) is one of the most common hospital acquired infections. The major cause associated with these infections is the use of indwelling urinary catheters. Bacteria invade the lower urinary tract by ascending through or around the catheter. Morbidity associated with urinary catheter-associated UTI can be minimized by prudent decisions concerning catheter usage and good catheter care. The principle route of dispersal of nosocomial infections is likely from patient-to-patient via transiently contaminated hands …

The Effect Of Leadership Skill-Building On Nurse Leader Behaviors, Barbara Drummond-Huth Jan 2009

The Effect Of Leadership Skill-Building On Nurse Leader Behaviors, Barbara Drummond-Huth

UNF Graduate Theses and Dissertations

Patient outcome data are an important factor in healthcare. Reports by the Institute of Medicine between 1999 and 2001, as well as recent research by Linda Aiken and her colleagues have added more emphasis to measures that can be taken to improve patient outcomes. Because of the role they play in healthcare facilities, nurse leaders are in a position to take the lead in improving patient outcomes. There is evidence to suggest that nurse leaders' transformational leadership behaviors are associated with positive patient outcomes.

The purpose of this project was to identify the effect of transformational leadership skill-building training on …

The Effect Of Electronic Feedback On Anesthesia Providers' Timely Preoperative Antibiotic Administration, Jonathan Pabalate Jan 2009

The Effect Of Electronic Feedback On Anesthesia Providers' Timely Preoperative Antibiotic Administration, Jonathan Pabalate

UNF Graduate Theses and Dissertations

The growing presence of electronic anesthesia record keeping and perioperative informatics systems is contributing to a database of valuable information that can significantly improve patient care and patient outcomes. Efforts such as the National Surgical Quality Improvement Project and the Surgical Care Improvement Project have analyzed quality measures that directly correlate to patient outcomes. Several of these quality indicators are influenced by the performance of anesthesia providers’ activities in the perioperative period. These programs promote timely administration of preoperative antibiotics. One of their guidelines states that preoperative antibiotic should be given within an hour prior to surgical incision. Surgical site …

A Guide To Integrating Cots Games Into Your Classroom, Richard Van Eck Jan 2009

A Guide To Integrating Cots Games Into Your Classroom, Richard Van Eck

Teaching, Leadership & Professional Practice Faculty Publications

Many of the educational outcomes we seek to promote in public education, such as problem solving and critical thinking, are difficult to achieve given the constraints of the real-world classroom. Commercial Off-the-Shelf (COTS) games make excellent tools for addressing both content-based and higher-order learning outcomes, and many educators are exploring their use in the classroom. But making effective use of commercial games in the classroom requires that we understand how games function in relation to the typical instructional strategies and practices of the classroom. The first part of this chapter will examine the theories that underlie the successful integration of …

Vision Therapy Promotional Packet: Through The Eyes Of Traumatic Brain Injury/Acquired Brain Injury: An Informational Resource On The Role Of Ot, Sarah A. Cooper, Whitney Schilling

Occupational Therapy Capstones

"Very few in the health care professions, including head trauma rehabilitation centers, are adequately aware of visual problems resulting from Traumatic Brain Injury (TBI)/ Acquired Brain Injury (ABI) and the visual-perception consequences. These visual deficits may lead to impaired functioning in the person's daily activities and roles because vision affects all other functions" (braininjuries.org, ~ 1). A few examples of activities of daily living (ADL's) and instrumental activities of daily living (lADL's) that may be impacted by visual deficits include but are not limited to: driving, eating, dressing, leisure participation (movies, reading, sports), and employment. "Unfortunately, this creates a gap …

Modelling Situation Awareness For Context‐Aware Decision Support, Yu-Hong Feng, Teck-Hou Teng, Ah-Hwee Tan Jan 2009

Modelling Situation Awareness For Context‐Aware Decision Support, Yu-Hong Feng, Teck-Hou Teng, Ah-Hwee Tan

Research Collection School Of Computing and Information Systems

Situation awareness modelling is popularly used in the command and control domain for situation assessment and decision support. However, situation models in real-world applications are typically complex and not easy to use. This paper presents a Context-aware Decision Support (CaDS) system, which consists of a situation model for shared situation awareness modelling and a group of entity agents, one for each individual user, for focused and customized decision support. By incorporating a rule-based inference engine, the entity agents provide functions including event classification, action recommendation, and proactive decision making. The implementation and the performance of the proposed system are demonstrated …

When Is It Beneficial For A Firm To Pursue A Unified Procurement Strategy For Enterprise Software Solutions?, Robert J. Kauffman, Juliana Y. Tsai Jan 2009

When Is It Beneficial For A Firm To Pursue A Unified Procurement Strategy For Enterprise Software Solutions?, Robert J. Kauffman, Juliana Y. Tsai

Research Collection School Of Computing and Information Systems

The underlying structure of the enterprise software marketplace during the past ten years suggests that the arrangements that firms make with respect to the acquisition of such software capabilities will become increasingly concentrated. This article explores the multiple theoretical rationales and business cases for the move to a unified procurement strategy for enterprise software, reflecting some differences in terms of what might be expected from the predictions of the well known move-to-the-middle hypothesis. Our central argument is that a "move-to-the-middle" with more than just a single vendor is the likely outcome in unconsolidated industry markets. In industries experiencing consolidation, firms …

Doctrine And Fairness In The Law Of Contract, Andrew B.L. Phang Jan 2009

Doctrine And Fairness In The Law Of Contract, Andrew B.L. Phang

Research Collection Yong Pung How School Of Law

This paper explores, through illustrations from the law of contract, the important centraltheme to the effect that the rules and principles, which constitute thedoctrineof the law,are not ends in themselves but are, rather, the means through which the courts arrive atsubstantively fairoutcomes in the cases before them. The paper focuses on the concept of‘radicalism’, which relates to the point at which the courts decide that it is legallypermissible to hold that a contract should come to an end because a radical or funda-mental ‘legal tipping point’ has not only been arrived at but has, in fact, been crossed. Itexplores the …

Analysis Of The Supporting Websites For The Use Of Instructional Games In K-12 Settings, Mansureh Kebritchi, Wendi M. Kappers Phd, Atsusi Hirumi, Renee Henry

Publications

This article identifies resources to be included in a website designed to facilitate the integration of instructional games in K-12 settings. Guidelines and supporting components are based on a survey of K-12 educators who are integrating games, an analysis of existing instructional game websites, and summaries of literature on the use of educational software in K-12 settings and teacher technology training. The results indicate that educators face three main challenges when integrating games, including: (a) technical and logistical requirements, (b) curriculum integration, and (c) teacher training. To overcome these challenges, K-12 educators should be provided with: (a) curriculum resources, (b) …

A Semiotic Analysis Of Unified Modeling Language Graphical Notations, Keng Siau, Yuhong Tian Jan 2009

A Semiotic Analysis Of Unified Modeling Language Graphical Notations, Keng Siau, Yuhong Tian

Research Collection School Of Computing and Information Systems

Unified modeling language (UML) is the standard modeling language for object-oriented system development. Despite its status as a standard, UML has a fuzzy formal specification and a weak theoretical foundation. Semiotics, the study of signs, provides a good theoretical foundation for UML research because graphical notations (or visual signs) of UML are subjected to the principles of signs. In our research, we use semiotics to study the effectiveness of graphical notations in UML. We hypothesized that the use of iconic signs as UML graphical notations leads to representation that is more accurately interpreted and that arouses fewer connotations than the …

Earth's Heat Source -- The Sun, Oliver Manuel Jan 2009

Earth's Heat Source -- The Sun, Oliver Manuel

Chemistry Faculty Research & Creative Works

The Sun encompasses planet Earth, supplies the heat that warms it, and even shakes it. The United Nation's Intergovernmental Panel on Climate Change (IPCC) assumed that solar influence on Earth's climate is limited to changes in solar irradiance and adopted the consensus opinion of a hydrogen-filled Sun - the Standard Solar Model (SSM). They did not consider the alternative solar model and instead adopted another consensus opinion: Anthropogenic greenhouse gases play a dominant role in climate change. The SSM fails to explain the solar wind, solar cycles, and the empirical link of solar surface activity with Earth's changing climate. The …

Promoting Parent Partnership In Head Start: A Qualitative Case Study Of Teacher Documents From A School Readiness Intervention Project., Carolyn P. Edwards, Tara Hart, Kelly Rasmussen, Y. M. Haw, Susan M. Sheridan

Department of Child, Youth, and Family Studies: Faculty Publications

To advance the field of children’s services, implementation and generalization studies are needed to help us reveal the inner workings of intervention projects and how they do (or do not) achieve their outcomes. This paper provides a case study of Head Start teachers’ uptake of the Getting Ready school readiness intervention, intended to strengthen professionals’ capacity to support parental engagement in young children’s development and learning. The qualitative method of document review was used in scrutinizing home visit reports and classroom newsletters as a source of authentic evidence about teachers’ implementation and generalization of an early intervention model. Home visits …

Effects Of Marital Quality On Children In Brazilian Families, Stephen V. Stutzman, Richard B. Miller, Cody S. Hollist, Olga G. Falceto Jan 2009

Effects Of Marital Quality On Children In Brazilian Families, Stephen V. Stutzman, Richard B. Miller, Cody S. Hollist, Olga G. Falceto

Department of Child, Youth, and Family Studies: Faculty Publications

Although there is a robust literature supporting the empirical generalization that parental conflict is related to childhood problems, the research has primarily studied European American populations in the U.S. There is minimal research that investigates the relationship between marital distress and child outcomes in other cultures (Bradford et al., 2004; Buehler et al., 1997; Krishnakumar & Buehler, 2000; Shek, 2001), including a specific lack of knowledge regarding Latino populations. This is a significant gap in the literature since Latino children make up the largest minority group in the U.S., accounting for 16% of children younger than 18 years of age …

Autistic Disorder Associated With A Paternally Derived Unbalanced Translocation Leading To Duplication Of Chromosome 15pter-Q13.2: A Case Report., David J Wu, Nicholas J Wang, Jennette Driscoll, Naghmeh Dorrani, Dahai Liu, Marian Sigman, N Carolyn Schanen

Department of Pediatrics Faculty Papers

Autism spectrum disorders have been associated with maternally derived duplications that involve the imprinted region on the proximal long arm of chromosome 15. Here we describe a boy with a chromosome 15 duplication arising from a 3:1 segregation error of a paternally derived translocation between chromosome 15q13.2 and chromosome 9q34.12, which led to trisomy of chromosome 15pter-q13.2 and 9q34.12-qter. Using array comparative genome hybridization, we localized the breakpoints on both chromosomes and sequence homology suggests that the translocation arose from non-allelic homologous recombination involving the low copy repeats on chromosome 15. The child manifests many characteristics of the maternally-derived duplication …

The Holocaust To Darfur: A Recipe For Genocide, Joseph Karb, Andrew Beiter Jan 2009

The Holocaust To Darfur: A Recipe For Genocide, Joseph Karb, Andrew Beiter

Journal of Inquiry and Action in Education

All too often, social studies teachers present the cruelty of the Holocaust as an isolated event. These units focus on Hitler, gas chambers, and war crimes and end with a defiant and honorable “Never Again!” While covering mass murder in this way is laudable, it ultimately might not go as far as it could. For as teaches if we really want to empower our students to prevent genocide, we must look beyond the facts alone to the larger lessons these horrific events can teach us. It is with this background in mind that we wrote this chapter; that in order …

Big Expectations: Big Ideas In Honors And Inclusion Classes, Sarah Foels Jan 2009

Big Expectations: Big Ideas In Honors And Inclusion Classes, Sarah Foels

Journal of Inquiry and Action in Education

“Big Expectations” discusses the benefits of developing and using big ideas for a diverse set of learners in social studies. Experimenting with both honors and inclusion classrooms at the middle school level, I found that all students are capable of relating to and thinking deeply about the content through the use of big ideas. Although the challenges of standardize testing and differentiated learning initially made me hesitant to try out big ideas in my transition from teaching an honors class to teaching an inclusion class, I came to recognize the importance of showing every student how to form their own …

Reflection And Resistance: Challenges Of Rationale-Based Teacher Education, Todd Dinkelman Jan 2009

Reflection And Resistance: Challenges Of Rationale-Based Teacher Education, Todd Dinkelman

Journal of Inquiry and Action in Education

The author draws on the voices of beginning teachers in a particular teacher education program and his own experiences as a teacher educator in several different settings to account for preservice teacher reflection and resistance to rationale-based social studies teacher education. Twelve categories represent the perspectives of beginning social studies student teachers. Some are directly related to larger explanatory frameworks offered by teacher education research. Others reflect commonplace tensions in the university classroom. These twelve categories of reflection and resistance in rationale-based teacher education may serve as starting points for thinking about more effective approaches to helping beginning teachers answer …

Homeless Education: Analyzing The Problematic Legal Remedies Available To Homeless School Children, Clifton S. Tanabe Jan 2009

Homeless Education: Analyzing The Problematic Legal Remedies Available To Homeless School Children, Clifton S. Tanabe

Journal of Inquiry and Action in Education

Given the extent to which our society values education, it is perplexing to learn that we continue to struggle to provide all children, especially homeless children, an adequate education. This troubling issue is the focus of this paper. Specifically, this paper will center around two basic questions; 1) what has the legal system done to ensure that homeless children receive an adequate education, and 2) what might be done, legally, to advocate for the educational well-being of such children? In addressing these two questions, this paper will begin by problematizing the definition of homelessness and by analyzing some national statistics …

This paper examines the various generations that include the greatest generation, the baby-boomers, generation X, and generation Y. The research encompasses many motivational elements that each generation covets, rejects, or shares. These generations are at different stages in life and each plays a vital role within our society. The workforce has become a melting pot of generational influences that produce a unique and complex dynamic that economic entities must decipher.

A New Way Forward: A Response To Judge Weinstein, Elizabeth Chamblee Burch Jan 2009

A New Way Forward: A Response To Judge Weinstein, Elizabeth Chamblee Burch

Scholarly Works

This short essay responds to Judge Jack Weinstein's essay, Preliminary Reflections on Administration of Complex Litigations, 2009 Cardozo De Novo 1. In so doing, it also provides a condensed version of my earlier article, Litigating Groups, which analyzes group dynamics within nonclass aggregation. By drawing on the literature of moral and political philosophy as well as social psychology, I contend that, in the face of hard cases, of instability and disunity, plaintiffs who have made promises and assurances to one another can invoke social norms of promise-keeping, social agglomeration, compatibility, and the desire for means-end coherence to achieve consensus, mitigate …
