Federalism And The Rule Of Law: Perspectives From The European Court Of Justice, Koen Lenaerts Jan 2009

Federalism And The Rule Of Law: Perspectives From The European Court Of Justice, Koen Lenaerts

Fordham International Law Journal

This Article unfolds as follows: Section I looks at the "pervasive effect" of European Union ("EU") law upon the substantive law of the Member States. Instead of attempting to cover all cases where this effect has arisen, a selective but in-depth approach is preferred. In this regard, four areas falling within the competences of the Member States will be discussed, namely education, family law, direct taxation, and health care. Section II is devoted to the pervasive effects of EU law upon national rules of procedure. Taking four cases as examples, this Section sets out to demonstrate that the European Court …

Owning What You Eat: The Discourse Of Food, David N. Cassuto Jan 2009

Owning What You Eat: The Discourse Of Food, David N. Cassuto

Elisabeth Haub School of Law Faculty Publications

This essay examines the role of communication in the formation of law and social norms and the implications of that role for animal law and ethics. Part III contextualizes animal law within contemporary risk society. Part IV looks at how efficiency has transformed from an economic concept into a normative guideline and discusses how that transformation has affected animals and agriculture. It tracks the rise of industrial agriculture and ties it to this fundamental misunderstanding of the concept of efficiency. The essay concludes with some thoughts on how to reformulate contemporary notions of efficiency and ethics to account for the …

Wind Power, National Security, And Sound Energy Policy, Elizabeth Burleson Jan 2009

Wind Power, National Security, And Sound Energy Policy, Elizabeth Burleson

Elisabeth Haub School of Law Faculty Publications

Wind-generated electricity in the United States has grown by more than 400 percent since 2000. According to the Department of Energy, 6 percent of US land could supply more than one and a half times the current electricity consumption of the country. Yet, challenges remain in matching demand for electricity with supply of wind as well as achieving grid parity. Careful wind turbine and transmission line siting can occur through cooperation between federal, state, tribal, and civil society participation in decision-making. Tribal wind initiatives have shown that developing wind power can also benefit rural communities. Congress should pass a national …

In The Name Of Fetal Protection: Why American Prosecutors Pursue Pregnant Drug Users (And Other Countries Don't), Linda C. Fentiman Jan 2009

In The Name Of Fetal Protection: Why American Prosecutors Pursue Pregnant Drug Users (And Other Countries Don't), Linda C. Fentiman

Elisabeth Haub School of Law Faculty Publications

For more than three decades, American prosecutors have been bringing criminal prosecutions against pregnant women based on their use of drugs while pregnant, with charges ranging from child abuse or neglect to murder. Almost all of these women are poor, and the vast majority are also women of color--many with histories of childhood sexual or physical abuse and mental disability. In all but three states-Alabama, Kentucky, and South Carolina--such prosecutions have been declared unconstitutional or the resulting convictions have been overturned. Nonetheless, prosecutions continue to be brought, in what can only be described as a crusade against pregnant women in …

Hein And Goldilocks Principle, Maya Manian Jan 2009

Hein And Goldilocks Principle, Maya Manian

Scholarly Articles in Law Reviews & Journals

Two weeks into his presidency, George W. Bush issued an executive order establishing the White House Office of Faith-Based and Community Initiatives (OFBCI) to encourage religious groups to provide federally funded social services. In particular, the OFBCI and its corresponding centers in various executive agencies sought to help religious organizations obtain federal grant monies by providing technical assistance to help them navigate the often byzantine bureaucracy surrounding federal grant-making. The OFBCI achieved its goal of increasing federal grants to religious organizations, in part by funding workshops and conferences designed to aid religious groups pursuing federal financing. Concerned that the Bush …

Experiential Education And The Rule Of Law: Teaching Values Through Clinical Education In China, Elliott Milstein Jan 2009

Experiential Education And The Rule Of Law: Teaching Values Through Clinical Education In China, Elliott Milstein

Scholarly Articles in Law Reviews & Journals

The author summarizes his discussions with Chinese law professors regarding the issues that separate American from Chinese attitudes in creating clinical legal education. The author observes that the baseline orientation of American lawyers to turn to the courts for redress is usually not the same for the Chinese, where bribery of judges is accepted. He also notes that in addition to teaching practical skills such as client interviewing and persuasive advocacy, American clinicians devote attention to value questions, such as client-centeredness, the demands and limits of zealous advocacy, and the commitment to bring about social justice. The inclusion of these …

Body condition score (BCS) is used as a management tool to predict reproduction of young beef cows. The objective was to determine the effects of BCS at calving on pregnancy rates, days to first estrus (DTFE), nutrient status (assessed by blood metabolites), and calf BW change in 315, 2- and 3-yr-old cows grazing native range over 5 yr at the Corona Range and Livestock Research Center, NM. Palpable BCS (1 to 9) were determined by experienced technicians prior to calving. Cows were assigned to 1 of 4 BCS groups: Thin (T; BCS = 3.5 …

The Tadpole Of Hypsiboas Atlanticus (Anura, Hylidae) From Northeastern Brazil, Filipe A. C. Do Nascimento, Marcelo G. De Lima, Gabriel O. Skuk, Rafael O. De Sá

Biology Faculty Publications

The tadpole of Hypsiboas atlanticus (Caramaschi & Velosa, 1996) is described from the municipality of Maceió, State of Alagoas, Brazil. At stage 36 the larvae have an overall elliptical body in lateral and dorsal views, oral disc anteroventral, spiracular tube sinistral, and labial tooth row formula 2(1,2)/3(1). The oral disc is surrounded, almost completely (anterior medial gap present) by a single row of marginal papillae. Described tadpoles of the H. punctatus species group can be differentiated by a combined disc oral features. Additional descriptions of H. punctatus (Schneider, 1799) tadpoles from populations throughout South America may be helpful in determining …

Bibliography Of The Frogs Of The Leptodactylus Clade - Adenomera, Hydrolaetare, Leptodactylus, Lithodytes (Ampbibia, Anura, Leptodactylidae). Volume 1. References, Miriam H. Heyer, W. Ronald Heyer, Rafael O. De Sá

Biology Faculty Publications

In the funded proposal to NSF, RdS and WRH included a project to create an electronic database for all publications containing mention of species names for Adenomera, Leptodactylus, and Vanzolinius (Vanzolinius has since been synonymized with Leptodactylus). At the beginning of the project, there were about 2,000 references on 3x5 cards. Miriam H. Heyer (MHH) was contracted to create the EndNote® file. MHH entered all citations into EndNote® and examined the literature citations in those publications to determine whether any of them contained information on the genera of interest. WRH anticipated that the intensive bibliography would yield a total …

Plant Species Composition And Biofuel Yields Of Conservation Grasslands, Paul R. Adler, Matt A. Sanderson, Paul J. Weimer, Kenneth P. Vogel Jan 2009

Plant Species Composition And Biofuel Yields Of Conservation Grasslands, Paul R. Adler, Matt A. Sanderson, Paul J. Weimer, Kenneth P. Vogel

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Marginal croplands, such as those in the Conservation Reserve Program (CRP), have been suggested as a source of biomass for biofuel production. However, little is known about the composition of plant species on these conservation grasslands or their potential for ethanol production. Our objective was to assess the potential of CRP and other conservation grasslands for biofuel production, describing the relationships of plant species richness and tall native C4 prairie grass abundance with plant chemical composition and the resulting potential ethanol yield. We determined plant species composition and diversity at multiple scales with the modified Whittaker plot technique, aboveground …

Theft As ‘Involuntary Gifting’ Among The Tacana Of Northern Bolivia, Laura A. Bathurst Jan 2009

Theft As ‘Involuntary Gifting’ Among The Tacana Of Northern Bolivia, Laura A. Bathurst

School of International Studies Faculty Articles

It has been well established in the anthropological literature that reciprocity, in its various cultural forms, is simultaneously produced by and productive of social relationships; it both comments upon social relationships and plays a role in creating them. However, this has generally been demonstrated using positive forms of reciprocity. In this paper I examine how theft, as a form of negative reciprocity, fit with a wider set of positive reciprocal obligations among the Tacana in northeastern Bolivia in 2001-2002. Theft, I argue, was part of a coherent cultural system in which a material basis, social norms, and values and beliefs …

All Dugoni School of Dentistry Faculty Articles

Suicide gene therapy has been used for the treatment of a variety of cancers. We reported previously the in vitro efficacy of the Herpes Simplex Virus Thymidine kinase (HSV-tk)/ganciclovir (GCV) system to mediate cytotoxicity in oral squamous cancer cells, using transferrin (Tf)-lipoplexes, prepared from cationic liposomes composed of 1,2-dioleoyl-3-(trimethylammonium) propane (DOTAP) and cholesterol. In the present study, we evaluated the antitumoral efficacy mediated by this lipoplex formulation in two suicide gene therapy strategies, HSV-tk/GCV and cytosine deaminase (CD)/5-fluorocytosine (5-FC), using a syngeneic, orthotopic murine model for head and neck squamous cell carcinoma. The cellular and molecular events associated with the …

Correlation Between The Levels Of Survivin And Survivin Promoter-Driven Gene Expression In Cancer And Non-Cancer Cells, Krystyna Konopka, Christopher Spain, Allison Yen, Nathan Overlid, Senait Gebremedhin, Nejat Düzgüneş Jan 2009

Correlation Between The Levels Of Survivin And Survivin Promoter-Driven Gene Expression In Cancer And Non-Cancer Cells, Krystyna Konopka, Christopher Spain, Allison Yen, Nathan Overlid, Senait Gebremedhin, Nejat Düzgüneş

All Dugoni School of Dentistry Faculty Articles

Survivin, a member of the inhibitor of apoptosis (IAP) protein family, is associated with malignant transformation and is over-expressed in most human tumors. Using lipoplex-mediated transfection, we evaluated the activity of the reporter enzyme, luciferase, expressed from plasmids encoding the enzyme under the control of either the cytomegalovirus (CMV) or survivin promoters, in tumor- and non-tumor-derived human and murine cells. We also examined whether there is a correlation between the survivin promoter-driven expression of luciferase and the level of endogenous survivin. Human cancer cells (HeLa, KB, HSC-3, H357, H376, H413), oral keratinocytes, GMSM-K, and chemically immortalized human mammary cells, 184A-1, …

Constitutional Borrowing, Robert L. Tsai Jan 2009

Constitutional Borrowing, Robert L. Tsai

Scholarly Articles in Law Reviews & Journals

Borrowing from one domain to promote ideas in another domain is a staple of constitutional decisionmaking. Precedents, arguments, concepts, tropes, and heuristics all can be carried across doctrinal boundaries for purposes of persuasion. Yet the practice itself remains underanalyzed. This Article seeks to bring greater theoretical attention to the matter. It defines what constitutional borrowing is and what it is not, presents a typology that describes its common forms, undertakes a principled defense of borrowing, and identifies some of the risks involved. The authors' examples draw particular attention to places where legal mechanisms and ideas migrate between fields of law …
