Principles, Prescriptions, And Polemics: Regulating Conflicts Of Interest In The Canadian Investment Fund Industry, Dan Awrey Apr 2009

Principles, Prescriptions, And Polemics: Regulating Conflicts Of Interest In The Canadian Investment Fund Industry, Dan Awrey

Dalhousie Law Journal

Conflicts ofinterest permeate the Canadian investment fund industry. In response, securities regulators have promulgated National Instrument 81-107 Independent Review Committee for Investment Funds. In the view of securities regulators, NI 81-107 reflects a "principles-based" approach toward the regulation of conflicts of interest. This Article articulates a theoretical conception of principles-based securities regulation, one which transcends the formalism of the traditional "rules" versus "principles" debate to reveal a new regulatory paradigm. Thereafter, the author explores whether and to what extent NI 81-107 truly reflects this principlesbased paradigm, manifesting the potential to tap into its inherent wisdom while at the same time …

Functional Characterization And Protein-Protein Interactions Of Trypanosome Splicing Factors U2af35, U2af65 And Sf1, Martin P. Vazquez, David Mualem, Natalia Bercovich, Michael Zeev Stern, Benson Nyambega, Omer Barda, Dan Masiga, Sachin Kumar Gupta, Shulamit Michaeli, Mariano J. Levin Apr 2009

Functional Characterization And Protein-Protein Interactions Of Trypanosome Splicing Factors U2af35, U2af65 And Sf1, Martin P. Vazquez, David Mualem, Natalia Bercovich, Michael Zeev Stern, Benson Nyambega, Omer Barda, Dan Masiga, Sachin Kumar Gupta, Shulamit Michaeli, Mariano J. Levin

All Peer-Reviewed Publications

Early in the assembly of the spliceosome of eukaryotes the branch-point binding protein (BBP, also called SF1) recognizes the branch point sequence, whereas the heterodimer U2AF consisting of a 65 and a 35 kDa subunit, contacts the polypyrimidine tract and the AG splice site, respectively. Herein, we identified, cloned and expressed the Trypanosoma cruzi and Trypanosoma brucei U2AF35, U2AF65 and SF1. Trypanosomatid U2AF65 strongly diverged from yeast and human homologues. On the contrary, trypanosomatid SF1 was conserved but lacked the C-terminal sequence present in the mammalian protein. Yeast two hybrid approaches were used to assess their interactions. The interaction between …

Resisting Altruism: How Systematic Power And Privilege Become Personal In One-On-One Community Tutoring, Beth Godbee Apr 2009

Resisting Altruism: How Systematic Power And Privilege Become Personal In One-On-One Community Tutoring, Beth Godbee

English Faculty Research and Publications

In this qualitative case study of one tutoring relationship, I present new data on the extracurriculum; investigate tutoring as it occurs in community spaces; and argue that individuals can connect across systematic inequalities through personal conversations around picture books, photographs, and other visual and textual materials. Rather than ignore individual positioning within institutionalized power and privilege, tutors and writers can strengthen relationships and make tutoring more effective by evaluating how the systematic becomes personal and intimately known in one-on-one conferencing.

Resource Outsourcing, Sowjanya Guntupalli

Masters Theses & Doctoral Dissertations

Resource outsourcing is developed for creating an interactive job vacancy for candidates. In examining one of the fastest growing trends in the business world today, namely outsourcing to service providers, we find evidence of positive market reaction to HR service provider contract announcements, and we find some evidence of differential effects on subsequent firm performance. This web application is to be conceived in its current form as a dynamic site- requiring constant updates both from the seekers as well as the companies. On the whole the objective of the project is to enable jobseekers to place their resumes and companies …

The Effects Of Isolated Hamstring Fatigue On Jump Landing In Healthy Recreational Athletes, Kristen Anne Phillips Apr 2009

The Effects Of Isolated Hamstring Fatigue On Jump Landing In Healthy Recreational Athletes, Kristen Anne Phillips

Human Movement Studies & Special Education Theses & Dissertations

The musculature of the lower extremity provides dynamic stability during daily and athletic tasks. In landing tasks, the lower extremity absorbs forces and reduces excessive stresses and motions that are placed upon the body. Neuromuscular fatigue has been linked to an increase in injury and altered kinematics during jump landing tasks. The purpose of this study was to analyze the effects of hamstring fatigue on knee and hip kinematics pre and post hamstrings fatigue while landing from a box drop of 30cm height, during the stop-jump phase. The study aimed to quantify the kinematic data of the hip and knee …

Nebraska Has Lots To Offer; No Joke, Sue Burzynski Bullard Apr 2009

Nebraska Has Lots To Offer; No Joke, Sue Burzynski Bullard

College of Journalism and Mass Communications: Faculty Publications

Nebraska is sometimes a lot like Rodney Dangerfield: It gets no respect. It's a bum rap typically applied to the Midwest in general. And there it was from the first day I told family and friends I was moving to Nebraska.
"Why Nebraska," they asked.
The original short answer is to teach at a world-class university. But the longer I live here, the longer the answer gets.

Women’S Rhetorical Agency In The American West: The New Penelope, Casey Ryan Kelly Apr 2009

Women’S Rhetorical Agency In The American West: The New Penelope, Casey Ryan Kelly

Department of Communication Studies: Faculty Publications

This essay theorizes women’s rhetorical agency in the nineteenth-century American West. Contrast between fluid gender norms in frontier life and the Cult of True Womanhood highlights how agency is confined by materiality. Agency is the capacity to recognize and act in moments when material structures are vulnerable to resignification. I offer an analysis of Frances Fuller Victor’s novella The New Penelope to demonstrate how pioneer women writers reinvented womanhood in light of socioeconomic changes.

Study Of The Dna Damage Complexes Within The Htlv-1 Tax Oncoprotein Interactome, Sidi Mehdi Belgnaoui Apr 2009

Study Of The Dna Damage Complexes Within The Htlv-1 Tax Oncoprotein Interactome, Sidi Mehdi Belgnaoui

Theses and Dissertations in Biomedical Sciences

Human T-cell leukemia virus type 1 (HTLV-1) is a transforming retrovirus that can give rise to adult T-cell leukemia (ATL) and HTLV-1 associated myelopathy/tropical spastic paraparesis (HAM/TSP). Tax is a virally encoded oncoprotein that is involved in HTLV-1 mediated cellular transformation. It has been hypothesized that Tax induces genomic instability via repression of the cellular DNA damage repair response. Our laboratory has previously shown that the interaction between Tax and various proteins involved in the DNA-damage response pathway impairs the ability of these proteins to mount an efficient repair response. As part of these observations, we proposed that Tax induces …

Attitudes And Beliefs Of Counselor Educators Toward Gatekeeping, Joanna W. Campbell Apr 2009

Attitudes And Beliefs Of Counselor Educators Toward Gatekeeping, Joanna W. Campbell

Counseling & Human Services Theses & Dissertations

The purpose of this study was to examine attitudes and beliefs of counselor educators toward gatekeeping, which become overt in gatekeeping decisions in the context of stringent and less stringent decisions made at seven gates that counselors-in-training must pass though to graduate, and factors extraneous to counselor-in-training competence that may influence gatekeeping decisions. A total of 84 counselor educators participated in this study. Results showed that counselor educators are most stringent at the admissions gate; that less stringent gatekeeping decisions are made by counselor educators who have experience as a professional counselor prior to becoming a counselor educator at the …

Effect Of Anastomotic Length On The Development Of Intimal Hyperplasia In The Distal Anastomosis Of Bypass Graft., Mohamed Elsharawy

Mansoura Medical Journal

Many hemodynamic factors have been shown to be associated with increased intimal hyperplasia at the distal anastomosis of arterial bypass graft. However, the relationship between the length of anastomosis and development of such complication has not been studied before. The aim of this study is to assess this relationship at the distal anastomosis with Dacron graft. Material and Methods : lleo-femoral bypasses were performed in 10 German shepherd dogs using 6-mm Dacron grafts. In accordance with preoperative randomization to individual animal legs, distal anasto- moses were reconstructed applying four different groups (A, B, C and D) depending on the length …

Establishing Inequality, Gene R. Nichol Apr 2009

Establishing Inequality, Gene R. Nichol

Michigan Law Review

Part I outlines Nussbaum's thesis and her similarly interesting, if perhaps not always completely consistent, applications of it. Part II touches on some challenges and potential shortcomings her theory presents-for clearly there are such. But, in Part III, I argue that her wide-ranging study of the work of the religion clauses nonetheless touches something residing at the core of American citizenship. No bosses. No masters. No insiders. None outcast. Finally, and far more idiosyncratically, in Part IV I explore and expand on Nussbaum's thesis in light of a modestly serious and rather public dispute over religious equality that occurred at …

Linking International Markets And Global Justice, Jeffrey L. Dunoff Apr 2009

Linking International Markets And Global Justice, Jeffrey L. Dunoff

Michigan Law Review

The U.S. government is the planet's largest purchaser of goods and services; worldwide, states spend trillions of dollars on procurement each year. Yet legal scholarship has devoted relatively limited attention to the conceptual and normative issues that arise when states enter the market. Should states as purchasers be permitted to "discriminate" to advance social objectives - say, racial justice - in ways that would be unlawful when they act as regulators? Is each country free to strike its own balance between the pursuit of economic and social objectives through procurement, or do international trade norms limit state discretion in the …

Supreme Neglect Of Text And History, William Michael Treanor Apr 2009

Supreme Neglect Of Text And History, William Michael Treanor

Michigan Law Review

Since his classic book Takings appeared in 1985, Richard Epstein's ideas have profoundly shaped debate about the Fifth Amendment's Takings Clause to a degree that no other scholar can even begin to approach. His broad, original, and stunningly ambitious reading of the clause has powerfully influenced thinking in academia, in the judiciary, and in the political arena. The firestorm of controvery that followed the Supreme Court's recent decision in Kelo - in which the Supreme Court upheld the constitutionality of a municipal urban renewal plan that displaced long-time homeowners and conveyed their land to developers - is in critical part …

Conflicts Between Dispute Settlement Mechanisms In Regional Trade Agreements And The Wto — What Should Wto Do?, Jennifer A. Hillman

Georgetown Law Faculty Publications and Other Works

It was a tremendous pleasure to participate in a symposium that honored one of the giants of the World Trade Organization's (WTO) Appellate Body—Professor Yasuhei Taniguchi. Professor Taniguchi served as a distinguished member of the Appellate Body from 2000 to 2007, during which time he served on the division for twenty-one appeals, many of them addressing landmark issues. In tribute to him, this article focuses on an issue that was a key element in the last dispute on which Professor Taniguchi served as member of the Appellate Body. This dispute concerned Brazil's restrictions on imports of retreaded tires and raised …

The exposure of children to profanity continues to be a concern for parents, media researchers, and policy makers alike. This study examines the types, frequency, and usage of profanity in movies directed at and featuring teenagers. A review of relevant literature explores the nature, use, and psychology of profanity, its potential social effects, and its prevalence in the media. A content analysis was conducted of the ninety top-grossing domestic teen films in the 1980s, 1990s, and 2000s (thirty from each decade) in the US based on domestic gross box-office amounts. Results indicate no change in preferences in types of profanity …

Interdependent Regulation Of Cytomegalovirus Proteins In Complex, Lisa L. Bolin Apr 2009

Interdependent Regulation Of Cytomegalovirus Proteins In Complex, Lisa L. Bolin

Theses and Dissertations in Biomedical Sciences

Human cytomegalovirus (HCMV) is a ubiquitous herpesvirus that causes significant morbidity and mortality in the immune compromised. Using the mutine cytomegalovirus (MCMV) model, we identified two genes, M140 and M141, which are determinants of macrophage tropism. Monocytes/macrophages are a critical cell type for cytomegalovirus (CMV) pathogenesis as sites of viral latency and by supporting viral replication and disseminating virus throughout the body. We previously found that the localization of the M140/M141 gene products (pM140/pM141) is different when the proteins are co-expressed as compared to their individual expression. When the proteins are individually expressed pM141 localizes diffusely throughout the cytoplasm and, …

Tree-D-Seek: A Framework For Retrieving Three-Dimensional Scenes, Saurav Mazumdar

Electrical & Computer Engineering Theses & Dissertations

In this dissertation, a strategy and framework for retrieving 3D scenes is proposed. The strategy is to retrieve 3D scenes based on a unified approach for indexing content from disparate information sources and information levels. The TREE-D-SEEK framework implements the proposed strategy for retrieving 3D scenes and is capable of indexing content from a variety of corpora at distinct information levels. A semantic annotation model for indexing 3D scenes in the TREE-D-SEEK framework is also proposed. The semantic annotation model is based on an ontology for rapid prototyping of 3D virtual worlds.

With ongoing improvements in computer hardware and 3D …

The Stories We Tell The Stars, Andrea Nolan Apr 2009

The Stories We Tell The Stars, Andrea Nolan

English Theses & Dissertations

The Stories We Tell The Stars is a collection of interconnected short stories united by character, place and theme. The stories radiate from Argos Island, a fictional Chesapeake island, and follow the characters of David, Roy, Josephine and Brianna. Thematically, the stories are concerned with the question of how to reconcile the existential conditions of separation, exile and meaninglessness. They also explore man' relationship with place, both in how place shapes us and in the longing to return to, or to escape from, home. Finally, the stories explore the ways myths and mythmaking create meaning and purpose in our lives.
