Transitional Discrimination, Elizabeth M. Glazer, Zachary A. Kramer Apr 2009

Transitional Discrimination, Elizabeth M. Glazer, Zachary A. Kramer

Hofstra Law Faculty Scholarship

Transgenderism is in transition. The recent decision in Schroer v. Billington offers transgender plaintiffs hopeful precedent, but it is as yet unclear whether other courts will rule the same way in cases of transgender discrimination. This Essay, prepared for the Temple Political and Civil Rights Law Review symposium on transgender rights, argues that in order to ensure more consistent results in cases of transgender discrimination, courts should embrace an understanding of transitional identity. Transitional identity is identity that borrows from one or more extant identities, but which is inchoate, in that the identity does not express fully any of those …

Sustainable Commerce: Public Health Law And Environmental Law Provide Tools For Industry And Government To Construct Globally-Competitive Green Economies, T. Rick Irvin, Peter A. Appel Apr 2009

Sustainable Commerce: Public Health Law And Environmental Law Provide Tools For Industry And Government To Construct Globally-Competitive Green Economies, T. Rick Irvin, Peter A. Appel

Scholarly Works

This Article examines the legal mechanics underlying the sustainable commerce private/public governance paradigm whereby industry and government create sustainable commerce initiatives which coordinately grow local/state economies and employment, enhance local/state competitiveness in the global marketplace, and at the same time substantially improve local/state public health and environmental infrastructure. This includes an examination of the legal foundation for state/local sustainable commerce initiatives drawn from existing public health and environmental law and a review of two specific local/state sustainable commerce initiatives which have followed this paradigm with impressive results over a two-to-four year timeframe. Part II of this Article examines how public …

Bloodstains On A "Code Of Honor": The Murderous Marginalization Of Women In The Islamic World, Kenneth Lasson Apr 2009

Bloodstains On A "Code Of Honor": The Murderous Marginalization Of Women In The Islamic World, Kenneth Lasson

All Faculty Scholarship

In the real world of the Twenty-first Century, deep biases against women are prevalent in much of Muslim society. Although there is no explicit approval of honor killing in Islamic law (Sharia), its culture remains fundamentally patriarchal. As unfathomable as it is to Western minds, "honor killing" is a facet of traditional patriarchy, and its condonation can be traced largely to ancient tribal practices. Justifications for it can be found in the codes of Hammurabi and in the family law of the Roman Empire. Unfortunately, honor killings in the Twenty-first Century are not isolated incidents, nor can they be regarded …

Children Of Men And A Plural Messianism, Sarah Schwartzman Apr 2009

Children Of Men And A Plural Messianism, Sarah Schwartzman

Journal of Religion & Film

Children of Men (2006) presents an apocalyptic narrative in which the hope for redemption relies on the formation and expansion of new communities. Director Alfonso Cuarón invents a realistic, modern Armageddon by playing on contemporary fears about environmental destruction, nuclear warfare, terrorist attack, and the sense of cultural loss that accompanies rapid globalization. The film relies on Christian theological symbols to propose a new kind of messianism – one in which many messiahs will collectively restore human sacrality and fertility by dismantling rigid systems of social control. By envisioning the apocalyptic world as one that dehumanizes outsiders, Children of Men …

Film And The Apologetics Of Biblical Violence, Hector Avalos Apr 2009

Film And The Apologetics Of Biblical Violence, Hector Avalos

Journal of Religion & Film

Most films that depict biblical violence are part of a broader apologetic effort to justify violence by biblical protagonists. In order to understand the variety and complexity of these apologetic efforts, the author introduces a typology that consists of five logical techniques that can be applied to biblical stories depicted on film: 1) deletion of violence; 2) addition of violence; 3) minimization of existing violence; 4) maximization of existing violence; 5) reconfiguration of violence. The author focuses on specific episodes in Jesus films and in films dealing with the life of Moses to illustrate his thesis.

Modeling Hiv Drug Resistance, Mingfu Zhu Apr 2009

Modeling Hiv Drug Resistance, Mingfu Zhu

All Dissertations

Despite the development of antiviral drugs and the optimization of therapies, the emergence of drug resistance remains one of the most challenging issues for successful treatments of HIV-infected patients. The availability of massive HIV drug resistance data provides us not only exciting opportunities for HIV research, but also the curse of high dimensionality.
We provide several statistical learning methods in this thesis to analyze sequence data from different perspectives. We propose a hierarchical random graph approach to identify possible covariation among residue-specific mutations. Viral progression pathways were inferred using an EM-like algorithm in literature, and we present a normalization method …

Forecasting Utility Of Uk Consumer Sentiment Indexes In Real Time : Do Consumer Sentiment Surveys Improve Consumption Forecasts In Real Time?, Bradford M. Smith

Honors Theses

This paper builds on recent research utilizing real time datasets in order to assess the forecasting utility of consumer sentiment indexes in the United Kingdom. Academic researchers have consistently found that consumer confidence indexes accurately predict consumer spending in the near term. Few of these examinations, however, have utilized out of sample forecasting and only one has incorporated real time data. In an effort to recreate the exact dataset that is available to economic forecasters in real time, this paper utilizes the recently published Gross Domestic Product Real-Time Database from the Bank of England in order to produce forecasts of …

Visual Discrimination Training For Rats : Developing A New Methodology To Explore Laterality Differences, Tiffany R. Brunelli Apr 2009

Visual Discrimination Training For Rats : Developing A New Methodology To Explore Laterality Differences, Tiffany R. Brunelli

Honors Theses

The goal of this study was to examine right hemisphere specialization for faces at the neuronal level. Research has shown that facial recognition relies on the right anterior temporal lobe and involves integrating multiple features (Bukach, Gauthier, & Tarr, 2006). Evidence from rat studies confirms that the anterior temporal lobe is involved in integrating multiple object features (Eacott, Machin, & Gaffan, 2001). However, these studies did not examine differences between the brain’s right and left hemispheres. It was hypothesized that the right anterior temporal lobe is more important for feature integration. The current study aimed to develop a methodology for …

Use Of Molecular Tools On Surveys Of Genetic Variation And Population Structure In Three Species Of Sharks, Andrey Leonardo F Castro Apr 2009

Use Of Molecular Tools On Surveys Of Genetic Variation And Population Structure In Three Species Of Sharks, Andrey Leonardo F Castro

USF Tampa Graduate Theses and Dissertations

Molecular tools, such as sequencing of the mitochondrial DNA Control Region (CR) and genotyping of highly variable nuclear microsatellites were applied to survey the genetic diversity, population structure and phylogeography of three shark species: the whale shark, Rhincodon typus; the bull shark, Carcharhinus leucas; and the nurse shark, Ginglymostoma cirratum. The highly migratory and pelagic whale shark exhibited the largest length variation yet reported for an elasmobranch CR (1143–1332 bp), and high haplotype (h = 0.974 ± 0.008) and nucleotide diversities(π = 0.011 ± 0.006). No geographical clustering of lineages was observed and the most common …
