Cliff swallows (Petrochelidon pyrrhonota) are migratory birds that breed in colonies and frequently nest on highway structures. Protected by the Migratory Bird Treaty Act of 1918, swallows in their active nests cannot be harmed by nesting-control methods. This causes problems and delays in maintenance of structures by divisions of many departments of transportation. We evaluated 2 aversion strategies, bioacoustic deterrents and surface modifications, for their effect on cliff swallow nesting behavior. The bioacoustic deterrents consisted of sonic devices that broadcast 8 unique recordings of alarm and distress calls of cliff swallows. Interactions between humans and white-tailed deer (Odocoileus virginianus) have become common, often resulting in management actions to mitigate negative impacts. Changes in population size are generally used to judge management actions. We examined deer population estimation techniques during 2 mark-resighting experiments in a woodland-grassland habitat in central New York State and in a suburban area. We compared program NOREMARK, Lincoln-Peterson estimates, and Jacobson’s (1997) buck:doe ratios (BDR) for estimating deer abundance. In the first field trial, we sought to validate the camera survey methods and computer applications. We used infrared-triggered cameras (IRCs) to survey a white-tailed deer population …

Management of problem wildlife within the airfield environment is a difficult job. Today’s Bird–Animal Aircraft Strike Hazard (BASH) program managers require as much information as possible to accomplish their tasks. Bird censuses and actual bird-strike events in and around the air operations area are used to make airfield management decisions and to assess the risk of bird hazards to aircraft. Both types of information are sampled rather sparsely. Avian radar is now being used as a new tool to provide continuous sampling of bird activity that significantly supplements visual censuses. This paper provides an overview of the predatory activities of the house cat (Felis catus) in Australia, focusing principally on the interactions of domestic and stray cats with native species of prey. Like their free-living, or feral, counterparts, domestic cats take a broad range of prey, with small mammals, birds, and human-derived foods forming the bulk of the diet. Domestic and stray cats have contributed to declines of suburban populations of eastern barred bandicoots (Perameles gunnii) and superb lyrebirds (Menura novaehollandiae) in Victoria, Australia. Bird–aircraft collisions (i.e., bird strikes) are a major problem at airports worldwide, often because birds are attracted to airfields to feed on seeds, insects, or rodents that abound in the grassy areas near runways and taxiways. We compared an alternative ground cover, wedelia (Wedelia trilobata), to existing vegetation (control plots) on the airfield at Lihue Airport, Kauai, Hawaii, to determine if bird populations on the airport could be reduced by eliminating their forage base. Can an actor justify criminal conduct when he was criminally culpable in creating the conditions making it necessary? Virtually every American jurisdiction answers that he cannot and bars the necessity defense under those circumstances. Whereas many scholars have condemned that response, this Article takes the very different view that the exclusion of the defense for purposeful, knowing, and reckless criminal conduct that directly causes the conditions leading to the allegedly justified act represents a sound retributivist check on what is an otherwise cruder evaluation of whether conduct is socially valuable, worthy of praise, or, in a word, justified. Public health ethics require individuals who are inherently at risk for transmitting communicable disease to be subjected, oftentimes, to isolation, quarantine, or compulsory vaccination - all undertaken, as such, to protect the common good and thereby secure the public-at-law for exposure to the spread of an infectious disease.

This article tests the extent to which public health emergencies necessitate a reinterpretation or reshaping of the common good and proceeds to analyze the extent to which the medical principle of triage is a relevant construct for allocating scarce medical resources during contemporary public health emergencies. In March 2003, I wrote an article for the Environmental Law Reporter surveying potential international judicial forums where victims of global warming could bring lawsuits. In the ensuing six years, numerous lawsuits have been brought in the United States and in other countries, and environmentalists can now celebrate their first significant victory. In April 2007, based upon its finding that greenhouse gases are pollutants under Section 202(a)(1) of the U.S. Clean Air Act, the Supreme Court in Massachusetts v. EPA held that the U.S. Environmental Protection Agency (EPA) has the authority to regulate greenhouse gases.

The debate over how to address the origins of life in American schools has been ongoing for almost a century. Proponents of creationism and intelligent design have used several different strategies in order to make sure their views are taught, and each time they have been struck down by the Supreme Court. This paper will analyze the three distinct forms the debate has taken, from attempts to ban outright the teaching of evolution, to the teaching of some form of creation-science alongside evolution, to attempts to “disclaim” evolution as it is taught. Over thirty-four years since the 1960-1975 Second Indochina War, Unexploded Ordnance (UXO) continues to inhibit a multitude of development priorities in Laos. One of only three remaining Least Developed Countries in Southeast Asia, greater understanding of the socio-economic effects of UXO is crucial to the development of Laos. Drawing on three weeks of field work in June 2009, primarily composed of semi-structured interviews, non-participant observation and literature analysis, this thesis examines the effects of UXO alongside an analysis of how existing responses to UXO contamination in Laos may be improved.

Cosmopolitanism in Derrida's works sounds like an afterthought in comparison to other more recurring themes of his texts, like 'writing', 'differance', 'supplement', 'metaphysics', or 'violence'. Cosmopolitanism seems to belong to deconstruction, which is often associated with decentring, fragmentation, and critique of totality and universality, only as an intimate other, a foreign element grafted in the body by force, or by miracle. Organic amendments are commonly used to improve tree nursery soil conditions for increased seedling growth. However, few studies compare organic amendments effects on soil conditions, and fewer compare subsequent effects on seedling growth. The effects of three organic amendments on soil properties and seedling growth were investigated at the USDA Forest Service J.W. Toumey Nursery in Watersmeet, MI. Pine sawdust (red pine, Pinus resinosa), hardwood sawdust (maple, Acer spp. and aspen, Populus spp.), and peat were individually incorporated into a loamy sand nursery soil in August, 2006, and soil properties were sampled periodically for the next 14 months. Hall-effect thruster (HET) cathodes are responsible for the generation of the free electrons necessary to initiate and sustain the main plasma discharge and to neutralize the ion beam. The position of the cathode relative to the thruster strongly affects the efficiency of thrust generation. However, the mechanisms by which the position affects the efficiency are not well understood. This dissertation explores the effect of cathode position on HET efficiency. Plant genomes are extremely complex. Myriad factors contribute to their evolution and organization, as well as to the expression and regulation of individual genes. Here we present investigations into several such factors and their influence on genome structure and gene expression: the arrangement of pairs of physically adjacent genes, retrotransposons closely associated with genes, and the effect of retrotransposons on gene pair evolution.

All sequenced plant genomes contain a significant fraction of retrotransposons, including that of rice. We investigated the effects of retrotransposons within rice genes and within a 1 kb putative promoter region upstream of each gene. We found …
