Pregnancy And Sex-Role Stereotyping: From ‘Struck’ To ‘Carhart’, Neil S. Siegel, Reva B. Siegel

The guarantee of equal protection of the laws extends to women as well as men. Yet for the first 100 years of the Fourteenth Amendment’s life, the Supreme Court never found a law unconstitutional on the grounds that it discriminated on the basis of sex. Between 1970 and 1980, social movement advocacy and brilliant litigation by Ruth Bader Ginsburg and others changed our constitutional law. Over the course of the decade, the Court extended the anti-stereotyping principle from discrimination on the basis of race to discrimination on the basis of sex. Presidential Popular Constitutionalism, Jedediah Purdy

This Article adds a new dimension to the most important and influential strand of recent constitutional theory: popular or democratic constitutionalism, the investigation into how the U.S. Constitution is interpreted (1) as a set of defining national commitments and practices, not necessarily anchored in the text of the document, and (2) by citizens and elected politicians outside the judiciary. Wide-ranging and groundbreaking scholarship in this area has neglected the role of the President as a popular constitutional interpreter, articulating and revising normative accounts of the nation that interact dynamically with citizens’ constitutional understandings. In 1991, the Tibetan Government in Exile adopted the Tibetan Constitution. This is a living document that is widely recognized by the Tibetan community inside Tibet and those living in exile. Since its adoption, it has been amended eleven times and successfully provides for the democratic elections of exile leaders.

This Note argues that formal and informal international recognition of the importance and potential value of this document can help secure environmental and political stability, effective communication and democratic development throughout the region. How Do You Know That? An Investigation Of Student Research Practices In The Digital Age, Randall Mcclure, Kellian Clink

This study investigates the types of sources that English composition students use in their research essays. Unlike previous studies, this project pairs an examination of source citations with deeper analysis of source use, and both are discussed in relation to responses gathered in focus groups with participating students and teachers. The researchers examine how students negotiate locating and using source material, particularly online sources, in terms of timeliness, authority, and bias. The researchers report on how teachers struggle to introduce these concepts and how students fail to perceive authority and bias in their sources.

For the purpose of constructing yam cDNA libraries, attempts to isolate high quality RNA using several previously reported protocols were unsuccessful. Therefore a protocol was standardized for yam total RNA isolation by using guanidium buffer at the Department of Biology, Virginia State University. The RNA isolated using this standardized protocol was high in quality and led to successful good quality cDNA library construction and identification of functional ESTs in yam.

The Fair Labor Standards Act Exemptions And The Pharmaceuticals Industry: Are Sales Representatives Entitled To Overtime?, Steven I. Locke

This article discusses the battle in the courts as to whether highly compensated pharmaceutical sales representatives are entitled to overtime pay under the Fair Labor Standards Act, or whether they are excluded from such an entitlement under one or more of the Act’s “exemptions.” This article also conducts a review of the courts’ various conflicting positions and charts a course for addressing the issue before the Courts of Appeals and ultimately the Supreme Court.

The Discover Mojave Forever Earth program is more than a field trip to Lake Mead National Recreation Area (NRA). The program takes place aboard the Forever Earth, a floating environmental learning center. Integration Of An Extended Octagonal Ring Transducer And Soil Coulterometer For Identifying Soil Compaction, Santosh K. Pitla, Larry G. Wells, Scott A. Shearer

The soil coulterometer is an "on-the-go" electro-mechanical system which collects impedance force data at multiple depths using an oscillating coulter. During the initial testing (summer 2006), only vertical soil impedance force data was collected using a pressure sensor. To improve the performance of the coulterometer, an extended octagonal ring transducer was integrated into the system to collect both the horizontal and vertical impedance forces given by the soil. In the summer of 2007, data was collected using the revised sensor from a typical central Kentucky field setting in a 0.8-ha (2-acre) plot. Four passes were made with the coulterometer. Seventy …

This Article recognizes that television programs outside of the law genre can engage in legal discourse: to wit, South Park. South Park has been called one of the most profane programs on television, as well as one of the most ideological. Indeed, through sophisticated, no-holds-barred satire, South Park contemplates a number of American culture's most complex and contentious legal issues. This Article systematically analyzes the legal ideologies conveyed by South Park, combining an interpretive ethnographic analysis with quantitative content analyses. Ultimately, these examinations reveal that South Park communicates a libertarian ideology of law. In doing so, however, it does not …

In the first decade of the twenty-first century, video games have finally taken their place alongside movies, comic books, and drawings as a form of protected First Amendment speech. Since the Seventh Circuit's 2001 decision in American Amusement Machine Association v. Kendrick, court after court has struck down ordinances and statutes aimed at restricting violent video games--on the grounds that such violate game designers' and players' First Amendment speech rights. In the United States, the line between the type and level of transformation required for a copyrightable derivative work and that required to constitute fair use has not been drawn clearly. With the rise of user-generated content, this question (which arises in two distinct copyright contexts) has become even more important. At the same time, copyright law has generally shied away from defining authorship as a legal concept, preferring instead to develop and rely on the related (but not identical) concept of originality. This dissertation examines the uses and conceptualizations of photography in college Composition. Composition has long been conflicted over the relation between form and content---and since the 1970s, between aesthetics and politics. Today, this disciplinary tension manifests in how the visual is brought into pedagogy: either it is approached aesthetically, as something to beautify a text, or politically, as a source of cultural critique. The field's uses of photography have been positioned within this aesthetics/politics binary, but to understand the medium as only one or the other is to miss its full practical and theoretical potential.

What follows is a study of Hollywood screenwriter Robert Towne. Theoretical notions of the screenplay have largely been cast in terms of screenwriting practice as an adjunct of studio production schedules. A popular cultural text in its own right, the screenplay is a procedurally central yet provisional document originated by a writer and subject to alteration within the production process. Auteurism has dominated film theory for over fifty years and is the point of departure for this study. Conflicts of interest permeate the Canadian investment fund industry. In response, securities regulators have promulgated National Instrument 81-107 Independent Review Committee for Investment Funds. In the view of securities regulators, NI 81-107 reflects a "principles-based" approach toward the regulation of conflicts of interest. This Article articulates a theoretical conception of principles-based securities regulation, one which transcends the formalism of the traditional "rules" versus "principles" debate to reveal a new regulatory paradigm. Learning Our Lessons: A Proactive Approach To Bibliotherapy And Its Application To Children, Marleah Augustine

The current study examined whether children can learn behaviors from fictional characters in books. Additionally, the researcher explored whether discussion of the topic at hand would improve the learning of those behaviors or if it would have no effect and reading alone can elicit change. Children in kindergarten and first-grade (n = 85) took both a pre-test and post-test about two separate topics, bullying and trying new things. They were assigned to four different groups: book only, discussion only, both book and discussion, and unrelated book. No significant differences were found between groups regarding the "trying new things" topic, whereas …
