Acute And Chronic Effects Of Coal Tar And Asphalt Sealants On Salamanders, Thomas Bommarito, Richard Halbrook, Donald W. Sparling
KIP Data Sets and Technical Reports
The Barton Springs salamander (Eurycea sosorum) is a federally endangered species inhabiting pools of the Edwards aquifer in the City of Austin, Texas. The presence of polycyclic aromatic hydrocarbons (PAH) in these pools elicited concern for the conservation of the species because 4 PAHs have acute and chronic effects on aquatic organisms, including amphibians. These PAHs appear to be coming from sealants applied to pavements within the watershed of these ponds. To determine if Barton Springs salamanders could be a risk to these PAHs three laboratory experiments were funded by the Barton Springs Conservation Foundation and conducted by at Southern …

KIP Articles
As historically recognized, three stygobitic species of the subgenus Aviticambarus, genus Cambarus inhabit Mississippian limestone caves along the southern edge of the Southern Appalachians and Highland Rim in southeastern Tennessee and Northern Alabama, U.S.A. These include Cambarus hamulatus, C. jonesi, and C. veitchorum. All stygobitic members of the genus Procambarus inhabit caves in Florida, Cuba, and Mexico with exception of P. pecki (in the monotypic subgenus Remoticambarus), which exists in only three caves with C. jonesi in Northwestern Alabama. It was hypothesized that Procambarus pecki was derived from a primitive Procambarus stock that gave rise to the genera Cambarus and …

Libel, Chad Raphael
Libel, Chad Raphael
Communication
Defamatory statements are those which harm an individual’s reputation in the eyes of the community. The law distinguishes between slander (spoken defamation) and libel (written or broadcast defamation). Libel law attempts to balance the interests of journalists and others with the rights of individuals and organizations to protect themselves against false and injurious attacks. American libel law has changed significantly since the 1960s, offering greater freedom to journalists to criticize public figures. At the same time, libel law has also become more complex, creating ongoing uncertainty about when journalists are on safe ground. Libel lawsuits are still the most common …
Broadcast Network Documentaries, Chad Raphael
Broadcast Network Documentaries, Chad Raphael
Communication
Documentaries are nonfiction programs that convey experience, provide information, and offer analysis. Many memorable and respected programs in American television journalism were documentaries. In part this is because documentaries offer journalists the luxury of more airtime to explore a single topic in greater depth than the shorter-format evening news or newsmagazine programs. In addition, documentarians are often freer to express their own conclusions on controversial issues than beat reporters, who are more constrained by the demands of objectivity and balance.
Although the line between documentary and docudrama is often blurry, documentaries are less likely to dramatize or re-enact events. In …
Women For A Peaceful Christmas: Wisconsin Homemakers Seek To Remake American Culture, Nancy Unger
Women For A Peaceful Christmas: Wisconsin Homemakers Seek To Remake American Culture, Nancy Unger
History
In the autumn of 1971, sixteen Madison homemakers, including Nan Cheney and Sharon Stein, began "Women for a Peaceful Christmas" (WPC), a unique attempt to do nothing less than remake American culture. Under the slogan "No More Shopping Days 'Til Peace," WPC organized ostensibly powerless homemakers into a "quiet revolt against 'an economy which thrives on war and the destruction of our earth's resources.'' WPC urged the public (especially women, the sex that did the vast bulk of holiday shopping) to take economic, political, and environmental matters into their own hands. "If you don't want your Christmas celebrations to be …

The Many Faces Of Fault In Contract Law: Or How To Do Economics Right, Without Really Trying, Richard A. Epstein
The Many Faces Of Fault In Contract Law: Or How To Do Economics Right, Without Really Trying, Richard A. Epstein
Faculty Articles
Modern law often rests on the assumption that a uniform costbenefit formula is the proper way to determine fault in ordinary contract disputes. This Article disputes that vision by defending the view that different standards of fault are appropriate in different contexts. The central distinction is one that holds parties in gratuitous transactions only to the standard of care that they bring to their own affairs, while insisting on the higher objective standard of ordinary care in commercial transactions. That bifurcation leads to efficient searches. Persons who hold themselves out in particular lines of business in effect warrant their ability …

The article presents the author's analysis on the research tools and materials called Pasteur's Quadrant use in basic science and applied overlap in the U.S. He explains that user innovation is in the form of collaborative communities, wherein, they share technical advances with other user. The article also presents various analyses of preference and social norms that highlight the scientific interest in the same research questions. In addition, it discusses the importance promotion of similar policies in different research tools by research funding agencies.
Should Property Scholars Embrace Virtue Ethics? A Skeptical Comment, Katrina M. Wyman
Should Property Scholars Embrace Virtue Ethics? A Skeptical Comment, Katrina M. Wyman
Faculty Articles
Will property scholars be as open as economic policymakers have been recently to abandoning longstanding ideas and adopting a new intellectual perspective? Only time will tell what, if any, impact the dramatic events of recent months will have in legal academic circles. In this Response I pursue what I hope is a more fruitful question for academic inquiry, namely whether property scholars should follow Pefialver's recommendations and embrace virtue ethics as a normative guide. I start by critically analyzing Pefialver's objections to economic analysis of law. I then identify four questions that Pefialver and other proponents of using virtue ethics …
Revenge As Revenant: Titus Andronicus And The Rule Of Law, Kenji Yoshino
Revenge As Revenant: Titus Andronicus And The Rule Of Law, Kenji Yoshino
Faculty Articles
The return of Titus and the revenge genre to which it belongs requires explanation. We might crib Coleridge's criticism that audiences today love violence and vulgarity. But that refines the question rather than answering it. Why do graphic representations of violence capture us today more than they captured our great-grandparents? I believe our view of revenge tragedies hews so closely to the Elizabethan one because our times are more like Elizabethan times along a crucial dimension: the sense of the fragility of the rule of law. The beginning of a fully globalized society without an overarching government means injuries will …
Activity Levels Under The Hand Formula: A Comment On Gilo And Guttel, Richard A. Epstein
Activity Levels Under The Hand Formula: A Comment On Gilo And Guttel, Richard A. Epstein
Faculty Articles
Within the law and economics field, there often surfaces a near hypnotic attraction to the Hand formula as the one and only tool that drives tort law toward economic efficiency. Hand’s intuition was, of course, that the test for efficiency requires a balancing of three variables. The burden of taking particular precautions is compared to the expected loss from some activity, which in turn consists of the likelihood of some particular harm multiplied by its anticipated severity. Liability attaches only where the burden of precautions is lower than the anticipated accident costs. By forcing cost-effective precautions and no others on …

Participatory Planning And Procedural Protections: The Case For Deeper Public Participation In Urban Redevelopment, Damon Y. Smith
Saint Louis University Public Law Review
For decades legal and planning commentators have advocated a deeper and more meaningful level of public participation in urban revitalization efforts. The result of such advocacy has increased the use of public participation as a criterion for awarding federal redevelopment funds but has had little impact on participatory requirements in state redevelopment law. This article explores the theoretical arguments in favor of increased public participation in the redevelopment context and finds that there is an overemphasis on direct democracy arguments and the “empowerment” theory, a concept that belies simple definition. This article explores the intrinsic and instrumental benefits of public …

Offsets generated by projects for reducing emissions from deforestation and degradation (“REDD”) is a particularly controversial form of carbon offset. Excluded from the Kyoto Protocol mechanisms, REDD offsets are now making a comeback ever since the Bali Action Plan specifically referred to REDD. Most recently, the Copenhagen Accord recognized the crucial role of REDD and the need to enhance removals of GHG emissions by forests and agreed on the need to provide incentives to such actions to enable the mobilization of financial resources from developed countries.4 It would seem therefore that the issuance and trade of REDD offsets may finds …

Effect Of Correlated Lateral Geniculate Nucleus Firing Rates On Predictions For Monocular Eye Closure Versus Monocular Retinal Inactivation, Brian S. Blais, Leon N. Cooper, Harel Z. Shouval
Science and Technology Department Faculty Journal Articles
Monocular deprivation experiments can be used to distinguish between different ideas concerning properties of cortical synaptic plasticity. Monocular deprivation by lid suture causes a rapid disconnection of the deprived eye connected to cortical neurons whereas total inactivation of the deprived eye produces much less of an ocular dominance shift. In order to understand these results one needs to know how lid suture and retinal inactivation affect neurons in the lateral geniculate nucleus (LGN) that provide the cortical input. Recent experimental results by Linden et al. showed that monocular lid suture and monocular inactivation do not change the mean firing rates …

The Influence Of An Ecosystem Engineer On Nutrient Subsidies And Fish Invasions In Southwestern Montana, Magnus Mccaffery
Graduate Student Theses, Dissertations, & Professional Papers
Streams and associated riparian zones are among the world's most highly valued yet threatened ecosystems. Interest in using the ecosystem engineering behavior of beaver tomeet watershed conservation goals is becoming more pervasive, owing to substantive work documenting the physical effects of beaver impoundments on freshwater ecosystems. However, it is unclear how beaver modify ecological processes linking abiotic factors to changes in the surrounding biotic community. I investigated how beaver impoundments influence local food web processes, as well as impact native fish species threatened by nonnative invasions.
I showed that beaver impoundments enhanced aquatic resource availability to terrestrial consumers. Beaver impounded …
