U.S. information privacy laws contain a memory gap: they regulate the collection and disclosure of certain kinds of information, but they say little about its retention. This memory gap has ever-increasing significance for the structure of government surveillance law. Under current doctrine, the Fourth Amendment generally requires government agents to meet high standards before directly and prospectively gathering a target's communications. The law takes a dramatically different approach to indirect, surveillance-like activities, such as the compelled production of communications from a third party, even when those activities yield the same information as, or more information than, direct surveillance activities. This article explores the evolving role of the U.S. Supreme Court in the politics of death. By constitutionalizing the death penalty in the 1970s, the Supreme Court unintentionally set into motion political forces that have seriously undermined the Court's vision of a death penalty that is fairly administered and imposed only on the worst offenders. With the death penalty established as a highly salient political issue, politicians - legislators, prosecutors, and governors - have strong institutional incentives to make death sentences easier to achieve and carry out. When All Eyes Are Watching: Trial Characteristics And Practices In Notorious Trials, Paula Hannaford-Agor

In part because of their relative scarcity and the uniqueness of each new notorious trial, it is difficult to generalize the effects of trial notori­ety. However, a recent study by the National Center for State Courts Center for Jury Studies reveals infor­mation about the prevalence of notorious trials and their impact on trial procedures and practices. The State-of-the-States Survey of Jury Improvement Efforts collected trial reports from nearly 12,000 jury trials conducted in state and federal courts in all 50 states and the District of Columbia. The vast majority of trials took place between 2002 and 2006.

The study assessed the psychosocial adjustment of international students in higher education in the United States (U.S.) and examined their overall experiences since their arrival in the country. Pa1iicipants completed the 54-item Inventory for Student Adjustment Strain. The adjustment variables which were examined in the inventory were culture shock, language fluency, academic difficulties, social support, loneliness, and assertiveness. The hypothesis of the study was that the variables of age, gender, and length of time in the U.S. would predict the psychosocial adjustment of the sample of international students after their arrival to an unfamiliar country. This thesis addressed the issue of assessment in Career Services Departments (CSDs) and specifically how prepared, confident, and knowledgeable users of the CSD perceived themselves to be in comparison to students who had not utilized services provided by the CSD. Ultimately, the intent of this project was to generate research about assessment methods and provide an assessment tool specifically for use in the assessment of CSDs.

Underage drinking, that is, anyone consuming alcohol under der the t age of 21, is one of the most important issues facing college campuses today. In thee United States, two out of every three full-time college students report having drunk alcohol in one capacity or another in the last 30 days (Wechsler et al., 1998). An estimated 307 college student were involved in non-traffic alcohol related deaths in 2002 (Hingson, Heeren, Zakocs, Kopstein & Wechsler, 2002). More and more U.S. students are seeking university study abroad in China. Information about how to prepare for overseas study in China, and what challenges need to be overcome, is limited. To develop the proposed orientation curriculum, Chinese professors teaching international students, international student affairs professionals serving international students, English-speaking international students studying in Chinese universities, and U.S. citizens visiting and working in China contributed their insights and experiences of culture shock, culture surprises, and cultural differences. The purpose of this study was to dialogue with several graduate programs at Eastern Illinois University to better examine their admissions requirements and philosophy on recruitment. Graduate recruitment at a midsized public institution, such as Eastern lllinois University, has strengths and weakness in regards to attracting students. Location, class size, reputation and preparing students for doctoral programs were reported as factors associated with attracting perspective graduate students. Many graduate programs did not actively recruit students because of heavy reliance on representatives from the graduate school.

The School of Continuing Education (SCE) at Eastern Illinois University offers evening and weekend courses for returning adult students at a variety of off campus locations. Program assessment conducted in 1988, 1993, 1997, and 2002 used an off campus adult student survey administered by traditional means. Since these program assessment administrations, the proportion of classes offered through traditional off campus classroom instruction has lowered in relation to classes that are technology delivered.

Age of first marriage for American women has been on the rise and Black women possessing higher education seem to top the charts of this growing trend. The review of recent literature articulates an increase in marriage ages for Black women that seem to correspond to educational attainment. This article argues for the importance of developing a relational ethic to guide university-community engagement practices and processes. Our objective is to demonstrate that ethical 'engagement bridges' can be formed to link higher education institutions (HEis), human capital at the community level, and the important global questions of our day that resonate with regional communities. Taking centre place in this triad is the notion of being-for, an ideal form of togetherness put forward by Zygmunt Bauman (1995) in his early work on globalisation and post-modernity. The forty or more different clan groups of Australian Aboriginal people who Jive on or near the coast and islands of north-east Arnhem Land, in the Northern Territory, are collectively known as Yolngu. Yolngu law dictates that all marriages must be outside the clan group, a principle which has given rise to complex ceremonial and economic exchange relationships among quite separate groups. This Essay reviews Civil Litigation in Comparative Context (West 2007), by Oscar G. Chase, Helen Hershkoff, Linda Silberman, Yasuhei Taniguchi, Vincenzo Varano, and Adrian Zuckerman. It also identifies some areas of exceptionalist American civil procedure that recently have been converging towards global norms and argues that those convergences, if they continue, could render comparative studies particularly meaningful.

Wnts play a central role in the development of many cells and tissue types in all species studied to date. Like many other extracellular signaling pathways, secreted Wnt proteins are involved in many different processes; in C. elegans these include cell proliferation, differentiation, cell migration, control of cell polarity, axon outgrowth, and control of the stem cell niche. Perturbations in Wnt signaling are also key factors in cancer formation, and therefore of interest to oncobiologists. Wnts are secreted glycoproteins, which bind to Frizzled transmembrane receptors and signal either through, or independently of β-catenin. Both β-catenin-dependent (Wnt/β-catenin) and -independent pathways function …

We present decompositions of various positive kernels as integrals or sums of positive kernels. Within this framework we study the reproducing kernel Hilbert spaces associated with the fractional and bi-fractional Brownian motions. As a tool, we define a new function of two complex variables, which is a natural generalization of the classical Gamma function for the setting we consider.

Motivated by the hyper-holomorphic case we introduce and study rational functions in the setting of Hida’s white noise space. The Fueter polynomials are replaced by a basis computed in terms of the Hermite functions, and the Cauchy-Kovalevskaya product is replaced by the Wick product.

Belief Propagation algorithms acting on Graphical Models of classical probability distributions, such as Markov Networks, Factor Graphs and Bayesian Networks, are amongst the most powerful known methods for deriving probabilistic inferences amongst large numbers of random variables. This paper presents a generalization of these concepts and methods to the quantum case, based on the idea that quantum theory can be thought of as a noncommutative, operator-valued, generalization of classical probability theory. Some novel characterizations of quantum conditional independence are derived, and definitions of Quantum n-Bifactor Networks, Markov Networks, Factor Graphs and Bayesian Networks are proposed. Nonclassicality Without Entanglement Enables Bit Commitment, Howard Barnum, Oscar C. O. Dahlsten, Matthew S. Leifer, Ben Toner

We investigate the existence of secure bit commitment protocols in the convex framework for probabilistic theories. The framework makes only minimal assumptions, and can be used to formalize quantum theory, classical probability theory, and a host of other possibilities. We prove that in all such theories that are locally non-classical but do not have entanglement, there exists a bit commitment protocol that is exponentially secure in the number of systems used.

In response to a long-lasting anticipation by the Java community, version 1.5 of the Java 2 platform - referred to as Java 5 - introduced generic types and methods to the Java language. The Java 5 generics are a significant enhancement to the language expressivity because they allow straightforward composition of new generic classes from existing ones while reducing the need for a plethora of type casts. While the Java 5 generics are expressive, the chosen implementation method, type erasure, has triggered undesirable orthogonality violations. Color Transparency In Qcd And Post-Selection In Quantum Mechanics, Shmuel Nussinov, Jeff Tollaksen

We discuss color transparency in the nuclear QCD context from the perspective of pre- and post-selected ensembles. We show that the small size of the hadronic states can be explained by the peculiar "force of post-selection," in contrast to the more standard explanation based on external forces.
