Inflating Goodyear's Bottom Line: Paying Women Less And Getting Away With It, Amalia Goldvaser
Inflating Goodyear's Bottom Line: Paying Women Less And Getting Away With It, Amalia Goldvaser
Cardozo Journal of Equal Rights & Social Justice
The note critiques the U.S. Supreme Court's decision in Ledbetter v. Goodyear Tire & Rubber Co., arguing that it unjustly limits the ability of employees, particularly women, to seek redress for pay discrimination under Title VII of the Civil Rights Act of 1964. The decision held that a claim for pay discrimination must be filed within 180 days of the initial discriminatory pay-setting decision, even if the employee did not discover the disparity until later. The note contends that this ruling ignores the reality that pay discrimination is often hidden and cumulative, making it difficult for employees to identify …

Wedlock, Blood Relationship, And Citizenship, Logan Bobo
Cardozo Journal of Equal Rights & Social Justice
The note examines the conflicting interpretations of U.S. nationality law under the Immigration and Nationality Act (INA), particularly focusing on whether citizenship transmission requires a blood relationship or can be based on the legal status of the parents' marriage. It argues that the Ninth Circuit's interpretation, which does not require a blood relationship for children born in wedlock, better aligns with the INA's goals of promoting family unity and avoiding gender-based discrimination. The note critiques the State Department's interpretation, as outlined in the Foreign Affairs Manual (FAM), for lacking statutory and judicial support, and highlights the need for congressional or …

Strict Liability And Negligent Rape: Or How I Learned To Start Worrying And Question The Criminal Justice System, Dini Rosenbaum
Cardozo Journal of Equal Rights & Social Justice
The note critiques strict liability and negligent rape standards, advocating for a more nuanced approach that prioritizes subjective fault and societal education to address the limitations of current rape laws. It emphasizes the need to align legal standards with the defendant's actual state of mind while addressing systemic barriers to justice, particularly in date rape cases. The analysis highlights the gap between legal reforms and their practical application, suggesting that education could be a more effective tool for prevention than relying solely on legal changes.

Reporting Sexual Assault Of Women In The Military, Jodie Friedman
Cardozo Journal of Equal Rights & Social Justice
The note examines the underreporting of sexual assaults in the military and the impact of policy changes aimed at addressing this issue. It highlights the challenges faced by victims, including fears of retaliation and the lack of confidentiality, and evaluates the effectiveness of the 2005 restricted reporting policy. The analysis suggests that while progress has been made, systemic issues persist, and further reforms are needed to protect victims' rights and ensure justice.

Developing Better Lawyers And Lawyering Practices: Introduction To The Symposium On Innovative Models Of Lawyering, John Lande
Journal of Dispute Resolution
To examine innovations in legal practice, the University of Missouri Center for the Study of Dispute Resolution and the Journal of Dispute Resolution held a symposium on October 12, 2007, featuring leading practitioners and scholars to analyze innovative models of lawyering, including Collaborative Law and other processes. David Hoffman gave an outstanding keynote address, which was followed by two panels of experts. This issue of the Journal of Dispute Resolution presents papers from that symposium was so productive that we did not have time for presentations from some participants and do not have space for all the papers in this …
Role Of Covalent Fe-As Bonding In The Magnetic Moment Formation And Exchange Mechanisms In Iron-Pnictide Superconductors, Kirill D. Belashchenko, Vladimir P. Antropov
Role Of Covalent Fe-As Bonding In The Magnetic Moment Formation And Exchange Mechanisms In Iron-Pnictide Superconductors, Kirill D. Belashchenko, Vladimir P. Antropov
Nebraska Center for Materials and Nanoscience: Faculty Publications
The electronic origin of the huge magnetostructural effect in layered Fe-As compounds is elucidated using LiFeAs as a prototype. The crucial feature of these materials is the strong covalent bonding between Fe and As, which tends to suppress the exchange splitting. The bonding-antibonding splitting is very sensitive to the distance between Fe and As nuclei. We argue that the fragile interplay between bonding and magnetism is universal for this family of compounds. The exchange interaction is analyzed in real space, along with its correlation with covalency and doping. The range of interaction and itinerancy increase as the Fe-As distance is …

Allergenicity Assessment Of Genetically Modified Crops—What Makes Sense?, Richard E. Goodman, Stefan Vieths, Hugh A. Sampson, David Hill, Motohiro Ebisawa, Ronald Van Ree
Department of Food Science and Technology: Faculty Publications
GM crops have great potential to improve food quality, increase harvest yields and decrease dependency on certain chemical pesticides. Before entering the market their safety needs to be scrutinized. This includes a detailed analysis of allergenic risks, as the safety of allergic consumers has high priority. However, not all tests currently being applied to assessing allergenicity have a sound scientific basis. Recent events with transgenic crops reveal the fallacy of applying such tests to GM crops.

Chinese Liver Flukes In Latrine Sediments From Wong Nim’S Property, San Bernardino, California: Archaeoparasitology Of The Caltrans District Headquarters (Galley Proofs), Karl J. Reinhard, Adauto Araújo, Luciana Sianto, Julia G. Costello, Karen Swope
School of Natural Resources: Faculty Publications
Parasitological analysis of 5 sediment samples from latrine deposits spanning the time period from about 1880 to the 1930s are presented. Two sediment samples are from a latrine used by European-Americans. Three sediment samples are from latrines used by Chinese-Americans on the property of Wong Nim, an important member of the Chinese community. Two of the Chinese latrines were positive for human parasites. The human parasites encountered include the human whipworm (Trichuris trichiura), the giant intestinal roundworm (Ascaris lumbricoides, c.f.), and the Chinese liver fluke (Clonorchis sinensis). Evidence of the liver fluke is especially …

Enterobius Vermicularis Ancient Dna In Pre-Columbian Human Populations, Alena Mayo Iniguez, Karl J. Reinhard, Luiz Fernando Ferreira, Adauto Araujo, Ana Carolina, Paulo Vincente
Karl Reinhard Publications
In prehistoric populations the paleoparasitological findings show an Enterobius vennicularis homogeneous distribution among North American hunter-gatherers intensified with the advent of agriculture. The same occurred in the transition from nomad hunter-gatherers to sedentary farmers in South America, although E. vermicularis infection encompasses only the ancient Andean peoples. Since molecular techniques are sensitive in detecting ancient DNA (aDNA), in this work we have performed a molecular paleoparasitological study of E. vermicularis. aDNA was recovered from North and South American coprolites (4110 BC-AD 900). Human (cox 2 and HVR) and pinworm (5S rRNA spacer) sequences were determined. The sequence analysis confirmed E. …
The Impact Of A Professional Learning Community On Student Achievement, Brandon S. Carter
The Impact Of A Professional Learning Community On Student Achievement, Brandon S. Carter
Walden Dissertations and Doctoral Studies
Professional learning communities (PLC) have the potential to strengthen students' academic achievement. An academic pyramid of interventions, one aspect of PLCs, may be especially helpful in schools where subgroups of students are underperforming relative to other students on standardized testing. This quantitative, one-group, pretest-posttest study examined the impact of implementing an academic pyramid of interventions as part of a PLC on middle school student academic achievement. The 100 students from grade 7 and 8 who participated in the study were identified by teachers as being at-risk for success on the Criterion Referenced Competency Test (CRCT). The reading and math test …
The Effects Of Prayer And Glossolalia On The Mental Health Status Of Protestants, Recco S. Richardson
The Effects Of Prayer And Glossolalia On The Mental Health Status Of Protestants, Recco S. Richardson
Walden Dissertations and Doctoral Studies
The resurgence of prayer and glossolalia (speaking in tongues) within Protestant denominations in the United States of America has stimulated widespread psychological and theological debate. Previous research has indicated that religiosity has both a negative and positive effect on mental health functioning. However, there remains an important gap in the current literature regarding the relationships between specific religious practices and mental health. Therefore the purpose of the proposed study is to report on the growing number of religious persons who pray/glossolate and the conflicting messages in the literature regarding the relationship between religiosity and mental illness. A total of 10 …
Dialogue Within Professional Learning Communities And Its Impact On The Professional Growth Of Teachers In The Elementary School Setting, Melanie Spradley
Dialogue Within Professional Learning Communities And Its Impact On The Professional Growth Of Teachers In The Elementary School Setting, Melanie Spradley
Walden Dissertations and Doctoral Studies
The implementation of professional learning communities is a professional development practice that uses collaborative interactions within a constructivist framework to increase teacher and student learning. The purpose of this qualitative phenomenological study was to explore the question of how the dialogue of grade level meetings within professional learning communities impacts the professional development of teachers using the constructivist theory of learning as the conceptual framework. The researcher gathered data through hour-long interviews over a 4-week period with 6 learning community participants, one from each of the 6 grade levels at the elementary school research site. A thematic analysis of the …
Parental Payment Abuse Within The Supplemental Security Income Program, Darlean Taylor-King
Parental Payment Abuse Within The Supplemental Security Income Program, Darlean Taylor-King
Walden Dissertations and Doctoral Studies
Management of Social Security Administration (SSA) has been challenged by the phenomena of overpayments with its Supplemental Security Income (SSI) program. Oversight authorities of SSA had expressed concerns about the overpayment abuse caused by parents as representative payees for disabled minor children. It was important to address this problem because the amount of overpayments prior to 1998 had caused integrity issues for management of SSA and increased federal debt from SSI claimants. The purpose of this study was to examine how management of SSA and the SSI program had responded to the concerns of the oversight authorities. Theoretical foundations for …
The Relationship Of Self -Evaluation, Writing Ability, And Attitudes Toward Writing Among Gifted Grade 7 Language Arts Students, Lisa Dement
Walden Dissertations and Doctoral Studies
Previous research has indicated that literary skills performance in reading and writing for middle school students has declined. There remains an important gap in the current literature regarding the decline in literary skills, which is a good predictor of the potential for students to drop out of school. The goal of this study was to determine if the use of self-evaluation influences students' writing ability and their attitudes toward writing. Using a quasi-experimental nonequivalent control group design, and over the course of 10 weeks, the researcher administered a writing pre- and posttest, as well as a pre- and posttest Writing …
Academic Incentives Impact On Increasing Seventh -Graders Physical Activity During Leisure Time, Jeffrey Scott Brinker
Academic Incentives Impact On Increasing Seventh -Graders Physical Activity During Leisure Time, Jeffrey Scott Brinker
Walden Dissertations and Doctoral Studies
Recent research clearly demonstrates that a decrease of physical activity has occurred among young people. Hence, the purpose of this study was to examine the impact of external motivation on physical activity. Drawn from self-determination theory, the specific research question examined if academic incentives effectively motivated 7th grade students to participate in a 3-week fitness program. A quasi-experimental pre-post design examined treatment and control groups drawn from a sample of 24 students from three physical education classes. The treatment group received academic incentives whereas the control group received no external incentives but were asked to complete the same fitness Program. …

Lithuanian Diaspora: An Interview Study On The Preservation Or Loss Of Pre-World War Two Traditional Culture Among Lithuanian Catholic Émigrés In Western Australia And Siberia, In Comparison With Lithuanians In Their Homeland, Milena Vico
Theses
This study is designed to ascertain the cultural changes which have taken place over a period of fifty years within three distinct Lithuanian communities. Of these three, two communities –one in Western Australia and the other in Siberia –were part of the post-World War Two (WWII) diaspora. The third is still living in Lithuania. I set out to determine the extent to which, during the period of fifty years covered by this study, cultural practices, values and beliefs have been maintained and lost by those who participated in the interviews carried out as part of the methodology of this thesis. …
Implementing A Forensic Educational Package For Registered Nurses In Two Emergency Departments In Western Australia, Christine M. Michel
Implementing A Forensic Educational Package For Registered Nurses In Two Emergency Departments In Western Australia, Christine M. Michel
Theses
The results of violence are a major public health problem that infiltrates hospital emergency departments (ED) daily. Often, ED nurses are the first healthcare professionals to see patients, speak with family members, handle personal property and collect laboratory specimens. Such actions can be of extreme importance to the 27 different categories of forensic patients. To adequately address forensic patient issues, ED nurses need exposure to forensic education. The aim of this research was to develop and evaluate the effectiveness of a clinical forensic education package on ED nurses’ perceptions, knowledge and care of forensic patients. To accomplish this aim, this …

Racism And Responsibility, Ladelle Mcwhorter
Racism And Responsibility, Ladelle Mcwhorter
Philosophy Faculty Publications
Forty years after the passage of the Civil Rights Act and the Voting Rights Act and fifty years after the historic Brown v. Board of Education decision, members of racial minority groups are still disproportionately disadvantaged in American society. Despite official civic integration, despite a massive shift in the terms of public discourse, despite a publicly avowed moral and cognitive reorientation on the part of a significant number of whites, neighborhoods and schools are more segregated than ever, whites still control an overwhelming percentage of this country's wealth and hold a virtual monopoly on elite corporate and governmental positions, the …
(Dis)Solving The Chronological Paradox In Customary International Law: A Hartian Approach, David Lefkowitz
(Dis)Solving The Chronological Paradox In Customary International Law: A Hartian Approach, David Lefkowitz
Philosophy Faculty Publications
As traditionally conceived, the creation of a new rule of customary international law requires that states believe the law to already require the conduct specified in the rule. Distinguishing the process whereby a customary rule comes to exist from the process whereby that customary rule becomes law dissolves this chronological paradox. Creation of a customary rule requires only that states come to believe that there exists a normative standard to which they ought to adhere, not that this standard is law. What makes the customary rule law is adherence by officials in the international legal system to a rule of …
On The Foundation Of Rights To Political Self-Determination: Secession, Non-Intervention, And Democratic Governance, David Lefkowitz
On The Foundation Of Rights To Political Self-Determination: Secession, Non-Intervention, And Democratic Governance, David Lefkowitz
Philosophy Faculty Publications
From a justificatory standpoint, perhaps the most basic question with respect to secession is what, if anything, provides the moral foundation for a group’s right to secede. My aim here is to make a start to answering this question. I do so, however, by considering a different, albeit closely related, question, namely what is the nature of the wrong done to members of a qualified group denied secession by the state that currently rules them? A compelling answer to this latter question, I suggest, will contribute significantly to a satisfactory answer of the former one.
