The Foundations Of The American Common Market, Norman R. Williams Nov 2008

The Foundations Of The American Common Market, Norman R. Williams

Notre Dame Law Review

The United States Constitution commits the United States to a common market system, yet, unfortunately, the nature and scope of the American common market have been incompletely — and, at times, inconsistently — described by the U.S. Supreme Court. This Article provides an original, theoretical account of the Court's commitment to national economic union. As I argue, the central constitutional commitment is one of deliberative equality — that is, states and localities may regulate or tax interstate commerce if and only if the government gives equal regard to similarly situated in-state and out-of-state interests burdened by the regulation or tax. …

To Travel Or To Compete? Motivations Of Masters Swimmers, Nancy M. Hritz, William D. Ramos Nov 2008

To Travel Or To Compete? Motivations Of Masters Swimmers, Nancy M. Hritz, William D. Ramos

International Journal of Aquatic Research and Education

The underlying motivations behind participating in sports event such as a swim meet are complex and varied especially for adult participants. These motivations may be related to the thrill of the competition, or the excitement of traveling to a new pool or aquatic facility. Investigation of motivations behind participation can enable aquatic facility managers to create memorable experiences that boost participation and encourage repeat visitors that have social and economic benefits for the aquatic facility and event. We motivations of Masters swimmers using the Participant Motivation Questionnaire (PMQ) modified for swimmers and the Travel Career Ladder (TCL) at the 2006 …

The Fundamental Goal Of Antitrust: Protecting Consumers, Not Increasing Efficiency, John B. Kirkwood, Robert Lande Nov 2008

The Fundamental Goal Of Antitrust: Protecting Consumers, Not Increasing Efficiency, John B. Kirkwood, Robert Lande

Notre Dame Law Review

This article defines the relevant economic concepts, summarizes the legislative histories, analyzes recent case law in more depth than any prior article, and explores the most likely bases for current popular support of the antitrust laws. All these factors indicate that the ultimate goal of antitrust is not to increase the total wealth of society, but to protect consumers from behavior that deprives them of the benefits of competition. When conduct presents a conflict between protecting consumers and improving the efficiency of the economy (e.g., a merger that raises prices but reduces costs), no court in recent years has chosen …

Queer Teens And Legislative Bullies: The Cruel And Invidious Discrimination Behind Heterosexist Statutory Rape Laws, Michael J. Higdon Nov 2008

Queer Teens And Legislative Bullies: The Cruel And Invidious Discrimination Behind Heterosexist Statutory Rape Laws, Michael J. Higdon

Scholarly Works

Most states make an exception to their statutory rape laws for sexual acts involving an adolescent victim, who is below the age of consent, when the defendant is close in age to the victim (i.e., generally no older than three or four years). However, a few states explicitly limit such exceptions (commonly referred to as Romeo and Juliet exceptions) to only those situations involving teens who are of the opposite gender. Thus, adolescents in these states who have sex with someone below the age of consent, and who are also the same gender as the defendant, cannot avail themselves to …

Implicit And Explicit Self-Esteem And Their Correlations With Codependency, Rachel N. Rogers Nov 2008

Implicit And Explicit Self-Esteem And Their Correlations With Codependency, Rachel N. Rogers

Undergraduate Psychology Research Methods Journal

The present study examined the correlations between implicit and explicit self-esteem and codependency. Implicit self-esteem involves automatic, over-learned self-evaluations and explicit self-esteem refers to conscious feelings of one’s self. It was predicted that participants who scored higher on the implicit self-esteem measure would score lower on the codependency scale, regardless of scores on the explicit self-esteem scale. Participants engaged in a timed task involving me/not-me primes and positive/negative words to measure implicit self-esteem. The Rosenberg Self-Esteem Scale and the Spann-Fischer Codependency Scale were used to measure explicit self-esteem and codependency, respectively. Should a strong negative correlation be found between codependency …

Finding A "Disappearing" Nontimber Forest Resource: Using Grounded Visualization To Explore Urbanization Impacts On Sweetgrass Basketmaking In Greater Mt. Pleasant, South Carolina, Patrick T. Hurley, Angela C. Halfacre, Norm S. Levine, Marianne K. Burke Nov 2008

Finding A "Disappearing" Nontimber Forest Resource: Using Grounded Visualization To Explore Urbanization Impacts On Sweetgrass Basketmaking In Greater Mt. Pleasant, South Carolina, Patrick T. Hurley, Angela C. Halfacre, Norm S. Levine, Marianne K. Burke

Environment and Sustainability Faculty Publications

Despite growing interest in urbanization and its social and ecological impacts on formerly rural areas, empirical research remains limited. Extant studies largely focus either on issues of social exclusion and enclosure or ecological change. This article uses the case of sweetgrass basketmaking in Mt. Pleasant, South Carolina, to explore the implications of urbanization, including gentrification, for the distribution and accessibility of sweetgrass, an economically important nontimber forest product (NTFP) for historically African American communities, in this rapidly growing area. We explore the usefulness of grounded visualization for research efforts that are examining the existence of "fringe ecologies" associated with NTFP. …

Family Affairs Newsletter 2008-11-01, Jean Vermette Nov 2008

Family Affairs Newsletter 2008-11-01, Jean Vermette

Family Affairs newsletter (2004-2016)

FAMILY AFFAIRS was a free, twice-a-month, social activities newsletter for the GLBTQI (gay/lesbian/bisexual/trans/queer/intersex) community, sent out around the 1st and 15th of each month. It covered the State of Maine only. The list was begun and maintained for many years by Jean Vermette in Bangor, and later operated by Zack Paakkonen of Portland. Over the years it evolved from a social activities newsletter into a business directory, classified ad service, and community bulletin board.

Sense And Sensibility In Securitization: A Prudent Legal Structure And A Fanciful Critique, Thomas E. Plank Nov 2008

Sense And Sensibility In Securitization: A Prudent Legal Structure And A Fanciful Critique, Thomas E. Plank

Scholarly Works

This article responds to a recent critique that the securitization of receivables is a legally shaky financial product that survives only because it is too big to fail. This critique argues that securitization's success in avoiding the costs that the Bankruptcy Code imposes on secured credit, including a bankruptcy trustee's ability to use the cash collateral from the receivables, is a type of fraud that hinders or delays the creditors of the originators of receivables. The critique, however, fails. The cases cited for the author's fraud analysis do not support its thesis. Further, the critique fails to demonstrate that securitization's …

Fair-Value Accounting Provides Much Needed Transparency In Dislocated Markets, Knowledge@Smu Nov 2008

Fair-Value Accounting Provides Much Needed Transparency In Dislocated Markets, Knowledge@Smu

Knowledge@SMU

In the current global financial turmoil, more transparency is needed, not less, say Singapore Management University professor of accounting Andrew Lee and accounting lecturer Lim Chu Yeong. While some critics argue that fair-value accounting is partly to blame and should be suspended, in a recent commentary Lee and Lim made the case for fair-value accounting as having an important role to play in providing timely and relevant information to investors.

Retail Investors And Structured Products: A Case Of 'Buyer Beware'!, Knowledge@Smu

Knowledge@SMU

Across the globe, buyers of structured products linked to Lehman Brothers have seen their investments wiped out. In Singapore, the MAS (Monetary Authority of Singapore) has appointed an independent committee to oversee the review and resolution of customer complaints. Tan Chong Hui, professor of quantitative finance at Singapore Management University, has this advice especially for retail investors of structured products: caveat emptor or ‘buyer beware’.

Regulating Self-Organizing Nanostructures Via External Mechanism, Jiangyu Li, Q. G. Du, Stephen Ducharme Nov 2008

Regulating Self-Organizing Nanostructures Via External Mechanism, Jiangyu Li, Q. G. Du, Stephen Ducharme

Stephen Ducharme Publications

Self-organizing nanostructures are ubiquitous in both natural and synthetic materials. They are not only appealing scientifically, by revealing the intrinsic atomic and molecular interactions that might be difficult to detect otherwise, but may also hold the key for the development of novel functional structures and devices. For their technological potential to be fully realized, the size, morphology, and distribution of the self-organizing nanostructures must be regulated. In this paper, we investigate the principles under which the self-organizing nanostructures can be regulated via external mechanisms. Using nanomesa and nanowell formation in polyvinylidene fluoride trifluoroethylene copolymer film as an example, we demonstrate …

It has long been known that the larger the dictionary, the longer the words that are contained in it. In an attempt to quantify this observation, I collected data from word lists based on several American and English dictionaries.

Leaping Letters, Susan Thorpe Nov 2008

Leaping Letters, Susan Thorpe

Word Ways

Each of these 2-word phrases contains a letter with flea-like tendencies whose sole aim in life is to leap across to the other word of the phrase! All well and good, but certain rules have to obtain and certain standards uphold in the process. The leap might be from the first word to the second word or from the second word to the first word. Whichever way they leap, the result must be another phrase.

Hewn-Ever, City-Head-You Occasion, A Anil

Word Ways

The cryptic title of this list reads "University Education". It features cognate homophonic puns of many of the academented Departments here at Puniversity. (Puny Verse at Tea?) The commentaries or course descriptions try to unearth some logic in the rubble, to 'defragment' it as it were, and to give clues if you have difficulty with any of them. As an additional clue it's alphabetical by the department's name before the degradation. I was going to make it a quiz but decided it's much too easy for you mob.

What's In? - A Name! - Part Iii, Steve Kahan Nov 2008

What's In? - A Name! - Part Iii, Steve Kahan

Word Ways

In this installment of "What's In? - A Name!", five-letter names have been removed from forty words and the remaining letters have been presented in consolidated form. For example, 'can' would readmit NADIA to reconstruct caNADIAn, a perfectly fine response were proper nouns eligible as answers. (They are not!) To make matters a bit more interesting this time, the genders, while equally represented, have been mixed together, much like the dorms in many modern-day colleges. Your goal is to imbed the invisible names into their compressions in order to identity the original word. Happy hunting!
