The generally accepted interpretation of Justice William O. Douglas's majority opinion in United States v. Ballard, 322 U.S. 78 (1944), casts the case as a ringing defense of religious freedom in the United States; a trial court may not charge a jury with inquiring into the factual truth of a defendant's religious beliefs incident to a prosecution for criminal fraud. This interpretation of Ballard is, at least arguably, unduly generous. By permitting juries to inquire into a religious leader's subjective good faith belief in the tenets of the faith, the Ballard majority provides an insufficient shield against prosecutions based on …

Demographics And Distrust: The Eleventh Circuit And Graduation Prayer In Adler V. Duval County, Paul Horwitz

This Article, a contribution to a symposium on the constitutional jurisprudence of the United States Court of Appeals for the Eleventh Circuit, focuses on the Eleventh Circuit's opinion in Adler v. Duval County. Adler involved a policy that permitted students to vote on whether to deliver opening and/or closing "messages" at high school graduation ceremonies. The Eleventh Circuit, sitting en banc, upheld the policy against an Establishment Clause challenge. After the Supreme Court remanded the case for reconsideration in light of its decision in Santa Fe Independent School District v. Doe, which outlawed a similar policy in the context of …

Ground water of the Echo Hills area in Clark County, Ohio was investigated for common water contaminants such as nitrate and coliform bacteria. Thirty-four water samples were collected from locations including private wells, streams and a spring. Nine of those samples were selected for nitrogen isotope analysis. Three locations were chosen for a tracer test. Additionally, well log data, historical water quality data, and GIS data were obtained from the Clark County Health Department in Springfield, Ohio. Results show that local agriculture likely has the greatest impact on ground water quality in Echo Hills especially the north-eastern portion, with local …

For centuries, repetition in one form or another has been seen as a significant element in the artistic palette. In numerous formats of expression, duplication and looping became a significant tool utilized by artisans in a multitude of creative formats. Yet within the realm of film, the Griffith and Eisenstein models of cinematic editing techniques (as the most popular-- and near-monolithic--narrative aesthetic criteria) effectively disregarded most other approaches, including looping. This dissertation project discusses individual photographs of the Brighton Seminole Tribe of Florida from the early 1900s to the current period, each organized by way of their institutional significance, not their place in chronological history. Following Jean Mohr and John Berger's model in Another Way of Telling, I create a narrative for the pictures with a discussion of historical information, current data from interviews, Tribal members' stories, and my own personal story as it is tethered to the tribe. In this dissertation, I analyze the organizational and political constraints that technical writers encounter when dealing with complex rhetorical situations, particularly within risk-management discourse. I ground my research in case studies of safety briefings that airlines provide to their passengers because these important documents have long been regarded as ineffective, yet they ve gone largely unchanged in the last 20 years. Airlines are required to produce these safety briefings, which must satisfy multiple audiences, such as corporate executives, federal safety inspectors, flight attendants, and passengers. Absorption of a chemical analyte into a polymercoating results in an expansion governed by the concentration and type of analyte that has diffused into the bulk of the coating. When the coating is attached to a microcantilever, this expansion results in bending of the device. Assuming that absorption (i.e., diffusion across the surface barrier into the bulk of the coating) is Fickian, with a rate of absorption that is proportional to the difference between the absorbed concentration and the equilibrium concentration, and the coating is elastic, the bending response of the coated device should exhibit a first-order behavior. The United States faces three enduring terrorism-related threats. First, there is the realistic prospect of additional attacks in the United States including attacks using weapons of mass destruction (“WMD”). Second, in responding to this threat, we may undermine the freedoms that enrich our lives, the tolerance that marks our society, and the democratic values that define our government. It is well-known that people with disabilities face multiple barriers to adequate health care, including lower average incomes, disproportionate poverty, and issues with insurance coverage. This article focuses on a more fundamental barrier-one that has not been discussed in the legal literature-inaccessible medical equipment and its effect on the delivery of women's health care to millions of women with disabilities .

The Mental, Emotional, And Bodily Toughness Inventory (Mebtough) [Survey Instrument], Mick G. Mack, Brian G. Ragan

The MeBTough is a 43-item, self-report measure of mental toughness. This one-dimensional scale assesses the mental, emotional, and physical (bodily) dimensions of toughness based on the writings of Loehr (1994). Respondents are asked to indicate how often they experience each item on a 4-point Likert-type scale, ranging from 1 (Almost Never) to 4 (Almost Always). Nine of the items are designed to be reverse-scored. Responses to the 43 items are then summed to obtain a total score that can range from 43 to 172. Higher MeBTough scores indicate higher levels of mental toughness.
