This article undertakes the first detailed critique of the proposal from Common Good and the Harvard School of Public Health to replace medical malpractice jury trials with adjudication before specialized health courts. Professor Peters concludes that the modest benefits likely to be produced by the current health court proposal are matched by the risks of bias and overreaching that these courts would also present. Missing from the plan is the doctrinal change mostly likely to improve patient safety - hospital enterprise liability. Without enterprise liability, the health court proposal is unlikely to achieve its patient safety goals and, as a …

Consistently high market demand combined with low commercial catches have made Florida pompano, Trachinotus carolinus, one of the highest valued finfish from the Gulf of Mexico. Economic incentive has spurred interest in pompano culture since the 1950s, yet the body of nutritional research on pompano is still sparse. This study was conducted to measure the apparent digestibility of nutrients among a selection of common feed ingredients, and determine the optimum dietary protein level for juvenile Florida pompano at a fixed protein-to-energy ratio, in order to formulate nutritionally complete, cost-effective diets. The Assembly of States Parties to the International Criminal Court will soon have its first opportunity to revise the Rome Statute and activate the latent crime of aggression, which awaits a definition of its elements and conditions for the exercise of jurisdiction. The working group charged with drafting a provision is scheduled to complete its task by 2008 or 2009, one year before the International Criminal Court’s first review conference.

Nothing excites civilian lawyers and judges more than commissions for codification. Codification is more than an academic enterprise. Codification projects directly cut across the interface between law and life. ALACDE intends to harness this Latin American interest in codification to bring the economic approach to Latin America. A new-generation law and economics civil and commercial code will be a conscious project to restate Roman law's usefulness for coping with today's problems. Through law and economics, Roman law will renew itself. As a paradigmatic private-law system, Roman law is eminently amenable to a state-of-the-art fusion with law and economics. Sensitivity to …

This article argues that in order to emancipate Indian-Muslim women from an outdated family legal code, their position at the intersection of gender and a minority religion must be taken seriously. Proposals for reform that have been suggested by Western liberal, secular feminists that ignore the importance of women's religious affiliation fail to do this. Moreover, by making assumptions about the strength of secularism in India, the willingness of the state to enact legal reforms driven by gender concerns, and by failing to acknowledge the limits of formal rights alone in changing norms, these scholars do not account for the …

In this study I examine three of Faulkner’s novels that concern his fictional Yoknapatawpha County: As I Lay Dying (1930), Absalom, Absalom! (1936), and Go Down, Moses (1942). These novels, I argue, indicate a development in Faulkner’s relationship to the formalist hierarchy of art over real life. To show this development I will investigate the topic of language as an inadequate medium in characters’ relationships to nature and the past. In As I Lay Dying Faulkner presents words as something unable to achieve the transcendence his characters desire. In Absalom, Absalom! and Go Down, Moses the author extends this suspicion …

Moore Abstract “William Apess: Autobiography and the Conversion of Subjectivity” In 1829, Apess published his first book A Son of the Forest, a conversion narrative documenting his life. This thesis is concerned with the manners in which Irishness has become highly desirable and commodified, and the manifestations that commodification has taken in Irish film. In recognition that the Irish American diaspora holds a special regard for Irishness, I will explore reasons for the allure of Irishness for Irish Americans and how that allure contributes to commodification. Chiefly among these reasons are Irishness’ desirability as a white ethnicity and its alignment with a family values based morality. Irishness also has strong appeal for the Irish diaspora with its ties to a land that offers a welcoming “authentic” homeland and …

This thesis addresses the Heideggerean notion of dwelling in Anne Brontë’s The Tenant of Wildfell Hall by analyzing the different ways the novel’s protagonist, Helen Huntingdon, adapts to the harsh, sublime landscape of Wildfell Hall and the subsequent relationship that develops between her and Gilbert Markham. Escaping her violent and abusive husband, Helen flees to Wildfell Hall and uses her skills as an artist to support both herself and her son. In the first chapter, late-eighteenth and early-nineteenth century aesthetics of the sublime and the picturesque are evaluated in relation to the aesthetic spaces of the novel. Helen enjoys an …

Simon Stow warns that the influence of political readings of literary texts could be harmful to political discourse. In particular, he cautions against the growing popularity of political “readings” over political “arguments.” Compared with traditional arguments, readings are, Stow argues, poorly suited for liberal political discourse. To demonstrate this point, Stow challenges the political character of Richard Rorty’s reading of Pale Fire. In this essay, I dispute Stow's criticism of Rorty. My basic argument is that literary criticism (or "readings") can be politically significant and that Rorty's acknowledgement of this fact ties him to rather than separates him from, both …

In The Lord of the Rings, Tolkien recreates the “pregnant moment of poise” that inspired him in his study of Beowulf. Tolkien believed that this moment was a brief period of “fusion” which occurred in the Dark Ages as paganism was in decline and Christianity on the rise, when the dueling notions of Doom and salvation briefly coexisted in the hearts and minds of the Anglo-Saxon people. Today, as a sexual harassment plaintiff who failed to report harassment before bringing suit, you likely will fare better under the law if you submitted to your harasser and engaged in relations with him, than you would if you had passively resisted until you were driven out of your employment. This Article examines the law’s illogical preference for plaintiffs who acquiesced to the propositions of their supervisors over those who resisted harassment but nonetheless failed to report it. It explores the roots of such a preference in society, as well as its consequences. Ultimately, this Article asks critical questions that …

Harassment victims who suffer a "tangible employment action," which the Supreme Court defines as a "significant change in employment status such as hiring, firing, failure to promote, reassignment, or a decision causing a significant change in benefits," enjoy unfettered recourse when they sue their employers. However, victims who do not endure what a court will deem a "tangible employment action" will have their prima facie case of harassment then rendered vulnerable to the interposition of an affirmative defense by a defendant-employer, who will escape liability if it can show "(a) that the employer exercised reasonable care to prevent and correct …

A Study Of Somatic Cell Counts In The Milk Of Holstein-Friesian Cows Managed In Mediterranean Climatic Conditions, Atakan Koç
Turkish Journal of Veterinary & Animal Sciences
Somatic cell counts (SCC) in the milk of Holstein-Friesian (HF) cows were determined by direct microscopic SCC technique. For a two-year period, milk samples were collected monthly from buckets during the morning and evening milkings at 4 different dairy farms. In total, 1,464 SCC readings from 88 HF cows were analyzed by using repeated measures. Herd, lactation month, parity, milking time, and herd interaction effects on SCC were statistically significant (P < 0.05). The average SCC in milk per herd was between 296,483 and 688,811 cells/ml. SCC in milk increased as parity increased. The average SCC in milk from evening milking was about 83,165 cells/ml higher than from morning milking. Improving milking management, reducing stress, providing extra care during the first month of lactation, and milking at a uniform interval will help to decrease SCC in milk and the prevalence of mastitis.

This study was carried out to determine the effects of mineral imbalances and negative energy balance on reproductive functions during the early and later stages of the postpartum period in dairy cows. The study included 100 randomly selected multiparous Holstein cows aged between 2 and 8 years (mean weight: 650 kg). The animals´ diets were not manipulated and they were fed the rations used by the study farm. Blood samples were taken on postpartum days 0, 20, 24, 30, 31, 38, 45, 60, and 90. Clostridium Perfringens Type D Enterotoxaemia In The Chinkara Deer (Gazella Bennettii), Ahrar Khan, Imtiaz Ali, Iftikhar Hussain, Nazir Ahmad

During an enterotoxaemia outbreak, 9 out of 11 (82%) Chinkara deer (Gazella bennettii) died; 5 animals died of peracute disease, whereas acute death was observed in 4 animals. The case fatality rate was 100%. Clinical signs, including high temperature, depression, anorexia, abdominal pain, greenish watery diarrhoea, and respiratory distress, were recorded in the affected deer. Post-mortem examinations of the affected animals revealed muscular and serosal haemorrhages, hydroperitoneum, hydrothorax, and hydropericardium. Severe haemorrhages were also observed in the small intestine, colon, and kidneys. Histopathologically, haemorrhagic enterocolitis, pulmonary oedema, accumulation of proteinaceous fluid in alveoli, perivascular oedema, and interstitial and intertubular haemorrhages …

The newest measures for the control of harmful rodent populations are from the anticoagulant rodenticide group, which are divided into 2 subgroups: first and second generations, and indandione derivatives. Non-target organisms are potentially at risk of direct consumption of baits (primary hazard) and of eating poisoned rodents (secondary hazard). Anticoagulant rodenticides inhibit the enzyme vitamin K-dependent carboxylase and thus impair the reactivation of vitamin K1, indirectly affecting physiological blood coagulation. The diagnosis is made on the basis of clinical signs (massive hemorrhages), laboratory findings, and especially the changes in coagulation markers (APTT, PT, TT, PCT, ACT, FDPs, and PIVKA). The …

Variance components, genetic parameters, and breeding values for birth weight in Brown Swiss cattle reared in Bahri Dağdaş International Agricultural Research Institute were estimated by REML-BLUP procedures using MTDFREML computer programme. Six different animal models were fitted for the trait ranging from a simple to the most comprehensive model. The most detailed model (model 6) provided the best fit to the used dataset. Heritability was higher in the model without maternal effect. Although maternal effect had a significant place for the data, environmental effect due to dam was not important. The relationship between the prepubertal body weight, testicular size, testosterone concentration, and postpubertal reproductive function was investigated in Kıvırcık ram lambs. The body weight, testicular size, and testosterone concentration were measured every 20 days between 60 and 420 days of age. Semen was collected from the ram lambs at 7, 8, 9, 10, 11, 12, 13 and 14 months of age. Data obtained were analyzed by best subsets regression model. Coxiella burnetii causes Q fever (Coxiellosis) in humans and animals worldwide. The present study was carried out to determine the seroprevalence of Q fever among stray cats in 3 providences (Ankara, Niğde, and Kayseri) in Central Anatolia, Turkey. A total of 143 sera from stray cats were examined for the presence of IgG against C. burnetii phase II antigen by indirect fluorescent antibody test (IFAT). A reflection hologram for visual indication of environmental humidity has been studied. The hologram is recorded in a self-developing photopolymer and changes color when exposed to a change in humidity and is fully reversible. The range of color change, reversibility, and the response time of the hologram have been studied in a controlled humidity environment. Fully reversible holograms with response times from few seconds to tens of minutes have been designed. Extremely sensitive bright visual humidity indicators, capable of dramatic color change within a few seconds of breathing on them are demonstrated
