Demarcating The Right To Gather News: A Sequential Interpretation Of The First Amendment, Erik Ugland Jan 2008

Demarcating The Right To Gather News: A Sequential Interpretation Of The First Amendment, Erik Ugland

College of Communication Faculty Research and Publications

The recent spate of cases in which reporters have been subpoenaed, fined, jailed, or otherwise disciplined has laid bare the divisions among the courts over the existence and scope of the “reporter’s privilege.” The cases have also exposed the doctrinal, historical, and theoretical infirmities of the broader law of newsgathering, which encompasses not only source relationships, but also rights of access to places and records, protections against civil and criminal liability for torts and crimes committed in the pursuit of news, and protections against government searches of newsrooms and phone records, among other things. Resolving these conflicts has grown more …

Splitting Np-Complete Sets, Christian Glaßer, A. Pavan, Alan L. Selman, Liyu Zhang Jan 2008

Splitting Np-Complete Sets, Christian Glaßer, A. Pavan, Alan L. Selman, Liyu Zhang

Computer Science Faculty Publications

We show that a set is m-autoreducible if and only if it is m-mitotic. This solves a long-standing open question in a surprising way. As a consequence of this unconditional result and recent work by Glaßer et al., complete sets for all of the following complexity classes are m-mitotic: NP, coNP, ⊕P, PSPACE, and NEXP, as well as all levels of PH, MODPH, and the Boolean hierarchy over NP. In the cases of NP, PSPACE, NEXP, and PH, this at once answers several well-studied open questions. These results tell us that complete sets share a redundancy that was not known …

Automated Journeys, Arianna Bassoli, Johanna Brewer, Alex Taylor Jan 2008

Automated Journeys, Arianna Bassoli, Johanna Brewer, Alex Taylor

Computer Science: Faculty Publications

Computing technology now pervades those moments of our day when we move through our cities. Mobile phones, music players, vending machines, contact-less payment systems and RFID-enabled turnstiles are de rigueur on our daily journeys. This workshop aims to examine these augmented journeys, to reflect on the public, semi-public and private technologies available to us in them, and to speculate on what innovations might be to come. Taking as our starting point cities such as Seoul, we aim to take seriously the developments in mobile technology as well as the advancements in autonomous machinery and how these mesh with our urban …

In Defense Of Property , Kristen A. Carpenter, Sonia K. Katyal, Angela R. Riley Jan 2008

In Defense Of Property , Kristen A. Carpenter, Sonia K. Katyal, Angela R. Riley

Faculty Scholarship

This Article responds to an emerging view, in scholarship and popular society, that it is normatively undesirable to employ property law as a means of protecting indigenous cultural heritage. Recent critiques suggest that propertizing culture impedes the free flow of ideas, speech, and perhaps culture itself. In our view, these critiques arise largely because commentators associate "property" with a narrow model of individual ownership that reflects neither the substance of indigenous cultural property claims nor major theoretical developments in the broader field of property law. Thus, departing from the individual rights paradigm, our Article situates indigenous cultural property claims, particularly …

Communication And The Knowable Community, Bonnie Brennen Jan 2008

Communication And The Knowable Community, Bonnie Brennen

College of Communication Faculty Research and Publications

This essay draws on Raymond Williams's concept of a knowable community in an effort to understand the myriad of connections that exist between individuals and society. Williams, who sees communication and community as synonymous, suggests that a knowable community may ultimately emerge through the process of communication and that in the discovery of connections between individuals and society, an understanding of historically specific patterns may be shown. This essay also discusses an oral history project with journalists who worked for Gannett in the 1960s as an example of an emerging knowable community that questioned traditional notions of community and challenged …
