This short article is a follow-up to a piece I wrote two years ago on Hamdan v. Rumsfeld, SSRN No. 913822. While applauding the result in Hamdan, I critiqued the Supreme Court for missing a “teachable moment” and obscuring the great issues at stake in prolixity and mind-numbing technical detail.

In this article, I applaud the Boumediene v. Bush Court not only for its result—that the Constitution’s Suspension Clause can require habeas corpus for aliens held abroad under certain circumstances—but for its reasoning and style as well. Background: Sulphur mustard gas, 2, 2′-dichlorodiethyl sulphide (HD), is a chemical warfare agent. Both mustard gas and its monofunctional analogue, 2-chloroethyl ethyl sulphide (CEES), are alkylating agents that react with and diminish cellular thiols and are highly toxic. Previously, we reported that lipopolysaccharide (LPS) significantly enhances the cytotoxicity of CEES in murine RAW 264.7 macrophages and that CEES transiently inhibits nitric oxide (NO) production via suppression of inducible NO synthase (iNOS) protein expression. NO generation is an important factor in wound healing. In this paper, we explored the hypotheses that LPS increases CEES toxicity by increasing oxidative stress and that …

With networks increasing in physical size, bandwidth, traffic volume, and malicious activity, network analysts are experiencing greater difficulty in developing network situational awareness. Traditionally, network analysts have used Intrusion Detection Systems to gain awareness but this method is outdated when analysts are unable to process the alerts at the rate they are being generated. Analysts are unwittingly placing the computer assets they are charged to protect at risk when they are unable to detect these network attacks. An Analysis Of Botnet Vulnerabilities, Sean W. Hudson

Botnets are a significant threat to computer networks and data stored on networked computers. The ability to inhibit communication between servers controlling the botnet and individual hosts would be an effective countermeasure. The objective of this research was to find vulnerabilities in Unreal IRCd that could be used to shut down the server. Analysis revealed that Unreal IRCd is a very mature and stable IRC server and no significant vulnerabilities were found. While this research does not eliminate the possibility that a critical vulnerability is present in the Unreal IRCd software, none were identified during this effort.

Interpretations of Japan’s involvement in the Pacific War and its war crimes have changed over time, and corresponding changes in social and political contexts both within and outside Japan have influenced these evolving interpretations. Today the people of Japan are far from a consensus over the meaning of the Asia-Pacific War (1931-45), and disputes relating to such topics as the Nanjing Massacre, Japan’s colonial occupation of Korea and Taiwan, and the sexual enslavement of the so-called Comfort Women continue to haunt the national memory. This research uses decision analysis to develop a structured, repeatable and most importantly defensible decision model for the evaluation of proposed IED defeat solutions submitted to the Joint IED Defeat Organization (JIEDDO). Additive value models using Value-Focused Thinking (VFT) and the Analytic Hierarchy Process (AHP) are examined as possible methodologies. VFT is determined to be the "best fit" for JIEDDO's decision situation in which proposals are submitted continuously and must be scored independently of previous proposals. VFT is first used to determine desirable qualities in IED defeat options, and then to generate a hierarchal value model to evaluate these qualities …

Key Insights from this seminar were (1) Without significant participation by the Reserve Components (RC), effective current and near future military operations and domestic emergency response would not be possible. Law And Politics As Play, Lief H. Carter

Liberal theory fails to cope effectively with the common human tendency, under certain conditions, to brutalize other humans. Liberal theory does not adequately accommodate the reality that humans contest concepts of rights, justice, and truth. The necessarily contextual, contested, and contingent character of substantive liberal principles necessarily prevents them, qua principles, from effectively inhibiting human brutality. Liberal theory also does not take adequate account of the passionate and non-rational character of the human animal. Giambattista Vico's remarkably prescient and comprehensive eighteenth century vision of the human condition anticipates these two barriers to achieving liberalism's pacific political and social vision. The aftermath of Kelo gives rise to urgent land use issues, both theoretical and historical. On the former, I argue that the analysts should be aware of the close and positive connection between restrictive land use policies on the one hand and a willingness to condemn parcels for private development on the other. The inability to overcome local opposition with private development forces developers to get in essence, pre-acquisition approval through public condemnation. HIV/AIDS, crime, security and governance are linked issues in the region of Southern Africa. According to the Joint United Nations Programme on HIV/AIDS (UNAIDS) and World Health Organisation (WHO), sub-Saharan Africa is home to approximately 10 percent of the world’s population and 2/3 of this population is infected with HIV. Within sub- Saharan Africa, Southern Africa remains the world’s most affected region: globally, 32% of people with HIV live in this sub-region and 34% of AIDS deaths occur within this region as well. Regulating international agricultural trade is the most difficult challenge the World Trade Organisation (WTO) faces. Despite the breakthrough in the WTOAgreement on Agriculture following years ofpiecemeal regulation under the General Agreement on Tariffs and Trade (GATT), agriculture remains problematic. Why is that? The traditional response to this question is that the existing rules in the WTO Agreement on Agriculture are inappropriate because they do not reduce restrictive barriers to trade; do not address developing countries' concerns sufficiently; or do not accommodate non-trade issues like human rights and the environment.
