The Buck Stops Where? A Critique Of Vicarious Liability In The Medical Malpractice Context, C.J. Colwell
The Buck Stops Where? A Critique Of Vicarious Liability In The Medical Malpractice Context, C.J. Colwell
Dalhousie Journal of Legal Studies
In Canadian tort law, liability is almost always linked to some notion of fault, save for a few well-established exceptions. By far the most common exception is vicarious liability, i.e. the liability of employers for the torts of their employees. In its 1999 ruling in Bazley v. Curry, the Supreme Court of Canada articulated exactly why this kind of faultless liability exists in Canada, and how it is justified. In medical malpractice cases involving teaching hospitals, there are usually three possible defendants to a negligence action: the attending physician, the treating resident, and the hospital. Due to the legal nature …

Route 66 In New Mexico: A Select Guide To Museum, Archival, And Library Resources, Russ Davidson
CSWR Reference Tools
A growing interest, on both popular and scholarly levels, in the study and preservation of historic roads in the United States has highlighted the need for supporting documentation and likewise spurred the production of related bibliographic tools and guides. Building on earlier contributions, this listing of primary resources documenting the history and development of Route 66 in New Mexico reflects the expanding interest in the subject and--it is hoped--offers historians and others a wider range of materials on which to base their research and writing.

Theses : Honours
This paper explores the influence of John Cage (1912-1992) on contemporary experimental music focusing on the indeterminate work The Importance of Being Earmarked (2008). Firstly through an investigation of selected works from Cage (written between the 1930s- 1960's) and the concepts that form a Cagean trajectory, and secondly by showing how a contemporary composer has adopted this trajectory in the composition of a new work that combines sound-installation, theatre, and Max/MSP programming.
Protean Careers And The Performing Arts: Antecedents For Intrinsic Motivation, Sophie Fernandes
Protean Careers And The Performing Arts: Antecedents For Intrinsic Motivation, Sophie Fernandes
Theses : Honours
The professional performing arts industry is typified by a high number of personnel employed on either a short-term or casual basis. Work is often unstable and wages are generally below the average, however, artists receive intrinsic rewards from their work, and this is why they choose to be employed in this field. Artists tend to manage their own careers, and have what is called a "protean career", whereby employment choices are made based on previous experiences and the resulting work is meaningful to the employee. The present study set out to explore three independent variables, namely organisational commitment, organisational identification …

Contemporary Aesthetics (Journal Archive)
It is through the ideal of a sensus communis that Aesthetics has offered to Philosophy an articulation to Politics. I will question the idea of an "aesthetic sociability" through the concept of "régime esthétique" (aesthetic regime) proposed by Jacques Rancière to define the 18th century fundamental change carried by Aesthetics in order to think art and sensibility together.
One question will be the central core of my essay, which is how to understand nowadays Deleuze’s assertion that art should be "contributing to the invention of a people."
Consensus and dissensus are two reefs between which art and philosophy navigate at …

From Human To Robot And Back Again: The Process Of Rehearsing And Performing Jacie Tripplethree In Alan Ayckbourn's "Comic Potential"., Denice R. Burbach
Graduate Theses, Dissertations, and Problem Reports (ETD)
The control of physical and vocal characteristics of Jacie Tripplethree in Alan Ayckbourn’s Comic Potential seemed imperative to the demands and success of the role. While important, the more difficult the task is, the simpler the approach through the process of research, rehearsal, and performance should be. E.C. Zeeman said, “Technical skill is mastery of complexity while creativity is mastery of simplicity.” In the midst of this modern farce I have found the simplicity of mere presence on stage and explored some of the history of comedy, women in comedy, and the invention of the android…and experienced the excitement and …

Performing Photographs: Memory, History, And Display, Melanie A. Kitchens
LSU Doctoral Dissertations
In my study, I place concepts and practices of photography and performance in dialogue to enable our understanding of how photographs perform and how performance contains or can contain elements we attribute to photographs. The connection between photography and performance that most intrigues me is how they make memories and when collected or restored in some socially shared way make histories too. My specific aim is to understand how photographs and performance might benefit from each other in how they make and transmit memories and histories. To activate the study, I select and focus on five specific events in which …
The Gallant Six Hundred: Performing The Light Brigade Into A Heroic Icon, Elizabeth Carrick Cawns
The Gallant Six Hundred: Performing The Light Brigade Into A Heroic Icon, Elizabeth Carrick Cawns
LSU Doctoral Dissertations
History is not so much what actually happened as how we have received and disseminated what happened. This reception and dissemination take place through a variety of media, many of which are not the purview of the traditional historian. It is in the trifles of daily life that we find the patterns of cultural norms – the ethos of the society that is as unnoticed by that society as the air it breathes. Society makes choices that affect the future based on what has been disseminated, rather than on the original event. This is especially true of such military disasters …
From The Mountains To The Podium: The Rhetoric Of Fidel Castro, Brent C. Kice
From The Mountains To The Podium: The Rhetoric Of Fidel Castro, Brent C. Kice
LSU Doctoral Dissertations
This dissertation examines the rhetoric utilized by Fidel Castro that Castro used in order to maintain his tenure as the sole leader of Cuba for almost 50 years. Castro employs identification through division with an enemy, and he is able to perpetuate this division through an ongoing, dynamically perceived narrative. This narrative takes shape in the form of “the revolution,” a rhetorical construction designed to create a collective Cuban identity, which, in turn, is furthered through ideology by Castro’s elimination of competing points of views. Castro’s unique role as narrator has allowed him to adapt to events and maintain this …
Processes And/Of Performance: Difference, Memory, And Experimentation, Benjamin Daniel Powell
Processes And/Of Performance: Difference, Memory, And Experimentation, Benjamin Daniel Powell
LSU Doctoral Dissertations
This study enacts performance analyses by combining experimental and avant-garde performance practices of artists or art movements such as John Cage, Jerzy Grotowski, Dadaism, and Eugenio Barba with the differential philosophies of Jacques Derrida and Gilles Deleuze. By focusing on the ways that performance practice informs understandings of “the ghost” and différance in Derrida’s theories, and processes of production and experimentation in Deleuze’s, this study examines performance as a process of negotiating practice and theory that continues to produce rather than disappear. To reinforce the productive capacity of performance, this study looks at three different sites and the processes at …
Dimensions Of Mentoring Relationships In The Workplace: A Holistic Perspective, Miriam Grace-Rowland
Dimensions Of Mentoring Relationships In The Workplace: A Holistic Perspective, Miriam Grace-Rowland
Antioch University Dissertations & Theses
This was an exploratory study to understand the lived experience of those involved in mentoring relationships within a formal mentoring program in a corporate context. The researcher looked for rich detail about the nature of the relationship from the perspective of the mentor and mentee. To achieve a holistic perspective, the experience of organizational managers was deliberately included in the research. Exploration of this triadic relationship of mentor, mentee, and organizational manager has been neglected in the empirical literature. An exploration of where meaning intersected and diverged among the triad relationship members gave depth to the dimensional frame. Findings suggested …

Dialogue As Performance. Performance As Dialogue, Laura Lynn
Antioch University Dissertations & Theses
This dissertation is an arts-based qualitative study in Leadership and Change that describes the qualities of dialogue revealed through the felt experience of Native and non-Native American music composers engaged in a dialogue through music composition. The fifteen co-collaborators who participated in the study range in age from three-years-old to elders. The study is theoretically embedded within Performance Studies, Dr. Carolyn Kenny’s music therapy model Field of Play, and aesthetic philosophy. Methodologically, this work is expressed through performance ethnography and autoethnography and privileges textual and non-textual modes of account including photographs, video excerpts, poetry, and music manuscript. The text is …

Cultural Advantages In China: Tale Of Six Cities, Florentin Smarandache, Fu Yuhua, Victor Christianto
Branch Mathematics and Statistics Faculty and Staff Publications
Nowadays, plenty of factories from Europe and other developed countries have been relocated to this country, considering its tremendous economic scale and rapid growth rate during the past three decades. But most of what happens inside the China nowadays is deeply hidden from the outside world (“the foreigners” as China people would call). This fact is partly because most reports on China were written by the so‐called fly‐high experts who are busy completing their reports despite a busy schedule. Very few books or reports were written by people inside, or at least “foreigners” who spent a few years in China. …
