Jon M. Garon, Reintermediation, 2 Int. J. of Private Law 227 (2009).
The digital revolution has interrupted traditional supply chains and wholesaler relationships with manufacturers and retailers, companies are developing new methodologies to create supplier loyalty critical to control of market share. This article documents the leading strategies being utilised by companies to reassert their relevance in the value proposition for their clients and the consequences of these new business models on intellectual property law, privacy rules and influences on judicial contract interpretation. In Philip Evans and Thomas Wurster's bestselling book, Blown to Bits (Harvard Business Press, 1999), the …

Pipe Dream: Eugene O'Neill's Rhetoric Of Tragedy, Ryan Francis Murphy
Pipe Dream: Eugene O'Neill's Rhetoric Of Tragedy, Ryan Francis Murphy
Theses Digitization Project
This thesis applies a rhetorical lens to the work of Eugene O'Neill, specifically, those plays written between the years 1939 and 1942-the height of his dramatic genius. This thesis works to reimagine Eugene O'Neill, often looked upon as "lacking rhetorical exuberance," as a distinctive and successful rhetor, in addition to installing the "pipe dream" as his foremost rhetorical device.

Selected Works Temporary Series
Designed a gig poster for the September 25 Beck show at the Abraham Chavez Theatre. The downloadable file here does not depict well that the poster was screenprinted with metallic gold ink on speckletone brown French paper. A photo of me with the poster appeared in Vanity Fair online in an article about Beck's "secret" show he played after the scheduled Abraham Chavez performance. Divan Japonais: Toulouse-Lautrec And Japanese Art, Eva Maria Raepple
Divan Japonais: Toulouse-Lautrec And Japanese Art, Eva Maria Raepple
Philosophy Scholarship
The French nineteenth century artists Henry Toulouse-Lautrec (1864-1901) is known for his distinctive style and bold character portraits of the theatrical scene of the gaslight era in Paris. The paper examines some of the formative influences of eighteenth century Japanese art on the development of visual characters, with specific focus on a lithograph entitled Divan Japonais. Alluding to the refined representation of Japanese courtesans, subtle nuanced reminiscences to an ideal of elegance create an allusion to highly respected courtesans in the Japanese ‘Green Houses’ of the Asian Yoshiwara the famous “Good Luck Meadow” in Edo, present day Tokyo. I argue …

The Future Of Licensing Music Online: The Role Of Collective Rights Organizations And The Effect Of Territoriality, 25 J. Marshall J. Computer & Info. L. 409 (2008), Neil Conley
UIC John Marshall Journal of Information Technology & Privacy Law
The current licensing regime practiced by collective rights organizations (“CROs”) is preventing rights holders from being able to reap the financial benefits that the Internet and digital transmissions of music can provide. The problem is that CROs license online music on a restrictive, national basis where the online transmission of music is worldwide, unrestricted by national boundaries. This territorially restrictive licensing system began in the nineteenth century and was practical for geographically limited methods by which music was played and transmitted. However, licenses to transmit music online or in the digital environment in general are restricted on a national basis …

This essay reviews David L. Faigman’s Constitutional Fictions: A Unified Theory of Constitutional Facts (Oxford U.P. 2008). Constitutional Fictions is a highly original book that promises to (and should) have an enormous impact on both constitutional law scholarship and practice. The book focuses on the methods, or lack thereof, that the Court employs in receiving evidence and resolving disagreements about questions of fact in constitutional cases. In doing so, the book does the legal profession an invaluable service by identifying and articulating the many frequently unspoken questions that arise in the context of judicial consideration and resolution of legislative facts …
