The Role Of Interagency Collaboration For Substance- Abusing Families Involved With Child Welfare, Beth L. Green, Anna Rockhill, Scott Burns
The Role Of Interagency Collaboration For Substance- Abusing Families Involved With Child Welfare, Beth L. Green, Anna Rockhill, Scott Burns
School of Social Work Faculty Publications and Presentations
Meeting the needs of families involved with the child welfare system because of a substance abuse issue remains a challenge for child welfare practitioners. In order to improve services to these families, there has been an increasing focus on improving collaboration between child welfare, treatment providers, and the court systems. This paper presents the results from qualitative interviews with 104 representatives of these three systems that explore how the collaborative process works to benefit families, as well as the barriers and supports for building successful collaborations. Results indicate that collaboration has at least three major functions: building shared value systems, …
The Market For Legal Innovation: Law And Economics In Europe And The United States, Nuno Garoupa, Thomas S. Ulen
The Market For Legal Innovation: Law And Economics In Europe And The United States, Nuno Garoupa, Thomas S. Ulen
Faculty Scholarship
There have been a large number of innovations in legal scholarship in the U.S. legal academy over the past twenty-five or so years and very few from legal scholars in other parts of the world. For instance, because both of us work in the area of law and economics, we are both acutely aware of the large differences in the receptivity to law and economics as between the United States and Europe. The U.S. legal academy has generously embraced law and economics (and some other legal innovations), while Europe (and the rest of the world) has not. Why has the …
The Scope Of Criminal Law And Criminal Sanctions: An Economic View And Policy Implications, Roger Bowles, Michael Faure, Nuno Garoupa
The Scope Of Criminal Law And Criminal Sanctions: An Economic View And Policy Implications, Roger Bowles, Michael Faure, Nuno Garoupa
Faculty Scholarship
This paper considers why some harm-generating activities are controlled by criminal law and criminal sanctions while others are subject to some other mechanism such as civil law, administrative law, regulation or the tax system. It looks at the question from the perspective of the law and economics approach. We seek to identify the comparative benefits of using the criminal law relative to other enforcement mechanisms and--more broadly--why certain specific behaviours are criminalized. The paper argues that an economic approach emphasizing the relative merits of alternative legal instruments for bringing about harm reduction can provide an explanation for a number of …
Disability And Difference: Adolescents' Interpretations Based On Television Viewing, Paula Anne Schmidt
Disability And Difference: Adolescents' Interpretations Based On Television Viewing, Paula Anne Schmidt
Dissertations and Theses @ UNI
This study was conducted in order to decipher adolescent interpretations of disability that were portrayed on television. Employing qualitative methodology and methods, I conducted focus groups with adolescents during which they viewed television programs containing portrayals of characters with disabilities, or otherwise defining differences. The sixth grade participants freely shared their perspectives of the programs and characters in addition to their thoughts about the nature of difference in general.
Although I originally intended to interpret adolescents' reactions toward characters with disabilities, I found that it was not only characters with disabilities that they viewed in a judgmental manner. As the …
No Place Like Home : Trans-Individuals' Search For Belonging In A Binary Gendered World, Leslie Catherine Kilpatrick
No Place Like Home : Trans-Individuals' Search For Belonging In A Binary Gendered World, Leslie Catherine Kilpatrick
Theses, Dissertations, and Projects
Subjective gender experiences for post-operative trans-individuals were investigated in this study to empirically assess participants' current sense of a match or a lack of a match between their present biological sex and their gender identity. Survey Monkey, an internet site for collection and analysis of responses to survey questions, was used to gather demographic information from 18 respondents and to answer the study questions about post-surgical congruence or incongruence. The responses generated themes of belonging or lack of belonging that lumped together in three categories through which the data was analyzed: A) the individual's relationship to self, B) their relationship …

The Many Masks Of Louisa May Alcott’S Gothic Heroines, Lisa Poggi
The Many Masks Of Louisa May Alcott’S Gothic Heroines, Lisa Poggi
Theses, Dissertations and Culminating Projects
Many of the female characters in the Gothic thrillers of Louisa May Alcott wear masks or are or portrayed as “actresses” who conceal their passion with the appearance of being the typical domestic woman. This idea is most clearly presented in “Behind a Mask” and “Pauline’s Passion and Punishment.” In these thrillers, hidden passion causes problems in each heroine’s life, either because her strong will is an unacceptable female characteristic and she will therefore be shunned in some way by society or by those dear to her; or, expressing her passion will result in disaster of some kind. This representation …
A Traditionalist Case For Gay Marriage, Dale Carpenter
A Traditionalist Case For Gay Marriage, Dale Carpenter
Faculty Journal Articles and Book Chapters
This article presents an argument for same-sex marriage within traditionalism or Burkeanism school of conservatism. The author begins by describing briefly Burkean conservatism. Second, he sketches, based on that description, a case against the recognition of gay marriages. Third, the author outlines an affirmative argument for same-sex marriage. Fourth, he reconsiders, in the light of those arguments, the Burkean case against same-sex marriage. Finally, he discusses what a Burkean conservative ought to say about the pace and the process for achieving same-sex marriage.
The Virtue Of Judicial Statesmanship, Neil S. Siegel
The Virtue Of Judicial Statesmanship, Neil S. Siegel
Faculty Scholarship
Some of America’s most important judges have emphasized or embodied the practice of judicial statesmanship. Yet from the examples they set, it is not particularly clear what judicial statesmanship is or why it matters. In this Article, I conceptualize the elusive phenomenon of judicial statesmanship, and I defend statesmanship as a core, if underappreciated, dimension of judicial role. I argue that judicial statesmanship defines a virtue in the role of a judge. Statesmanship charges judges with approaching cases so as to facilitate the capacity of the legal system to legitimate itself—over the long run and with respect to the nation …
Judging Measures, Mitu Gulati, David F. Levi
Judging Measures, Mitu Gulati, David F. Levi
Faculty Scholarship
The question of how to optimally design judicial institutions is one of central importance to the scholarship focused on courts. Basic questions such as whether there should be mandatory retirement for judges, whether judges should be expected to write their own opinions and whether greater racial or gender diversity on the courts improves decision making are optimal design questions. Given the vast variation in the types of judicial system designs used around the world (and even within the United States), it should be possible to conduct a comparative analysis of the relative efficacy of the different designs. These comparisons cannot …
The Upside Of Overbreadth, Samuel W. Buell
The Upside Of Overbreadth, Samuel W. Buell
Faculty Scholarship
Overbreadth in criminal liability rules, especially in federal law, is abundant and much lamented. Overbreadth is avoidable if it results from normative mistakes about how much conduct to criminalize or from insufficient care to limit open texture in statutes. Social planners cannot so easily avoid overbreadth if they cannot reach behaviors for which criminalization is well justified without also reaching behaviors for which it is not. This mismatch problem is acute if persons engaging in properly criminalized behaviors deliberately alter their conduct to avoid punishment and have resources to devote to avoidance efforts. In response to such efforts, legal actors …

What forms of discrimination are likely to be salient in the coming decade? This review flags a cluster of problems that roughly fall under the rubric of inclusive exclusions or discrimination by inclusion. Much contemporary discrimination theory and empirical work is concerned not simply with mapping the forces that keep people out of the labor market but also with identifying the forces that push them into hierarchical structures within workplaces and labor markets. Underwriting this effort is the notion that, although determining what happens before and during the moment in which a prospective employee is excluded from an employment opportunity …

Nothing But The Truth? Experiments On Adversarial Competition, Expert Testimony, And Decision Making, Cheryl Boudreau, Mathew D. Mccubbins
Nothing But The Truth? Experiments On Adversarial Competition, Expert Testimony, And Decision Making, Cheryl Boudreau, Mathew D. Mccubbins
Faculty Scholarship
Many scholars debate whether a competition between experts in legal, political, or economic contexts elicits truthful information and, in turn, enables people to make informed decisions. Thus, we analyze experimentally the conditions under which competition between experts induces the experts to make truthful statements and enables jurors listening to these statements to improve their decisions. Our results demonstrate that, contrary to game theoretic predictions and contrary to critics of our adversarial legal system, competition induces enough truth telling to allow jurors to improve their decisions. Then, when we impose additional institutions (such as penalties for lying or the threat of …
Corporate Confessions, Brandon L. Garrett
Corporate Confessions, Brandon L. Garrett

In corporate crime investigations, when prosecutors pursue charges against both employees and corporations, confessions raise several novel questions without clear answers in constitutional criminal procedure. First, corporations confess. The firm, a target of a criminal investigation, may itself admit to crimes by employees as part of a settlement agreement with prosecutors. While useful to study in their impact and form, as a constitutional matter such confessions can not be coerced, the Supreme Court has adopted a "collective entity rule" that corporate persons may not invoke Fifth Amendment privilege. Second, before itself confessing, the firm may encourage employees to provide statements to …
Introducing A ‘Different Lives’ Approach To The Valuation Of Health And Well-Being, Matthew D. Adler, Paul Dolan
Introducing A ‘Different Lives’ Approach To The Valuation Of Health And Well-Being, Matthew D. Adler, Paul Dolan
Faculty Scholarship
We introduce a new "different lives" survey format, which asks respondents to rank hypothetical lives described in terms of longevity, health, happiness, income, and other elements of the quality of life. In this short paper, we show that the format is of policy relevance whether a mental state, preference satisfaction or extra-welfarist account of well-being is adopted and discuss some of the advantages the format has over standard formats, such as contingent valuation surveys and QALY-type methods. An exploratory survey indicates that the format is feasible and that health and happiness might be more important than income and life expectancy.

An Examination Of Intercultural Communication Training Programs For U.S. Sojourners In Denominational And Non-Denominational Organizations, Stuart L. Holsing
Dissertations and Theses @ UNI
Whether for business or personal pleasure, service projects or military service, each year millions travel to destinations very different from their own culture. The preparation of the sojourner for effective interaction in their host culture will largely determine success or failure in meeting the mutual objectives all parties involved. My experiences both as a participant and leader of seven different teams of volunteers with Christian agencies led me to investigate what training is given to equip sojourners for the challenges they will face in navigating the unfamiliar territory of cultural differences in the course of performing their mission. How is …

After Innocence: Framing Wrongful Convictions, Susan A. Bandes
Public Law and Legal Theory Working Papers
The debate about the future of the death penalty often focuses on whether its supporters are animated by instrumental or expressive values, and if the latter, what values the penalty does in fact express, where those values originated, and how deeply entrenched they are. In this article I argue that a more explicit recognition of the emotional sources of support for and opposition to the death penalty will have salutary consequences for the clarity of the debate. The focus on emotional variables reveals that the demarcation between instrumental and expressive values is porous; both types of values are informed (or …

L1 Acquisition Of Japanese Particles: A Corpus-Based Study, Mari Fujimoto
Dissertations, Theses, and Capstone Projects
This dissertation is a comprehensive examination of L1 Japanese particle acquisition using two sets of corpora of naturalistic speech, JCHAT, longitudinal speech data of three Japanese children and the mothers (Miyata 2004a, b, and c, and MacWhinney 2000), and CHJ, adult-to-adult telephone conversation. The analysis reveals that despite differences in their language environment, all three children complete particle acquisition around MLU (m) 3.00 regardless of differences in the threshold of particle use. Further, none of the three children mimicked their mother's frequency of particle use, even as they all conform to a particular sequence of particle acquisition. The first set …
The Impact Of A Home-Based Intervention Program On Maternal Reflective Functioning In First-Time Mothers, Maia Rebecca Miller
The Impact Of A Home-Based Intervention Program On Maternal Reflective Functioning In First-Time Mothers, Maia Rebecca Miller
Dissertations, Theses, and Capstone Projects
The present study investigates the impact of "Minding the Baby," a home-based intervention program, on maternal reflective functioning (RF). It was hypothesized that the reflective capacity of mothers who received the MTB intervention would increase over the course of the study, and that this increase would be reflected in the quality of their responses to clinical interviews administered before and after birth. The guiding premise of the intervention was that helping mothers develop a reflective stance would enable them to become more regulating, sensitive, and autonomy-promoting caregivers and thus positively affect a range of developmental outcomes in their infants.

A Study Of The Level Of Interest Among Adolescents In Physical Education, Brooke N. Davitt
Dissertations and Theses @ UNI
There has been an incredible amount attention given to the issue of childhood obesity in America today because the prevalence and incidence rates have grown at alarming rates. When addressing this problem, there are multiple things to consider, (a) diet, (b) exercise, (c) support systems, (d) healthy behavior modification, and ( e) interest toward physical activity. This last item mentioned is of significance for the current study. In this study, adolescent children, ages 11 to 18, were asked to evaluate their interest in physical activity, specifically badminton, volleyball, and HALS Pals, during their physical education class. These children were also …
The Relationship Between Learning Style Preference And Achievement In The Adult Student In A Multicultural College., Matilde E. Roig
The Relationship Between Learning Style Preference And Achievement In The Adult Student In A Multicultural College., Matilde E. Roig
Walden Dissertations and Doctoral Studies
Minority college students have varied learning styles and process information from distinct background and cultural perspectives, which influences their learning. Accordingly, the way faculty approach teaching affects student achievement. Few minorities are in scientific fields, with a shortage of scientists predicted. A problem exists in understanding the relationship between learning style preferences and achievement of minority college students. The purpose of the study was to investigate this relationship in adult minority students in a South Florida college's biology courses. Research questions pertained to relationships between learning style preferences, race, ethnicity and grades. This quantitative study used the online Felder-Soloman Inventory …
How The Merits Matter: Directors' And Officers' Insurance And Securities Settlements, Tom Baker, Sean J. Griffith
How The Merits Matter: Directors' And Officers' Insurance And Securities Settlements, Tom Baker, Sean J. Griffith
Faculty Scholarship
This Article seeks what may be the holy grail of securities law scholarship—the role of the "merits" in securities class actions--by investigating the relationship between settlements and directors' and officers' (D&O) liability insurance. Drawing upon in-depth interviews with plaintiffs' and defense lawyers, D&O insurance claims managers, monitoring counsel, brokers, mediators, and testifying experts, we elucidate the key factors influencing settlement and examine the relationship between these factors and notions of merit in civil litigation. We find that, although securities settlements are influenced by some factors that are arguably merit related, such as the "sex appeal" of a claim's liability elements, …

Religion And Initiation Into Marijuana Use: The Deterring Role Of Religious Friends, Amy Adamczyk, Ian Palmer
Publications and Research
Over the last two decades researchers have begun to look at how personal religious beliefs and behaviors influence substance use, finding that more religious teens are less likely to drink, smoke, and use illegal drugs. This study builds on this previous research, combining it with work on religious contextual effects to develop a theoretical model that explains why friends’ religion would influence teens’ marijuana use, even if teens are not personally religious. Using two waves of data from the National Longitudinal Study of Adolescent Health, this study examines whether individual and friends’ religiosity (e.g., religious participation and importance) or born-again …
