Children's Beliefs And Family Law, Margaret F. Brinig Jan 2008

Children's Beliefs And Family Law, Margaret F. Brinig

Journal Articles

In a recent series of opinions authored by Justice Stevens, the Court has recognized that children may have independent religious rights, and that these may be in conflict with their parents'. The questions for this piece are whether considering children's rights independently is a good thing whether it is warranted by children's actual religious preferences and whether children's religious activities actually do anything measurable for the children.

I do not advocate that the Supreme Court become more involved with family law than it has been since the substantive due process days of Meyer and Pierce. I am also not one …

Jail For Juvenile Child Pornographers?: A Reply To Professor Leary, Stephen F. Smith Jan 2008

Jail For Juvenile Child Pornographers?: A Reply To Professor Leary, Stephen F. Smith

Journal Articles

Even though Professor Leary and I are united in the goal of protecting children against sexual exploitation, we part company on the proper societal response to the problem of self-produced child pornography. In my view, children who produce and distribute pornographic images of themselves ordinarily should not be regarded as proper objects of punishment. In this context, child protective services, backed up if necessary by the threat of criminal prosecution, is a much more appropriate way of reforming minors and protecting them against the serious dangers to which they expose themselves by creating and distributing pornographic images of themselves. A …

The Supreme Court And The Politics Of Death, Stephen F. Smith Jan 2008

The Supreme Court And The Politics Of Death, Stephen F. Smith

Journal Articles

This article explores the evolving role of the U.S. Supreme Court in the politics of death. By constitutionalizing the death penalty in the 1970s, the Supreme Court unintentionally set into motion political forces that have seriously undermined the Court's vision of a death penalty that is fairly administered and imposed only on the worst offenders. With the death penalty established as a highly salient political issue, politicians - legislators, prosecutors, and governors - have strong institutional incentives to make death sentences easier to achieve and carry out. The result of this vicious cycle is not only more executions, but less …

The Impact Of Internet Social Networking Websites On The Gay Community: Behavior And Identity, Michael Cinquanti Jan 2008

The Impact Of Internet Social Networking Websites On The Gay Community: Behavior And Identity, Michael Cinquanti

Theses

The hypothesis of this thesis is that social networking website design can exert a mediating influence upon the culture of a site by supporting certain behaviors more than others; this influence can be analyzed in an active and structured way that takes into account the culture of the community it addresses. Evidence will be offered by case study, demonstration of specific mediations, and analysis. This hypothesis will be tested with specific reference to the gay male community. The scope of this paper will be limited to the analysis of gay-oriented social networking websites as new media, in general and through …

Guest Satisfaction And Guest Loyalty Study For Hotel Industry, Danijel Carev Jan 2008

Guest Satisfaction And Guest Loyalty Study For Hotel Industry, Danijel Carev

Theses

Common perception by practitioners in the hotel industry today that a satisfied guest would become a repeat customer was considered as a major subject of this research. It determined the extent to which satisfaction fostered loyalty. Interviewing guests and demonstrating the expression of visual experience through photography illustrated the guests´ propensity for recommending and returning to the hotel as a repeat customer. Using a provided digital camera, participating guests were asked to photograph whatever caught their eye to illustrate the hotel as being meaningful. In examining factors such as ambience, service, as well as with the guest’s overall satisfaction with …

Off-Label Psychopharmacologic Prescribing For Children: History Supports Close Clinical Monitoring., Julie M Zito, Albert T Derivan, Christopher J Kratochvil, Daniel J Safer, Joerg M Fegert, Laurence L Greenhill

Department of Psychiatry and Human Behavior Faculty Papers

The review presents pediatric adverse drug events from a historical perspective and focuses on selected safety issues associated with off-label use of medications for the psychiatric treatment of youth. Clinical monitoring procedures for major psychotropic drug classes are reviewed. Prior studies suggest that systematic treatment monitoring is warranted so as to both minimize risk of unexpected adverse events and exposures to ineffective treatments. Clinical trials to establish the efficacy and safety of drugs currently being used off-label in the pediatric population are needed. In the meantime, clinicians should consider the existing evidence-base for these drugs and institute close clinical monitoring.

Lifting The Veil: Women And Islamic Law, Christie S. Warren Jan 2008

Lifting The Veil: Women And Islamic Law, Christie S. Warren

Cardozo Journal of Equal Rights & Social Justice

The article explores whether Islamic law can reconcile its teachings with the rights of women, highlighting the Prophet Muhammad's respectful treatment of women while examining the current disparities in women's rights in various Muslim-majority countries. It argues that while Islamic law has the potential to support gender equality, historical and cultural interpretations have often led to discrimination against women. The article suggests that reform is possible through reinterpretation of Islamic sources and increased female participation in legal scholarship.

Amending The Massachusetts Parental Notification Statute, Yuval Simchi-Levi Jan 2008

Amending The Massachusetts Parental Notification Statute, Yuval Simchi-Levi

Cardozo Journal of Equal Rights & Social Justice

The note argues that the Massachusetts Parental Notification Statute, enacted in 1996, should be amended to explicitly permit public schools to teach about sexual orientation in the context of promoting tolerance without requiring parental notification. The statute's ambiguity regarding whether such discussions fall under "human sexual education or human sexuality issues" has led to hesitation among schools and legal challenges. The author contends that clarifying the statute would align it with Massachusetts' commitment to diversity and tolerance, as reflected in court rulings like Goodridge v. Department of Public Health.

Geo-Ontology Tools – The Missing Link, Jochen Albrecht, Laxmi Ramasubramanian, Brandon Derman

Publications and Research

Numerous authors have presented ontology building tools that have all been developed as part of academic projects and that are usually adaptations of more generic tools for geo-spatial applications. While we trust that these tools do their job for the special purpose they have been built, the GIScience user community is still a long way away from off-the-shelf ontology builders that can be used by GIS project managers. In this article, we present a comparative study of ontology building tools described in some twenty peer-reviewed GIScience journal articles. We analyze them from the perspective of two application domains, crime analysis …

Irritable Bowel Syndrome Patients Exhibit Depressive And Anxiety Scores In The Subsyndromal Range, Sean D. Hood, Jonathon Q. Shufflebotham, Julie Hendry, Dana A. Hince, Ann S. Rich, Chris S J Probert, John Potokar

Medical Papers and Journal Articles

Irritable bowel syndrome (IBS) patients frequently experience affective disorders and psychiatric outpatients frequently meet criteria for IBS. The exact nature of this co-morbidity is not clear. 34 patients with Rome-II diagnosed IBS were recruited from a Gastroenterology clinic. Patients with social anxiety disorder (10 SSRI-remitted and 7 untreated subjects) were used as a psychiatric comparison, 28 normal subjects from our register were included as a fourth group (Volunteers). Depressive and anxiety symptoms were measured by the Beck Depression Inventory (BDI) and Spielberger Trait Anxiety Inventory (STAI), respectively. Personality traits were measured with the Swedish universities Scales of Personality (SSP). IBS …

Love-Variant: The Wakin-Vo I. D. R. Model Of Limerence, Albert H. Wakin, Duyen B. Vo Jan 2008

Love-Variant: The Wakin-Vo I. D. R. Model Of Limerence, Albert H. Wakin, Duyen B. Vo

Psychology Faculty Publications

The purpose of the current paper is to 1) propose the Wakin-Vo I.D.R model of limerence and 2) establish grounds for the scientific query of limerence. Limerence is an involuntary interpersonal state that involves intrusive, obsessive, and compulsive thoughts, feelings, and behaviors that are contingent on perceived emotional reciprocation from the object of interest. The model that the authors propose holds that although limerence resembles normative love, it is a state that is necessarily negative, problematic, and impairing, with clinical implications. The model frames limerence as consisting of three functional components: initiating force, driving forces, and resultant forces. Parallels between …

Towards A Model Of Critical Ethics To Inform The Research Process In Postgraduate Research, Aidan Kenny

Level 3

he ethics narrative has become embedded in the contemporary research process, as evident in the emergence of Ethical Committees in faculty and both public and private organisations. Ethics have been codified, made visible and accessible as text artefacts in the forms of (both voluntary and regulatory) codes, statements, conventions, guidelines, principles, procedures, practices. In this short paper I explore this codification of ethics from the period post WWII, detailing some of the milestone text artefacts

International League Tables And Rankings In Higher Education: An Appraisal, Kathleen Lynch Jan 2008

International League Tables And Rankings In Higher Education: An Appraisal, Kathleen Lynch

Level 3

Universities have marketed themselves in the public sphere and justified public funding for their activities on the grounds that they serve the public good. They have traded on their Enlightenment inheritance that they are the guardians and creators of knowledge produced for the greater good of humanity in its entirety. They are seen and claim to be seen as the watchdogs for the free interchange of ideas in a democratic society; they claim to work to protect freedom of thought, including the freedom to dissent from prevailing orthodoxies.

Beyond The Early Adopters: Examining The Potential For Car-Sharing In Richmond, Virginia, Steven P. Spears Jan 2008

Beyond The Early Adopters: Examining The Potential For Car-Sharing In Richmond, Virginia, Steven P. Spears

Theses and Dissertations

Car-sharing is a membership-based mobility service that offers short-term vehicle rentals. Studies have shown that car-sharing can increase transportation sustainability by encouraging the use of public transit and reducing vehicle miles traveled. This thesis examines the potential for car-sharing in Richmond, Virginia through an attitude-based qualitative pilot study. Using the theory of planned behavior as a framework, urban and suburban residents were asked questions that measured car-sharing intention strength, mode choice habit, and life change effects. The study found that even among those with positive attitudes toward car-sharing, existing habits, lack of adequate commuting alternatives and the needs of non-driving …

Contributors include Meyerhold, Piscator, Brecht, Hallie Flanagan and Arthur Arent, and Augusto Boal. Influential factors include technology, politics, and the influence of theatrical movements. The most popular and most frequent contributors to contemporary newspaper theatre are the legitimate news media and comedy news shows.

Clients, Empathy, And Compassion: Introducing First-Year Students To The "Heart" Of Lawyering, Kristin B. Gerdy Jan 2008

Clients, Empathy, And Compassion: Introducing First-Year Students To The "Heart" Of Lawyering, Kristin B. Gerdy

Nebraska Law Review

In this piece I explore the need for instruction and experience with the "heart" of law practice within the first year of law school. According to the report on legal education prepared by the Carnegie Foundation, the two major limitations in American legal education are 1) a lack of attention to practical education, including a marked lack of understanding client problems, and 2) failure to support development of ethical and social skills. With the release of this report it is likely that law school faculties throughout the United States will be looking at their curricula to see how to better …

Competence Development Of Synchronously Coached Trainee Teachers In Collaborative Learning., Ralph W. Hooreman, Piet A. Kommers, Wim M. Jochems

Australian Journal of Teacher Education

The need to make trainee teachers more prepared to coach collaborative learning effectively is increasing, as collaborative learning is becoming more important. One complication in this training process is that it is hard for the teacher trainer to hear and understand the students’ utterances and those of the coaching trainee teacher. Besides, it is essential that the teacher trainer does not intervene with the students directly. This constraint is a strong plea for facilitating the direct whispered suggestions by an earpiece to the trainee teacher. In this study, first of all an instrument for measuring the quality of the teacher …

Exploring The Sources Of Turkish Pre-Service Chemistry Teachers’ Chemistry Self-Efficacy Beliefs, Esen Uzuntiryaki

Australian Journal of Teacher Education

This study aimed to examine the underlying sources in developing chemistry self-efficacy beliefs of Turkish pre-service chemistry teachers. For this purpose, the College Chemistry Self-efficacy Scale (CCSS) was administered to 20 pre-service chemistry teachers. Then, phenomenological approach was employed and semi-structured interviews were conducted with five pre-service teachers selected based on their scores on the CCSS to identify the underlying sources. The emerging meanings and self-reported sources of participants’ chemistry self-efficacy beliefs were analysed according to Bandura’s sources of self-efficacy. Results indicated that mastery experiences were the major source of self-efficacy beliefs, supporting the tenets of social cognitive theory. Physiological …

Child As Researcher: Within And Beyond The Classroom, Shelley Kinash, Maddison Hoffman Jan 2008

Child As Researcher: Within And Beyond The Classroom, Shelley Kinash, Maddison Hoffman

Australian Journal of Teacher Education

This article was authored by a university educator and a twelve year-old child. The first author was a visiting teacher to a small, rural, state primary school in Queensland Australia. She spent one day per week for nineteen weeks fostering an inquiry-based stance to teaching and learning. The second author is a student within the researched school. Because research generated and co-authored by a child is a largely unprecedented approach to articles published in scholarly journals, the topics of this inquiry are both the within-school research and the complexity of researching and writing about it. The research uses the methodology …

Characteristics Of Preservice Teachers In Multi-Campus Settings: Using Demographics And Epistemological Beliefs To Unpack Stereotypes, Beryl Exley, Sue Walker, Joanne Brownlee

Australian Journal of Teacher Education

The last two decades have seen the massification of preservice teacher education and critiques of its quality in Australia and elsewhere. Part of the strategy of massification has been the establishment of satellite campuses in growth corridors. This paper enters the debate on the quality of preservice candidates. The purpose of this research is two-fold: to note comparisons and parallels in demographics across main and satellite campuses, and to advance research on the epistemological beliefs of first year preservice teachers according to campus location. In doing so, we offer an alternative metric for characterising these two groups of students. The …

Will They Know Enough?: Pre-Service Primary Teachers’ Knowledge Base For Teaching Integrated Social Sciences, Mallihai Tambyah Jan 2008

Will They Know Enough?: Pre-Service Primary Teachers’ Knowledge Base For Teaching Integrated Social Sciences, Mallihai Tambyah

Australian Journal of Teacher Education

A significant issue in primary teacher education is developing a knowledge base which prepares teachers to teach in a range of subject areas. In Australia, the problem in primary social science education is compounded by the integrated nature of the key learning area of Studies of Society and Environment (SOSE). Recent debates on teaching integrated social sciences omit discussions on the knowledge base for teaching. In this paper, a case study approach is used to investigate primary pre-service teachers’ approaches to developing a knowledge base in designing a SOSE curriculum unit. Data from five teacher-educators who taught primary SOSE curriculum …

Previous research has identified maintenance information as one of the primary causal factors of maintenance error. Incorrect maintenance information has also been cited as a contributing factor in a number of recent aircraft mishaps. To date no one has studied the types of errors found in aircraft maintenance manuals published by manufacturers. The purpose of this research is to analyze Publication Change Requests (PCRs) to document the most frequently reported types of errors found in aircraft maintenance manual, to identify how errors vary across Air Transport Association (ATA) chapters, and identify the corrective actions required to address the cited problem. …
