The Influence Of Demographic Characteristics, Cognitive And Non-Cognitive Attributes On The Effectiveness Of The Ladders Probation Intervention Program, Terri M. Mathews Jan 2008

The Influence Of Demographic Characteristics, Cognitive And Non-Cognitive Attributes On The Effectiveness Of The Ladders Probation Intervention Program, Terri M. Mathews

Educational Leadership & Workforce Development Theses & Dissertations

Retention is an important measure for institutions of higher education thereby making improved academic success and increased retention of paramount concern to university administrators. This concern has resulted in a body of literature addressing retention and the development of retention programs. Few of these programs however, have been empirically evaluated for their effectiveness and repeatedly, the literature has cited the need for evaluation of retention and probation programs across demographic, cognitive and non-cognitive characteristics. The purpose of this research was to determine whether the LADDERS (Let Academic Difficulty Disappear to Energize and Retain Students) program developed by Old Dominion University …

Gene Therapy Using Tet-Repressor System To Modulate Prostate Tumor Microenvironment, Nazita Yousefieh Jan 2008

Gene Therapy Using Tet-Repressor System To Modulate Prostate Tumor Microenvironment, Nazita Yousefieh

Theses and Dissertations in Biomedical Sciences

Prostate cancer is the most commonly diagnosed malignancy in men in the United States and is projected to be the third most frequent cause of male cancer-related deaths in 2007 after lung and skin cancers. The initial treatment for prostate cancer at early stages is prostatectomy or radiation, which usually is curative. However, approximately 20% of patients are not cured by such treatments and their cancer recurs, sometimes with long latencies. In other patients prostate cancer is diagnosed only after the cancer has metastasized and there are no effective therapies at this stage. Therefore immunotherapy seems to be a promising …

Current research supports the impact of responsive social emotional support and positive teacher-child interactions on both short and long term social and academic outcomes, with specific remediating benefits for children most at risk of school failure. The 101s training and materials evaluated in this study included ten principles/skills to support respectful, responsive interactions hypothesized to support positive prosocial skill responding. Training was provided to 34 teachers with control and experimental groups. Analysis of quantitative pre and post observation data found …

American Sovereigns: The People And America's Constitutional Tradition Before The Civil War, Christian G. Fritz Jan 2008

American Sovereigns: The People And America's Constitutional Tradition Before The Civil War, Christian G. Fritz

Faculty Book Display Case

American Sovereigns: The People and America's Constitutional Tradition Before the Civil War challenges traditional American constitutional history, theory, and jurisprudence that sees today's constitutionalism as linked by an unbroken chain to the 1787 federal constitutional convention. American Sovereigns examines the idea that after the American Revolution, a collectivity -- the people -- would rule as the sovereign. Heated political controversies within the states and at the national level over what it meant that the people were the sovereign and how that collective sovereign could express its will were not resolved in 1776, in 1787, or prior to the Civil War. …

Narrative Braids: Performing Racial Literacy (Interviewed By Gene Grant), Christine Zuni Cruz, Margaret Montoya

Faculty Scholarship

The performance that is the basis for this joint publication was performed at the Harriet Tubman Theatre at the National Underground Railroad Justice Center in Cincinnati, Ohio. The two of us, Christine Zuni Cruz, a Pueblo woman from the Rio Grande Pueblos of Oke Owingeh and lsleta in New Mexico, and Margaret Montoya, a mestiza/Chicana from northern New Mexico, using both our personal voices and our professional voices as legal scholars, enacted the theatrical performance, a conversation between two women of color from different communities with different identities. This performance experiments with both method and content. The method is a …

Dams, Duties, And Discretion: Bureau Of Reclamation Water Project Operations And The Endangered Species Act, Reed D. Benson Jan 2008

Dams, Duties, And Discretion: Bureau Of Reclamation Water Project Operations And The Endangered Species Act, Reed D. Benson

Faculty Scholarship

Nearly thirty years ago, the U.S. Supreme Court decided whether the survival of a relatively small number of three-inch fish among all the countless millions of species extant would require the permanent halting of a virtually completed dam for which Congress has expended more than $100 million.' Stunningly, the fish won, because the language, history, and structure of the Endangered Species Act showed 'beyond doubt that Congress intended endangered species to be afforded the highest of priorities.' The Court acknowledged that this view of the statute would carry substantial economic costs, but was persuaded that '[t]he plain intent of Congress …

We present direct upper limits on gravitational wave emission from the Crab pulsar using data from the first 9 months of the fifth science run of the Laser Interferometer Gravitational-wave Observatory (LIGO). These limits are based on two searches. In the first we assume that the gravitational wave emission follows the observed radio timing, giving an upper limit on gravitational wave emission that beats indirect limits inferred from the spin-down and braking index of the pulsar and the energetics of the nebula. In the second we allow for a small mismatch between the gravitational and radio signal frequencies and interpret …

Design For Manufacturing For Friction Stir Welding, Harish Bagaitkar Jan 2008

Design For Manufacturing For Friction Stir Welding, Harish Bagaitkar

Masters Theses

"This thesis is divided in two parts. In the first part, technical feasibility of implementing Friction Stir Welding (FSW) for automobile chassis fabrication is discussed using a case study. In the case study, Design for Manufacturing (DFM) principles are applied to manufacture an aluminum automobile chassis. Various DFM issues such as Tool Accessibility Issue, Joint Configuration Issue, and Fixture Support Issue along with relevant guidelines such as component geometry change and component elimination are discussed in the first section. Results show that more than 50% of the chassis joints can be welded using FSW technique. The second part of the …

Application Of Product Family Design For Engineered Systems In Changing Market Space, Mohit Goswami Jan 2008

Application Of Product Family Design For Engineered Systems In Changing Market Space, Mohit Goswami

Masters Theses

"The focus of this paper is on the design of an engineered system for a changing market space. Due to the dynamic nature of the customer requirements, the specification of product offerings in a particular market may change. Manufacturers need to strategically design their product portfolio in such a way that their profitability is maximized, while deploying the right number of platforms necessary for deriving product variants. Depending on the system architecture, subsystems can be classified into one of the two types: scalar subsystems and modular subsystems. Each subsystem is defined by various parameters, performance criteria, and physical compatibility constraints. …

Fabrication Of Soy Oil Epoxy Resin Based Composites, Vinay Prabhakar Pai Jan 2008

Fabrication Of Soy Oil Epoxy Resin Based Composites, Vinay Prabhakar Pai

Masters Theses

"A renewable resource derived epoxidized ester - Epoxidized Allyl Soyate (EAS) yields a versatile epoxy resin system that can be used in pure form combination with bis-phenol epoxy systems to obtain high strength composite materials. EAS containing composites materials exhibit higher toughness and impact resistance than the traditional bis-phenol epoxy composites. These resin systems were found to be compatible with different fibers and screens such as glass fibers, glass mats, carbon fibers and metallic wire screens including those obtained from an automobile tire recycling process. The materials were tested for mechanical properties including tensile and flexure strengths. The highest tensile …

What Hath Faith Wrought? (Book Review), Michael S. Ariens Jan 2008

What Hath Faith Wrought? (Book Review), Michael S. Ariens

Faculty Articles

A number of academic lawyers have explored the relationship of religion (and religious belief) and law. Ostensibly starting with the late Harold Berman’s The Interaction of Law and Religion, the “religious lawyering” movement evaluates the role religious faith has in how lawyers practice law. Extended by subsequent works such as Christian Perspectives on Legal Thought, the discussion has expanded beyond the question whether a religious lawyer is a contradiction.

This essay serves as a commentary on Robert F. Cochran’s Faith and Law: How Religious Traditions from Calvinism to Islam View American Law, a compilation of sixteen essays from legal academics …

Data Security And Tort Liability, Vincent R. Johnson Jan 2008

Data Security And Tort Liability, Vincent R. Johnson

Faculty Articles

Established tort principles carefully applied to the contemporary problems of cybersecurity and identity theft can perform a key role in protecting the economic foundations of modern life. Tort law offers an appropriate legal regime for allocating the risks and spreading the costs of database intrusion-related losses. It can also create incentives, on the part of both database possessors and data subjects, to minimize the harm associated with breaches of database security.

In considering this field of tort law, it is useful to differentiate three questions. The first issue is whether database possessors have a legal duty to safeguard data subjects’ …

Loose Lips Sink Attorney-Client Ships: Unintended Technological Disclosure Of Confidential Communications, Bill Piatt, Paula Dewitte Jan 2008

Loose Lips Sink Attorney-Client Ships: Unintended Technological Disclosure Of Confidential Communications, Bill Piatt, Paula Dewitte

Faculty Articles

Attorneys have an ethical obligation to protect their clients' confidences. Attorneys are required to consider what possibilities exist for unintended disclosure through technology, how they can adapt to these new realities to fulfill obligations of effective representation and maintenance of client trust and confidences, and how attorneys can employ a tripartite approach to information security to better protect client information. Under the general obligation to maintain confidentiality as set out in Rule 1.6 of the Model Rules of Professional Conduct, attorneys are precluded from revealing “information relating to the representation of a client.”

The legal profession has started to educate …
