Equality's Future: An Introduction, Victoria Nourse Jan 2008

Equality's Future: An Introduction, Victoria Nourse

Georgetown Law Faculty Publications and Other Works

We stand at an extraordinary moment: never before have so many powerful men wished to be women. For the first time in history, a massive number of male and female voters--18 million in fact--cast their ballots to nominate a woman, Senator Hillary Clinton, to be President of the United States. Disappointed at Senator Clinton's failure to win the Democratic Party's nomination, many women threatened to bolt the party. Sensing opportunity, the Republican Presidential candidate, Senator John McCain, promptly named as his vice-presidential running mate the first woman ever nominated by the Republican Party to a Presidential ticket. And, not to …

Sight, Sound And Meaning: Teaching Intellectual Property With Audiovisual Materials, Rebecca Tushnet Jan 2008

Sight, Sound And Meaning: Teaching Intellectual Property With Audiovisual Materials, Rebecca Tushnet

Georgetown Law Faculty Publications and Other Works

This article addresses the author's experience using audiovisual materials from the Georgetown Intellectual Property Teaching Resources database. She used audiovisual materials extensively in class to allow students to see the subject matter of the cases rather than just reading verbal descriptions and enable them to apply the principles they read about to new, concrete examples. Many students in IP courses have special interests in music, film, or the visual arts, and the database allows her--and other teachers--to present materials that engage them. She found that students are more willing to speak up in class when they can see or hear …

From Snail Mail To E-Mail: The Traditional Legal Memorandum In The Twenty-First Century, Kristen Konrad Robbins-Tiscione Jan 2008

From Snail Mail To E-Mail: The Traditional Legal Memorandum In The Twenty-First Century, Kristen Konrad Robbins-Tiscione

Georgetown Law Faculty Publications and Other Works

Traditional legal memoranda have been used to teach objective analysis since the inception of legal writing programs in the 1970's. The continued use of these memoranda in the legal writing classroom leads law students to believe that traditional memoranda are still the primary form of communication between attorney and client. A 2006 survey of Georgetown University Law Center graduates, however, suggests that the traditional legal memorandum is all but dead in law practice. Seventy-five percent of the graduates surveyed said they write no more than three traditional memoranda per year. Instead, these graduates are more likely to communicate with clients …

The Choice Between Madison And Fdr, Randy E. Barnett Jan 2008

The Choice Between Madison And Fdr, Randy E. Barnett

Georgetown Law Faculty Publications and Other Works

This exchange is about three clauses that have often been used by the courts since the New Deal to expand federal power: the Commerce Clause, the Necessary and Proper Clause, and the Taxation Clause, from which the spending power has (at least until today) been construed. This Essay addresses the originalist interpretation of the Necessary and Proper Clause.

Guilty Pleas Or Trials: Which Does The Barrister Prefer?, Peter W. Tague Jan 2008

Guilty Pleas Or Trials: Which Does The Barrister Prefer?, Peter W. Tague

Georgetown Law Faculty Publications and Other Works

Barristers in England and attorneys in the United States have been upbraided for pursuing their interests to their clients' detriment in recommending guilty pleas over trials. While this accusation against American attorneys could be true since their incentives are sometimes skewed to favor guilty pleas, it is not accurate with respect to barristers in England. This is because the latter’s selfish incentives--to maximize income and avoid sanction--incline them to prefer trials over guilty pleas. In Melbourne and Sydney, barristers have never been similarly accused. Indeed, the topic has not been studied. Based on interviews with legal professionals in those cities, …

Constitutional Possibilities, Lawrence B. Solum Jan 2008

Constitutional Possibilities, Lawrence B. Solum

Georgetown Law Faculty Publications and Other Works

What are our constitutional possibilities? The importance of this question is illustrated by the striking breadth of recent discussions, ranging from the interpretation of the United States Constitution as a guarantee of fundamental economic equality and proposals to restore the lost constitution to arguments for the virtual abandonment of structural provisions of the Constitution of 1789. Such proposals are conventionally understood as placing constitutional options on the table as real options for constitutional change. Normative constitutional theory asks the question whether these options are desirable--whether political actors (citizens, legislators, executives, or judges) should take action to bring about their plans …

Panel: Restrictions On Freedom Of Association Through Material Support Prohibitions And Visa Denials, David Cole

Georgetown Law Faculty Publications and Other Works

In the 1950s, we were afraid of communism. We were afraid, in particular, of the Soviet Union, the world's second greatest superpower, which was armed with masses of nuclear warheads aimed at all our largest cities. As a result, we fought the Cold War, engaged in espionage, proxy wars, and an arms race. We also took aggressive preventive measures at home. The principal preventive measure of that period was guilt by association. We made it a crime to be a member of the Communist Party, and we created a whole administrative scheme to implement and enforce this notion of guilt …

Less Safe, Less Free: A Progress Report On The War On Terror: Address To The Terrorism & Justice Conference At The University Of Central Missouri, David Cole

Georgetown Law Faculty Publications and Other Works

The Bush Administration since 9-11 has adopted a strategy, which in some sense depends upon the ability to predict with incredible accuracy at what will happen in the future. It was given its name by the U.S. Attorney General during the first Bush Administration, Missouri’s John Ashcroft, who argued that what we need in the wake of 9-11 is a “preventive paradigm.” The argument is understandable: when facing foes who are willing to commit suicide in order to inflict mass casualties on innocent civilians, it is not enough to bring them to justice after the fact. The perpetrators are dead--and …

Government As Educator: A New Understanding Of First Amendment Protection Of Academic Freedom And Governance, Judith C. Areen Jan 2008

Government As Educator: A New Understanding Of First Amendment Protection Of Academic Freedom And Governance, Judith C. Areen

Georgetown Law Faculty Publications and Other Works

In Garcetti v. Ceballos, 547 U.S. 410 (2006), the Supreme Court held that statements made pursuant to the official duties of public employees are not shielded by the First Amendment from employer discipline, despite a warning from three dissenting justices that the holding could "imperil First Amendment protection of academic freedom in public college and universities." This article responds to the invitation in Garcetti to identify constitutional interests that support academic freedom and that are not fully accounted for by public-employee speech jurisprudence. It also argues that, contrary to common understanding, academic freedom is about more than faculty research and …

Risk Governance And Deliberative Democracy In Health Care, Nan D. Hunter Jan 2008

Risk Governance And Deliberative Democracy In Health Care, Nan D. Hunter

Georgetown Law Faculty Publications and Other Works

I argue in this article that the concept of risk-centered governance is the best theoretical paradigm for understanding health law and the health care system. Over the past 20 years, an insurance-inflected discourse has migrated from the purely financial side of the health system into the heart of traditional medicine - the doctor-patient relationship. Rather than focus on doctrinal strands, I argue that scholars should analyze the law of health care as a set of governance practices organized around managing and allocating financial, as well as clinical, risk.

Over the same period, the body of law that structures most private …

Densification, Microstructure, And Mechanical Properties Of Zirconium Diboride Based Ultra-High Temperature Ceramics, Sumin Zhu Jan 2008

Densification, Microstructure, And Mechanical Properties Of Zirconium Diboride Based Ultra-High Temperature Ceramics, Sumin Zhu

Doctoral Dissertations

"The first part of this dissertation was aimed at studying the densification of ZrB₂ ceramics by pressureless sintering techniques. Various processes have been applied to coat ZrB₂ powders with polymer precursors, which were used to produce C after charring. After sintering at 1900⁰C, relative density increased of ~70% for uncoated ZrB₂ to >99% for ZrB₂ coated with at least 1.0 wt% C. Thermodynamic analysis suggested that C reacted with and removed oxide impurities (ZrO₂ and B₂O₃) that were present on the ZrB₂ particle surfaces, which promoted densification by minimizing grain coarsening"--Abstract, page iv.

Federal Government Documents: Dead Or Alive, Charles D. Bernholz Jan 2008

Federal Government Documents: Dead Or Alive, Charles D. Bernholz

University of Nebraska-Lincoln Libraries: Faculty Publications

Marcel Proust wrote “What we call our future is the shadow that our past projects in front of us.” For the federal documents universe, this is only partially correct. We should attend more to how it has felt to be documents librarians, instead of trying to reconcile the past with all those wishful digital delivery monologues. A lack of courage on our part now—or relying solely upon that handy silhouette—will jeopardize the prospect of tomorrow's federal documents and their use. That absence of daring, or the use of that crutch, will guarantee that whatever results we are handed in our …

Ebsco’S Communication & Mass Media Complete: An Appreciable Improvement Over Previous Communication Studies Indexing?, David C. Tyler, Signe Boudreau, Katharine C. Potter, Misty Redinbaugh

University of Nebraska-Lincoln Libraries: Faculty Publications

In a prior edition of this study, we examined whether the established online communication studies indexes—Communication Abstracts, ComIndex, and ComAbstracts—provided a good avenue of access to the journal literature that researchers in the field cite and whether, where the current journal literature was concerned, that avenue of access might be equal or superior to that provided by large, multisubject online indexes. In this iteration of the study, we similarly address EBSCO’s new product for communication studies, Communication & Mass Media Complete.

Technology And Signal Processing For Brain-Machine Interfaces, Justin C. Sanchez, Jose C. Principe, Toshikazu Nishida, Rizwan Bashirullah, John G. Harris, José A.B. Fortes

Electrical and Computer Engineering Faculty Research & Creative Works

Brain-machine interfaces (BMIs) aid disabled humans. BMI systems face challenges such as interfacing with neural tissue, selecting the most appropriate control signals, acquiring data and decoding patient intent in implantable or wearable computers. They must be able to adapt to different variety of behavioral states. Today's hybrid BMI systems consume less power and are made to chronically extract control commands from the nervous system. In terms of signal processing approaches, one challenge for BMI data analysis is learning how to handle large multi-input multi-output systems with signal representations that span continuous and discrete time. BMI systems also need sufficient information …

Implementing An Architectural Framework To Define And Deliver Net-Centric Capability To Legacy Military Air Assets Operating Within A System Of Systems, Mark S. Anderson, S. M. Martin, Cihan H. Dagli, Ann K. Miller

Engineering Management and Systems Engineering Faculty Research & Creative Works

The United States Air Force (USAF) is implementing an integrated net-centric system of systems for airborne operations in support of the global war on terror (GWOT). The GWOT demands that a successful architecture framework transforms and delivers net-centric assets to the war-fighter in a timely manner. A critical component of this implementation is the transformation of legacy strategic air platforms into net-centric air power assets operating within a system of systems. The System Architectural (SA) framework, and the Department of Defense Architectural Framework (DoDAF) are ways of managing complexity and organizing information within a system of systems network. This paper …

Estimation Of Earthquake Loss Due To Bridge Damage In The St. Louis Metropolitan Area. Ii: Indirect Losses, David Lee Enke, Chakkaphan Tirasirichai, Ronaldo Luna

Engineering Management and Systems Engineering Faculty Research & Creative Works

An approach to estimate the indirect economic loss due to damaged bridges within the highway system from an earthquake event is presented. The indirect cost considered refers to the increased highway transportation cost only. The study zone covers the St. Louis metropolitan area and its surrounding suburban regions. An earthquake scenario centered in St. Louis, with a magnitude 7.0 is used. The direct earthquake loss was primarily damage to bridges, which causes an increase in travel time and distance within the transportation network. This information is then used as input for the indirect loss model. The indirect loss is examined …

The Effects Of Congressional Elections On Future Equity Market Returns, Vincent Louis Ovlia, David Lee Enke, Michael C. Davis Jan 2008

The Effects Of Congressional Elections On Future Equity Market Returns, Vincent Louis Ovlia, David Lee Enke, Michael C. Davis

Engineering Management and Systems Engineering Faculty Research & Creative Works

As the primary entity responsible for new legislation, Congress is capable of enacting legislation that may affect future market returns. To examine potential effects, the percentage of the House of Representatives and Senate controlled by a political party is examined. Additionally, the effect on returns in a change in the percentage of seats gained or lost in Congressional elections is analyzed. To test both theories, a modified “partisan view” model is adopted. Results point to the fact that equity markets perform better in situations in which power is distributed between political parties.

Weather-related health effects have attracted renewed interest because of the observed and predicted climate change. The authors studied the short-term effects of cold weather on mortality in 15 European cities. The effects of minimum apparent temperature on cause- and age-specific daily mortality were assessed for the cold season (October-March) by using data from 1990-2000. For city-specific analysis, the authors used Poisson regression and distributed lag models, controlling for potential confounders. Meta-regression models summarized the results and explored heterogeneity. A 1 degrees C decrease in temperature was associated with a 1.35% (95% confidence interval (CI): 1.16, 1.53) increase in the daily …

The Use Of Cellomics To Study Enterocyte Cytoskeletal Proteins In Coeliac Disease Patients, Bashir M. Mohamed, Conleth Feighery, Yvonne Williams, Anthony Davies, Dermot Kelleher, Yuri Volkov, Jacinta Kelly, Mohamed Abuzakouk

Articles

Coeliac disease is characterised by inflammation of small intestinal mucosa accompanied by abnormal villous architecture. It is now accepted that some patients with positive coeliac serology tests may have minor mucosal lesions that may not be apparent on routine histopathological analysis. The aim of the study was to perform detailed examination of enterocyte morphology and cytoskeletal structures using a high content analysis technology. Duodenal biopsies from 14 untreated and 10 treated coeliac patients and from 20 non-coeliac controls were examined. Tissue sections from six patients (study group subjects) before and after the development of gluten-sensitive enteropathy were also investigated. Immunohistochemical …

Integrating Service-Learning Into Undergraduate Students' Curricula: Recommendations For Best Practices, Neivin Mahmoud Marzouk Shalabi

Electronic Theses and Dissertations

Several recent studies have revealed that there is increasing individualism and declining interest in politics and civic engagement among college students. Accordingly, many scholars called for reinvigorating the civic mission of higher education. This thesis study examines academic service-learning as an effective pedagogy for promoting students’ civic engagement. The purpose of this thesis is to investigate the best ways of integrating service-learning into the curricula of undergraduate students. Using McCarthy’s (2003) conceptual framework, the “Concept of Triangles,” this study provides a comprehensive review of literature on the theoretical underpinnings, partners, and relationships of academic service-learning. The results of the study …

Analysis Of Japanese Hotel Employees' Job Satisfaction And Its Association With Annual Income And Other Socio-Economic Variables, Tadayuki Hara, Dana Tesone

Rosen Faculty Scholarship and Creative Works

Researcher conducted quantitative analyses of Japanese hotel employees' job satisfaction and its association with the other variables such as actual annual salary, desired annual salary, age, gender, highest education, years in the industry, number of jobs switched, size of the hotel etc. While some of the descriptive statistics might indicate that overall mean score of the job satisfaction appears to be improving, the research revealed where the increased variances of satisfaction might have come from. Series of hypotheses testing based on the industry-generated questions were conducted. While there were substantial evidences to support some allegations, relatively huge variances often indicated …
