Electro-Optic And Dielectric Study Of The De Vries-Type Smectic A* Phase Exhibiting Transitions To Smectic-C*A And Smectic-C* Phases, U. Manna, Jang-Kun Song, Yuri Panarin, Atsuo Fukuda, J. K. Vij Jan 2008

Electro-Optic And Dielectric Study Of The De Vries-Type Smectic A* Phase Exhibiting Transitions To Smectic-C*A And Smectic-C* Phases, U. Manna, Jang-Kun Song, Yuri Panarin, Atsuo Fukuda, J. K. Vij

Articles

Mixtures of different compositions of an antiferroelectric liquid crystal compound that exhibits direct smectic-A*(Sm-A*)-smectic-C*A(Sm-C*A) transition with a ferroelectric liquid crystal compound that exhibits Sm-A*-smectic-C*(Sm-C*) transition are studied using electro-optics and dielectric spectroscopy. The results of optical texture, birefringence, and the tilt angle suggest that a part of the Sm-A* phase is of de Vries type, since an increase in the tilt angle with decreasing temperature results in a reduction in the value of the birefringence in the Sm-A* phase, whereas the birefringence at Sm-A* to Sm-C* transition goes up by 12.7%. The soft mode relaxation strength, the Landau coefficient of …

Analysis Of Financial Data Using Non-Negative Matrix Factorization, Ruairí De Fréin, Konstantinos Drakakis, Scott Rickard, Andrzej Cichocki Jan 2008

Analysis Of Financial Data Using Non-Negative Matrix Factorization, Ruairí De Fréin, Konstantinos Drakakis, Scott Rickard, Andrzej Cichocki

Articles

We apply Non-negative Matrix Factorization (NMF) to the prob-lem of identifying underlying trends in stock market data. NMF is arecent and very successful tool for data analysis including image andaudio processing; we use it here to decompose a mixture a data, thedaily closing prices of the 30 stocks which make up the Dow Jones In-dustrial Average, into its constitute parts, the underlying trends which govern the financial marketplace. We demonstrate how to impose ap-propriate sparsity and smoothness constraints on the components of thedecomposition. Also, we describe how the method clusters stocks to-gether in performance-based groupings which can be used for …

Preparation And Accreditation Of Level 7 Engineering Programmes, Mark Mcgrath Jan 2008

Preparation And Accreditation Of Level 7 Engineering Programmes, Mark Mcgrath

Conference Papers

Accreditation of 3rd level educational programmes by a suitably recognised professional body is of particular relevance in relation to engineering. The completion of a sequence of modules which leads to the attainment of this professionally recognised award is viewed as integral to the undertaking. The engineering technology fields are developing and expanding rapidly and the third level sector must keep abreast of these changes. This is essential if the third level institutions wish to continue delivering programmes which produce graduates who can successfully complete the transition from 3rd. Level to the various engineering sectors.

This paper outlines various aspects …

August Wilson’S The Piano Lesson And The Limits Of Law, Emilie Benoit, James Tackach Jan 2008

August Wilson’S The Piano Lesson And The Limits Of Law, Emilie Benoit, James Tackach

Arts & Sciences Faculty Publications

August Wilson’s The Piano Lesson features a debate between an African American brother and sister over the ownership of a richly symbolic piano, a family heirloom that represents the Charles family’s slave heritage and its endurance through Reconstruction. Ownership questions like the one presented in The Piano Lesson can usually be resolved in the courts, but Wilson’s play suggests that the law might be unable to resolve property disputes so problematically entangled with the legacy of slavery. Wilson offers, instead, a non-legal resolution to the piano debate presented in his play.

From Obsession To Confession: A False Confession Paradigm In The Murder Of Jon Benet Ramsey, Morgan Moffa, Judith Platania Jan 2008

From Obsession To Confession: A False Confession Paradigm In The Murder Of Jon Benet Ramsey, Morgan Moffa, Judith Platania

Arts & Sciences Faculty Publications

In this study, we used a fact pattern similar to the John Mark Karr scenario to examine perceptions of DNA and confession evidence. Specifically, we hypothesized that DNA evidence, confessor level of psychopathology, and presence or absence of Miranda protections would affect participants’ perceptions of guilt and attitudes towards the interrogation process. One hundred nine undergraduates read a two-page summary based on John Mark Karr’s confession. Summaries varied based on psychopathology of confessor, the presence or absence of DNA evidence, and the provision of Miranda warnings prior to confession. The DNA manipulation explained participants’ attitudes towards specific aspects of the …

Ovarian Signalling:Insights Into The P13k/Pkb/Foxo And The Ras/Raf/Mek/Erk Pathways, Nicola Cahill Jan 2008

Ovarian Signalling:Insights Into The P13k/Pkb/Foxo And The Ras/Raf/Mek/Erk Pathways, Nicola Cahill

Masters

The ovaries are a pair of female reproductive organs that are involved in the production of gametes “oogenesis” and the production of hormones “steroidogenesis” to mediate the oestrous cycle, preparation of the uterus for pregnancy and the preparation of the breast for lactation www.lab.anhb.uwa.edu.au/mb140/corepages/femaleRepro). The oestrous cycle is controlled by the release of the pituitary gonadotrophins, follicle stimulating hormone (FSH) and lutenising hormone (LH). The physiological responses of ovarian steroidogenesis, oogenesis, folliculargenesis, ovulation and lutenisation to the gonadotrophins are accomplished by the activation of greater than one hundred ovarian target genes (Hunzicker-Dunn et al 2006). These processes are dependant on …

Preparing Instructors Of Adult Learners To Address The Needs Of Minority Students, Travell Unique Brock Jan 2008

Preparing Instructors Of Adult Learners To Address The Needs Of Minority Students, Travell Unique Brock

Graduate Research Papers

In predominately Caucasian educational systems, diversity in the classroom is becoming a fast-growing phenomenon. With this new phenomenon, adult instructors now have a new challenge of facilitating learning in an environment where the learners not only have different learning capabilities, but also language and cultural differences. The reviewer answers the following questions: what are the important considerations for instructors to prepare diverse adult learners for corporate work environments, higher education, and K-12 professional development? And what are the appropriate cultural specific media and literature resources to include in training?

The literature collected focused on resources related to teaching adult minority …

Vicarious Criminal Liability And The Constitutional Dimensions Of Pinkerton, Alex Kreit Jan 2008

Vicarious Criminal Liability And The Constitutional Dimensions Of Pinkerton, Alex Kreit

American University Law Review

This article considers what limits the constitution places on holding someone criminally liable for another's conduct. While vicarious criminal liability is often criticized, there is no doubt that it is constitutionally permissible as a general matter. Under the long-standing felony murder doctrine, for example, if A and B rob a bank and B shoots and kills a security guard, A can be held criminally liable for the murder. What if, however, A was not involved in the robbery but instead had a completely separate conspiracy with B to distribute cocaine? What relationship, if any, does the constitution require between A's …

Tactical Ineffective Assistance In Capital Trials, Kyle Graham Jan 2008

Tactical Ineffective Assistance In Capital Trials, Kyle Graham

American University Law Review

Are defense attorneys sandbagging in their death-penalty cases? In Poindexter v. Mitchell, a habeas corpus case decided in 2006, Chief Judge Danny Boggs of the United States Court of Appeals for the Sixth Circuit wrote that by conducting a deliberately defective investigation into mitigation evidence that might otherwise have been presented at the penalty phase of a capital trial, a defense attorney can virtually guarantee that any death sentence the jury returns will be vacated in later proceedings. The likelihood of such an outcome, Boggs wrote, will more than make up for the somewhat greater chance that a jury that …

Guarantors Of Our Genes: Are Egg Donors Liable For Latent Genetic Disease, Suriya E.P. Jayanti Jan 2008

Guarantors Of Our Genes: Are Egg Donors Liable For Latent Genetic Disease, Suriya E.P. Jayanti

American University Law Review

Assisted reproductive technology ("ART"), including egg donation, is changing the topography of the American family. Heated debates and legislative battles over cloning and stem cell research reveal the complexity of the moral, scientific, and legal implications of emerging alternative reproductive methods. In fact, the field of reproductive medicine is the "Wild West" of the healthcare world where technological development is testing the boundaries of science and ethics. The legal and ethical issues intrinsic to the evolution of the egg donation industry are poised to become central topics of public debate as we, as a culture, reevaluate who and what constitutes …

Scottish Common Sense And Nineteenth-Century American Law: A Critical Appraisal, John Mikhail Jan 2008

Scottish Common Sense And Nineteenth-Century American Law: A Critical Appraisal, John Mikhail

Georgetown Law Faculty Publications and Other Works

One overriding concern I have with Susanna Blumenthal's insightful and stimulating article, "The Mind of a Moral Agent: Scottish Common Sense and the Problem of Responsibility in Nineteenth-Century American Law," is whether there is anything sufficiently distinctive about Scottish Common Sense philosophy that justifies the role Blumenthal ascribes to it. One could probably replace "Common Sense philosophy" in Blumenthal's formulation with something as diffuse as "The Enlightenment," or even "Western jurisprudence," without significantly altering its import, because the assumption that rational and moral faculties are innate and universal is common to most writers in these traditions. There are subtle differences …

The Inevitability Of Conscience: A Response To My Critics, David Luban Jan 2008

The Inevitability Of Conscience: A Response To My Critics, David Luban

Georgetown Law Faculty Publications and Other Works

This essay by Professor David Luban is written in response to critics of his book, Legal Ethics and Human Dignity.

In part I Professor Luban addresses the primacy that he assigns conscience over the professional role and focuses mainly on the arguments of his critics, Professors Norman Spaulding and W. Bradley Wendel. Part II explores the challenge of pluralism, replying primarily to Professors Katherine Kruse, Spaulding, and Wendel. Part III, in response to Professors Kruse and William Simon, elaborates on the concept of human dignity. Part IV discusses institutions and ethics, focusing on Professors Susan Carle and Simon. The …

It takes lawyers, physicians, psychologists, and anthropologists as its case studies. It originated as the keynote speech at the Association of Practical and Professional Ethics annual meeting in 2007.

Silence Of The Laws? Conceptions Of International Relations And International Law In Hobbes, Kant, And Locke, Michael W. Doyle, Geoffrey S. Carlson Jan 2008

Silence Of The Laws? Conceptions Of International Relations And International Law In Hobbes, Kant, And Locke, Michael W. Doyle, Geoffrey S. Carlson

Faculty Scholarship

This Essay explains how the political theorists Hobbes, Kant, and Locke interpret the decision to go to war (us ad bellum) and the manner in which the war is conducted (just in bello). It also considers the implications of the three theories for compliance with international law more generally. It concludes that although all three can lay claim to certain key features of modern international law, it is Locke who provides the most complete support for both the laws of war, in particular, and with international law, in general.

Letting Guidelines Be Guidelines (And Judges Be Judges), Gerard E. Lynch Jan 2008

Letting Guidelines Be Guidelines (And Judges Be Judges), Gerard E. Lynch

Faculty Scholarship

In a prescient New York Times op-ed piece entitled "Let Guidelines be Guidelines," written in response to the Supreme Court's decision in Blakely v. Washington, before certiorari was granted in United States v. Booker, Bill Stuntz of Harvard and Kate Stith Cabranes of Yale urged that the best solution for the constitutional crisis facing the United States Sentencing Guidelines would be to treat the Guidelines as guidelines, and not as a straightjacket. The Supreme Court evidently took a similar view, deciding in Booker that the Guidelines were constitutional only to the extent that they were not mandatory. The recent follow-up …
