Family Law Cases As Law Reform Litigation: Unrecognized Parents And The Story Of Alison D. V. Virginia M., Suzanne B. Goldberg Jan 2008

Family Law Cases As Law Reform Litigation: Unrecognized Parents And The Story Of Alison D. V. Virginia M., Suzanne B. Goldberg

Faculty Scholarship

Although the gap between law and lived experience comes as no surprise to most people, the divergence is especially striking – and disturbing – in the area of family law. Legal training quickly reveals that love is not a foundational element of family law, yet it can still be jarring to find that love has little, if any, bearing on the contours of the legal family. Love, after all, does not account for who can and cannot marry. Nor does the past love of an unmarried couple trigger the protections of divorce should the couple separate.

When children are involved, …

Reputational Sanctions In China's Securities Market, Benjamin L. Liebman, Curtis J. Milhaupt Jan 2008

Reputational Sanctions In China's Securities Market, Benjamin L. Liebman, Curtis J. Milhaupt

Faculty Scholarship

Literature suggests two distinct paths to stock market development: an approach based on legal protections for investors, and an approach based on self-regulation of listed companies by stock exchanges. This Essay traces China's attempts to pursue both approaches, while focusing primarily on the role of the stock exchanges as regulators. Specifically, the Essay examines a fascinating but unstudied aspect of Chinese securities regulation – public criticism of listed companies by the Shanghai and Shenzhen exchanges. Based on both event study methodology and extensive interviews of market actors, we find that the public criticisms have significant effects on listed companies and …

Longing For Loving, Katherine M. Franke Jan 2008

Longing For Loving, Katherine M. Franke

Faculty Scholarship

Our task in this Symposium is to place Loving v. Virginia in a contemporary context: to interpret, if not reinterpret, its meaning in light of the settings in which race, sexuality, and intimacy are being negotiated and renegotiated today. So we might ask, in what way are Mildred and Richard Loving role models for us today? How, if at all, does the legal movement for marriage equality for interracial couples help us think through our arguments and strategies as we struggle today for marriage equality for same-sex couples?

One way to frame these questions is to ask whether there is …

Congress & Sports Agents: A Legislative History Of The Sports Agent Responsibility And Trust Act, Edmund P. Edmonds, William H. Manz, Thomas J. Kettleson. Jan 2008

Congress & Sports Agents: A Legislative History Of The Sports Agent Responsibility And Trust Act, Edmund P. Edmonds, William H. Manz, Thomas J. Kettleson.

Books

Although a majority of individual states have adopted legislation directed toward the conduct of sports agents, the federal government found it necessary to enact Public Law 108-304, the Sports Agent Responsibility and Trust Act (SPARTA). Congress has recognized that many acts of sports agents go unpunished because of disparate, ineffective, or in some cases, a complete absence of state laws.

This volume offers readers the legislative history of SPARTA, including copies of the law, reports, hearings, and related bills. An additional feature of the set is an appendix containing state legislation in this area. The appendix includes the language from …

The Phonetic Context Of American English Flapping: Quantitative Evidence, Dirk Elzinga, David Eddington Jan 2008

The Phonetic Context Of American English Flapping: Quantitative Evidence, Dirk Elzinga, David Eddington

Faculty Publications

The phonetic context in which word-medial flaps occur (in contrast to [th]) in American English is explored. The analysis focuses on stress placement, following phone, and syllabification. In Experiment 1, subjects provided their preference for [th] or [ɾ] in bisyllabic nonce words. Consistent with previous studies, flaps were preferred before stressless syllables and [th] before stressed syllables, but the following phone also exerted a small degree of influence. Experiments 2 and 3 tested whether [th] or [ɾ] are associated with a particular syllable position in bisyllabic words. They demonstrate that [th] is favored in onsets, while [ɾ] is not consistently …

Community Wellness Center: Providence, Rhode Islan, Eva Marie Mercurio

Architecture Theses and Projects

The Wellness Center in Providence, Rhode Island incorporates alternative medicine, medical, and dental facilities for the benefit and education of patients within and around surrounding neighborhoods as well as for others who reside outside the immediate area. These services, all of which are available in one centrally located area have the potential to captivate and entice those who are interested in creating a better lifestyle for themselves. A predominant focus of this facility is to instill and promote healthy lifestyles while at the same time educating the public who can contribute to a society and become capable of addressing and …

Pushing The Green Envelope: Education & Research Center For Sustainability, Emma Fischer Jan 2008

Pushing The Green Envelope: Education & Research Center For Sustainability, Emma Fischer

Architecture Theses and Projects

I propose to design a Center for Sustainability that serves as a place to educate students and the public, as well as provide a place to research and experiment, in an effort to further the developing technologies of this ecological study. While living in a perpetually changing world, I believe a place is needed to teach about these changes as well as adapt to them. I propose to build a center that both educates people about the background of the subject as well as teaching them the present, practical aspects of sustainability. Classes and exhibits will give visitors the education …

Ceramic Variability And Cultural Diversity In The Northern San Juan Region, Janet Hagopian, James R. Allison Jan 2008

Ceramic Variability And Cultural Diversity In The Northern San Juan Region, Janet Hagopian, James R. Allison

Faculty Publications

The Northern San Juan region during the Pueblo I period has been subdivided into eastern and western groups based on differences in site structure and organization. Ceramic assemblages from across the Northern San Juan region also vary significantly. This poster uses both stylistic and technological traits to examine ceramic variability between Animas- La Plata sites and contemporary sites from the surrounding Northern San Juan region. The ceramics suggest at least three regionalized traditions, implying a greater degree of cultural diversity than previously suspected.

Alejandro Amenábar And The Embodiment Of Skepticism In Abre Los Ojos, David Laraway Jan 2008

Alejandro Amenábar And The Embodiment Of Skepticism In Abre Los Ojos, David Laraway

Faculty Publications

For most philosophers of the Anglo-American tradition, the problem of radical skepticism and its variants - i.e., the possibility that I could be massively mistaken in my beliefs about the external world, other minds, and even myself - no longer has the cachet itonce did. Although itmaintains a respectable place in contemporary epistemology it is clearly on the periphery of the discipline and no longer claims the attention once devoted to it by philosophers of the stature of Descartes, Hume, and Kant. Pride of place now goes, rather, to the task of naturalizing epistemology, which seeks to interpret questions about …

Abortion, Embryonic Stem Cell Research, And Waste, David A. Jensen Jan 2008

Abortion, Embryonic Stem Cell Research, And Waste, David A. Jensen

Faculty Publications

Can one consistently deny the permissibility of abortion while endorsing the killing of human embryos for the sake of stem cell research? The question is not trivial; for even if one accepts that abortion is prima facie wrong in all cases, there are significant differences with many of the embryos used for stem cell research from those involved in abortion—most prominently, many have been abandoned in vitro, and appear to have no reasonably likely meaningful future. On these grounds one might think to maintain a strong position against abortion but endorse killing human embryos for the sake of stem cell …

Human Reproductive Cloning And Reasons For Deprivation, David A. Jensen Jan 2008

Human Reproductive Cloning And Reasons For Deprivation, David A. Jensen

Faculty Publications

Human reproductive cloning provides the possibility of genetically related children for persons for whom present technologies are ineffective. I argue that the desire for genetically related children is not, by itself, a sufficient reason to engage in human reproductive cloning. I show this by arguing that the value underlying the desire for genetically related children implies a tension between the parent and the future child. This tension stems from an instance of a deprivation and violates a general principle of reasons for deprivation. Alternative considerations, such as a right to procreative autonomy, do not appear helpful in making the case …
