Complying With Export Laws Without Importing Discrimination Liability: At Attempt To Integrate Employment Discrimination Laws And The Deemed Export Rules, Sandra F. Sperino Jan 2008

Complying With Export Laws Without Importing Discrimination Liability: At Attempt To Integrate Employment Discrimination Laws And The Deemed Export Rules, Sandra F. Sperino

Faculty Articles and Other Publications

The federal deemed export rules prohibit certain individuals from receiving any information about certain technologies without the required license, even if those individuals are otherwise authorized to work within the United States. In other words, employers who deal with technology or software subject to export control may be considered to be illegally exporting such technology or software, simply by allowing certain foreign nationals to work with or gain information about the restricted items.

This article will attempt two moderately simple tasks and one more difficult. The first task is to identify the tensions that exist between the deemed export rules …

Pison Menkei, A New Crabronid Wasp In Dominican Amber, Daniel J. Bennett, Michael S. Engel Jan 2008

Pison Menkei, A New Crabronid Wasp In Dominican Amber, Daniel J. Bennett, Michael S. Engel

Faculty Publications

A new crabronid wasp species, Pison menkei sp. n., is described and figured from a single female preserved in Early Miocene (Burdigalian) Dominican amber. The fossil is herein distinguished from extant and extinct congeners and regarded as an isolated species removed from modern Neotropical species groups. It is the seventh named fossil Pison and the second from Dominican amber.

Rapid Detection Of Avian Eimeria Species Using Denaturing Gradient Gel Electrophoresis, Alexandra Martynova-Van Kley, A. Syvyk, I. Teplova, M. E. Hume, A. Nalian Jan 2008

Rapid Detection Of Avian Eimeria Species Using Denaturing Gradient Gel Electrophoresis, Alexandra Martynova-Van Kley, A. Syvyk, I. Teplova, M. E. Hume, A. Nalian

Faculty Publications

A denaturing gradient gel electrophoresis (DGGE) assay was developed to rapidly discriminate species of avian Eimeria. Amplification by PCR of the small subunit ribosomal RNA gene (approximately 1,600 nucleotides) with Eimeria genus-specific primers followed by cloning and sequencing allowed us to carry out phylogenetic analyses and identify clone sequences to species level in most cases. Clones were subsequently used to amplify a smaller fragment (approximately 120 nucleotides) suitable for DGGE. The fragments were separated on denaturing gradient gel and bands with unique migration distances were mixed to obtain an identification ladder. The identification ladder and PCR products obtained from …

Denaturing Gradient Gel Electrophoresis As A Tool To Determine Batch Similarity Of Probiotic Cultures Of Porcine Cecal Bacteria, Michael Hume, Charles M. Scanlan, Roger B. Harvey, Kathleen Andrews, James D. Snodgrass, Armen Nalian, Alexandra Martynova-Van Kley, David Nisbet

Faculty Publications

A continuous-flow porcine cecal bacterial culture has been used experimentally as treatment against enterotoxigenic Escherichia coli in weanling pigs. Periodically, the cultures must be started from frozen stock. Our results indicate that denaturing gradient gel electrophoresis can be applied as an indirect indication of culture similarity for each new batch generated from frozen stock.

Sexual Selection And Alternative Reproductive Tactics In Cyprinodon Elegans, Jennifer M. Gumm Jan 2008

Sexual Selection And Alternative Reproductive Tactics In Cyprinodon Elegans, Jennifer M. Gumm

Faculty Publications

In systems with alternative reproductive tactics (ARTs), males have discrete behaviors and morphologies that allow them to optimize their reproductive success in relation to others in the population. Males with different phenotypes directly compete with one another for mates, providing unique opportunities for studying social interactions within a species. Using the Comanche Springs pupfish, Cyprinodonelegans, a species with three alternative reproductive tactics, I examine how male behaviors and social interactions influence the reproductive success of each tactic.

Previous studies suggest that large territorial males have high reproductive success, while satellite males and female mimics must intrude into territories in order …

Singlet Oxygen Chemistry In Water:  A Porous Vycor Glasssupported Photosensitizer, David Aebisher, Nikolay S. Azar, Matibur Zamadar, Naveen Gandra, Harry D. Gafney, Roumei Gao, Alexander Greer Jan 2008

Singlet Oxygen Chemistry In Water:  A Porous Vycor Glasssupported Photosensitizer, David Aebisher, Nikolay S. Azar, Matibur Zamadar, Naveen Gandra, Harry D. Gafney, Roumei Gao, Alexander Greer

Faculty Publications

Singlet molecular oxygen [1O2 (1Δg)] is generated cleanly in aqueous solution upon irradiation of a heterogeneous complex, meso-tetra(N-methyl-4-pyridyl)porphine (1) adsorbed onto porous Vycor glass (PVG). The cationic photosensitizer 1 tightly binds onto PVG and gives a stable material, which does not dissociate 1 into the surrounding aqueous phase. The production of 1O2 was measured by monitoring the time-resolved 1O2 (1Δg) phosphorescence at 1270 nm. Indirect analysis of 1O2 generation was also carried out with the photooxidation oftrans-2-methyl-2-pentenoate anion, which afforded the corresponding hydroperoxide. Sensitizer-1-impregnated PVG gives rise to a new singlet …

Irrational Exuberance For Babies: The Taste For Heterosexuality And Its Conspicuous Reproduction, Jose M. Gabilondo Jan 2008

Irrational Exuberance For Babies: The Taste For Heterosexuality And Its Conspicuous Reproduction, Jose M. Gabilondo

Faculty Publications

This article targets a flying buttress of normative heterosexuality: its physical reproduction via procreation and its symbolic propagation through parents' pre-natal preferences for heterosexuality in future children. While the parental "taste for heterosexuality" is often asserted for the sake of future children themselves, this justification overlooks the role of parental self-interest, including anticipated social gains to parents from heterosexuality in children. Hence the taste sets the stage both for sexual orientation-based abuse of future children and the devaluation of sexual minority adults. Courts too have a taste for heterosexuality, shown here in two state court cases denying gays and lesbians …

A Global Perspective On Andragogy: An Update, John Henschke Jan 2008

A Global Perspective On Andragogy: An Update, John Henschke

Adult Education Faculty Works

Andragogy has received mixed reviews in the past. Some have analyzed in from a positive perspective. Some have analyzed it from a negative perspective, and some have ignored it altogether. Most of the discussions have limited their observations to how Malcolm S. Knowles addressed andragogy. There has been an inadequate investigation of the foundation and background of andragogy from a world perspective. This research presents 240 major works published in English from national and international sources on andragogy that may help provide a clear and understandable international foundation for the linkage between the research, theory, and practice of andragogy. Six …

Collegiate Student’S Epistemologies And Conceptual Understanding Of The Role Of Models In Precalculus Mathematics: A Focus On The Exponential And Logarithmic Functions., Robert Melendy

Faculty Publications - Department of Electrical Engineering and Computer Science

Collegiate student’s conceptual distinctions of what define a mathematical and a physical model seems to be affected by the epistemological beliefs they hold about this knowledge. These beliefs seem to influence student’s thinking and reasoning as they embark on problem solving activities in collegiate mathematics. Student’s epistemological beliefs of mathematical models and the descriptive role that such models hold with physical phenomena was established using a modified version of a preexisting instrument titled Student’s Understanding of Models in Science (SUMS). The modified version contains additional items that were developed to capture student’s mathematical epistemologies. These new items were interwoven into …

Minority Language Rights: Historical And Comparative Perspectives, Douglas A. Kibbee Jan 2008

Minority Language Rights: Historical And Comparative Perspectives, Douglas A. Kibbee

Intercultural Human Rights Law Review

Language is an instrument of communication that brings us together. Language is an element of identity that distinguishes us from one another. Language education is a means of leveling the playing field and giving all an equal opportunity. Language education is a way of destroying non-official languages and nonstandard language varieties and inevitably disfavors native speakers of those other languages and language varieties. Such are the paradoxes that every government must confront, from the largest to the smallest. Today, these questions of community and nation are being influenced by international organizations and treaties, transforming practice in spite of national traditions …

Biodiversity, Traditional Knowledge And Folklore: Work On Related Ip Matters In The Wto, Hannu Wager

Intercultural Human Rights Law Review

Issues related to biodiversity, traditional knowledge and folklore have received increasing attention in the global intellectual property (IP) arena, including in the work of intergovernmental organizations and civil society. The World Trade Organization (WTO) is one of the forums in which the debate on related IP matters is occurring. Other intergovernmental organizations in which such debates are taking place include, among others, the World Intellectual Property Organization (WIPO), the Convention on Biological Diversity (CBD), the Food and Agriculture Organization (FAO), the United Nations Conference on Trade and Development (UNCTAD), the World Bank, and various United Nations human rights bodies. Report Of The Commission To Assess The Threat To The United States From Emp Attack: Critical National Infrastructures, George Baker Jan 2008

Report Of The Commission To Assess The Threat To The United States From Emp Attack: Critical National Infrastructures, George Baker

Selected Works

The physical and social fabric of the United States is sustained by a system of systems; a complex and dynamic network of interlocking and interdependent infrastructures (“critical national infrastructures”) whose harmonious functioning enables the myriad actions, transactions, and information flow that undergird the orderly conduct of civil society in this country. The vulnerability of these frastructures to threats — deliberate, accidental, and acts of nature — is the focus of greatly heightened concern in the current era, a process accelerated by the events of 9/11 and recent hurricanes, including Katrina and Rita. This report presents the results of the Commission’s …

The Denial Of Emergency Protection: Factors Associated With Court Decision Making, Carol E. Jordan, Adam J. Pritchard, Pamela Wilcox, Danielle Duckett-Pritchard Jan 2008

The Denial Of Emergency Protection: Factors Associated With Court Decision Making, Carol E. Jordan, Adam J. Pritchard, Pamela Wilcox, Danielle Duckett-Pritchard

Office for Policy Studies on Violence Against Women Publications

Despite the importance of civil orders of protection as a legal resource for victims of intimate partner violence, research is limited in this area, and most studies focus on the process following a court’s initial issuance of an emergency order. The purpose of this study is to address a major gap in the literature by examining cases where victims of intimate partner violence are denied access to temporary orders of protection. The study sample included a review of 2,205 petitions that had been denied by a Kentucky court during the 2003 fiscal year. The study offers important insights into the …
