Drowning In Wetlands Jurisdictional Determination Process: Implementation Of Rapanos V. United States, Kenneth S. Gould

Today, through court interpretation and administrative agency adoption of related regulations, § 404 of the Clean Water Act of 1972 (the "Act") has become the major tool for protection of wetlands. Section 404(a) requires a permit from the United States Army Corps of Engineers for "the discharge of dredged or fill material into the navigable waters at specified disposal sites." If the Corps concludes that development activity might harm wetlands subject to Corps jurisdictional protection, it can decline to issue a permit to allow development or issue a permit under conditions designed to protect the wetlands from harm.

It Takes A Village To Solve The Problems In Legal Education: Every Faculty Member's Role In Academic Support, Melissa J. Marlow

University of Arkansas at Little Rock Law Review

This article suggests a fundamental shift in the way traditional faculty view their role in academic support, from merely assisting with academic support duties to becoming equally responsible with academic support faculty for student achievement. The article explores how legal education arrived at the current division of labor in teaching weaker students. Additionally, it examines why the current situation is not the best plan of action for maximizing student learning. Finally, it touches upon possible solutions that would work toward uniting law school faculty in their common purpose of preparing all students for the rigors of legal practice.

Tree diversity, species richness, basal area, population structure and distribution patterns were investigated in disturbed, moderately disturbed and undisturbed areas of the tropical dry deciduous forest of Piranmalai, Eastern Ghats in Tamil Nadu. The forest areas were selected based on the disturbance index. Six sites of 0.1 ha area were established in the Piranmalai forest. Humans depend on marine fish stocks for economic and nutritional purposes throughout the world. Consequently, commercial fleets and super-trawlers are nothing new and many countries have found ways to regulate fleet sizes and catch limits within their territorial waters. But something new is happening in the Arctic Circle. As sea ice begins to disappear during summer months, a previously inaccessible fishing ground is emerging, and like all fishing grounds, it will be susceptible to mismanagement and exploitation.

Minimal Components Of The Rna Polymerase Ii Transcription Apparatus Determine The Consensus Tata Box, Gudrun Bjornsdottir, Lawrence C. Myers

In Saccharomyces cerevisiae, multiple approaches have arrived at a consensus TATA box sequence of TATA(T/A)A(A/T)(A/G). TATA-binding protein (TBP) affinity alone does not determine TATA box function. To discover how a minimal set of factors required for basal and activated transcription contributed to the sequence requirements for a functional TATA box, we performed transcription reactions using highly purified proteins and CYC1 promoter TATA box mutants. The TATA box consensus sequence is a good predictor of promoter activity. However, several nonconsensus sequences are almost fully functional, indicating that mechanistic requirements are not the only selective pressure on the TATA box. We …

This paper focuses on a public trust resource -- wetlands -- and examines an issue that has been studied primarily with reference to health-based pollution-control statutes. This paper assesses whether information gaps create an obstacle to successful regulation under section 404 of the Clean Water Act (CWA or "the Act") as it applies to discharges of dredged and fill material in wetlands. It focuses on how section 404 and the regulations governing permitting determine information demands, information supply, and the legal consequences of a gap between supply and demand. Adolescents Under International Law: Autonomy As The Key To Reproductive Health, Aliya Haider

As a matter of policy, the reproductive and sexual health of adolescents matter because they comprise almost one half of the world's population. As a matter of international human rights law, adolescents have reproductive and sexual health rights. This article outlines how the international community must ensure adolescents' access to and exercise of those reproductive health rights. Governments must enable informed decision-making while also offering state protections for this vulnerable population. Without laws and policies that uphold adolescent health worldwide, future generations will needlessly suffer.

Polygamy And Same-Sex Marriage - Allies Or Adversaries Within The Same-Sex Marriage Movement, Jaime M. Gher

William & Mary Journal of Race, Gender, and Social Justice

This article addresses the charged slippery slope accusation that permitting same-sex marriage will inevitably lead to the legalization of polygamy. While same-sex marriage advocates generally distance their cause from polygamy and its disparaging history when responding to such accusations, this article determines whether that response is appropriate, or alternatively, whether the same-sex marriage movement could benefit from linkages between polygamy and same-sex marriage. In conducting the analysis, this article presents a nuanced discussion of marriage and its varying forms. Specifically, it examines the United States' historical regulation of polygamy, interrogates analogies between polygamy and same-sex marriage, compares cross-cultural practices and …

Bringing Down The Bedroom Walls: Emphasizing Substance Over Form In Personalized Abuse, Orly Rachmilovitz

William & Mary Journal of Race, Gender, and Social Justice

This article explores what makes domestic violence special and whether privileging certain abusive relationships, and thus certain victims, over others is justified. It argues that abuse in familial, romantic, or cohabitating relationships is not necessarily any more harmful than abuse in other personal relationships; that harm from abuse should be identified through substantive criteria, for which marriage or cohabitation should not be proxies; and that heightened protections should be extended accordingly. The article pinpoints the criteria that justify distinguishing domestic violence from other forms of violence and examines how federal and state domestic violence laws define protected victims and relationships. …

This thesis examines black women's understandings of and experiences with breast cancer through the use of narratives. These narratives offer different positions from which to critically analyze the dominate conceptualization of breast cancer in American society, which is primarily associated with white, middle class, heterosexual women. There is a focus on issues such as breast cancer 'risk', increased mortality rates among black women, dominate discourses and media representations of breast cancer, and mastectomy and body image. African American women's stories are used to 'deconstruct' and reveal how this disease is socially constructed in ways that has profound impact on their …

The Enemy In The Screen: A Collective Case Study On Perpetrators Of Internet Crimes Against Children, Janet M. Brown

This collective case study explored the phenomenon of Internet crimes against children from the perspectives of select Internet Crimes Against Children (ICAC) investigators. The research focused on three questions: (1) How do select investigators describe perpetrators of Internet crimes against children? (2) What, if any, common characteristics do participants identify among the perpetrators and (3) How do participants' descriptions compare and/or contrast? Data was obtained utilizing semistructured, conversational interviews with eight ICAC investigators. Three main themes emerged from these interviews: general demographic descriptions, motivations and behaviors.
