Resolving Conflict In Non-Ideal, Complex Systems: Solutions For The Law-Science Breakdown In Environmental And Natural Resource Law, Barbara Cosens

In 2006, the U.S. Supreme Court decided a consolidated case concerning the scope of the U.S. Army Corps of Engineers' jurisdiction to require permits for dredge and fill of wetlands under section 404 of the Clean Water Act, issuing a plurality, two concurrences, and two dissents. Each opinion has a solid legal foundation, yet none truly makes sense if the science of the resource in question is considered. The opinions in Rapanos v. United States illuminate the struggle at the law-science interface. The problem is not due to either a failure in legal reasoning or a failure in scientific methodology …

Multiple reproductive parameters including flower number, pods initiated, pods matured, seeds matured and mass per seed each require a certain percentage of a plant’s generated energy to ensure viable successive generations. In an attempt to determine the most important quality, these factors were documented over the span of several weeks as test rapid grow radish plants matured. Variables of reproductive effort would divide nutritional allocations in accordance of priority, with the effort of least variability being most critical to success. The massive scale of current and next-generation massively parallel processing (MPP) systems presents significant challenges related to fault tolerance. For applications that perform periodic checkpoints, the choice of the checkpoint interval, the period between checkpoints, can have a significant impact on the execution time of the application. Finding the optimal checkpoint interval that minimizes the wall clock execution time, has been a subject of research over the last decade. Research on child misbehavior has examined the influence of many factors, including the child’s typical behaviors and functioning, child temperament, parenting strategies, parental stress, parental attributions, perceptions of parenting, and parental tolerance.The concept of parental tolerance has recently been advocated as an important variable influencing child misbehavior by Brestan, Eyberg, Algina, Johnson, and Boggs (2003) who developed two parent report measures for it. The present study investigated the validity of one of these measures, the Child Rearing Inventory (CRI). We propose a Phase I clinical trial design that seeks to determine the cumulative safety of a series of administrations of a fixed dose of an investigational agent. In contrast to traditional Phase I trials that are designed to solely find the maximum tolerated dose (MTD) of the agent, our design instead identifies a maximum tolerated schedule (MTS) that includes an MTD as well as a vector of recommended administration times. Our model is based upon a non-mixture cure model that constrains the probability of toxicity for all subjects to monotonically increase with both dose and the number of administrations …

In 2008, Prime Wetland Designations (PWDs) were on the town ballot in the towns of Fremont, Hampton Falls, Brentwood, and Newfields. Three of the four passed (Appendix A); however, the Town of Newfields’ proposed designation was not approved due to significant opposition in the community (Appendix B). Portsmouth City Council will decide whether to designate the wetlands identified by their PWD report in the late spring or summer of 2008. This report documents the NHEP and community efforts to adopt PWD and offers insight into the unique situations of each community that may assist other communities in the PWD process. …

Background and Aims Early observations that genome size was positively correlated with cell size formed the basis of hypothesized consequences of genome size variation at higher phenotypic scales. This scaling was supported by several studies showing a positive relationship between genome size and seed mass, and various metrics of growth and leaf morphology. However, many of these studies were undertaken with limited species sets, and often performed within a single genus. Here we seek to generalize the relationship between genome size and the phenotype by examining eight phenotypic traits using large cross-species comparisons involving diverse assemblages of angiosperm and gymnosperm …

1. Carotenoids transferred from mother to offspring may enhance the quality of the offspring. Whether such maternal effects occur in guppies (Poecilia reticulata) has an important bearing on mate preference evolution.
2. By raising female guppies from birth on different dietary carotenoid levels, we examined the pattern of carotenoid allocation to maternal tissue (skin) vs. eggs. Skin carotenoid content was only weakly affected by carotenoid intake while egg carotenoid content was strongly affected.

Ocean observing systems provide a means to monitor oceanic variables on a variety of temporal and spatial scales. Data from ocean observing systems are most useful when they are collected in real-time; real-time data allow the detection of important events as they occur. Various real-time telemetry options exist for transferring data from sea to shore and from the subsurface to the surface. The National Institutes of Health (NIH) recently opened a center for the study of the use of complementary and alternative medicine (CAM). While the NlH has conducted a few random sampling studies, none have examined the knowledge and use of CAM among undergraduates and whether these differ by gender. 111 college students were asked about the usage of a variety of CAM techniques, as well as about beliefs and opinions about CAM techniques. Several gender differences emerged. Implications for college wellness centers will be discussed.

Background: The potential for widespread exposure to agricultural pesticides through drift during application raises concerns about possible health effects to exposed children living in areas of high agricultural activity.

Objectives: We evaluated whether residence in a county with greater agricultural activity was associated with risk of developing cancer in children < 15 years of age.

Methods: Incidence data for U.S. children 0–14 years of age diagnosed with cancer between 1995 and 2001 were provided by member registries of the North American Association of Central Cancer Registries. We determined percent cropland for each county using agricultural census data, and used the overall study distribution to classify …

The pending construction of the Changuinola 75 Hydroelectric Project (Chan-75) has sparked significant controversy as the affected communities, national non-governmental organizations (NGO’s) and international NGO’s have protested against the conduct of the project’s promoters, the AES Corporation and supporters, the Panamanian government. Located in the Bosque Protector Palo Seco, a buffer zone to La Amistad International Park, the Chan-75 hydroelectric dam project will have significant consequences for the biodiversity, flora and fauna of the area. A year and a half after the August 2006 eruption of the Tungurahua volcano, the vegetative growth on the pyroclastic flows is young and scarce. To determine the types of plants and the mechanisms which control the dynamics of vegetative recovery, two transects were made; one in the Cusúa gorge and the other in the Bascún gorge in which the type, quantity and ages of the plants were noted. A third transect of vegetation not directly affected by the 2006 flows was made near the Bascún gorge for comparison purposes. In the two main sites, a total of 47 species …
