Review Of Greener Pastures: Decentralizing The Regulation Of Agricultural Pollution. By Elizabeth Brubaker, Eva Pip Jan 2008

Review Of Greener Pastures: Decentralizing The Regulation Of Agricultural Pollution. By Elizabeth Brubaker, Eva Pip

Great Plains Research: A Journal of Natural and Social Sciences (through 2013)

Greener Pastures chronicles the proliferation of intensive hog production in Canada. Exploring the history of right-to-farm legislation, Elizabeth Brubaker focuses on the experiences of Manitoba, New Brunswick, and Ontario, although parallel situations may be found throughout the country. Starting with Manitoba's notorious 1976 Nuisance Act, which paved the way for similar industryshielding legislation in all other provinces, this book follows the devious evolution of laws that protect barn operators from environmental and public health liabilities, erode citizens' rights to seek relief and compensation through the judicial system, and remove decision-making powers from the communities that will be most affected. The …

Women In History - Leta Stetter Hollingworth: Educator And Advocate For Gifted Children, Jan Deeds

Journal of Women in Educational Leadership

Leta Stetter Hollingworth gave what she had to human beings through her life as a poet, a scholar, a researcher, a feminist, an educational psychologist, and a powerful advocate for gifted children. Leta was born on a homestead near Chadron, Nebraska, on May 25, 1886. Her mother died when she was three years old, so she and her two younger sisters went to live with their maternal grandparents. When Leta was twelve, she and her sisters went to live with their father and stepmother in Valentine, Nebraska. After graduating from high school, she attended the University of Nebraska in Lincoln, …

Is Bayh-Dole Good For Developing Countries?: Lessons From The Us Experience, Arti K. Rai, Jerome H. Reichman, Robert Weissman, Amy Kapczynski, Robert Cook-Deegan, Bhaven N. Sampat, Anthony D. So Jan 2008

Is Bayh-Dole Good For Developing Countries?: Lessons From The Us Experience, Arti K. Rai, Jerome H. Reichman, Robert Weissman, Amy Kapczynski, Robert Cook-Deegan, Bhaven N. Sampat, Anthony D. So

Faculty Scholarship

Recently, countries from China and Brazil to Malaysia and South Africa have passed laws promoting the patenting of publicly funded research, and a similar proposal is under legislative consideration in India. These initiatives are modeled in part on the United States Bayh-Dole Act of 1980. Bayh-Dole (BD) encouraged American universities to acquire patents on inventions resulting from government-funded research and to issue exclusive licenses to private firms, on the assumption that exclusive licensing creates incentives to commercialize these inventions. A broader hope of BD, and the initiatives emulating it, was that patenting and licensing of public sector research would spur …

Purpose: Platelet-derived growth factor (PDGF) is associated with corneal fibroblast migration and proliferation and plays an important role in corneal wound healing. However, the intracellular mechanisms of PDGF-mediated functions in corneal fibroblasts are poorly understood. We tested the hypothesis that PDGF functional activities in the cornea involve the Janus kinase-2/signal transducers and activators of transcription-3 (JAK2-STAT3) signaling pathway and whether PDGF induces the expression of suppressors of cytokine signaling 3 (SOCS3), belonging to the novel family of feedback regulators of cytokine and growth factor activities.

Methods: Human corneal fibroblast (HSF) cultures were used as an in vitro model for functional …

Hedonic Adaptation And The Settlement Of Civil Lawsuits, John Bronsteen, Christopher J, Buccafusco, Jonathan S. Masur Jan 2008

Hedonic Adaptation And The Settlement Of Civil Lawsuits, John Bronsteen, Christopher J, Buccafusco, Jonathan S. Masur

Faculty Scholarship

This Essay examines the burgeoning psychological literature on happiness and hedonic adaptation (a person's capacity to preserve or recapture her level of happiness by adjusting to changed circumstances), bringing this literature to bear on the probability of pretrial settlement in civil litigation. The existing economic and behavioral models of settlement are incomplete because they do not incorporate the effect of adaptation on the sum for which a plaintiff is willing to accept an offer. When an individual first suffers a serious injury, she will likely predict that the injury will greatly diminish her future happiness. However, during the time that …

State Domas, Neutral Principles, And The Möbius Of State Action, Darrell A. H. Miller Jan 2008

State Domas, Neutral Principles, And The Möbius Of State Action, Darrell A. H. Miller

Faculty Scholarship

This essay uses the Mobius strip as a mathematical metaphor for how state "defense of marriage amendments" (DOMAs) can twist the Shelley v. Kraemer contribution to state action doctrine. It argues that Shelley's core insight -- that judicial enforcement of private agreements can constitute state action and must meet federal Fourteenth Amendment commands -- can be used by state judiciaries to hold that state judicial enforcement of private agreements between same sex-couples is a species of state action forbidden by state DOMA. As explored in this essay, the potential doctrinal contortion of Shelley by state DOMAs is at once a …

Pathways Across The Valley Of Death: Novel Intellectual Property Strategies For Accelerated Drug Discovery, Arti K. Rai, Jerome H. Reichman, Paul F. Uhlir, Colin Crossman Jan 2008

Pathways Across The Valley Of Death: Novel Intellectual Property Strategies For Accelerated Drug Discovery, Arti K. Rai, Jerome H. Reichman, Paul F. Uhlir, Colin Crossman

Faculty Scholarship

Drug discovery is stagnating. Government agencies, industry analysts, and industry scientists have all noted that, despite significant increases in pharmaceutical R&D funding, the production of fundamentally new drugs - particularly drugs that work on new biological pathways and proteins - remains disappointingly low. To some extent, pharmaceutical firms are already embracing the prescription of new, more collaborative R&D organizational models suggested by industry analysts. In this Article, we build on collaborative strategies that firms are already employing by proposing a novel public-private collaboration that would help move upstream academic research across the valley of death that separates upstream research from …

Radiative Forcing: Climate Policy To Break The Logjam In Environmental Law, Jonathan B. Wiener Jan 2008

Radiative Forcing: Climate Policy To Break The Logjam In Environmental Law, Jonathan B. Wiener

Faculty Scholarship

This article recommends the key design elements of US climate law. Much past environmental law has suffered from four design problems: fragmentation, insensitivity to tradeoffs, rigid prescriptive commands, and mismatched scale. These are problems with the design of regulatory systems, not a rejection of the overall objective of environmental law to protect ecosystems and human health. These four design defects raised the costs, reduced the benefits, and increased the countervailing risks of many past environmental laws. The principal environmental laws successfully enacted since the 1990s, such as the acid rain trading program in the 1990 Clean Air Act (CAA) Amendments …

Mitochondrial Cob And Cox1 Genes And Editing Of The Corresponding Mrnas In Dinophysis Acuminata From Narragansett Bay, With Special Reference To The Phylogenetic Position Of The Genus Dinophysis, Huan Zhang, Debashish Bhattacharya, Lucie Maranda, Senjie Lin Jan 2008

Mitochondrial Cob And Cox1 Genes And Editing Of The Corresponding Mrnas In Dinophysis Acuminata From Narragansett Bay, With Special Reference To The Phylogenetic Position Of The Genus Dinophysis, Huan Zhang, Debashish Bhattacharya, Lucie Maranda, Senjie Lin

Graduate School of Oceanography Faculty Publications

Dinophysis acuminata cells were isolated from Narragansett Bay water samples in June 2005 using flow cytometry. Dinoflagellate-specific PCR primers were used to isolate small-subunit rRNA (18S rRNA), mitochondrial cytochrome b (cob), and cytochrome c oxidase I (cox1) genes and the encoded cDNAs. Maximum-likelihood analysis of a concatenated data set of ribosomal DNA and cDNA sequences of cob and cox1 showed that D. acuminata was sister to Gonyaulacoids, but without strong bootstrap support. The approximately unbiased test could not reject alternative positions of D. acuminata. To gain better resolution, mRNA editing of cob and cox1 was …

Incorporating Cooperative Learning Activities Into Traditional Aerospace Engineering Curricula, Abraham Mathew, David B. Spencer Jan 2008

Incorporating Cooperative Learning Activities Into Traditional Aerospace Engineering Curricula, Abraham Mathew, David B. Spencer

Journal of Aviation/Aerospace Education & Research

Active learning is a term used to describe programs where students learn by doing. In active learning programs, students work on projects where they use their theoretical classroom knowledge in real-world, hands-on activities. The activities range from single person projects to larger, complex, team oriented programs. In many programs the students work on actual hardware and software, many times similar to those used in industry. Many of the methods and techniques in active learning, such as time management and cost control are also similar to that of industry. A benefit of these types of projects is that the students cannot …

On June 10–12, 2007, Harvey Mudd College hosted A Conference on the Art of Teaching Mathematics. The conference brought together approximately thirty mathematicians from the Claremont Colleges, Denison, DePauw, Furman, Middlebury, Penn State, Swarthmore, and Vassar to explore the topic of teaching as an art. Assuming there is an element of artistic creativity in teaching mathematics, in what ways does it surface and what should we be doing to develop this creativity?

Superior Adaptation To Drought In Rubus Armeniacus (Himalayan Blackberry) In Northwest Oregon, J. Alan Yeakley, Joshua S. Caplan

Environmental Science and Management Faculty Publications and Presentations

Despite the status Rubus armeniacus (Himalayan blackberry) has as one of the most prolific and damaging plant invaders in the Pacific Northwest, we know little about the role of water relations in its success. The information available on invasive blackberry water relations (Fotelli et al. 2001; McDowell and Turner 2002) suggests that an ability to avoid water stress has been critically important to their proliferation in regions with Mediterranean climates (Amor et al. 1998). We had two objectives regarding the role of water relations in the invasive success of R. armeniacus:

Objective 1. Determine if R. armeniacus is better adapted …
