Jury Nullification: An Empirical Perspective, Irwin A. Horowitz
Jury Nullification: An Empirical Perspective, Irwin A. Horowitz
Northern Illinois University Law Review
Prominent jurists have suggested that it may be permissible to inform juries of their power to decide verdicts according to their conscience, regardless of the law. Juries may be informed of their power, known as jury nullification, to nullify the law either by carefully crafted instructions from the judge or by permitting the defense counsel to make a nullification argument during closing statements. This article examines these proposals in light of the latest empirical research on these issues. This article also presents a short history of jury nullification and its current status in the U.S. legal system. Current research suggests …
People V. Coughlin And Criticisms Of The Criminal Jury In Late Nineteenth-Century Chicago, Eizabeth Dale
People V. Coughlin And Criticisms Of The Criminal Jury In Late Nineteenth-Century Chicago, Eizabeth Dale
Northern Illinois University Law Review
The last decades of the nineteenth century and the first decades of the twentieth century are often described as the era in which the criminal jury trial came to an end. Criminal juries did not completely disappear, of course, but their role became smaller in those decades. Studies of the phenomenon typically attribute that decline to the rise of plea bargains in that same period. These studies note that institutional factors, such as caseloads and the political pressure on elected prosecutors to be "tough on crime," made plea bargains an increasingly attractive option for the State, and conclude from this …

Is There A Perception Of A Glass Ceiling? The Relationship Between Gender And Promotional Opportunities, Cassandra L. Matthews
Is There A Perception Of A Glass Ceiling? The Relationship Between Gender And Promotional Opportunities, Cassandra L. Matthews
Sociology & Criminal Justice Theses & Dissertations
This thesis is an exploratory study which examines the perceptions of a glass ceiling for females employed in the field of corrections. Interviews with fourteen women who are or have worked in various job rankings in the correctional field provided the data for this study. Participants described their perceptions of barriers facing women seeking a promotion. Themes identified include the balance between their career and their home life, personal encounters with sexual harassment and the amount of interaction with other males and females while employed in the correctional setting.
This research addresses two central research questions: 1. Is there a …

Recent Developments In Transnational Human Rights Litigation: A Postscript To Torture As Tort, Francois Larocque
Osgoode Hall Law Journal
Torture as Tort: Comparative Perspectives on the Development of Transnational Tort Litigation marked the first in-depth inquiry by non-US scholars into transnational human rights litigation. In this article, the author canvasses a range of new developments in the field since its publication in 2001. Of special note are five transnational human rights claims, decided after September 11, that were brought in Canadian and British courts. The author mines these cases for insights into other important developments involving the American Alien Tort Statute (Part I) corporate complicity in human rights abuses (Part II) the expansion of common law jurisdiction to include …

Purloined Voices: Edgar Allan Poe Reading Samuel Taylor Coleridge, Alexander M. Schlutz
Purloined Voices: Edgar Allan Poe Reading Samuel Taylor Coleridge, Alexander M. Schlutz
Publications and Research
This essay unfolds the complex intertextual relationship between the work of Samuel Taylor Coleridge and that of Edgar Allan Poe. References to and extended borrowings from Coleridge’s poetry and philosophical texts mark Poe’s œuvre throughout, but – as is only fitting for borrowings from the great borrower Coleridge – they are never anything as simple as plagiarisms or acts of intellectual theft. As this piece demonstrates through readings of Poe’s early poetological text “Letter to B–,” the Dupin story “The Purloined Letter,” and the late tour-de-force prose-poem Eureka, tracing the recurrence of Coleridgean poetry and prose in the work …

Eyewitness Identification Reform In Massachusetts, Stanley Z. Fisher
Eyewitness Identification Reform In Massachusetts, Stanley Z. Fisher
Faculty Scholarship
This article traces the impact of the new scientific learning upon police eyewitness identification procedures in the Commonwealth of Massachusetts. Over the past 25 years, experimental psychologists have devised more reliable techniques for gathering eyewitness identification evidence than have been traditionally used by police. Massachusetts has over 350 autonomous municipal police departments, plus approximately 39 college campus police departments, the state police, and the MBTA (transit) Police Department. The decision how to investigate crime rests principally with the police chief responsible for each department. How does such a system of policing absorb new, scientifically superior methods of investigation?

From Kneecappings Toward Peace: The Use Of Intra-Community Dispute Resolution In Northern Ireland, Patrick Cody
From Kneecappings Toward Peace: The Use Of Intra-Community Dispute Resolution In Northern Ireland, Patrick Cody
Journal of Dispute Resolution
Violence has been a way of life in Northern Ireland for many years as communities were divided by separate warring paramilitary factions. Each side believed that it existed for the benefit and protection of the local community against the forces on the other side. The Irish Republican Army ("IRA") pledged itself to the defense of Northern Irish Catholics from persecution by those loyal to the British government. Similarly, groups such as the Ulster Volunteer Force ("UVF") and the Ulster Defense Association ("UDA") formed to defend Protestant citizens against IRA attacks. Policing of local neighborhoods fell largely to these groups. Enforcement …

This study provides a method for comparing six individual human dentition characteristics using the standard measuring tool in Adobe Photoshop CS2 as compared to measuring individual characteristics with an automated software program under development at Marquette University, which has been adapted for bitemark analysis. The algorithm identifies color-specific pixels and automatically calculates the measurements.

The Nature Of K-12 Teacher Need Through 2050: A Demographic Investigation Of The Teacher Shortage Crisis In The United States, Rebecca M. Mullen
Sociology & Criminal Justice Theses & Dissertations
In this paper, I outlined research regarding a so-called "crisis" in K-12 education in the United States, which refers to an alleged shortage of teachers that is manifesting and will continue to manifest itself in the near future. I then used a modified version of the cohort component analysis to project the number of teachers needed to project the number of a) students who will be enrolled in public or private K-12 education in the united states, b) teachers needed to maintain the student to teacher ratio in the United States as of the year 2000, 16.0, by benchmark year …

The California Commission on the Fair Administration of Justice was created by the California State Senate in 2004 to “study and review the administration of criminal justice in California, to determine the extent to which that process has failed in the past” and to examine safeguards and improvements. The Commission completed its work on June 30, 2008 in Sacramento by delivering a report on the fair administration of the death penalty in California to the Legislature and the Governor.

Parenting From Prison: Family Relationships Of Incarcerated Women In Massachusetts, Erika Kates, Sylvia Mignon, Paige Ransford
Publications from the Center for Women in Politics and Public Policy
Historically in the United States, there has been little concern about the needs of incarcerated women and their family members, especially children. This began to change with the tremendous increase in the number of incarcerated women. The rate of women’s incarceration increased dramatically during the 1980s and today the number of female inmates continues to rise faster than the number of male inmates. In 1986, 19,812 women were incarcerated in the United States and this number rose in 1991 to 38,796. Today, over 112,000 women are incarcerated in state or federal facilities (Sabol et al., 2007; Snell 1994). While in …
