Duress, Demanding Heroism, And Proportionality, Luis E. Chiesa Jan 2008

Duress, Demanding Heroism, And Proportionality, Luis E. Chiesa

Vanderbilt Journal of Transnational Law

This Article discusses the Erdemovic case in order to examine whether duress should be a defense to a crime against humanity. Although the Article contends that the arguments in favor of permitting the defendant to claim duress weaken as the seriousness of the offense charged increases, the Article also argues that the duress defense should usually succeed if it can be proved that the actor could not have prevented the threatened harm by refusing to capitulate to the coercion.

After balancing the competing considerations, the Author concludes that the defendant in Erdemovic should have been able to claim duress as …

Review Of The Social And Emotional Wellbeing Of Indigenous Australian Peoples, Darren Garvey Jan 2008

Review Of The Social And Emotional Wellbeing Of Indigenous Australian Peoples, Darren Garvey

Research outputs pre 2011

The first case of diabetes among Indigenous people was recorded in Adelaide in 1923. Records prior to this time showed that Indigenous people were fit, lean, and did not suffer from any form of metabolic condition, which were largely believed to be a characteristic of European populations. The earliest detailed studies investigating the development of diabetes in Indigenous populations were not undertaken, however, until the early 1960s. These and subsequent studies found a significant correlation between the development of a ‘westernised’ lifestyle and the levels of type 2 diabetes in the Indigenous population.

Since that time, type 2 diabetes has …

Research outputs pre 2011

All organisations, whether in the public or private sector, increasingly use computers and other devices that contain computer hard disks for the storage and processing of information relating to their business, their employees or their customers. Individual home users also increasingly use computers and other devices containing computer hard disks for the storage and processing of information relating to their private, personal affairs. It continues to be clear that the majority of organisations and individual home users still remain ignorant or misinformed of the volume and type of information that is stored on the hard disks that these devices contain …

Slipping Through The Cracks And Into Schools: The Need For A Uniform Sexual Predator Tracking System, Cheryl Page Jan 2008

Slipping Through The Cracks And Into Schools: The Need For A Uniform Sexual Predator Tracking System, Cheryl Page

Journal Publications

Over half a million registered sex offenders currently live in the United States. Sex offenses are among the most devastating crimes because of the long-lasting emotional, physical, and psychological effects it has on victims. Sadly, most victims of sex offenses are innocent children. "Most sex offenders are not in prison, and ... are largely unknown to people in the community." Sex offenders also have a propensity for reoffending their crimes. "While community supervision and oversight is widely recognized as essential, the system for providing such supervision is overwhelmed." There are many loopholes in the current system that allow sex offenders …

The Effect Of Collective Bargaining On The Use Of Innovative Police Policy, Kyle Christopher Veatch Jan 2008

The Effect Of Collective Bargaining On The Use Of Innovative Police Policy, Kyle Christopher Veatch

All Volumes (2001-2008)

While there have been numerous studies examining certain aspects of the effects of collective bargaining, there have yet to be any empirical studies on the effects of collective bargaining on the use of police policy. This study looks to address this issue by examining the impact of collective bargaining on the use of three currently innovative police policies: early warning systems, civilian review boards, and the use of in-car cameras. Using data from the 2003 Law Enforcement Management and Administrative Statistics (LEMAS) survey, we look at municipal agencies with over 100 officers. Using bi-variate analyses we compare each of the …

Social Science And The Evolving Standards Of Death Penalty Law, Samuel R. Gross, Phoebe C. Ellsworth Jan 2008

Social Science And The Evolving Standards Of Death Penalty Law, Samuel R. Gross, Phoebe C. Ellsworth

Book Chapters

Unlike many of the topics covered in this book, death penalty litigation involves a wide variety of empirical issues. The Eighth Amendment of the U.S. Constitution provides that "Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishment inflicted." But what is a "cruel and unusual punishment?" It could be a punishment that is morally unacceptable to the American people, like cutting off noses or hands. Following the other clauses of the amendment, it could be a punishment that is excessive, in that a lesser penalty would achieve the same ends. For example, if a …

Evaluating The Serious And Violent Offender Reentry Initiative Within And Across The New England Region, Jessica A. Parent Jan 2008

Evaluating The Serious And Violent Offender Reentry Initiative Within And Across The New England Region, Jessica A. Parent

Master's Theses and Capstones

The reentry of inmates back into the community is a hotly debated topic in society today. A descriptive study was conducted to analyze what mental health services were being provided to inmates who were participants in the Serious and Violent Offender Reentry Initiative (SVORI). Additionally, barriers to implementing comprehensive mental health services, along with trends within and across the New England Region regarding mental health services were examined. The data collected was from three program evaluation surveys completed by Project Directors for SVORI in 2003, 2005, and 2006. The results indicate that the mental health services provided to SVORI participants …

Condemning Our Youth To Lives As Criminals:Incarcerating Children As Adults, Chelsea Dunn Jan 2008

Condemning Our Youth To Lives As Criminals:Incarcerating Children As Adults, Chelsea Dunn

Richmond Journal of Law and the Public Interest

Underlying the juvenile court system are two competing philosophies of justice which have taken predominance over the system at different historical periods in relation to the public climate. Early reformers conceptualized juvenile justice as an informal and protective system that would seek to rehabilitate disadvantaged children who had succumbed to criminal influences. In response to negative assessments noting the leniency of juvenile courts, critics began to advocate for a more punitive system which would focus on retribution rather than treatment. Measures adopted by courts to increase the criminal responsibility placed upon juveniles include minimum sentencing guidelines and transfer of offenders …

Richmond Journal of Law and the Public Interest

Virginia is one of 12 states in the United States that does not automatically restore the right to vote to all felons who have completed their sentences. Dna Is Different:Implications Of The Public Perception Ofdna Evidence On Police Interrogation Methods, Christine D. Salmon Jan 2008

Dna Is Different:Implications Of The Public Perception Ofdna Evidence On Police Interrogation Methods, Christine D. Salmon

Richmond Journal of Law and the Public Interest

These reform proposals have been met with vehement criticism, most of which stem from a concern that any attempt to prohibit or regulate deceptive interrogation methods would decrease the number of confessions and convictions produced by the criminal justice system. With these concerns in mind, this article proposes a different, more moderate reform: a per se ban on the falsification of DNA evidence during police interrogations. This proposal differs from those described above in three important ways. First, the prohibition on fabricating DNA evidence does not require a change in the voluntariness test used to ascertain the admissibility of a …

Mental Health In Virginia, Phillip Hamilton Jan 2008

Mental Health In Virginia, Phillip Hamilton

Richmond Journal of Law and the Public Interest

Since the April 16, 2007 tragedy at Virginia Tech, the public's attention has focused on Virginia's mental health system. Like far too many public policy issues that face the government, it often takes a tragedy to bring an issue to the point where real action is taken. Over the years, one of the major issues facing Virginia has been how to best meet the needs of its citizens requiring mental health services. This is not a new issue. Since 1949 there have been many studies of Virginia's mental health system. These studies have emphasized the same issues over and over …

Dui Gilt Pl8: An Evaluation Of The Proposed Shaming Sanction For Multiple Dui Offenders, Theresa M. Young Jan 2008

Dui Gilt Pl8: An Evaluation Of The Proposed Shaming Sanction For Multiple Dui Offenders, Theresa M. Young

Richmond Journal of Law and the Public Interest

This comment seeks to analyze House Bill 1281 in the larger social context of shaming sanctions. It begins by tracing a brief history of offender punishment from the common use of shaming mechanisms to their disappearance and gradual resurgence. It further looks to the theoretical foundations of such alternative sanctions, as well as their potential effects on both individual conduct and social norms. Finally, it looks at the relationship between other approaches to DUI convictions and the methods proposed in Virginia.
