How The Courts Opened The Door To Impeaching Criminal Defendants With Prior Convictions, Jeffrey Bellin

This Article spotlights the flawed analytical framework at the heart of the federal courts' approach to one of the most controversial trial practices in American criminal jurisprudence - the admission of prior convictions to impeach the credibility of defendants who testify. As the Article explains, the flawed approach is a byproduct of the courts' reliance on a five-factor analytical framework to implement the governing legal standard enacted by Congress in Federal Rule of Evidence 609. Tracing the evolution of the five-factor framework from its roots in pre-Rule 609 case law, the Article demonstrates that the courts' reinterpretation of the framework …

In Part I, this Article presents the first published, worldwide survey of international practice in interpreting and applying various international human rights norms to the issue of sexual freedom, with a special emphasis on the rights to privacy, family life, and freedom from arbitrary discrimination based on sexual orientation. Although progress toward general recognition of such rights by international authorities and states has been extremely rapid over a very short period, such recognition continues to vary geographically and according to the subject matter. Pathways To Prison: Impact Of Vicitimization In The Lives Of Incarcerated Women, Dana Dehart

This study examined ways in which victimization may contribute to criminal involvement among incarcerated women. We conducted interviews with 60 women in a maximum securtiy prison to gather each woman's perspective on psychological, physical, and sexual victimization in her life. Qualitative analyses indicated ways that victimization related directly to women's crimes as well as influenced health, psychosocial functioning, or systemic involvement to create difficult situations with which the women struggled. Case histories are used to illustrate pervasive impacts of victimization, and role of multiple traumas and cumulative impact are discussed.

Dimensions Of Genocide: The Circumplex Model Meets Violentization Theory, Mark A. Winton

The Qualitative Report

The purpose of this study is to examine the use of Olson’s (1995, 2000) family therapy based circumplex model and Athens’ (1992, 1997, 2003) violentization theory in explaining genocide. The Rwandan genocide of 1994 is used as a case study. Published texts, including interviews with perpetrators, research reports, human rights reports, and court transcripts were analyzed. The use of both theories was consistent with the data and resulted in a greater understanding of the genocide. Rwanda moved to a rigidly enmeshed society during the genocide with the perpetrators going through the violentization process. Suggestions for further research are provided.

This research presents a new and unique technique called SÁDI, statistical analysis data identification, for identifying the type of data on a digital device and its storage format based on data type, specifically the values of the bytes representing the data being examined. This research incorporates the automation required for specialized data identification tools to be useful and applicable in real-world applications. Technologically Assisted Intervention (Tai): Are Clients Satisfied With Online Therapy?, Jennifer A. Morrow

This study examined the level of satisfaction reported by participants of a technologically assisted intervention study (TAI). TAI is a type of teletherapy done through online, live video conferencing. Satisfaction was examined at three different time points, post therapy, 3-months post therapy, and 6-months post therapy. Analyses examined if there were any changes in reported satisfaction over the three time periods. Participants received cognitive behavioral therapy (CBT) targeted at reducing symptoms of mild to moderately severe depression. A satisfaction measure was developed for this study, and included quantitative and qualitative items which were analyzed to determine participants' level of satisfaction. …

Defendants in criminal cases are overwhelmingly more likely to plead guilty than to go to trial. Presumably, at least a part of the reason that most of them do so is that it is in their interest to plead guilty, i.e., they will receive a more favorable outcome if they plead guilty than if they go to trial. The extent to which pleas reflect fair or rational compromises in practice, however, depends upon a variety of factors, including the amount of information each of the parties has about the case. This is an inquiry that explores the cross-generational lived affects of educational, political, and public policies on my paternal family from 1899 to the present in Northern Mississippi and West Tennessee. It is an exploration of my family's history and my lived experience as the first person in the family to obtain an undergraduate degree, a graduate degree, and a doctorate, who has attempted to use education in a substantive way to break the cycle of generational poverty. Members of six generations of my family are the main characters in the stories collected. Using oral history, I document their experiences. …

This Article responds to the numerous critics of Daniel J Seidmann & Alex Stein, The Right to Silence Helps the Innocent: A Game-Theoretic Analysis of the Fifth Amendment Privilege, 114 HARV. L. REV. 430 (2000). Under Seidmann and Stein's theory, the right to silence protects innocents who find themselves unable to corroborate their self-exonerating accounts by verifiable evidence. Absent the right, guilty criminals would pool with innocents by making false self-exonerating statements. Factfinders would consequently discount the probative value of all uncorroborated exculpatory statements, at the expense of those innocents who cannot corroborate their true accounts.
