How To Escape Modernity?: An Actor-Network Theory Take On Organizational Forming, Paul Donnelly Jan 2008

How To Escape Modernity?: An Actor-Network Theory Take On Organizational Forming, Paul Donnelly

Conference papers

The topic of organizational form has been gaining increased attention. Often portrayed as ‘new times’ driving the need for new forms, what is more evident in the literature is that the need for new ways of looking at form has yet to be addressed. The problem that “new organizational form” presents is precisely located in the inability of the field to think in other than “form” itself. By problematizing the focus on “form,” I take issue with the largely ahistorical and aprocessual character of much organizational theorizing and with the privilege obtained by modernist paradigmatic approaches in such theorizing. With …

Anglo-American And Continental Systems: Marsupials And Mammals Of The Law., Richard O. Lempert

Book Chapters

When Peter Tillers invited me to participate in this festschrift for Mirjan Damaška, I proposed to write a short concluding essay reviewing the articles in this volume and drawing links between them. Perhaps I should have anticipated that this would be no easy task, and maybe even have foreseen that it was an assignment I would eventually shun. I should have known that there would not be the six to eight articles I anticipated but the 17 that have been submitted. Had I thought more, I would have realised that there would be many people, myself included, who would seek …

Methinks The Lady Doth Protest Too Little: Reassessing The Probative Value Of Silence, Mikah K. Thompson Jan 2008

Methinks The Lady Doth Protest Too Little: Reassessing The Probative Value Of Silence, Mikah K. Thompson

Faculty Works

The syllogism goes as follows: major premise - Innocent people proclaim their innocence in response to an accusation; minor premise - Defendant failed to respond to an officer's accusation that he killed his wife; conclusion - Defendant is guilty of killing his wife. This syllogism is the basis upon which courts and lawmakers allow a defendant's silence to be admitted into evidence as proof of guilt. They reason that it is quite appropriate for jurors to infer that innocent people would proclaim their innocence and, therefore, a defendant's decision not to speak constitutes evidence of his or her guilt.

Contract Enslavement Of Female Migrant Domestic Workers In Saudi Arabia And The United Arab Emirates, Romina Halabi Jan 2008

Contract Enslavement Of Female Migrant Domestic Workers In Saudi Arabia And The United Arab Emirates, Romina Halabi

Human Rights & Human Welfare

Slavery was not abolished in Saudi Arabia until 1962, and in the United Arab Emirates (UAE) until 1963. It is unsurprising, then, that contract slavery of domestic servants continues to thrive in much of the Persian Gulf, where local economies prosper on the immigration of foreign workers. Economic incentives on the part of the sending and receiving nations encourage the migration of female workers from their home countries to Saudi Arabia and to the UAE. These incentives, coupled with restrictive contract systems, bind the female domestic worker to her employer and create an environment conducive to exploitation and involuntary servitude.

“Civil Discourse Under Fire” You probably won’t see the above words as a headline in your morning newspaper any time soon, but it’s happening nonetheless. Civil discourse seems to be in trouble. The art of respectful argument and the effort to find mutual solutions seem to be losing ground. Our public debates on critical issues are filled with sound bites instead of substance, and our popular culture seems motivated more by the desire to dominate and win than by the commitment to learn, understand, seek common ground, or persuade. There’s trouble in the Academy too. Faculty members are challenged for …

Entrepreneurship And Self-Employment: The State-Of-The-Art And Directions For Future Research, Giseung Kim

New England Journal of Entrepreneurship

This survey overviews the literature on entrepreneurship and self-employment. The author catalogs the main contributions of this body of research and makes a distinction between issues on which there is now widespread agreement and those for which no consensus has yet emerged. This latter set of issues provides fertile ground for further research.

Separated At Birth: An Inquiry On The Conceptual Independence Of The Entrepreneurship And The Leadership Constructs, Richard C. Becherer, Mark Mendenhall, Karen Ford Eickhoff

New England Journal of Entrepreneurship

Entrepreneurship and leadership may flow from the same genealogical source and the appearance of separation of the two constructs may be due to differences in the contexts through which the root phenomenon flows. Entrepreneurship and leadership are figuratively different manifestations of the need to create. To better understand the origin of entrepreneurship and leadership, research must first focus on the combinations or hierarchy of traits that are necessary, but perhaps not sufficient, to stimulate the two constructs. Factors that trigger a drive to create or take initiative within the individual in the context of a particular circumstance should be identified, …

Superintendent In Action: A Qualitative Study Of An African -American Female Superintendent, Janice M. Kennedy Jan 2008

Superintendent In Action: A Qualitative Study Of An African -American Female Superintendent, Janice M. Kennedy

Doctoral Dissertations

Remarkably few females hold the position of superintendent of schools; although, there are capable women in the educational field who are qualified and interested in obtaining the position of superintendent of schools. Researchers proposed many reasons for this disparity, including the lack of studies regarding females in the superintendency. This research study sought to determine how one African-American female entered the male dominated executive position to become superintendent of a large school district in a southern state.

The following research questions were used to determine how this African-American female constructed her understanding of her leadership role through the lenses of …

Rifton Finns: An Ethnic Enclave In Ulster County, New York, Mika Roinila Jan 2008

Rifton Finns: An Ethnic Enclave In Ulster County, New York, Mika Roinila

Ethnic Studies Review

When you begin to consider the Finns of New York State, there are two obvious foci that have received the majority of attention in the ethnic literature. The presence of some estimated 20,000 Finns in New York City during the 1920s provided a large population with its myriad cultural, religious and social organizations and activities. The heyday of the large Finnish population has passed, and as of 2000, a total of 3,466 Finns lived in New York City.1 This number remains the highest population within the state. Due to this large population size, much has been written about their existence, …

Artisans And The Marketing Of Ethnicity: Globalization, Indigenous Identity And Nobility Principle In Micro-Enterprise Development, Robin M. Chandler Jan 2008

Artisans And The Marketing Of Ethnicity: Globalization, Indigenous Identity And Nobility Principle In Micro-Enterprise Development, Robin M. Chandler

Ethnic Studies Review

As a constructed category of human difference, 'ethnicity' has given way to 'culture' in its shared genealogy in the new millennium. Public knowledge about such phenomena as 'ethnic cleansing', debates on immigration, and the use of ethnicity as both a dependent and independent variable in research and policy are central realities in the domestic and foreign policies of many nations. The social psychology of group affiliation, nationalism, and the use of ethnicity (as well as gender) in workplace diversity, or the deployment of ethnicity in electoral politics continues to perplex and complicate human social interaction.

Fire In De Cane: Metaphors Of Indo Trinidadian Identity In Ramabai Espinet's The Swinging Bridge, Rosanne Kanhai Jan 2008

Fire In De Cane: Metaphors Of Indo Trinidadian Identity In Ramabai Espinet's The Swinging Bridge, Rosanne Kanhai

Ethnic Studies Review

The evolution of identity is on-going, yet to articulate identity is the self analysis of a people's understanding of who they are at a particular time. Perhaps in more stable societies, identity has not been a preoccupation, not the "stuff" of literature and other types of art. However, for us, in the western hemisphere, where indigenous populations have been brutally decimated and room made for more brutality in the uprootment, transportation and relocation of peoples from different parts of the globe, we find it a crucial to pause and understand who we are as we connect with each other. In …

Perception On The Innovative Characteristics Of Small And Medium Enterprises (Smes) Manufacturing Firms In Peninsular Malaysia., A.Z. Yahya, R. Mail, M.S. Othman, M.S. Ibrahim

Research Publications (2006 to 2010)

The main purpose of the paper is to attempt to explore the perception on the innovative characteristics of SMEs manufacturing firms based on three dimensions of a business: strategy, process and ways of working (culture). A survey of 60 Peninsular Malaysia-based manufacturing SMEs was conducted. In this study, a definition of innovation was established based on past studies and a systematic approach to measure company innovativeness was adopted. Ten indicators were used to measure company innovativeness. The top 20 per cent firms were compared with bottom 80 per cent firms in terms of product innovation management, process and work organisation. …

Extending Prevention Of Mother-To-Child Transmission Through Postpartum Family Planning In Lesotho, Charlotte E. Warren, Semakaleng Phafoli, Bosielo Majara, Thato Tsukuluet

Reproductive Health

Recognizing the need to improve the care and follow up of mothers and infants in the postpartum period, the Lesotho Ministry of Health and Social Welfare (MOHSW), with technical support from the Frontiers in Reproductive Health (FRONTIERS) of Population Council and funding from PEPFAR/RHAP/USAID, carried out an operations research project to strengthen the existing postpartum care services. This study had a specific focus on strengthening linkages with existing PMTCT follow-up and family planning services during the postpartum period by changing the number, timing, and content of postpartum consultations that a woman and her newborn should receive. The key findings indicated …

Reconstruction: Studies in Contemporary Culture

[First paragraph]

A couple of years ago, a fleeting "scandal" flickered across the pages of the British tabloid press. Through a combination of coincidence and British Data Protection laws, a woman acquired a copy of her own – formerly confidential – medical records. It transpired that her General Practioner (family doctor) had covertly recommended she be sterilized, following multiple pregnancies by different fathers. Needless to say, as the target of these recommendations, she was outraged, taking her story to The Sun, Britain's bestselling newspaper (July 21, 2006). In turn, the tabloid transformed her individual fury by redirecting hostilities towards …

Predicting Public Opinion About Juvenile Waivers, I-Fang Jan, Jeremy Ball, Anthony Walsh Jan 2008

Predicting Public Opinion About Juvenile Waivers, I-Fang Jan, Jeremy Ball, Anthony Walsh

Criminal Justice Faculty Publications and Presentations

The accountability movement of the juvenile justice system in the late 1980s and early 1990s encouraged more punitive practices by juvenile justice professionals. Public opinion was strong during this time. The attitudes about the juvenile justice system are a product of individual demographic, cultural, and political characteristics. This study addresses opinions about juvenile waivers–a punitive sanction–examining data from the National Opinion Survey of Crime and Justice in the 1990s (see Flanagan, 1996). This study analyzes attitudes about juvenile waivers, using multivariate quantitative methods. The results indicate a consistent relationship between the perception of the sentencing goals of the juvenile court …

Attachment Styles And Male Sex Addiction, James L. Zapf, Jay Greiner [email protected], James Carroll

Walden Faculty and Staff Publications

This study addresses the adult romantic attachment styles of sexually addicted men. The Sexual Addiction Screening Test and the Experiences in Close Relationships Revised were used to determine the presence of a sexual addiction and the participants’ style of romantic attachment. ANOVA revealed that sexually addicted men are more likely to relate with insecure attachment styles. Specifically, sexually addicted men were found to have higher anxiety F(1, 38) = 6.122, p < .05 and avoidance F(1, 37) = 4.685, p < .05 in their romantic relationships. Treatment for male sexual addicts should address both addiction and relationship insecurity.

Taking Stock: Adr Responses In Post-Disaster Situations, Maria R. Volpe Jan 2008

Taking Stock: Adr Responses In Post-Disaster Situations, Maria R. Volpe

Cardozo Journal of Conflict Resolution

As the use of innovative dispute resolution processes becomes more widespread and diverse, it is understandable and perhaps even inevitable that dispute resolvers will continue to explore ways to apply their knowledge, skills, and expertise in new and challenging settings. One of the contexts that dispute resolvers have paid increasing attention to since September 11th has been post-disaster situations. Despite this observation, however, dispute resolution experts continue to struggle with how to respond. While many professions, particularly those which provide emergency or essential rescue, evacuation, recovery, relocation, repair, rebuilding, and survival-related services have readily identified roles in post disaster situations, …
