Women In History - Leta Stetter Hollingworth: Educator And Advocate For Gifted Children, Jan Deeds
Journal of Women in Educational Leadership
Leta Stetter Hollingworth gave what she had to human beings through her life as a poet, a scholar, a researcher, a feminist, an educational psychologist, and a powerful advocate for gifted children. Leta was born on a homestead near Chadron, Nebraska, on May 25, 1886. Her mother died when she was three years old, so she and her two younger sisters went to live with their maternal grandparents. When Leta was twelve, she and her sisters went to live with their father and stepmother in Valentine, Nebraska. After graduating from high school, she attended the University of Nebraska in Lincoln, …

Entrepreneurial Spirit In Government Managed Enterprises: Evidence From The U.S. General Aviation Airports, Vitaly S. Guzhva, Massoud Bazargan, David A. Byers
Entrepreneurial Spirit In Government Managed Enterprises: Evidence From The U.S. General Aviation Airports, Vitaly S. Guzhva, Massoud Bazargan, David A. Byers
Management, Marketing and Operations - Daytona Beach
While a number of studies introduce entrepreneurship in the public sector, there is still a need for empirical research in this field. We use a survey of U.S. general aviation airport managers to investigate the benefits of entrepreneurial spirit in public sector management. The results of logistic regressions suggest that the airport managers’ beliefs in importance of self-sustainability significantly improve the likelihood of general aviation airports to be self-sustaining. On the other hand, the airport specific characteristics, such as a favorable location, county population, and others are not statistically significant in achieving self-sustainability. Our findings support the literature that argue …

Judicial Transparency In An Age Of Prediction, Adam M. Samaha
Judicial Transparency In An Age Of Prediction, Adam M. Samaha
Articles
The Empirical Legal Studies (ELS) movement is making strides toward understanding judicial behavior, and ELS models could become the foundation for more accurate prediction of judicial decisions. This essay raises two questions. First, what would an age of predictable judicial behavior look like? Second, would satisfying the informational needs of ELS prediction models also exhaust the demands for 'judicial transparency"? The essay concludes that a state of predictable judicial behavior, if somehow stable, would leave almost no litigation to observe; and that a prediction-oriented information policy would nearly meet the demands of today's transparency advocates. One shortfall involves the intrinsic …

Another Structure Of Knowledge Is Possible: The Social Forum Process And Academia, Sherman
Societies Without Borders
The author highlights how the World Social Forum (WSF), the annual meeting held by members of the anti-globalization or alter-globalization movement, has unexpected consequences for epistemology. He considers the possibilities opened by the emergence of the social forum process for the reconstruction of the structures of knowledge. By structures of knowledge, he means following the disciplinary organization and hegemonic approaches since the late nineteenth century in the social sciences.

The Heart Has Its Reasons: Examining The Strange Persistence Of The American Death Penalty, Susan A. Bandes
The Heart Has Its Reasons: Examining The Strange Persistence Of The American Death Penalty, Susan A. Bandes
Coase-Sandor Institute for Law & Economics Research Paper Series
The debate about the future of the death penalty often focuses on whether its supporters are animated by instrumental or expressive values, and if the latter, what values the penalty does in fact express, where those values originated, and how deeply entrenched they are. In this article I argue that a more explicit recognition of the emotional sources of support for and opposition to the death penalty will have salutary consequences for the clarity of the debate. The focus on emotional variables reveals that the demarcation between instrumental and expressive values is porous; both types of values are informed (or …

Combating The Color-Coded Confinement Of Kids: An Equal Protection Remedy, Perry L. Moriearty
Articles
This Article considers the viability of a constitutional challenge to the disproportionate confinement of juveniles of color – a phenomenon known as “disproportionate minority contact” or “DMC.” Specifically, I ask whether, in the wake of McCleskey v. Kemp and its progeny, it is possible bring an Equal Protection claim based on statistical evidence that juveniles of color are significantly more likely to be detained by juvenile court judges than similarly-situated white youth. I argue that the nature of the juvenile detention decision places it squarely within the contours of the types of administrative decisions for which the Supreme Court has …

HIV and AIDS
The International Center for Research on Women, the Muhimbili University College of the Health Sciences, the Population Council, and Family Health International conducted an evaluation of a community-based effort to reduce stigma surrounding HIV infections in a peri-urban community in Tanzania. Results presented a mixed, but hopeful, picture for a way forward in tackling stigma at the community level. Tackling stigma requires that the individuals tasked with doing this undergo personal change. Programs can start by focusing stigma-reduction efforts on a smaller, more manageable geographical area and adding specific anti-stigma components to their portfolio of activities. Engaging community opinion leaders …

A Slower Form Of Death: Implications Of Roper V. Simmons For Juveniles Sentenced To Life Without Parole, Barry C. Feld
A Slower Form Of Death: Implications Of Roper V. Simmons For Juveniles Sentenced To Life Without Parole, Barry C. Feld
Articles
The Supreme Court in Roper v. Simmons 1 interpreted the Eighth Amendment to prohibit states from executing offenders for crimes they committed when younger than eighteen years of age. The Court relied on objective indicators of "evolving standards of decency," such as state statutes and jury decisions to support its judgment that a national consensus existed against executing adolescents. The Justices also conducted an independent proportionality analysis of youths' criminal responsibility and concluded that their reduced culpability warranted a categorical prohibition of execution. Juveniles' immature judgment, susceptibility to negative peer influences, and transitory personality development diminished their criminal responsibility. Because …

Reproductive Health
FRONTIERS supported the Division of Reproductive Health and the National AIDS and STI Control Program of the Kenya Ministry of Health to design, implement, and compare two models of integrating counseling and testing (CT) for HIV within family planning (FP) services in terms of their feasibility, acceptability, cost, and effect on the voluntary use of CT, as well as the quality of FP services. The study demonstrated that both models were feasible and acceptable to providers and to clients as means of integrating and linking HIV prevention counseling, condom promotion, and counseling and testing with FP services, and are effective …

R. V. Bryan: The Supreme Court And The Electoral Process, Christopher D. Bredt, Margot Finley
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
This paper provides an overview of recent Supreme Court of Canada jurisprudence in the area of freedom of expression in the political context, focusing on Thomson Newspapers Co. v.Canada (Attorney General), Harper v. Canada (Attorney General) and R. v. Bryan. In R. v. Bryan, the Court was faced with a constitutional challenge under section 2(b) of the Charter to section 329 of the Canada Elections Act, which prohibits the transmission of election results in one electoral district to another electoral district before the close of all polling stations in that other district. A majority of the Court held that the …

Not My Father's Game: Immigration, Major League Baseball And The Dominican Republic, Marylyn Koble
Sociology & Anthropology Theses - Archive
Since the 1980's the number of Latino players, specifically, Dominicans, on major and minor league baseball teams has increased significantly. This demographic shift is due, in large part, to Major League Baseball (MLB) teams actively recruiting and developing Dominican players via the Dominican academy system. This thesis focuses on the process through which Dominican minor league baseball players are made into commodities by the global corporation of MLB. I examine the experiences of Dominican players as both baseball commodities and immigrants, comparing the challenges they face acculturating to American life with other Dominican immigrants in the North Texas area. A …

Archaeology And Nationalism : The Trojan Legend In Etruria, Valeria Forte
Sociology & Anthropology Theses - Archive
In this study, the role of archaeology in relation to national identity formation will be analyzed in one of the most debated archaeological subjects in the western world, the case of Etruscan origins. This study will demonstrate how through history the Etruscan legend has permeated the political reality at many levels and how this legend of provenience has been used to promote the formation of national identity and unified mythical ethnic origins. The ultimate purpose of this study is to demonstrate that what is accepted today as solid and objective cultural reality of the past might have been fluid expressions …

Sex On The Brain: The Rise And Fall Of German Sexual Science, Kevin S. Amidon Ph.D.
Sex On The Brain: The Rise And Fall Of German Sexual Science, Kevin S. Amidon Ph.D.
Modern Languages Faculty Publications
Throughout the 19th century, German medical, scientific and legal scholars found themselves puzzled and engaged by the diverse forms of human sexuality. Psychiatrists like Richard von Krafft-Ebing interested in explaining deviance encountered scientifically trained advocates for emancipation like Magnus Hirschfeld, and the result was the new – if unstable – discipline of sexual science. Because they based arguments for social intervention on knowledge of nature and the body, the field’s proponents – like the advocates of eugenics and racial hygiene – argued that they were biologists. After 1900, this mutual biological engagement of sexual science and eugenics revealed itself in …
What Happens To Countess Geschwitz? Revisiting Homosexuality In Horkheimer And Adorno, Kevin S. Amidon Ph.D.
What Happens To Countess Geschwitz? Revisiting Homosexuality In Horkheimer And Adorno, Kevin S. Amidon Ph.D.
Modern Languages Faculty Publications
In the philosophical and culture-critical works of Theodor Adorno and Max Horkheimer, the concept of homosexuality exists almost always in close textual relation to fascist domination. This is because they cannot see homosexual persons as existing outside the dominating discourses of the nineteenth-century bourgeois legal and psychiatric explication of homosexuality. This issue throws the stakes of ethical reflection in Critical Theory into high relief, especially since feminist thinkers including Judith Butler have recently provided a highly positive rereading of Adorno’s ethics. A close reading of Adorno’s exploration of Alban Berg’s opera Lulu further demonstrates the labile ethical and philosophical status …
