Ideological Endowment: The Staying Power Of The Electoral College And The Weaknesses Of The National Popular Vote Interstate Compact, Daniel P. Rathbun Jan 2008

Ideological Endowment: The Staying Power Of The Electoral College And The Weaknesses Of The National Popular Vote Interstate Compact, Daniel P. Rathbun

Michigan Law Review First Impressions

The National Popular Vote (“NPV”) movement is designed to eliminate the federalist impact of the Electoral College without amending the Constitution. By fashioning an interstate compact to grant participating states’ electoral votes to the winner of the national popular vote, NPV proponents suppose they can induce states to forfeit their electoral “weights” and replace the current, federalist election process with a fully majoritarian one. But by leaving the Electoral College in place, the NPV movement is setting itself up for a double pushback: first, in the form of immediate legal resistance, and second, through states’ long-term involvement in a meaningfully …

Deriving A Taxonomy Of Its Transition Costs, Zhi Tang, Delmonize Smith, Joanne Hale Jan 2008

Deriving A Taxonomy Of Its Transition Costs, Zhi Tang, Delmonize Smith, Joanne Hale

Articles

Those charged with implementing information technology often face the daunting task of assessing the total organizational costs of such initiatives. Our study posits evaluating such expenditures as IT transition costs - organizational resource expenditures stemming from a positive IT investment decision. A content analytic review of academic, IT-related articles yielded 57 cases germane to the construct. Data produced a meaningful and comprehensive taxonomy that distinguished IT transition costs by two dimensions: goal (prescriptive, evaluative, adaptive, corrective) and target (human, structure, process, technology). The significance of the taxonomy as a useful guide to both practitioners and future research is discussed.

Chaos, Law, And God: The Religious Meanings Of Homosexuality, Jay Michaelson Jan 2008

Chaos, Law, And God: The Religious Meanings Of Homosexuality, Jay Michaelson

Michigan Journal of Gender & Law

This Article argues that the religious meaning of homosexuality cannot be explained merely in terms of homophobia, "church and state," or traditional values versus progressive ones. Rather, the regulation of sexuality has a particular religious meaning: sexuality is a primary site in which religious law is engendered, where the lawfulness of religion meets the chaos beyond it. Whether in Biblical times or today, changing the way sexuality is regulated is a threat to the notion of order itself, as construed by Jewish and Christian religion. Arguments about gay rights, same-sex marriage, and related issues are not merely arguments informed by …

A New Frontier Or Merely A New Medium - An Analysis Of The Ethics Of Blawgs, Justin Krypel Jan 2008

A New Frontier Or Merely A New Medium - An Analysis Of The Ethics Of Blawgs, Justin Krypel

Michigan Telecommunications & Technology Law Review

The purpose of this Note is to investigate those rules of ethics which interact with attorney blogs, placing a special emphasis on advertising rules. The central finding is that, under the Supreme Court's current First Amendment jurisprudence, attorney blogs (or, more cleverly, "blawgs") are not subject to regulation by the ethics codes of the ABA or the various state bars. Furthermore, if the Supreme Court were to, for some reason, construe blawgs as falling outside of First Amendment protection, evidence suggests that regulating this new medium would be neither desirable nor effective. Part II outlines the historical framework which underlies …

Analysis Of The Transformative Potential Of Blended Problem-Based Learning In Higher Education Faculty Development, Roisin Donnelly Jan 2008

Analysis Of The Transformative Potential Of Blended Problem-Based Learning In Higher Education Faculty Development, Roisin Donnelly

Papers, presentations and other resources

A hugely important area in any form of PBL delivery is the role of the instructor; in a blended learning environment, it is even more crucial. Hughes and Daykin (2002) have suggested that a move to online delivery needs a greater attention to design and development of facilitator skills than has been previously recognised. A blended module for faculty, delivered using a problem-based learning approach, is the setting for continuing research into the transformative role that an instructor can play during the learning process. Coppola, Hiltz and Rotter (2001) identify a number of roles played by instructors in e-learning, but …

Illusory Judgments Under Conditions Of Uncertainty: Reasoning Errors Related To Paranormal And Religious Beliefs, Erin C. Goforth Jan 2008

Illusory Judgments Under Conditions Of Uncertainty: Reasoning Errors Related To Paranormal And Religious Beliefs, Erin C. Goforth

Doctoral Dissertations

This research examined the predictors of illusory judgments of prediction under conditions of uncertainty. Study 1 investigated the believability of an experimental manipulation that required participants to choose a strategy for target object selection. Study 2 expanded upon Study 1 by giving participants an additional choice strategy (e.g., a computer's selection). In both Study 1 and Study 2, participants relied on the paranormal strategy (e.g., a psychic) to a greater degree under conditions of uncertainty than under conditions of certainty. Study 3 replicated these results using a between subjects design but also expanded upon Study 1 and 2 by examining …

Law Enforcement's Reconceptualization Of Juvenile Prostitutes From Delinquency Offenders To Child Sexual Abuse Victims In Six Us Cities, Stephanie Halter Jan 2008

Law Enforcement's Reconceptualization Of Juvenile Prostitutes From Delinquency Offenders To Child Sexual Abuse Victims In Six Us Cities, Stephanie Halter

Doctoral Dissertations

The involvement of youth in prostitution has proven to be a difficult and complex issue for law enforcement, child welfare, and social service agencies to confront. This stems from the complicated social and legal aspects of the problem, which have created considerable ambiguity in how to recognize, define and, ultimately, handle juveniles engaging in prostitution. This research project examined how juvenile prostitutes were conceptualized by law enforcement, as victims or offenders, by examining the law enforcement response to this social problem. One hundred and twenty-six juvenile prostitute's case files from six law enforcement agencies in major U.S. cities were reviewed …

How Spanish -Speaking Parents Understand Kindergarten And Support Their Children's Education Within The Context Of A School, Phyllis Barton Schlichter

Doctoral Dissertations

The intention of this study was to examine the experiences of nine Spanish-speaking families in a public kindergarten setting during the 2005-2006 school year to understand how individual agency of parents, access to a community's practices and events, and the resulting interrelationship, shape parent understanding of and participation in school practices and events and ultimately impact student achievement outcomes. In a nation that is becoming increasingly diverse, the Hispanic population is the largest minority group in the country. There are more than two million English-language learners in the U.S. K-3 classrooms with Spanish accounting for almost 80% of the non-English …

Patterns Of Skinhead Violence, Derek Bowen Jan 2008

Patterns Of Skinhead Violence, Derek Bowen

Doctoral Dissertations

Violence committed by racist skinheads has often been characterized as being motivated by racial hatred and by white supremacist ideology. This ideological aspect has been used to make a distinction between the violent acts committed by racist skinheads and violent acts committed by other groups of young males. Recent research on skinheads has indicated that this distinction may have been overstated. Researchers doing fieldwork with skinheads have found that racist skinheads are involved in violent conflicts with a variety of opponents, and that this violence often lacked an overtly ideological character. Building on this emerging research, I hypothesized that racist …

Behavioral Responses To Public Insurance Programs: Three Essays, Timothy F. Page Jan 2008

Behavioral Responses To Public Insurance Programs: Three Essays, Timothy F. Page

Doctoral Dissertations

Evaluating the effectiveness of public programs requires an understanding of how these programs affect the choices of individuals and households. For example, the program design of Social Security and Medicare may affect how much people work. While these effects are not intended goals of the programs, proper evaluation of these programs requires analyzing costs and benefits from all sources, even those that may be unintended. Given the growing number of uninsured individuals, currently 47 million, policy makers are considering an expanded role for government in the provision of health insurance. With any expansion may come secondary effects, such as those …

The Social Production Of Community Garden Space: Case Studies Of Boston, Massachusetts And Havana, Cuba, Charles A. French

Doctoral Dissertations

This research incorporates 'production of space' theory to explore how individual and societal characteristics influence community gardening practices and outcomes for individuals and neighborhoods in Havana, Cuba and Boston, Massachusetts. Methods used for this research include demographic analysis, interviews, surveys, field mapping, photo documentation and direct observation. The hope is that this research will bring to light certain policies and actions that will help ensure access to community garden space by diverse individuals. The following describes the main findings of this research.

In Boston, some neighborhoods experiencing rapidly escalating rents are also experiencing an outmigration of ethnic minorities, particularly Hispanic-Latinos …

The Effect Of Peer And Parental Smoking On Adolescent Smoking Initiation: Exploring Potential Moderators, Jeffrey Allen Eaton Jan 2008

The Effect Of Peer And Parental Smoking On Adolescent Smoking Initiation: Exploring Potential Moderators, Jeffrey Allen Eaton

Doctoral Dissertations

The factors that contribute to smoking initiation among adolescents are poorly understood. The current approaches to smoking prevention may have achieved their maximum potential as evidenced by a stalling in the decline in smoking rates. To date, approaches to smoking prevention based on social and individual factors have previously met with limited success. A promising new approach will be to examine the interaction between social and individual factors and the effects of their interaction on smoking initiation. Parental and peer smoking behaviors are well-known risk factors for smoking initiation. Several theoretical models suggest that perceptual or interpretative processes may moderate …

The Fallacy Of Endless Growth: Exposing Capitalism's Insustainability, William S. Strauss Jan 2008

The Fallacy Of Endless Growth: Exposing Capitalism's Insustainability, William S. Strauss

Doctoral Dissertations

What if we were to have 100 years of no growth? What if conditions were such that there is no future scenario under which growth will ever occur again? We might characterize this as impossible, as a vision that violates the outcome that we as innovative people must realize.

In the document that follows I will show you our world as it must be sometime in the future. I will describe a world in which the real growth of the world economy is zero and remains zero. I will tell a story of a world that is so different from …

Human Rights And Contemporary Slavery, Kevin Bales Jan 2008

Human Rights And Contemporary Slavery, Kevin Bales

Human Rights & Human Welfare

The anti-slavery movement will welcome this important compilation of work on debt bondage slavery. In the academic and policy analysis of contemporary slavery, many of the fundamental areas of enslavement are yet to be explored and brought into systematic presentation. This work by the Graduate School of International Studies at the University of Denver helps to build up our understanding of debt bondage, as well as adding to the emerging discipline of contemporary slavery studies. Debt bondage slavery is one of the oldest forms of slavery that continues into the present day. The date of the establishment of hereditary debt …

Poverty’S Captives, Tim Brauhn Jan 2008

Poverty’S Captives, Tim Brauhn

Human Rights & Human Welfare

Today’s manifestations of bondage are a marked departure from those of pre-modern slavery. Now the value of the human “goods” is so low that slavers do not have to worry about damaging them. Two hundred years ago, slaves had to at least be treated with a modicum of safety, if for no other reason than to ensure continued profitability. But in the 20th and 21st centuries, slavers have become less like “hunters” and more like “gatherers,” since their work no longer involves raids and chains, at least in the physical sense. No, today’s raids are the false promises of work …
