African Women In The New Diaspora: Transnationalism And The (Re) Creation Of Home, Mary J. Osirim Jan 2008

African Women In The New Diaspora: Transnationalism And The (Re) Creation Of Home, Mary J. Osirim

Sociology Faculty Research and Scholarship

During the past 25 years, African immigrants have been arriving in the US in increasing numbers due to the push factors of globalization, wars, civil unrest and natural disasters. Drawing on in-depth interviews with African women as immigrants in Greater Boston and Philadelphia, this paper will explore how the intersections of gender, race and class affect their contributions to civil society and business development. This work illustrates how transnational ties, specifically in the form of a new pan-Africanism, lead African immigrants to make significant contributions to community revitalization, particularly in historically African American communities. Although African women immigrants are clearly …

The Other Side Of Metamorphosis: An Exploratory Study Of How Partners Of Transsexuals Experience Transition, Kara Harvey

Interest in, and research within, transgender studies has exploded in recent years. The majority of the research, however, has focused primarily on the experience of transsexuals1 themselves. Romantic partners of transsexuals, though, have remained unexplored within the literature. Details of their experiences in the romantic relationship and during their partners’ transitions have yet to be investigated within scholarly research.

Building A 'New Institutional' Approach To Corporate Speech, Michael R. Siebecker Jan 2008

Building A 'New Institutional' Approach To Corporate Speech, Michael R. Siebecker

Sturm College of Law: Faculty Scholarship

This Article represents the second installment in a three-part series designed to articulate a New Institutional approach to corporate speech that could foil the otherwise inevitable collision between the commercial speech doctrine and the Supreme Court's disparate approach to corporate political speech.

The problem arises because corporations are attempting to escape regulation or liability in a variety of settings by investing commercial messages with just enough political content to render the amalgam of politically tinged corporate speech fully protected under the First Amendment. Why would this strategy work? If corporate speech is political, existing Supreme Court jurisprudence suggests that government …

The International Child Poverty Gap: Does Demography Matter?, Patrick Heuveline, Matthew Weinshenker Jan 2008

The International Child Poverty Gap: Does Demography Matter?, Patrick Heuveline, Matthew Weinshenker

Sociology Faculty Publications

According to the Luxembourg Income Study data, the United States child poverty rate is the second highest among 15 high-income nations. The present work reveals that 55% of all American children living in a household headed by a single female with no other adult live in poverty —the highest rate for any of the five living arrangements in the 15 countries examined by this Study. While previous analyses have focused on market forces and governmental redistribution across households, we question the contribution of demographic factors that place children in family structures with different poverty risks relative to other factors such …

Sixty Years In The Making: The Definition Of Aggression For The International Criminal Court, Keith A. Petty

UC Law SF International Law Review

The post-war trials of Axis, war criminals marked the last time that the crime of aggression was prosecuted. Today, the Special Working Group on the Crime of Aggression (SWG) is nearing agreement on a definition that will likely be adopted by the Assembly of States Parties to the International Criminal Court (ICC) - a prerequisite to the Court's exercise of jurisdiction over this, particular offense. In spite of decades of work, several key issues remain to be resolved before the definition is finalized. These include: The level of involvement of the Security Council in determining when a State commits aggressive …

Balancing, The Global And The Local Judicial Balancing As A Problematic Topic In Comparative (Constitutional) Law, Jacco Bomhoff Jan 2008

Balancing, The Global And The Local Judicial Balancing As A Problematic Topic In Comparative (Constitutional) Law, Jacco Bomhoff

UC Law SF International Law Review

Courts in Europe, North America and elsewhere frequently use the language of "balancing" when dealing with fundamental rights cases. In addition, judges and scholars increasingly often rely on the image of balancing, or "weighing," to draw (self-)portraits of legal cultures and to frame contrasts and similarities between legal orders. This article argues that this form of discourse occupies a particularly problematic position as a topic of comparative constitutional law, and this for two primary reasons.

First, while balancing references, as legal arguments, function primarily to justify the exercise of judicial power in particular - local - settings, their legitimizing force …

“Diesmal Fehlt Die Biologie!” Max Horkheimer, Richard Thurnwald, And The Biological Prehistory Of German Sozialforschung, Kevin S. Amidon Ph.D. Jan 2008

“Diesmal Fehlt Die Biologie!” Max Horkheimer, Richard Thurnwald, And The Biological Prehistory Of German Sozialforschung, Kevin S. Amidon Ph.D.

Modern Languages Faculty Publications

In his early writings Max Horkheimer explored the issues surrounding biological explanation in Kantian and neo-Kantian philosophy. After he became director of the Institut für Sozialforschung in 1930, he continued to explore the relationships between biology, materialism, philosophy, and social theory. This interest was reflected both in his editorial policy for the Zeitschrift für Sozialforschung and in his own scholarly development that led to the development of critical theory in the later 1930s and the anti-Semitism research of the 1940s. Horkheimer's interests and ambitions also generated resistance from other social scientists. The Berlin ethnologist Richard Thurnwald, along with his student …

Understanding Gender Stereotypes And Their Impact On Clients, Stacey Hurt Jan 2008

Understanding Gender Stereotypes And Their Impact On Clients, Stacey Hurt

Graduate Research Papers

Gender stereotyping has a complex and enduring history in our society, and it is an underlying factor in many issues – clients bring to counseling, including – among other things-women's and men's experience of depression (Nugent & Jones, 2005). A complicating aspect of gender stereotyping is that both males and females in our culture have been socially conditioned to fulfill many of the stereotypes imposed on them, and following stereotypical gender roles excessively can be harmful to their mental health, self-image, and interpersonal relationships (Nugent & Jones).

Counselors can use gender-role analysis and other interventions to help clients gain insight …

Moving Beyond The Enduring Dominance Of Positivism In Psychological Research: An Australian Perspective, Lauren Breen, Dawn Darlaston-Jones Jan 2008

Moving Beyond The Enduring Dominance Of Positivism In Psychological Research: An Australian Perspective, Lauren Breen, Dawn Darlaston-Jones

Arts Conference Papers

Almost since its inception, the dominant narrative of modern psychology has embraced positivism through its insistence that psychological science is objective, generalisable, and value free (or neutral). Consequently, quantitative research and in particular, experimental designs, are privileged over other forms of enquiry and other epistemologies, methodologies, and methods remain marginalised within the discipline. Alternative epistemologies and methodologies remain predominantly at the margins within psychological research yet have resulted from the growing dissatisfaction with the dominance of positivism. We argue that the enduring hegemony of positivism needs to be opposed to enable psychology to genuinely understand the antecedents of, and provides …

Mythical Expectations, Robert Leeson, Warren Young Jan 2008

Mythical Expectations, Robert Leeson, Warren Young

Business Book Chapters

According to the conventional account, economists have relied on three types of expectations: static (contained in the original Keynesian Phillips curve); adaptive (introduced by Milton Friedman’s in the course of his Monetarist counter-revolution) and rational (part of Robert Lucas’s natural rate New Classical counter revolution). This chapter argues that there is a fourth expectational type: the myths associated with these natural rate counter revolutions.

The Campaign To Arrest Ed Shann’S Influence In Western Australia, Gregory C G Moore

Business Conference Papers

Shann towered over the discipline of economics in the state of Western Australia in the first third of the twentieth century. He was the foundation professor in history and economics from 1913 to 1931 and inaugural professor of economics from 1931 to 1934 at the University of Western Australia (UWA); he set the curriculum for the subjects that constituted the economics major that was offered at UWA over this period and ensured that it had a market-driven, policy-oriented and historical flavour; he trained a generation of bright young men and women—such as John La Nauze, Nugget Coombs, Merab Harris, Paul …

Civic Lessons: Public Schools And The Civic Development Of Undocumented Students And Parents, John Rogers, Marisa Saunders, Veronica Terriquez, Veronica Valez Jan 2008

Civic Lessons: Public Schools And The Civic Development Of Undocumented Students And Parents, John Rogers, Marisa Saunders, Veronica Terriquez, Veronica Valez

Northwestern Journal of Law & Social Policy

In the Court reasoned that by providing undocumented students with core academic instruction, public schools could contribute to their participation in democratic institutions and thus enhance civic life. This article assesses this and a set of related claims. Drawing on three data sets, the authors consider how access to public schools shapes the civic development and civic engagement of undocumented students and their parents. They first introduce data from a longitudinal study tracking the civic development of youth through high school and into adulthood. They then share survey data that indicates the relatively high levels of school participation among undocumented …

Slots In The City: A Critical Look At The Balance Of Decision-Making Power In Gaming Legislation, Eric B. Becker Jan 2008

Slots In The City: A Critical Look At The Balance Of Decision-Making Power In Gaming Legislation, Eric B. Becker

Fordham Urban Law Journal

This Note focuses on the ability of local governmental bodies and local actors to become involved when a state seeks to introduce casino-based gaming or license additional casino properties. Traditionally, states retain the power to make most gaming-related decisions, sometimes only allowing simple "yes or no" voter referenda. This note argues that an increased role for local actors in bringing gaming to cities will best protect the interests of the people most affected by casinos. Part I provides a brief background of gambling in America and the key aspects of gaming-enabling legislation in various states. Part II discusses local government …

Do Poison Pills Increase Firm Risk?, Thomas Turk, Jeremy C. Goh, Candace Ybarra Jan 2008

Do Poison Pills Increase Firm Risk?, Thomas Turk, Jeremy C. Goh, Candace Ybarra

Business Faculty Articles and Research

Management scholars have argued that an active takeover market discourages risk-taking by managers and that takeover defenses serve to counter the risk-reducing pressures of an active takeover market. This study employs the Black and Scholes Option Pricing Model to determine whether or not adoption of poison pill securities increases investor perceptions of firm risk. The results provide evidence that the Option-Implied Standard Deviations of common stock returns increase significantly on the poison pill adoption date, on average. Furthermore, the implied standard deviations remained significantly above pre-adoption levels for several days after the poison pill adoption, suggesting that the perceived increase …
