Lawyers As Quasi-Public Actors, W. Bradley Wendel Jun 2008

Lawyers As Quasi-Public Actors, W. Bradley Wendel

Cornell Law Faculty Publications

This paper was written for a panel on access to justice at the 100th anniversary conference of the Law Society of Alberta, Canada. In it I argue that the debate over access to justice, which in the United States generally means pro bono representation provided by individual lawyers, cannot be divorced from broader theoretical debates about the lawyer's role. My claim is that lawyers are quasi-public actors, in the sense that they have some responsibility to aim directly at justice in their representation of clients, and cannot rely only on indirect strategies to ensure that justice is served. The argument …

Understanding Declining Mobility And Interhousehold Transfers Among East African Pastoralists, Marieke Huysentruyt, Christopher B. Barrett, John G. Mcpeak Jun 2008

Understanding Declining Mobility And Interhousehold Transfers Among East African Pastoralists, Marieke Huysentruyt, Christopher B. Barrett, John G. Mcpeak

Economics - All Scholarship

We model interhousehold transfers between nomadic livestock herders as the state-dependent consequence of individuals' strategic interdependence resulting from the existence of multiple, opposing externalities. A public good security externality among individuals sharing a social (e.g., ethnic) identity in a potentially hostile environment creates incentives to band together. Self-interested interhousehold wealth transfers from wealthier herders to poorer ones may emerge endogenously within a limited wealth space as a means to motivate accompanying migration by the recipient. The distributional reach and size of the transfer are limited, however, by a resource appropriation externality related to the use of common property grazing lands. …

Discerning Leadership Perceptions Of Central Eurasian Managers: An Exploratory Analysis, Kiran M. Ismail, David L. Ford Jr. Jun 2008

Discerning Leadership Perceptions Of Central Eurasian Managers: An Exploratory Analysis, Kiran M. Ismail, David L. Ford Jr.

Organization Management Journal

This exploratory study examined the responses of Central Eurasian corporate, government, and non-governmental organization managers regarding their perceptions of work-related values of effective organizational leadership. The respondents were participants in a 2-week leadership development program held in Istanbul, Turkey. Two inter-related research questions regarding leadership concepts and challenges were explored through content analysis of program intake interview protocols. The participants’ pre-program perspectives on what constituted effective organizational leadership were found to be consistent with the GLOBE Project’s culturally endorsed leadership dimensions. Moreover, several common patterns of behaviors and challenges were uncovered that could be attributed to particular idiosyncrasies in the …

Is Talking Online To Unknown People Always Risky? Distinguishing Online Interaction Styles In A National Sample Of Youth Internet Users., Janis Wolak, David Finkelhor, Kimberly J. Mitchell

Sociology

Abstract

We examined the risk of unwanted online sexual solicitations and characteristics associated with four online interaction styles among youth Internet users. The interaction styles took into account the people with whom youth interacted online (people known in person only, unknown people met through face-to-face friends, unknown people met in chatroom, and other places online) and high- and low-risk patterns of online behavior. The aim was to provide a basis for identifying which youth may be most at risk from interacting online with unknown people.

All I’M Askin’ Is For A Little Respect: How Can We Promote Civility In Our Classrooms?, Susan D. Baker, Debra R. Comer, M. Linda Martinak

Organization Management Journal

Across geographical regions and academic disciplines, faculty members are lamenting the rise in behavior problems in the classroom. We present here a review of the literature on classroom incivility and a categorization of uncivil behaviors. Next, attributing classroom incivility, in part, to cultural characteristics of our current undergraduates, we compare Millennials to earlier generations and discuss the impact of specific cultural characteristics on their classroom behavior. Then, using transactional and transformational leadership theories to frame our recommendations, we combine insights from research on Millennial culture to offer pedagogical methods for helping to prevent incivility, as well as how to respond …

Reaching Out With Research: Engaging Community In Mapping Legal Service Accessibility, Effectiveness And Unmet Needs, Mary Stratton Jun 2008

Reaching Out With Research: Engaging Community In Mapping Legal Service Accessibility, Effectiveness And Unmet Needs, Mary Stratton

Canadian Forum on Civil Justice

Emerging international research demonstrates that high economic and social costs accrue when individuals cannot access timely and effective resolutions to legal problems. Canadian research also shows that most people lack knowledge and understanding of legal rights, legal processes and services, and experience significant barriers when attempting to seek legal information and assistance. Within the Canadian justice community there is strong interest in engaging all relevant stakeholders in collaborative processes of research and policy development. This paper discusses how community-based mapping research can facilitate such engagement in compiling evidence that informs the development of legal processes and services that are more …

Commitment To Corporate, Social, And Environmental Responsibilities: An Insight Into Contrasting Perspectives In China And The Us, Carlos Wh. Lo, Carolyn P. Egri, David A. Ralston

Organization Management Journal

This cross-national study investigates antecedents and outcomes of corporate responsibility (CR) practices to stakeholders and the natural environment in the contrasting contexts of China and the US. In general, we found partial support for the proposition that the divergence of CR stakeholder practices across nations is dependent on the institutional environments of business. Whereas customer and community stakeholder practices were found to be more prevalent in US companies, there were no significant country differences in the prevalence of employee, investor, and environmental CR practices. In addition, we found that the relationship between the prevalence of CR practices and business outcomes …

Securities Fraud, Recidivism, And Deterrence, Jayne W. Barnard Jun 2008

Securities Fraud, Recidivism, And Deterrence, Jayne W. Barnard

Dickinson Law Review (1908-2003)

Legal scholars have expended considerable energy on the study of high-level securities fraud violators-Ken Lay, Bernie Ebbers, Dennis Kozlowski, etc. There has been little attention, however, to the perpetrators of "retail" securities fraud-the con artists who sell bogus stock over the Internet, orchestrate elaborate pump-and-dump schemes, and create a never-ending array of purportedly "risk free" investment opportunities. Collectively, and in a cruel mockery of capitalism, these offenders extract hundreds of millions dollars from investors each year. In this article, Professor Barnard examines this group of offenders, focusing particularly on those who recidivate-often moving from state to state and scheme to …

Study Of The Role Of Preparers In Relation To Taxpayer Compliance With Internal Revenue Laws, Leslie Book Jun 2008

Study Of The Role Of Preparers In Relation To Taxpayer Compliance With Internal Revenue Laws, Leslie Book

Working Paper Series

The use of paid tax return preparers has grown steadily. All paid return preparers, including those who are not regulated by any licensing entity or subject to competency or continuing education requirements, must comply with certain requirements in connection with the preparation of a tax return, including signing the return and providing a copy of the return to taxpayers. Preparers are also subject to civil and even criminal penalties for improper conduct and the Code provides that the United States may bring a civil action to enjoin tax preparers if preparers engage in certain types of impermissible conduct. As discussed …

``No One Does That Anymore": On Tushnet, Constitutions, And Others, Penelope J. Pether

Working Paper Series

In this contribution to the Quinnipiac Law Review’s annual symposium edition, this year devoted to the work of Mark Tushnet, I read his antijuridification scholarship “against the grain,” concluding both that Tushnet’s later scholarship is neo-Realist rather than critical in its orientation, and that both his early scholarship on slavery and his post-9/11 constitutional work reveal an ambivalence about the claim that we learn from history to circumscribe our excesses, which anchors his popular constitutionalist rhetoric.

The likeness of Tushnet’s scholarship to the work of the Realists lies in this: while the Realists’ search for a science that would satisfy …

“Militant Judgement?: Judicial Ontology, Constitutional Poetics, And ‘The Long War’”, Penelope J. Pether

Working Paper Series

This Article, a contribution to the Cardozo Law Review symposium in honor of Alain Badiou’s Being and Event, uses Badiou’s theorizing of the event and of the militant in Being and Event as a basis for an exploration of problems of judicial ontology and constitutional hermeneutics raised in recent decisions by common law courts dealing with the legislative and executive confinement of “Islamic” asylum seekers, “enemy combatants” and “terrorism suspects,” and certain classes of criminal offenders in spaces beyond the doctrines, paradigms and institutions of the criminal law. The Article proposes an ontology and a poetics of judging equal to …

Postscript to Frauen im Laufgitter Bern: efef Verlag, 1996

The 1950s

Iris von Roten wrote her epochal work Frauen im Laufgitter (Women in the Playpen) in the 1950s. Growth of industry and increasing prosperity marked the times, and the Unites States had emerged victorious from the war. The American life style had gained model status also for the role assigned to women and mothers; the change, however, was only superficial. The new housewife was young, uncomplicated, spontaneous, and she knew how to handle daily chores with amazing ease. Refrigerators as well as …

Updating The Farm Bill Safety Net In An Expanding Sea Of Risk, Wes Harris, Bradley Lubben, James Novak, Larry Sanders

Department of Agricultural Economics: Faculty Publications

Several months past due, the Food, Conservation and Energy Act (FCEA) of 2008 (P.L. 110-246) is now law. Reform, budget, and national and international politics were central issues fueling a debate that resulted in this new bill. Whether this new Farm Bill will ultimately succeed in providing an adequate farm and food safety net and whether it is a “good” or “bad” bill depends on one’s perspective. As to cost, the Congressional Budget Office (CBO) scores the bill at $307 billion for a 5–year period (2008–2012), with 68% going to nutrition, 11% to commodity programs, 8% of estimated expenditures to …

On The (Legal) Study Methods Of Our Time: Vico Redux, Marianne Constable Jun 2008

On The (Legal) Study Methods Of Our Time: Vico Redux, Marianne Constable

Chicago-Kent Law Review

This essay draws on the form and spirit of Vico's On the Study Methods of Our Time to comment on intellectual and institutional approaches to U.S. legal studies today. It compares rhetoric to the many disciplines—philosophy, economics, sociology, political science, anthropology, poetry, and history—that take law as their subject matter. It argues that law is only partly understood by those who characterize it as command or as morality, as coercive system or as system of rules. It is only partly understood by those who reject law-on-the-books in favor of the empirical study of social behavior. It argues instead that attending …

Sublime Jurisprudence: On The Ethical Education Of The Legal Imagination In Our Time, Richard K. Sherwin Jun 2008

Sublime Jurisprudence: On The Ethical Education Of The Legal Imagination In Our Time, Richard K. Sherwin

Chicago-Kent Law Review

The broad dissemination of digital communication technologies is raising disturbing questions about the nature of truth as representation. This epistemological crisis shares an uncanny affinity with the crisis of representation that lay at the heart of the baroque era during the seventeenth century in Europe. The resolution of that crisis, through the work of Descartes and others, came on the heels of a philosophical shift from the image to the sign. However, as Vico presciently realized 300 years ago, Descartes' semiotic model, together with the totalizing rational method that accompanies it, are ill-suited to civic flourishing. Today, signifiers shorn of …

Transforming Caregiving: African American Custodial Grandmothers And The Child Welfare System, S. Yvette Murphy, Andrea G. Hunter, Deborah J. Johnson Jun 2008

Transforming Caregiving: African American Custodial Grandmothers And The Child Welfare System, S. Yvette Murphy, Andrea G. Hunter, Deborah J. Johnson

The Journal of Sociology & Social Welfare

Growing numbers of African American grandmothers are raising grandchildren under the auspices of the child welfare system; however, little is known about the manner in which child welfare policies and practices impact custodial grandparenting. Based on focus groups with African American grandmothers who are raising grandchildren as formal kinship caregivers, this study explored the ways in which the new formalized relationship between the child welfare system and African American custodial grandmothers is transforming the meanings and practices related to intergenerational caregiving in African American families. Drawing on cultural and historical traditions, grandmothers forge a transformative partnership with child welfare that …
