Nihilism With A Happy Ending? The Interstate Commerce Commission And The Emergence Of The Post-Enlightenment Paradigm, Mark F. Kightlinger
Nihilism With A Happy Ending? The Interstate Commerce Commission And The Emergence Of The Post-Enlightenment Paradigm, Mark F. Kightlinger
Law Faculty Scholarly Articles
This Article examines early Supreme Court opinions about the Interstate Commerce Commission (ICC)—the first federal administrative agency—in an effort to identify the intellectual roots of the modern administrative state. The Article argues that the Court's effort to explain and justify the function of the newborn ICC shows the traces of a post-Enlightenment crisis in the field of moral philosophy—i.e., the growing conviction that it is no longer possible for reasonable people to agree on what constitutes a true, objective, universally valid standard of reasonable or just conduct. From this essentially nihilistic starting point, the Court helped to fashion a new …

Bones To Read: An Interpretation Of Forensic Crime Fiction, Ingrida Povidiša
Bones To Read: An Interpretation Of Forensic Crime Fiction, Ingrida Povidiša
Reconstruction: Studies in Contemporary Culture
The anthropological forensic crime fiction is a detective genre which is primarily concerned with investigating human bodies. In the hermeneutical process of reading the bones (i.e. studying, interpreting, understanding, embodying), the most enduring record carrier of one's individuality, supported by a rhizoid network of scientific disciplines, the anonymous corpse becomes a personalized victim. The present discussion is based on the novels of Kathy Reichs. Specific characteristics of the materiality and mediality of representation can be traced through a juxtaposition of Reichs' novels with the serial Bones (Twentieth Century Fox, 2005 - Present) and the novel by Max Allan Collins Bones …
On Cornel Sandvoss's Fans: The Mirror Of Consumption, Barry King
On Cornel Sandvoss's Fans: The Mirror Of Consumption, Barry King
Reconstruction: Studies in Contemporary Culture
[First paragraph]
Recent theorisations of fandom show a tendency towards the sequestration of fan activity and experience as if occurring outside, or at least comfortably on sabbatical from, commodity relationships. This is an old theme. John Fiske's claims for semiotic democracy and Henry Jenkins's celebration of the anarchic pleasures of textual poaching both tended, despite their internal differences of emphasis, to place fandom outside of the commodification process that is central to capitalist relations of cultural production. Matt Hills, one of the "new wave" of fan theorists drawn upon in the text under review still strives to address the dialectic …

Mead And The International Mind, Marilyn Fischer
Mead And The International Mind, Marilyn Fischer
Philosophy Faculty Publications
In this paper I analyze the conceptions of internationalism and the international mind that Mead uses in "The Psychological Bases of Internationalism" (1915); in his 1917 Chicago Herald columns defending U.S. entry into the war; in Mind, Self, and Society (1934); and in "National- Mindedness and International Mindedness" (1929). I show how the terms "internationalism" and "the international mind" arose within conversations among some Anglo-American thinkers. While Mead employs these terms in his own philosophical and sociological theorizing, he draws their meaning from these conversations and does not generate their meaning from within his own theorizing. This places Mead among …

The Art Of Vision Casting For Church Multiplication, J. D. Payne
The Art Of Vision Casting For Church Multiplication, J. D. Payne
Journal of the American Society for Church Growth
“A plan in the heart of man is like deep water, but a man of understanding draws it out.” Proverbs 20:5 (NASB). The writer of the above verse reminds us of the importance of having knowledge in regard to moving one’s plans out of the deep recesses of the heart to the surface to where those plans can be carried out. This proverb has much to say about casting a vision for multiplication. Casting, or drawing out that vision from the heart so that others will take ownership of that vision and work to carry it out, requires a discerning …
Changing Perspectives On Leadership During Four Decades, Eddie Gibbs
Changing Perspectives On Leadership During Four Decades, Eddie Gibbs
Journal of the American Society for Church Growth
The significance of leadership for the growth of the church has been a constant focus of attention throughout the history of the Church Growth movement in North America during the past four decades. During that time, different aspects of leadership have been explored in response to the challenges and pressures encountered by leaders. Increasing pressures have resulted in heightened levels of stress.

Graduate Training In Sociological Theory And Theory Construction, Barry N. Markovsky
Graduate Training In Sociological Theory And Theory Construction, Barry N. Markovsky
Faculty Publications
Nearly all of sociology's top graduate training programs require their students to complete one or two courses on sociological theory. The instructors for these courses have an extraordinary opportunity to affect the perspectives and practices of future generations of scholars. This study assesses the backgrounds, attitudes, beliefs, and practices of those instructors regarding different approaches to theorizing, with particular attention paid to topics related to science and to theory construction. Sociologists who teach required theory courses in the discipline's top fifty graduate training programs were asked a series of questions pertaining to their own training and to the courses they …
E(Race)Ing Race From A National Conversation On Mathematics Teaching And Learning: The National Mathematics Advisory Panel As White Institutional Space, Danny Bernard Martin
E(Race)Ing Race From A National Conversation On Mathematics Teaching And Learning: The National Mathematics Advisory Panel As White Institutional Space, Danny Bernard Martin
The Mathematics Enthusiast
In this paper, I wish to argue that several factors support a characterization of the National Mathematics Advisory Panel as an instantiation of the white institutional space (Moore, 2008) that characterizes mathematics education research and policy contexts more generally. In particular, my analysis highlights that mathematics education research and policy contexts such as the National Mathematics Advisory Panel are not immune to the structural and institutional racism that characterize many other areas of U.S. society.

Sexual Violence As The Language Of Border Control: Where French Feminist And Anti‐Immigrant Rhetoric Meet, Miriam Ticktin
Sexual Violence As The Language Of Border Control: Where French Feminist And Anti‐Immigrant Rhetoric Meet, Miriam Ticktin
Publications and Research
When I first arrived in the Paris region in 1999 to do research on the struggle by undocumented immigrants (les sans papiers) for basic human rights, discussions of violence against women were remarkably absent from the public arena. Nongovernmental organizations and researchers had begun to broach the topic, but with little public visibility. However, this changed in late 2000, with a media explosion on the issue of les tournantes, or the gang rapes committed in the banlieues of Paris. Such tournantes involve boys “taking turns” with their friends’ girlfriends, both parties usually being of Maghrebian or North …

When Perception Changes Reality: An Empirical Study Of Investors' Views Of The Fairness Of Securities Arbitration, Jill I. Gross, Barbara Black
When Perception Changes Reality: An Empirical Study Of Investors' Views Of The Fairness Of Securities Arbitration, Jill I. Gross, Barbara Black
Journal of Dispute Resolution
Arbitration in securities industry-sponsored forums is the primary mechanism to resolve disputes between investors and their brokerage firms. Because it is mandatory, participants debate its fairness, and Congress has introduced legislation to ban pre-dispute arbitration clauses in customer agreements. Missing from the debate has been empirical research of perceptions of fairness by the participants, especially investors. To fill that gap, we mailed 25,000 surveys to participants in recent securities arbitrations involving customers to learn their views of the process. The article first details the survey's background, explains the importance of surveying perceptions of fairness, and describes our methodologies, procedures, and …

The Elder Economic Security Initiative™ Program: The Elder Economic Security Standard™ Index For Wisconsin, Jan E. Mutchler, Alison Gottlieb, Ellen A. Bruce, Laura Henze Russell
Gerontology Institute Publications
This report addresses income adequacy for Wisconsin’s older adults using the WOW-GI Elder Economic Security Standard Index (the Index) methodology. The Index benchmarks basic costs of living for elder households and illustrates how costs of living vary geographically and are based on the characteristics of elder households, including household size, home ownership or renter status, and health status. The costs are based on market costs for basic needs of elder households and do not assume any public or private supports.
