New Strategies For Progressive Realization Assessments Of Economic, Social, And Cultural Rights: Cambodian Aids-Related Orphans And Vulnerable Children As The Hard Case, Elizabeth Shura Jan 2008

New Strategies For Progressive Realization Assessments Of Economic, Social, And Cultural Rights: Cambodian Aids-Related Orphans And Vulnerable Children As The Hard Case, Elizabeth Shura

Fordham International Law Journal

This Note proposes two alternatives to the standard use of progressive realization assessments under international human rights law. The first is to identify "key rights"-immediately enforceable civil and political rights that are so deeply intertwine with related social, economic, and political rights that enforcing the first unlocks access to the second. This strategy relies on the deep interconnection of all human rights a connection that is heightened among vulnerable populations such as Cambodian AIDS-related orphans. The second solution offered is an alternative method of conducting analysis under the progressive realization standard. Economic, social, and cultural rights can be examined and …

When Chinese Criminal Defense Lawyers Become The Criminals, Yanfei Ran

Fordham International Law Journal

This Article tries to find some practical resolutions for the problematic situation of Chinese defense lawyers. Part I introduces how Chinese laws and regulations provide legal protection for criminal defendants and their defense lawyers, and compares Chinese laws with well-established international standards. Part II focuses on examples of the problems and difficulties faced by Chinese lawyers in their defense work. Part III specifically discusses criminal charges that lawyers face in their practice. Part IV argues that the long-awaited new Chinese Lawyers Law cannot solve all of the problems or wipe away all obstacles they face. Rather, solving those problems requires …

Are Eu Trade Sanctions On Burma Compatible With Wto Law?, Robert L. Howse, Jared M. Genser Jan 2008

Are Eu Trade Sanctions On Burma Compatible With Wto Law?, Robert L. Howse, Jared M. Genser

Michigan Journal of International Law

This Article will explore the European Union's approach to Burma. The European Union, until recently, has implemented quite limited trade sanctions against the Burmese junta. According to the most recent figures, E.U. countries still import €306 million ($454 million) of commodities and products, ninety-five percent of which are textiles, timber, gems, and precious metals. However, the Common Position of November 19, 2007, strengthens considerably E.U. measures against the Burmese regime and contains a ban on the importation of these goods from Burma. Further, the Common Position requires E.U. countries to prohibit intentional and knowing "participation" in activities that "directly or …

Global Integration And The Complete Public Goods, Sungjoon Cho Jan 2008

Global Integration And The Complete Public Goods, Sungjoon Cho

Chicago Journal of International Law

This Article unfolds as follows: Section II first situates RTAs against the backdrop of the global trading system in an effort to bring out RTAs' global implications. Section III highlights certain negative effects of RTAs on nonmembers and the global trading system, and demonstrates how the club goods of regional trade may turn into public bads. In particular, this Section describes three aspects of negative externalities that RTAs may occasion: negative externalities to the global trading system as a whole, those to individual economic players (global businesspeople) within the system, and those to poor nations. In order to address these …

Competitive Supragovernmental Regulation: How Could It Be Democratic?, Errol Meidinger Jan 2008

Competitive Supragovernmental Regulation: How Could It Be Democratic?, Errol Meidinger

Chicago Journal of International Law

The purpose of this Article is to work through an initial assessment of the democratic potential of competitive supragovernmental regulatory systems. Section II lays out the main institutional elements of competitive supragovernmental regulation and gives some examples of its operation. Key features include implementation through market chains, increasingly participatory and transparent deliberative procedures, and competition among programs. Section III then focuses on the democratic dimensions of competitive supragovernmental regulatory systems. In partial contrast to other work important in the field, it takes a systemic view, examining the composite democratic potential of regulatory systems composed of multiple programs, rather than focusing …

Reproductive Tourism And The Role Of The European Union, Elizabeth Ferrari Morris

Chicago Journal of International Law

This Development will focus on the role that the EU can and should play in administering the reproductive technology needs of its Member States. First, this Development will delve into the specific problems that have arisen from lack of central regulation. The discussion will then turn to current EU regulation practices of donated cell material and how these initiatives are insufficient to confront the public health problems produced by reproductive tourism. Finally, the argument concludes by discussing how the EU can administer cell donations more effectively and in a manner that is more consistent with its other bioethical practices without …

The Scale Of Networks?: Local Climate Change Coalitions, Hari M. Osofsky, Janet Koven Levit

Chicago Journal of International Law

Spring 2007 was a heady time for climate advocates. The fourth report of the Intergovernmental Panel on Climate Change expressed an overwhelming scientific consensus that anthropogenic climate change is a serious problem. The US Supreme Court not only addressed climate change for the first time, but also found that the US Environmental Protection Agency ("EPA") had abused its discretion in denying a petition asking it to regulate motor vehicle emissions . The UN Security Council also took an initial look at climate change, with a ranging debate over its security implications. Amid that furor, it is perhaps unsurprising that another …

Indigenous Recognition In International Law: Theoretical Observations, Patrick Macklem Jan 2008

Indigenous Recognition In International Law: Theoretical Observations, Patrick Macklem

Michigan Journal of International Law

This Essay addresses this question in the context of the evolving status of indigenous peoples in international law. International instruments vest rights in indigenous peoples, and establish indigenous peoples as international legal actors to whom States and other international legal actors owe legal duties and obligations. These developments began between the First and Second World Wars, when the International Labour Organization (ILO) began to supervise indigenous working conditions in colonies. They continued after the Second World War with ILO Conventions No. 107 and 169, which vested rights in indigenous populations located in States that are a party to their terms. …
