Direct Marketing, Mobile Phones, And Consumer Privacy: Ensuring Adequate Disclosure And Consent Mechanisms For Emerging Mobile Advertising Practices, Nancy J. King
Federal Communications Law Journal
Advertisers are poised to deliver advertising to cell phones in the U.S. This emerging advertising context is called mobile advertising. It will generate a host of privacy and personal data issues for consumers and for mobile advertisers, mobile phone manufacturers, and mobile carriers. This Article focuses on the existing federal regulatory environment applicable to mobile advertising and consumer privacy, the role of federal administrative agencies that enforce consumer privacy regulation, and the potential for industry selfregulation, particularly privacy policies, to enhance consumer privacy. Maine Department Of Corrections Annual Juvenile Recidivism Report, Susan Pate
Maine Department Of Corrections Annual Juvenile Recidivism Report, Susan Pate
Justice Policy
Executive Summary:
This Juvenile Recidivism Report is the latest in a series of juvenile recidivism reports that began with the 1998 Baseline Report. The purpose of this report is to gain a better understanding of first time juvenile offenders, the crimes they are adjudicated for, how soon they recidivate, and to continue to measure juvenile recidivism over time. This report was developed by the University of Southern Maine’s Muskie School of Public Service for the Maine Department of Corrections (MDOC) Division of Juvenile Services (DJS).
DJS has a long standing tradition of tracking juvenile recidivism. Beginning with the 1998 Baseline …
Counterfeit Pharmaceuticals In China: Could Changes Bring Stronger Protection For Intellectual Property Rights And Human Health?, Dina M. Bronshtein
Counterfeit Pharmaceuticals In China: Could Changes Bring Stronger Protection For Intellectual Property Rights And Human Health?, Dina M. Bronshtein
Washington International Law Journal
Although China seeks to improve its image as a legitimate participant in the global intellectual property (“IP”) market, Chinese companies continue to produce more than thirty percent of the counterfeit drugs circulating in the world today. The counterfeit pharmaceutical industry profits from efficient and cost-effective production systems by producing counterfeits at an exceedingly low cost. This poses a serious problem because the production and sale of counterfeit drugs leads to negative economic and social health-related effects. China’s existing penalties for counterfeit pharmaceutical production are considered a mere cost of doing business in China, rather than a deterrent from engaging in …

Guantánamo In The Supreme Court: Welcome Back, Welcome Back, Welcome Back, Marc D. Falkoff
College of Law Faculty Publications
Boumediene v. Bush is the latest of the Guantánamo detainee cases to make it to our nation's highest court, and it will be the third time that the Justices take a metaphorical tour of Guantánamo in order to sort out some fundamental issues concerning our country's dedication to the rule of law in the age of terror. What's the issue in Boumediene? In simplest terms, the case is a challenge to the constitutionality of the Military Commissions Act, a statute in which Congress stripped the federal courts of the power to hear habeas corpus petitions that were filed years ago …

The 2003 Slovenian Alcohol Policy: Background, Supporters, And Opponents, Aleksandra J. Snowden, William Alex Pridemore
Social and Cultural Sciences Faculty Research and Publications
High levels of wine, beer, and spirits consumption have historically characterized Slovenian drinking culture. The geographical location of the country provides an ideal environment for wine production, historical ties with the Austro-Hungarian Empire contribute to the tradition of beer drinking, and the custom of home distilling has resulted in a considerable level of spirits consumption. This combination of factors contributes to the high level and cultural acceptance of alcohol consumption in Slovenia. Alcohol-related harm in Slovenia was recognized as a problem as early as 1834, and since then Slovenian public health experts have implemented various programs and policies in an …

School Bullies—They Aren't Just Students: Examining School Interrogations And The Miranda Warning, Elizabeth A. Brandenburg
Mercer Law Review
In the first few weeks of working at the Macon Circuit Public Defender's Office in Macon, Georgia, I represented a juvenile client who was charged with possession of a weapon on school grounds. She was a fourteen-year-old public high school student accused of bringing a knife to school. She did not mean to bring the knife to school, having that morning switched purses, and when she realized the knife was in her bag, she did not know what to do. She did not get caught with the knife in a fight, nor were there ever allegations that she was involved …

The Two-Step Evidentiary And Causation Quandary For Medium- Specific Laws Targeting Sexual And Violent Content: First Proving Harm And Injury To Silence Speech, Then Proving Redress And Rehabilitation Through Censorship, Clay Calvert
Federal Communications Law Journal
This Article argues that legislators today that want to suppress First Amendment-protected images of sexual and violent conduct conveyed on a specific medium face a steep two-step evidentiary burden. First, they must prove actual harm caused by the speech in question as it is conveyed on a specific medium--not the aggregate injury from viewing all media generallythat is sufficient to overcome free-speech rights. Second, even if sufficient harm from viewing violent or sexual content on a particular medium is proven by social science research, the government then must prove that its legislative remedy-its censorship of the harmful expression conveyed via …

Social Security Privatization: An Ideologically Structured Movement, Judie Svihula, Carroll L. Estes
Social Security Privatization: An Ideologically Structured Movement, Judie Svihula, Carroll L. Estes
The Journal of Sociology & Social Welfare
We document the cumulative change in expressions of support for Social Security's social insurance ideals to privatization, from the late 1970s through 2007. Social Security's basic structure and principles generally were supported by the United States government and in amendments to the original Act of 1935. However, in the 1980s market arguments began to proliferate in government alongside pension privatization projects by international governmental organizations and conservative think tanks. Although in 1983 Commission members concluded "the Social Security system is sound in principle.. and... structure," four members wrote a supplemental statement that emphasized market rationalism. By 1994 dissension in Congress was …

Exploring The Impact Of Consumerism And The Role Of Stewardship In The Church, Christine Roush
Exploring The Impact Of Consumerism And The Role Of Stewardship In The Church, Christine Roush
Doctor of Ministry
This paper claims that Christianity, as practiced in the contemporary United States, fails to address the problem of consumption and that society desperately needs a Romans 12 movement. American Christians look similar to American non-Christians in almost every aspect of life. Others propose solutions to challenge the consumer culture. Organizations such as Crown Financial Concepts and Dave Ramsey's Financial Peace Seminars encourage individuals to use their wealth and resources wisely. Some experts suggest science and technology have produced dramatic results in the past and wiII continue to aid humanity in the future. Others claim more consumption addresses the problem because …
Dod Role For Securing United States Cyberspace, Jane J. Griffin
Dod Role For Securing United States Cyberspace, Jane J. Griffin
Theses and Dissertations
The cyber attacks on Estonia in late April and the early weeks of May 2007 significantly crippled the country, preventing it from performing banking, communications, news reporting, government transactions and command and control activities. Estonia is considered a “Wired Society”, much like the United States. Both countries rely on the cyberspace infrastructure economically and politically. Estonia sought assistance outside the country to recover from and to address the attacks. The cyber attacks on Estonia focused world-wide attention on the effects that cyberspace attacks could have on countries. If a cyber attack of national significance occurred against the United States, what …
