The following thesis is a qualitative comparative case study which investigated the values, practices, perspectives, and strategies of Indian and American community organizers (practitioners and volunteers of non-profits and non-governmental organizations) who use microfinance, including savings schemes, as an instrument within the social intermediation process of developing disadvantaged women's capacities for self-sufficiency/empowerment. The focused inquiry was conducted through similarly structured in-depth interviews of directors, staff members and volunteers/community-based organizers of a women's business center in Northern Virginia, a large U.S. metropolitan area, and a women's federation in the rural Himalayas of Uttarakhand, India. The most studied and academically debated laws regarding outer space consist of the five United Nations treaties, which were entered into force from 1967 to 1984. After this condensed period of treaty activity, United Nations resolutions and principles took the place of treaties on which consensus otherwise needed to be achieved. Hard space law developed primarily at the national level in the form of various acts or regulations adopted by individual nation states. Essays On Remote Monitoring As An Emerging Tool For Centralized Management Of Decentralized Wastewater Systems, Clement Solomon

According to the United States Environmental Protections Agency (USEPA), nearly one in four households in the United States depends on an individual septic system (commonly referred as an onsite system or a decentralized wastewater system) to treat and disperse wastewater. More than half of these systems are over 30 years old, and surveys indicate at least 10 to 20% might not be functioning properly. The USEPA concluded in its 1997 report to Congress that adequately managed decentralized wastewater systems (DWS) are a cost-effective and long-term option for meeting public health and water quality goals, particularly in less densely populated areas.;The …

When Deterrence And Death Mitigation Fall Short: Fantasy And Fetishes As Gap-Fillers In Border Regulation, Mary D. Fan

Drawing on fieldwork and political theory with Lacanian psychoanalytic influences, this article analyzes how fantasy and fetishes help sustain strategies shown to be no solution to U.S. border control problems. More than a decade after the official launch of the border control paradigm of "prevention through deterrence," predicated on the assumption that ramping up walls, barriers, policing, and the human costs of border crossing would deter, there has been scant evidence of deterrence and much evidence of diversion of migrants to more dangerous crossing points where death rates have soared. Effect Of Statute Changes On Admission Trends At A New Jersey State Psychiatric Hospital , Monica Malone

The impact of changes in New Jersey civil commitment laws on admission patterns at a New Jersey state psychiatric hospital was studied using an interrupted time series design. The target years were 1965, 1988, 1994, and 1998, years when significant changes in the commitment law took effect. The data studied were the total number of admissions per month. There were no significant changes in admission trends at any of the target dates. Possible reasons for these findings are discussed.

Rapid testing methods are needed for monitoring waters for fecal contamination to identify associated health hazards. Today, standard methods quantify the amount of indicator bacteria, E. coli and enterococci, using culture-based techniques that require incubation periods from 18 to 48 hours. For recreational waters, this time lag delays the closure of waters when a potential health hazard exists and prolongs closures after contamination has dissipated. A remotely deployable, autonomous sampler capable of rapid automated data analysis and reporting of fecal contamination would provide a more effective warning system for both managers and the public. There have been a number of recent studies documenting the various physical, psychological, and social health benefits associated with participation in regular physical activity. In response to compelling evidence of the benefits associated with improving health and in an attempt to promote healthy lifestyles, the Bush Administration proposed the Healthier U.S. Initiative (Executive Order 13266) in 2002. Several state legislatures now require that before a woman may consent to an abortion, she must first undergo an ultrasound and be offered the image of her fetus. The justification is that without an ultrasound, her consent will not be fully informed. Such legislation, the latest move in abortion regulation, supposes that a woman who sees the image will be less likely to abort. This Article explores how visual politics has combined with visual technology, and how law has seized upon both in a campaign to encourage women to choose against abortion. This chapter uses data from the Federal Reserve Board's Survey of Consumer Finances for 2004 (the "SCF") to examine the penetration of credit cards into LMI markets. The chapter has two purposes. First, I discuss the rise of the modern credit market, emphasizing the segmentation of product lines based on behavioral and financial characteristics of customer groups. Among other things, that trend involves the use of products aimed at LMI households that differ significantly from those aimed at middle-class households. This is book review of Lawrence O. Gostin's new edition of Public Health Law: Power, Duty, Restraint (University of California Press, Berkeley, California, 2d ed., 2008). A review of a second edition of a book may be somewhat unusual as subsequent editions of already published works typically do not break new ground. But this book is different. Gostin's first edition, published in 2000, established and defined the modern field of public health law. The revised and expanded second edition emerges in the post-9/11, post-Katrina, post-Bush world. Gostin now seeks to apply public health paradigms to social problems beyond the field's …

The Perspective And Practice Of Leadership By Managers Within The Virginia Department Of Corrections: An Instrumental Case Study, Elizabeth M. Gagnon

This dissertation explores the extent to which the perspective and practice of leadership by managers in the Virginia Department of Corrections (DOC) reflect the Leadership Perspectives Model (LPM), and the extent to which their perspective varies by level of management. The LPM is a model of leadership that consolidates leadership study into five distinct leadership perspectives that managers use in their understanding and practice of leadership. This study builds upon research in which the a LPM was tested and validated within a sample managers from municipal government agencies (M. R. Fairholm, 2004a, 2004b).

For close to 50 years, so-called ‘dons’ have positioned themselves as civic leaders in Jamaica, gaining acceptance among poor urban communities and (tacit) political recognition in the wider society. The dons' systematic, coercive organization of the ghetto community and the counter-hegemonic, executive-style bureaucracy and culture entrenched here resembles the ‘godfather’-led criminal culture and power of the (Italian) Mafia. However, over the last ten years the Mafia has faced a considerable decline in its omnipotence, due to increased state intervention and resistance within civil society, particularly by women in the local Italian communities. The concept of the rule of law ties together the seemingly disparate strands of administrative law. Indeed, the puzzles and tensions that administrative law evokes cannot be understood without recourse to this foundational concept. This chapter discusses several of the key attributes of the rule of law and explores their relevance for Canadian administrative law, for example: the rule of law as an unwritten constitutional principle; the rule of law as a political ideal which structures institutional relations and competencies; and, the rule of law as a distinctive political morality. In a large number of products liability lawsuits, sellers assert that plaintiffs' claims should be rejected because their products fall under some federal regulatory regime, and that the regulatory statute takes precedence over or preempts state tort law. This paper is an attempt to set out a positive theory of the doctrine on preemption of products liability claims. The federal case law is largely consistent with an approach that seeks to minimize the costs of erroneous decisions to preempt tort lawsuits. In particular, two factors explain many of the outcomes of the preemption cases in federal courts: agency independence and …
