Too many deer–vehicle collisions (DVCs) are one of the primary reasons local governments implement lethal deer management programs. However, there are limited data to demonstrate that a reduction in deer (Odocoileus spp.) densities will result in a decline in DVCs. We conducted sharpshooting programs in 3 suburban communities to reduce deer numbers and to address rising DVCs. Annual or periodic population estimates were conducted using both helicopter snow counts and aerial infrared counts to assess population trends. Management efforts were conducted from 3 to 7 years. Local deer herds were reduced by 54%, 72%, and 76%, with resulting reductions …

Burgeoning deer populations in urban and suburban areas, along with the inherent problems stemming from this increase, are becoming increasingly widespread. To address these problems, wildlife biologists need quality baseline data of herd composition for harvest and treatment forecasts for management and fertility control research programs. In this study, we provide white-tailed deer (Odocoileus virginianus) population data from 4 areas where localized suburban white-tailed deer populations were substantially reduced utilizing sharpshooting as a management tool. Consensus is lacking regarding the influence of vehicle speed and traffic volume on deer–vehicle collision (DVC) rates. Yet, annual average daily traffic fl ow (AADT) and posted speed limit (PSL) typically are used to measure these variables. To resolve this conflict, we studied the effects of traffic volume and vehicle speed on DVCs in Utah. Our results showed no relationship between AADT or PSL and DVC occurrence. There are at least 3 explanations for our results: (1) no causal relationship exists; (2) AADT and PSL, as measured, actually explain little of the variation; and (3) data quality problems exist. Although good data are lacking, published estimates suggest that >1.5 million deer– vehicle collisions (DVCs) occur annually in the United States. The estimated losses exceed 1 billion dollars. In some states, DVCs are a major cause of reportable accidents. Federal, state, and private partners have cooperated in monitoring trends in DVCs and implementing mitigation measures. Most of this information about such measures is readily available via the Internet. The purpose of this paper is to provide the reader with a broad overview of and a guide to the information currently available online to mitigate DVCs.

The development and maintenance of highway infrastructure in the US is becoming an important challenge due to increasing costs and revenues that are not adequate to meet the costs. Traditionally, fuel taxes have provided a significant portion of the revenues for the highway network. This research evaluates the impacts of changes in automobile and light truck fleet fuel economies, as well as hybrid and alternative fuel vehicles in the fleet, on gasoline tax based revenues. Background: Most children at petting zoos are at least somewhat naïve with respect to animal contact, which is probably why they are being taken to a petting zoo. Unfortunately, their immune systems may be equally naïve, thereby putting these children at high risk of contracting one of several enteric zoonotic diseases. A cross-sectional study was conducted to determine public and organizational compliance with current recommendations for hygiene and public safety for human-animal contact at permanent and temporary petting zoos. This research examines the roles that race and political party affiliation play in an elections official's knowledge of voting rights restoration for felons in Illinois. Felon disenfranchisement as public policy traces a path from pre-modem society to present day and has become a viable issue as the numbers of those incarcerated and denied voting rights has increased. This research proposes to determine if felon disenfranchisement as public policy is prevalent in Illinois, a state that grants franchise to felons after release from Department of Corrections custody or if, as the academic and scholarly literature proposes, it is so entrenched in …

Our society and laws allow a space for a multitude of identities and forms of expression. Many kinds of differences are legally protected in various ways, such as differences in race, religion, and gender. Sometimes protection takes the form of requiring social institutions to adapt to the unique needs of certain individuals or groups. Rights for disabled individuals, as exemplified by the Americans with Disabilities Act, rest on the principle that impairment disables because the world is structured around an incompatible model of human ability; not because of a fundamental deficit within the individual. Feminism has long been concerned with privacy. Second-wave feminists assailed the divide between the public and the private spheres that trapped women in the home, excluded them from the workforce, and subjected them to domestic abuse. Second-wave feminists also argued in favor of a sphere of privacy that would allow women to make reproductive choices without state interference. These were powerful critiques of existing power structures, but they tended to overlook the experiences of poor women. As a condition of receiving welfare benefits, poor women have been subjected to drug tests, and they continue to face unannounced home inspections by …

How does one estimate the value of an individual's time? One possible way is to estimate how much a person is willing to pay for time savings. The majority of transportation studies have used stated preference surveys to estimate an individual's willingness to pay (WTP) for travel time savings. However, stated preferences approaches are subject to hypothetical bias since they elicit WTP for hypothetical outcomes instead of real outcomes. One study used a revealed preference approach in a natural experiment to elicit WTP for travel time savings but the data was for a non-recurring event, which was not replicable. The …

Intermittent access to improved urban water supplies is a large and expanding global problem. This paper describes 16 supply enhancement and 23 demand management actions available to urban residential water users in Jordan to cope with intermittent supplies. We characterize actions by implementation, costs, and water quantities and qualities acquired or conserved. This effort systematically identifies potential options prior to detailed study and shows that water users have significant capacity to affect demand. We suggest several methods to evaluate options and highlight the need to include local water management decisions in integrated water resources management and planning at utility and …

This Article examines the correlation between the Court's perception and its resolution of the constitutional issues, most dramatically exhibited in Atkins. Part II of this Article briefly examines the history of discrimination against persons with mental retardation. Part III of this Article traces the history of the Court's decisions involving persons with mental retardation, giving special attention to the way in which the Justices' opinions reveal their apparent understanding of mental retardation and the relationship between individuals who have the disability and the law.5 Finally, Part IV addresses the Atkins opinion itself, with emphasis on the Court's understanding of mental …

To some, applying the National Environmental Policy Act (NEPA) to decisions affecting land use in an urban or built environment is an oxymoron. Cities have historically not been seen “as natural entities but as foreign impositions upon the native landscape,” places where the physical environment is already largely destroyed or reduced to insignificant remnants. Moreover, detecting the required federal presence to trigger NEPA may initially seem difficult when decisions affecting urban resources appear to be principally made by local or state agencies.

States and other governmental bodies increasingly invoke the government speech defense to First Amendment challenges by private parties who seek to alter or join what the government contends is its own expression. These disputes involve competing claims to the same speech: a private party maintains that a certain means of expression reflects (or should be allowed to reflect) her own views, while a public entity claims that same speech as its own, along with the ability to control its content.

Our nation's 9-1-1 system's success to date belies the fact that its core premises will not continue to serve it effectively and it has come to a critical juncture. In particular, the balkanized nature of 9-1-1 operations that differ across jurisdictions and are supported by Byzantine funding mechanisms obscure a simple but profound development: our nation's emergency system is not keeping up with or taking advantage of technological change. This essay, to be published in the First Amendment Law Review's forthcoming symposium issue on Public Citizens, Public Servants: Free Speech in the Post-Garcetti Workplace, critiques the Supreme Court's decision in Garcetti v. Ceballos as reflecting a distorted understanding of government speech that overstates government's own expressive interests while undermining the public's interest in transparent government.
In Garcetti, the Court held that the First Amendment does not protect public employees' speech made "pursuant to their official duties," concluding that a government employer should remain free to exercise "employer control over what the employer itself has commissioned or created." …
