Charkaoui And Bill C-3: Some Implications For Anti-Terrorism Policy And Dialogue Between Courts And Legislatures, Kent Roach

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

The first part of the paper examines Charkaoui withparticular attention to the Court’s survey of less rights-invasive alternatives, including British special advocates and the Arar Commission’s use of security-cleared lawyers. The Court’s holding with respect to indeterminate detention and its relation to the possibility of deportation to torture is also examined. The second part of the paper examines the legislative response to Charkaoui with attention to the role of special advocates and the role of Federal Court judges in defining their precise role. The issue of whether Parliament simply obeyed the Court’s decision or expanded the policy debate is examined. In …

Lidar In Coastal Storm Surge Modeling: Modeling Linear Raised Features, David Coggin Jan 2008

Lidar In Coastal Storm Surge Modeling: Modeling Linear Raised Features, David Coggin

Electronic Theses and Dissertations

A method for extracting linear raised features from laser scanned altimetry (LiDAR) datasets is presented. The objective is to automate the method so that elements in a coastal storm surge simulation finite element mesh might have their edges aligned along vertical terrain features. Terrain features of interest are those that are high and long enough to form a hydrodynamic impediment while being narrow enough that the features might be straddled and not modeled if element edges are not purposely aligned. These features are commonly raised roadbeds but may occur due to other manmade alterations to the terrain or natural terrain. …

Negligent Hiring And Criminal Rehabilitation: Employing Ex-Convicts, Yet Avoiding Liability, Timothy L. Creed Jan 2008

Negligent Hiring And Criminal Rehabilitation: Employing Ex-Convicts, Yet Avoiding Liability, Timothy L. Creed

St. Thomas Law Review

This article will argue that the proper way to balance the competing public policies of protecting victims from workplace harm and of reintegrating ex-convicts is for states to make it clear to employers when they will be liable for negligent hiring and when they can hire ex-convicts and avoid liability. States can accomplish this in at least two ways. First, states should adopt uniform and clear requirements for negligent hiring while retaining employers' discretion to refuse ex-convicts employment based solely on their status as ex-convicts. Second, all states should fashion legislation with similar requirements. For example, courts should hold employers …

Blackwater And The Privatization Of Immigration Control, Robert Koulish Jan 2008

Blackwater And The Privatization Of Immigration Control, Robert Koulish

St. Thomas Law Review

In this article, I examine the significance of Blackwater's move to the border and its recent post 9/11 involvement in immigration control. I argue that Blackwater is symbolic of a much larger immigration industrial complex, privatizing decades of border militarization and low intensity conflict that, as author Tim Dunn has documented, has been waged against border crossers and residents since the 1970s. I also argue that Blackwater is part of a post-9/11 neo-liberal regime that is designed to re-territorialize and privatize the war on terror on the domestic front. Finally, I contend that the immigration industrial complex, with Blackwater quickly …

When Mobile Phones Are Rfid-Equipped - Finding E.U.-U.S. Solutions To Protect Consumer Privacy And Facilitate Mobile Commerce, Nancy J. King Jan 2008

When Mobile Phones Are Rfid-Equipped - Finding E.U.-U.S. Solutions To Protect Consumer Privacy And Facilitate Mobile Commerce, Nancy J. King

Michigan Telecommunications & Technology Law Review

New mobile phones have been designed to include delivery of mobile advertising and other useful location-based services, but have they also been designed to protect consumers' privacy? One of the key enabling technologies for these new types of phones and new mobile services is Radio Frequency Identification (RFID), a wireless communication technology that enables the unique identification of tagged objects. In the case of RFID-enabled mobile phones, the personal nature of the devices makes it very likely that, by locating a phone, businesses will also be able to locate its owner. Consumers are currently testing new RFID-enabled phones around the …

Parliament’S Response To Charkaoui: Bill C-3 And The Special Advocate Regime Under Irpa, David Dunbar, Scott Nesbitt Jan 2008

Parliament’S Response To Charkaoui: Bill C-3 And The Special Advocate Regime Under Irpa, David Dunbar, Scott Nesbitt

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

The Supreme Court of Canada’s decision in Charkaoui and Parliament’s subsequent enactment of Bill C-3 demonstrate how the Charter dialogue between the judiciary and legislatures can enhance the protection of constitutional rights and freedoms while preserving the ability of elected officials to pursue legitimate policy objectives. The notion of constitutional dialogue suggests that Charkaoui be read as setting parameters for future legislative action, recognizing not only those aspects of the security certificate scheme where the Court found constitutional deficiencies, but also those where it found the scheme to be constitutionally sound. The Court’s conclusion that the in camera, ex parte hearing …

Aboriginal Over-Representation And R. V. Gladue: Where We Were, Where We Are And Where We Might Be Going, Jonathan Rudin

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

The most significant development in the criminal law for Aboriginal people over the last 25 years was the decision by the Supreme Court of Canada in R. v. Gladue. This paper looks at the background and history behind the Gladue decision, the impact or lack of impact of the decision on Aboriginal rates of over-representation and the role that the Charter, notably section 15, has played and might play in this issue over the coming years.

Foreword: Making Sense Of Information For Environmental Protection, James Salzman, Douglas A. Kysar

Faculty Scholarship

Despite the ubiquity of information, no one has proposed calling the present era the Knowledge Age. Knowledge depends not only on access to reliable information, but also on sound judgment regarding which information to access and how to situate that information in relation to the values and purposes that comprise the individual's or the social group's larger projects. This is certainly the case for wise and effective environmental governance. A regulator needs accurate information to understand the nature of a problem and the consequences of potential responses. Likewise, the regulated community needs information to decide how best to comply with …

Combating The Color-Coded Confinement Of Kids: An Equal Protection Remedy, Perry L. Moriearty Jan 2008

Combating The Color-Coded Confinement Of Kids: An Equal Protection Remedy, Perry L. Moriearty

Articles

This Article considers the viability of a constitutional challenge to the disproportionate confinement of juveniles of color – a phenomenon known as “disproportionate minority contact” or “DMC.” Specifically, I ask whether, in the wake of McCleskey v. Kemp and its progeny, it is possible bring an Equal Protection claim based on statistical evidence that juveniles of color are significantly more likely to be detained by juvenile court judges than similarly-situated white youth. I argue that the nature of the juvenile detention decision places it squarely within the contours of the types of administrative decisions for which the Supreme Court has …

A Slower Form Of Death: Implications Of Roper V. Simmons For Juveniles Sentenced To Life Without Parole, Barry C. Feld Jan 2008

A Slower Form Of Death: Implications Of Roper V. Simmons For Juveniles Sentenced To Life Without Parole, Barry C. Feld

Articles

The Supreme Court in Roper v. Simmons 1 interpreted the Eighth Amendment to prohibit states from executing offenders for crimes they committed when younger than eighteen years of age. The Court relied on objective indicators of "evolving standards of decency," such as state statutes and jury decisions to support its judgment that a national consensus existed against executing adolescents. The Justices also conducted an independent proportionality analysis of youths' criminal responsibility and concluded that their reduced culpability warranted a categorical prohibition of execution. Juveniles' immature judgment, susceptibility to negative peer influences, and transitory personality development diminished their criminal responsibility. Because …
