From Little Rock To Seattle And Louisville: Is "All Deliberate Speed" Stuck In Reverse?, Charles J. Ogletree Jr., Susan Eaton

University of Arkansas at Little Rock Law Review

More than 50 years after Brown v. Board of Education, in Parents Involved in Community Schools v. Seattle School District, the Supreme Court issued a much anticipated, sharply divided opinion concerning the conscious use of a student’s "race" in plans to desegregate now de facto segregated public schools. The Court found unconstitutional the race-inclusive methods used by the Seattle and Louisville public school officials who were attempting to create racially integrated schools.

In order to understand the full impact of the Supreme Court’s recent decisions regarding school desegregation, an analysis of the Seattle and Louisville plans and the Court’s reasoning …

Student Motivation And Attitude Towards Virtual Versus Traditional Learning Based On Cognitive Styles, Wacheerapan Kaewprapan, Surachai Suksakulchai Jan 2008

Student Motivation And Attitude Towards Virtual Versus Traditional Learning Based On Cognitive Styles, Wacheerapan Kaewprapan, Surachai Suksakulchai

EDU-COM International Conference

The purpose of this study was to identify differences in student motivation and attitude in relation to cognitive styles between two types of instruction (virtual and traditional). The study‘s participants were 40 first-year students enrolled in the Metal Technology Department at Rajamangala University of Technology Phra Nakhon Thailand. All students were doing a virtual reality module within one course and traditional lecture within another. The students completed a cognitive style test (Group Embedded Figures Test) which classified students as either field-dependent (FD) or field-independent (FI). Students also completed a questionnaire designed to measure motivation and attitude. The sample included 20 …

Parametric Probability Densities And Distribution Functions For Tukey G-And-H Transformations And Their Use For Fitting Data, Todd C. Headrick, Rhonda K. Kowalchuk, Yanyan Sheng Jan 2008

Parametric Probability Densities And Distribution Functions For Tukey G-And-H Transformations And Their Use For Fitting Data, Todd C. Headrick, Rhonda K. Kowalchuk, Yanyan Sheng

Publications

The family of g-and-h transformations are popular algorithms used for simulating non-normal distributions because of their simplicity and ease of execution. In general, two limitations associated with g-and-h transformations are that their probability density functions (pdfs) and cumulative distribution functions (cdfs) are unknown. In view of this, the g-and-h transformations’ pdfs and cdfs are derived in general parametric form. Moments are also derived and it is subsequently shown how the g and h parameters can be determined for prespecified values of skew and kurtosis. Numerical examples and parametric plots of g-and-h pdfs …

Less Privacy Please, We're British: Investigating Crime With Dna In The U.K. And The U.S., Duncan Carling

UC Law SF International Law Review

The United States and Great Britain are the world leaders in the use of DNA databases for criminal investigations, but the laws governing their use are evolving differently in each country. This note compares the American and British DNA database programs, and looks at two notable differences in practice: the collection of DNA samples from people who have been arrested but not convicted, and the technique of looking for an offender's relatives in the database. The note offers an explanation as to why the legislation is evolving differently, and argues that disparate cultural views on privacy are as much part …

The Effect Of Intellectual Property Protection On Economic Growth, Andrew Jonathan Mahurin Jan 2008

The Effect Of Intellectual Property Protection On Economic Growth, Andrew Jonathan Mahurin

Masters Culminating Experiences (1993-2011)

This paper tests whether stronger intellectual property protection is good for a country. It focuses on the overall effect of intellectual property protection on per capita economic growth. To measure the strength of intellectual property protection, I use the Ginarte-Park index. An education and an investment variable are also included in the models.

The models are based on simple linear regressions involving a cross-section of countries. The models consistently showed a negative correlation between intellectual property protection and per capita economic growth. Moreover, I tested to see if the effect is different in some countries than in others, based on …

A Pluralistic Approach To Oppression And Latino Terra Nullius, Valerie J. Phillips Jan 2008

A Pluralistic Approach To Oppression And Latino Terra Nullius, Valerie J. Phillips

St. Thomas Law Review

This paper contains the substance of a talk that I gave at LatCrit XII in Miami, Florida on Panel C4: Coalition Building, Globally and Locally. It is an outgrowth of my observation of the relative lack of participation by indigenous peoples from the Americas, particularly from the South, within LatCrit itself. It draws on my lived experiences at LatCrit's South-North Exchange on Theory, Culture, and Law in San Juan, Puerto Rico in May of 2005 (SNX 2005) as well as the comments of my hotel roommate, June McCue at the University of British Columbia law school in Canada. The topic …

24 And The Efficacy Of Torture, Matthew D. Semel Jan 2008

24 And The Efficacy Of Torture, Matthew D. Semel

Criminal Justice Faculty Publications

In the Fox Television Network program 24 a fictional counterterrorism agent named Jack Bauer uses extreme measures, including torture, to save the United States from catastrophic terrorist attacks. Bauer uses torture even though its efficacy is in question and it is illegal. Political leaders, including President George Bush, have endorsed the use of torture and Bauer's fictional success has reinforced that the idea these methods are both necessary and effective in obtaining actionable intelligence. This paper examines existing literature on military interrogations in the context of 24 and reviews empirical and descriptive evidence about existing practices. While researchers cannot ethically …

Cover To Cover: Contemporary Issues In Popular Women’S Magazines, Debbie Danowski

Communication, Media & The Arts Faculty Publications

Exposure to popular magazine covers is widespread among even those choosing not to read a particular magazine. With news racks in all grocery and convenience stores, the American public cannot escape at least a quick glance at the material presented on the cover. Because of this, it is vital that we analyze the messages being disseminated each month through these publications.

This study will attempt to analyze and categorize the messages sent out via the covers of the five most popular general interest women's magazines with the highest circulation during the year 2000: Family Circle, Good Housekeeping, Ladies' Home Journal, …

Memories Of Home: Reading The Bedouin In Arab American Literature, Anissa J. Wardi, Katherine Wardi-Zonna

Ethnic Studies Review

In an urban neighborhood with a large Jewish population near my home, there is an Arabic restaurant. Name, menu and ownership mark its ethnic identification, yet its politics are otherwise obscured. An American flag, permanently placed in the restaurant's window since 9/11, greets American customers with a message of reconciliation. I am one of you, it says: come; eat; you are welcome here. In a climate where "Arabs, Arab-Americans and people with Middle Eastern features, everywhere are struggling to merely survive the United States' aggressive drive to 'bring democracy to the Middle East'" (Elia 160) and where the hostility toward …

Presidential Power In Comparative Perspective: The Puzzling Persistence Of Imperial Presidency In Post-Authoritarian Africa, H. Kwasi Prempeh Jan 2008

Presidential Power In Comparative Perspective: The Puzzling Persistence Of Imperial Presidency In Post-Authoritarian Africa, H. Kwasi Prempeh

UC Law Constitutional Quarterly

This Article focuses on the comparative dimension of a phenomenon that is already well known to U.S. constitutional discourse: the imperial presidency. While U.S. constitutional scholars have shown a great deal of interest in new constitutional courts in the world's newest democracies, the contemporaneous phenomenon of persistent imperial presidency in Africa has been largely ignored. Although relatively little attention has been paid to it in comparative constitutional discourses, Africa has witnessed since 1990 a dramatic transition to democratic rule that has resulted in the toppling of many of the region's long-reining autocrats and the installation of new counter-authoritarian constitutions. However, …

Reconstructing Contemporary Democracy, Jan Aart Scholte Jan 2008

Reconstructing Contemporary Democracy, Jan Aart Scholte

Indiana Journal of Global Legal Studies

Democratic practice varies historically, and transformations of the societal context require accompanying reconstructions of democracy if "rule by the people" is to remain meaningful. Contemporary society is witnessing particularly profound changes in underlying structures of space, governance, and identity. Fundamental reconsideration of democracy is therefore also needed. This article first develops a generic understanding of democracy; next elaborates on currently unfolding transformations of geography, regime, and community; and then develops a five-faceted reconstruction of democracy to meet these changed circumstances. This prescription entails: (1) reconceptualizing democracy, shifting away from obsolete assumptions of territorialists pace, statist regulation, and nationalist identity; (2) …

The Effects Of Target Age And Perceived Death Responsibility On Posthumous Impression Formations, Jenny Rebekah Heilborn Jan 2008

The Effects Of Target Age And Perceived Death Responsibility On Posthumous Impression Formations, Jenny Rebekah Heilborn

Master's Theses

Death positivity biases and posthumous evaluations are considered a universal normative social phenomenon which influences social judgments of the dead; we postulate that these individual biases are mediated by both sympathy and fear of mortality, or the belief in a just world. Study 1 postulated that sympathy mediates such positivity biases when target responsibility for cause of death is manipulated. We hypothesized the mediation of the just world violation on posthumous evaluatory measures when age at the time of death was manipulated in Study 2. Although results were inconclusive for both studies, alternate hypotheses and boundary conditions of death positivity …

Introduction: Re-Stating The Standard Of Practice For Death Penalty Counsel: The Supplementary Guidelines For The Mitigation Function Of Defense Teams In Death Penalty Cases, Eric M. Freedman Jan 2008

Introduction: Re-Stating The Standard Of Practice For Death Penalty Counsel: The Supplementary Guidelines For The Mitigation Function Of Defense Teams In Death Penalty Cases, Eric M. Freedman

Hofstra Law Review

This is the Introduction to the Hofstra Law Review symposium issue on the Supplementary Guidelines for the Mitigation Function of Defense Teams in Death Penalty cases, and summarizes its thirteen articles.

A central - indeed, arguably the central - duty of defense counsel in a capital case is to humanize the client in the eyes of those who will decide his fate. The daunting task of imagining, collecting, and presenting such mitigation evidence pervades counsel's responsibilities from themoment of detention on potentially capital charges to the instant of execution.

A truly multi-disciplinary team, with skills in eliciting and documenting sensitive …

Capital Guidelines And Ethical Duties: Mutually Reinforcing Responsibilities, Lawrence J. Fox Jan 2008

Capital Guidelines And Ethical Duties: Mutually Reinforcing Responsibilities, Lawrence J. Fox

Hofstra Law Review

This article appears in the Hofstra Law Review symposium issue on the Supplementary Guidelines for the Mitigation Function of Defense Teams in Death Penalty cases.

It is counsel, and not any non-lawyer member of the multidisciplinary defense team which needs to be assembled to provide competent representation in a capital case, who bears ultimate responsibility for the team's performance and for decisions affecting the client and the case. This article describes the many respects in which counsel's specific obligations under both the ABA's Guidelines for the Appointment and Performance of Defense Counsel in Death Penalty Cases reprinted in 31 Hofstra …

The Indispensable Role Of The Mitigation Specialist In A Capital Case: A View From The Federal Bench, Helen G. Berrigan Jan 2008

The Indispensable Role Of The Mitigation Specialist In A Capital Case: A View From The Federal Bench, Helen G. Berrigan

Hofstra Law Review

This article appears in the Hofstra Law Review symposium issue on the Supplementary Guidelines for the Mitigation Function of Defense Teams in Death Penalty cases.

Writing from the perspective of a federal trial judge, the author, who is Chief Judge of the United States District Court for the Eastern District of Louisiana, describes the crucial importance of mitigation development in the trial of a capital case in accordance with the ABA's Guidelines for the Appointment and Performance of Defense Counsel in Death Penalty Cases reprinted in 31 Hofstra L. Rev. 913 (2003) and the Supplementary Guidelines that are the subject …

Evolving Standards Of Decency: Advancing The Nature And Logic Of Capital Mitigation, Craig Haney Jan 2008

Evolving Standards Of Decency: Advancing The Nature And Logic Of Capital Mitigation, Craig Haney

Hofstra Law Review

This article appears in the Hofstra Law Review symposium issue on the Supplementary Guidelines for the Mitigation Function of Defense Teams in Death Penalty cases.

The article builds on converging lines of research in the social sciences that have constructed a framework which conceptualizes the roots of violent behavior as extending beyond the personality or character structure of those people who perform it, connecting it historically to the brutalizing experiences they have commonly shared as well as the immediately precipitating situations in which their violence transpires.

The piece explains how to translate these insights into the collection and presentation of …

The Importance Of Recognizing Trauma Throughout Capital Mitigation Investigations And Presentations, Kathleen Wayland Jan 2008

The Importance Of Recognizing Trauma Throughout Capital Mitigation Investigations And Presentations, Kathleen Wayland

Hofstra Law Review

This article appears in the Hofstra Law Review symposium issue on the Supplementary Guidelines for the Mitigation Function of Defense Teams in Death Penalty cases.

A PhD. in psychology, the author formerly served on the faculty of Duke University Medical Center, where her primary emphasis was on traumatic stress syndromes and the psychological consequences of chronic exposure to interpersonal violence. For the last fifteen years she has been assisting capital defender organizations in integrating mental health themes into mitigation narratives. This article presents the current state of scientific knowledge about trauma, treating the subject from these dual perspectives.

The inevitable …

Mitigation Abroad: Preparing A Successful Case For Life For The Foreign National Client, Gregory J. Kuykendall, Alicia Amezcua-Rodriguez, Mark Warren Jan 2008

Mitigation Abroad: Preparing A Successful Case For Life For The Foreign National Client, Gregory J. Kuykendall, Alicia Amezcua-Rodriguez, Mark Warren

Hofstra Law Review

Many capital defendants are foreign nationals; their representation both presents special challenges and offers special opportunities. In accordance with the ABA's Guidelines for the Appointment and Performance of Defense Counsel in Death Penalty Cases reprinted in 31 Hofstra L. Rev. 913 (2003) and the Supplementary Guidelines that are the subject of this issue, competent counsel must handle both effectively. Our article provides a detailed primer for accomplishing this.

A foreign country may acknowledge a person as a national on a basis that is not intuitively obvious to American counsel. If so, the person may be entitled to rights under both …

Competent Capital Representation: The Necessity Of Knowing And Heeding What Jurors Tell Us About Mitigation, John H. Blume, Sheri Lynn Johnson, Scott E. Sundby Jan 2008

Competent Capital Representation: The Necessity Of Knowing And Heeding What Jurors Tell Us About Mitigation, John H. Blume, Sheri Lynn Johnson, Scott E. Sundby

Hofstra Law Review

This article appears in the Hofstra Law Review symposium issue on the Supplementary Guidelines for the Mitigation Function of Defense Teams in Death Penalty cases.

Capital defense counsel have a duty at every stage of the case to take advantage of all appropriate opportunities to argue why death is not a suitable punishment for their particular client. But that duty can hardly be discharged effectively if the arguments are made in ignorance of available information concerning how persuasive they are likely to be to their audience.

Heeding that simple proposition we present lessons from the work of the Capital Jury …

Using The Supplementary Guidelines For The Mitigation Function Of Defense Teams In Death Penalty Cases To Change The Picture In Post-Conviction, Mark E. Olive, Russell Stetler Jan 2008

Using The Supplementary Guidelines For The Mitigation Function Of Defense Teams In Death Penalty Cases To Change The Picture In Post-Conviction, Mark E. Olive, Russell Stetler

Hofstra Law Review

This article appears in the Hofstra Law Review symposium issue on the Supplementary Guidelines for the Mitigation Function of Defense Teams in Death Penalty cases.

As the ABA's Guidelines for the Appointment and Performance of Defense Counsel in Death Penalty Cases reprinted in 31 Hofstra L. Rev. 913 (2003) detail, success in capital post-conviction proceedings will depend not just on the quality of the legal arguments counsel advance but, probably more critically, on counsel's skill at changing the picture that has previously been presented. The old facts and legal arguments - those which resulted in a conviction and imposition of …
