Promissory Estoppel And The Protection Of Interpersonal Trust , John J. Chung Jan 2008

Promissory Estoppel And The Protection Of Interpersonal Trust , John J. Chung

Cleveland State Law Review

This paper examines the role of trust in promissory estoppel and the extent to which the law should protect trust when a promise is made. Part II of this Article summarizes some of the scholarship discussing the nature and role of trust. In particular, it discusses the role of trust in a market economy, and the related role of trust in Contracts law. Part III examines whether there is a difference between trust and reliance, and whether it matters. Part III further asserts that a separate discussion of trust is beneficial because it has the potential to guide and inform …

Revisiting On-Line Discussion As Practice For Reflective Thinking In Three Sequential Classes, Charles Dittrich, Jonelle Pool, Divonna M. Stebick, Emily Weigler Jan 2008

Revisiting On-Line Discussion As Practice For Reflective Thinking In Three Sequential Classes, Charles Dittrich, Jonelle Pool, Divonna M. Stebick, Emily Weigler

Education Faculty Publications

In a previous study, the authors questioned the potential of an on-line environment for increasing productive reflection in three sequential education classes. Of their findings, the issue of consistency stood out as particularly perplexing, namely, why did students exhibit high level reflections sometimes, but not all the time, in an on-line environment? In this follow-up study, the authors question whether in-class reflections coupled with on-line prompts could yield consistently high level pre-service teacher reflections, as measured by individual and class progress over time. This study also examines perceived relationships between the length of a student's reflection and its productivity, as …

The Law Review Article Selection Process: Results From A National Study, Jason P. Nance, Dylan J. Steinberg Jan 2008

The Law Review Article Selection Process: Results From A National Study, Jason P. Nance, Dylan J. Steinberg

UF Law Faculty Publications

The student-edited law review has been a much criticized institution. Many commentators have expressed their belief that students are unqualified to determine which articles should be published in which journals, but these discussions have been largely based on anecdotal evidence of how journals make publication decisions. It was against that backdrop that we undertook a national survey of law reviews in an attempt to determine how student editors responsible for making publication decisions went about their task. This article compiles the results of that survey, which received 191 responses from 163 different journals. We analyzed 56 factors that influence the …

Tort Arbitrage, Robert J. Rhee Jan 2008

Tort Arbitrage, Robert J. Rhee

UF Law Faculty Publications

The economic models of bargaining and tort law have not been integrated into a coherent theory that reflects the empirical world. This Article models the interaction of settlement dynamics and the theory of negligence. It shows that tort claims are systematically devalued during settlement relative to the legal standard. Central to this thesis is a proper conception and accounting of cost. Cost is typically viewed as the transaction cost of litigation processing. Cost, however, encompasses more than this. Each dispute has a cost of resolution, defined as the discounting effect of risk on legal valuation. A spread between the parties' …

The Good And Bad News About Consent Searches In The Supreme Court, Tracey Maclin Jan 2008

The Good And Bad News About Consent Searches In The Supreme Court, Tracey Maclin

UF Law Faculty Publications

This article is about the Supreme Court's consent search doctrine. Part I describes how the law of consent searches developed between the 1920s and 1973, when Schneckloth v. Bustamonte was decided, which is the Court's seminal consent search case. Part II of the article is a discussion of Bustamonte. In particular, this part highlights the spoken and unspoken premises that influenced the result in Bustamonte and outlines Bustamonte's continuing relevance for consent search cases today. Part III examines United States v. Drayton, a ruling authored by Justice Kennedy that explains why a cryptic passage in that ruling provides important clues …

History And Ecological Basis For Areawide Pest Management, Norman C. Elliott, David W. Onstad, Michael J. Brewer Jan 2008

History And Ecological Basis For Areawide Pest Management, Norman C. Elliott, David W. Onstad, Michael J. Brewer

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

The traditional approach to pest management is to treat the crop or commodity in a particular management unit before an economically significant infestation of the pest has developed. Determining the need to take corrective action is based on the economic threshold concept, which forms the basis of most integrated pest management programmes (Metcalf and Luckman, 1975). Areawide pest management (AWPM) can be contrasted with traditional pest management in that pest management tactics are used over a broad spatial area, often treating the whole area simultaneously to maintain the pest below economic levels or, in some cases, completely eradicate it. A …

Uncertainty In Environmental Decision Making: Issues, Challenges And Future Directions, H. R. Maier, J. C. Ascough, M. Wattenbach, C. S. Renschler, W. B. Labiosa, J. K. Ravalico

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

There has been an increase in the use of formal approaches to environmental management. Jakeman and Letcher (2003) and Jakeman et al. (2006) have demonstrated the importance of integrated models as a means of assessing the response of environmental systems to proposed enlargement options. Gunderson and Holling (2000), Cowie and Borrett (2005), Curtis et al. (2005) and Pahl-Wostl (2005) have highlighted the need for the incorporation of social and institutional aspects into decision-making processes.

Background and Purpose: The purpose of this study was to collect data on the effects of incline and decline surfaces, combined with partial body weight support (PBWS), on muscle activity of the lower extremities during treadmill walking for normal subjects. By collecting lower extremity electromyographical (EM G) data we hope that the information may be applied to the development of treatment alternatives or future research options for patients with both neurological and orthopedic dysfunction.

Methods: Twenty subjects (14 female, 6 male) were recruited for this study. EMG data was collected for lower extremity muscle activity during conditions of level, incline …

Towards A Theology Of Liberation, Angus Brook Jan 2008

Towards A Theology Of Liberation, Angus Brook

Theology Papers and Journal Articles

In 1971 Gustavo Gutierrez was the first theologian to pronounce the advent of the theology of liberation. This book received both praise and criticism for its ‘radical new’ approach to theological endeavour. This paper will attempt to provide a broad overview of the complex processes or possibilities which led to the publishing of this book. In doing so, I will focus my discussion upon what has made liberation theology possible; the cultural environment, the intellectual inspiration, and the events that have played an important role in its development. Of course, I cannot hope to give depth to the breadth of …

The Characterisation Of God In Lamentations, Elizabeth Boase Jan 2008

The Characterisation Of God In Lamentations, Elizabeth Boase

Theology Papers and Journal Articles

One of the dominant characters within the book of Lamentations is God. God is spoken about and spoken to, although the voice of God is never heard. Various voices within the text speak of God, describing both God’s actions and God’s attributes. These descriptions give rise to various, and at times conflicting images: God is the violent destroyer of the city and her inhabitants; God is an absent God, whose presence is longed for; God is a God of steadfast love and mercy; God is the one in whom future hope lies. This paper analyses the multifaceted portrayal of the …

Humanism, Education And Spirituality: Approaching Psychosis With Levinas, Glenn J. Morrison Jan 2008

Humanism, Education And Spirituality: Approaching Psychosis With Levinas, Glenn J. Morrison

Theology Papers and Journal Articles

The article investigates the recent turn towards Emmanuel Levinas’ writings in the philosophy of Education. Engaging this turn, the article sets out to develop an ethical, personal and contemplative approach towards understanding and responding to psychosis. By imagining a Levinasian horizon for understanding the experience of psychosis in the Teaching-Learning environment, Levinas’ thought gives hope to take on the work of justice and offer a gift of friendship especially when faced with students experiencing psychosis. The approach towards people suffering the moods and difficulties of psychosis, the article argues, parallels the very spiritual practice of contemplation.

What The Erie Surrogate Triplets Can Teach State Legislatures About The Need To Enact Article 8 Of The Uniform Parentage Act (2000) , Robert E. Rains Jan 2008

What The Erie Surrogate Triplets Can Teach State Legislatures About The Need To Enact Article 8 Of The Uniform Parentage Act (2000) , Robert E. Rains

Cleveland State Law Review

This Article will explain the protracted legal battles over the "surrogate triplets" and explore potential legislation designed to avoid such battles in the future. While reasonable minds could certainly differ as to the wisdom of the legislative scheme proposed in Article 8 of the UPA (2000), or as to some of its details, surely it would be a vast improvement over the current situation in which most state legislatures have failed to address surrogacy through statutes and those that have done so have failed to act in a uniform manner. As the Erie triplets case amply demonstrates, the state courts …

Does Fraud Pay - An Empirical Analysis Of Attorney's Fees Provisions In Consumer Fraud Statutes , Debra Pogrund Stark, Jessica M. Choplin Jan 2008

Does Fraud Pay - An Empirical Analysis Of Attorney's Fees Provisions In Consumer Fraud Statutes , Debra Pogrund Stark, Jessica M. Choplin

Cleveland State Law Review

The discretionary language in some consumer fraud statutes may cause consumers and lawyers to be less likely to decide to bring even a strong meritorious consumer fraud case, impeding the articulated legislative policy to promote the bringing of such cases. These statutes should be modified to eliminate such discretion by the courts. Part II of the Article sets out the economic dilemma a typical consumer faces in deciding whether to bring an action under the common law to be compensated for her losses when she has been defrauded (the "economic feasibility" issue). It then discusses the legislative response to the …

Model Field Training And Evaluation Program Policy For The Turkish National Police Organization, Erhan Beyhan

Theses and Dissertations

Police field training and evaluation programs are vital for officer development; although very little research has been conducted in this area. This study aimed to build a field training and evaluation program policy for the Turkish National Police Organization using the framework of corresponding police departments’ programs in the United States. Mission statements, program structure, standard evaluation guidelines, field training officer selection, and recruit termination are the fundamental elements of the FTO programs, which were reviewed in this research.

Criminal Histories Of Methamphetamine Users: A Rural Analysis, Israt Zohra Jan 2008

Criminal Histories Of Methamphetamine Users: A Rural Analysis, Israt Zohra

Theses and Dissertations

This thesis examined criminal histories of methamphetamine users in rural counties of Arkansas. More specifically, the study explored the difference between methamphetamine users with and without criminal histories. Although there are plenty of research on demographic characteristics, sociological attributes, and drug dependencies of methamphetamine users, there seems to be a gap in the literature focusing on why certain methamphetamine users have been arrested versus users who have not been arrested. A preliminary analysis of the data indicated 60 percent of the participants in the study had criminal histories, while 40 percent have never been arrested; therefore, this study explored potential …

Art Education In Arkansas: The Organizational History Of The Arkansas Art Educators From 1922 To The Present, Ronda Ramsey May

Theses and Dissertations

The purpose of my research is to document the changes and advancements in art education in Arkansas through the written history of the art teacher organization, the Arkansas Art Educators (AAE). Chronicling the efforts of AAE's membership to advocate for art education will help preserve the history of AAE and connect it with the broader history of the educational developments in the state between 1922 and the present.

Institutional Processes Intended To Achieve Accreditation: An Investigation Of How The Leadership Approaches Of Deans Of Schools And Colleges Of Education, Organizational Factors, And Environmental Conditions Influence The Process, Donna R. Hunnicutt

Theses and Dissertations

The leadership approach of five deans of teacher education from institutions in a southern state were examined using a cross case comparative qualitative analysis to determine how the dean's leadership approach along with organizational factors and environmental conditions influence the National Council for Accreditation of Teacher Education (NCATE) accreditation process within their respective institutions. Five institutional sites were selected for the case studies based upon the institutional head count, number of teacher education candidates, institutional type, and date of the next NCATE accreditation visit. The five institutions included one doctoral intensive, one doctoral extensive, one master's granting, one private, and …

The Rhetoric Of Leadership: A Look At Leadership Through The Rhetorical Triangle, Kathryn M. Oliverio Jan 2008

The Rhetoric Of Leadership: A Look At Leadership Through The Rhetorical Triangle, Kathryn M. Oliverio

Theses and Dissertations

The rhetorical triangle (sender/message/receiver) applies to more than just writing papers and delivering speeches. It is applicable to effective leadership as well. This leadership triangle includes the leader, the message or the leader's goals, and the follower. In order for leaders to be effective, they must understand their strengths and weaknesses, because both help form a leader's morale character (ethos). Leaders must also analyze their audience. A leader's audience, referred to as followers in this Final Project, is made up of human beings and all humans are different. These differences can be analyzed by looking at differences in personality, needs, …

Women In Black: Shirin Neshat's Images Of Veiled Revolutionaries, Heyam Dannawi

Theses and Dissertations

Shirin Neshat, an Iranian-born artist, uses photography and film to address issues of female identity. When the Islamic Revolution took place in 1978-1979, Neshat was living in the United States. Unable to return to her homeland, she was exiled for eleven years. The Islamic Revolution became a defining moment in Neshat's life and work. The profound change that took place in Iran inspired her to address the role of Iranian women in religion and society, which subsequently became the basis of much of her work. The hijab or veil became a symbol of repression and oppression after the Islamic Revolution. …

Employment & Disability Law—Americans With Disabilities Act Of 1990—The Weight Of Personal Responsibility: Obesity, Causation, And Protected Physical Impairments, Matthew Glover Jan 2008

Employment & Disability Law—Americans With Disabilities Act Of 1990—The Weight Of Personal Responsibility: Obesity, Causation, And Protected Physical Impairments, Matthew Glover

University of Arkansas at Little Rock Law Review

On July 26, 1990, Congress enacted the Americans with Disabilities Act (ADA), which became effective two years later. Because the ADA lacked a list of all the disabilities it covered, courts have considered obesity and morbid obesity to be disabilities in some cases but not in others, notwithstanding the legislation’s desire for clarity and consistency in eliminating discrimination against the individuals with disabilities.

There seems to be a trend towards presuming that obesity is a matter of personal responsibility rather than a protected disability. The most recent developments in obesity jurisprudence have held that morbid obesity—absent evidence of physiological causation—was …
