Sunstein1s And 2s, Tracey E. George, Paul H. Edelman

Vanderbilt Law School Faculty Publications

In Six Degrees of Cass Sunstein: Collaboration Networks in Legal Scholarship, we began the study of the legal academy's collaboration network. When mathematicians discuss the nature of collaboration in their field they focus on the most influential collaborator in the discipline-- Paul Erdos, the peripatetic Hungarian mathematician who authored over 1500 papers with over 450 different collaborators before his death in 1996. They introduced the concept of the Erdos Number, which is the number of degrees of separation between a mathematician and Erdos.

Lessons In Access To Justice: Racialized Youths In Ontario's Safe Schools, Janet E. Mosher

Osgoode Hall Law Journal

Access to justice is often equated with access to institutionalized dispute resolution processes, and the objective barriers that hinder such access-costs and delay most particularly-are commonly identified as the primary objects of reform efforts. In sharp contrast, when interviews and focus groups were conducted with racialized youths in Toronto regarding their experiences of access to justice in the context of school disciplinary matters, accounts of access to dispute resolution processes being impeded by costs and delay did not figure prominently. The interviews and focus groups revealed that many racialized youths scarcely ever considered accessing institutionalized dispute resolution processes largely because …

A Double Edged Sword: Understanding Vanity Across Cultures, Srinivas Durvasula, Steven Lysonski

Marketing Faculty Research and Publications

Purpose – Based on their size, disposable income, and purchasing power, generation Y (Gen Y) consumers are viewed as the Holy Grail for marketers. Conversely, some of this group's behavior disturbs public policy officials, particularly when dealing with issues such as poor financial planning, bulimia and anorexia nervosa. The key question for both marketers and policy makers is what is the best way to understand the Gen Y segment? The vanity concept is used in this study as a way to understand the Gen Y consumer segment. The purpose of this paper is to examine vanity perceptions (cross-nationally and by …

Historic Thermal Calibration Of Landsat 5 Tm Through An Improved Physics Based Approach, Francis P. Padula Oct 2008

Historic Thermal Calibration Of Landsat 5 Tm Through An Improved Physics Based Approach, Francis P. Padula

Theses

This investigation is motivated by the current need for a detailed post launch calibration of the Thematic Mapper (TM) thermal band (Band 6), aboard NASA’s Landsat 5 spacecraft. The historical calibration spans the period from 1984 to 2007. It is through fusion of environmental data sources (i.e. buoy observations, surface observations, and radiosonde observations) that a vicarious calibration approach will be implemented to construct the complete calibration record of the Landsat 5 TM thermal band. The vicarious calibration process takes advantage of the long standing National Data Buoy Center (NDBC) moored buoy fleet to acquire historic ground truth measurements needed …

What Is Truth?: True Suspects And False Defamation, Peter B. Kutner Oct 2008

What Is Truth?: True Suspects And False Defamation, Peter B. Kutner

Fordham Intellectual Property, Media and Entertainment Law Journal

A television station reports that an individual is a suspect in a murder case. A newspaper reports that a business or charity is under investigation to determine whether it has provided funding to terrorists or terrorist organizations. It is true that the individual is a suspect in the police investigation of the murder, and that the government is investigating the business or charity for possible financial links to terrorists. However, the suspicion is wrong, or at least unprovable. As far as can be determined from the available evidence, the individual did not commit a murder, and the business or charity …

Fall 2008: The Next Chapter, St. Norbert College

St. Norbert College Magazine 2007-2012

A most excellent celebration

It’s a new chapter for the college and for the United States, too. The inauguration of St. Norbert’s seventh president preceded the U.S. election by less than a month. This conjunction of events has us looking at new beginnings that stand in noble traditions – and the kind of leadership that will ensure success in the 21st century.

On the cover: New president Thomas Kunkel leaves the platform after his inauguration Oct. 10. Behind Kunkel, the Bishop of Green Bay, David Ricken, and Abbot Gary Neville, O.Praem., ’73 lead the procession of guests departing the installation …

Shattering And Moving Beyond The Gutenberg Paradigm: The Dawn Of The Electronic Will, Joseph Karl Grant Oct 2008

Shattering And Moving Beyond The Gutenberg Paradigm: The Dawn Of The Electronic Will, Joseph Karl Grant

University of Michigan Journal of Law Reform

Legislators in Nevada have already acted to modernize the law of wills. This Article advocates that other states follow their lead and depart from what is described as the "Gutenberg Paradigm" by adopting similar legislation and embracing electronic technology. Part One of this Article explores the history of print, Johann Gutenberg's role in this development, and the emergence of the "Gutenberg Paradigm." Part Two examines the history and policy underpinnings of will execution formalities, and the role of the "writing" requirement. Part Three explores the use of electronic wills as conforming and nonconforming testamentary instruments. More specifically, Part Three highlights …

La Follette'S Folly: A Critique Of Party Associational Rights In Presidential Nomination Politics, Alan Martinson Oct 2008

La Follette'S Folly: A Critique Of Party Associational Rights In Presidential Nomination Politics, Alan Martinson

University of Michigan Journal of Law Reform

Every four years, observers of the presidential nomination season decry the undue influence of those states that hold their primaries first, particularly Iowa and New Hampshire. Currently, Democratic Party rules protect the position of these states. In 2008, two states disregarded party rules in order to move their primaries to a more influential position in the primary season. As punishment for disobeying the rules, the national party diluted the influence of the delegates from these states at the national convention. Legislative solutions to the problems of the current nomination process appear unlikely. Moreover, Supreme Court jurisprudence places no limits on …

From Pulp Hero To Superhero: Culture, Race, And Identity In American Popular Culture, 1900-1940, Julian C. Chambliss, William L. Svitavsky Oct 2008

From Pulp Hero To Superhero: Culture, Race, And Identity In American Popular Culture, 1900-1940, Julian C. Chambliss, William L. Svitavsky

Faculty Publications

Adventure characters in the pulp magazines and comic books of the early twentieth century reflected development in the ongoing American fascination with heroic figures. As established figures such as the cowboy became disconnected from everyday experiences of Americans, new popular fantasies emerged, providing readers with essentialist action heroes whose adventures stylized the struggle of the American everyman with a modern, industrialized, heterogeneous world. Popular characters such as Tarzan, Conan, the Shadow, and Doc Savage perpetuated the individualistic archetype Americans associated with the frontier cowboy and the struggles of manifest destiny while offering the fantastic adventure, exoticism, and escapism that modernity …

Liability For Lapses: First Or Second Order Negligence?, Robert D. Cooter, Ariel Porat Oct 2008

Liability For Lapses: First Or Second Order Negligence?, Robert D. Cooter, Ariel Porat

Coase-Sandor Institute for Law & Economics Research Paper Series

"First order precaution" directly affects the probability of an accident, such as judging the speed of a car and stepping on the brakes. Intentions are not always realized, so first order precaution is a draw from a probability distribution. Drawing an uncharacteristically low value is a "lapse." "Second order precaution" reduces the probability of a lapse. Examples include concentration when driving and preparation before performing a medical operation. The prevailing tort rule holds the injurer liable for harm caused by unreasonable first order precaution, regardless of second order precaution. Unlike the standard model, our model allows injurers to make second …

The Iphone And The Dmca: Locking The Hands Of Consumers, John Haubenreich Oct 2008

The Iphone And The Dmca: Locking The Hands Of Consumers, John Haubenreich

Vanderbilt Law Review

On August 24, 2007, less than two months after its initial release for sale, the Apple iPhone was unlocked, untethering the phones from the AT&T cellular network. Because AT&T has exclusive rights to provide coverage for the iPhone until the year 2010, hackers and computer enthusiasts worked feverishly to be the first to use the iPhone on a network other than AT&T. Although the practice of cell phone unlocking has been occurring for years, the tremendous public interest surrounding the launch of the iPhone focused attention on the issue like never before.

Wireless carriers can use software locks, hardware locks, …

The Changing Usage Of A Mature Campus-Wide Wireless Network, Tristan Henderson, David Kotz, Ilya Abyzov Oct 2008

The Changing Usage Of A Mature Campus-Wide Wireless Network, Tristan Henderson, David Kotz, Ilya Abyzov

Dartmouth Scholarship

Wireless Local Area Networks (WLANs) are now commonplace on many academic and corporate campuses. As "Wi-Fi" technology becomes ubiquitous, it is increasingly important to understand trends in the usage of these networks. This paper analyzes an extensive network trace from a mature 802.11 WLAN, including more than 550 access points and 7000 users over seventeen weeks. We employ several measurement techniques, including syslog messages, telephone records, SNMP polling and tcpdump packet captures. This is the largest WLAN study to date, and the first to look at a mature WLAN. We compare this trace to a trace taken after the network's …

Assessment And Refinement Of Real-Time Travel Time Algorithms For Use In Practice, Kristin A. Tufte, Sirisha Murthy Kothuri Oct 2008

Assessment And Refinement Of Real-Time Travel Time Algorithms For Use In Practice, Kristin A. Tufte, Sirisha Murthy Kothuri

TREC Final Reports

The Federal Highway Administration (FHWA) has set a high priority on the use of existing dynamic message signs (DMS) to provide travel time estimates to the public. The Oregon Department of Transportation (ODOT) currently has three DMS in the Portland metropolitan area configured to display travel time information. In the near future, ODOT would like to make travel time estimates available on additional DMS, over the Internet on tripcheck.com and via 511. Travel time estimates are valuable to the traveling public; however, the estimates must be accurate to be useful. The FHWA indicates that 90% accuracy is ideal and suggests …

Northern Range Expansion And Coastal Occurrences Of The New Zealand Mud Snail Potamopyrgus Antipodarum (Gray, 1843) In The Northeast Pacific, Timothy Mathias Davidson, Valance E. F. Brenneis, Catherine E. De Rivera, Robyn Draheim, Graham E. Gillespie

Environmental Science and Management Faculty Publications and Presentations

The New Zealand mud snail Potamopyrgus antipodarum (Gray, 1843) is a common invasive species in fresh and brackish water ecosystems in Europe, Australia, Japan, and North America. In some invaded habitats, P. antipodarum can reach high densities (over 500,000 snails m-2) and dominate the biomass of the benthos, leading to detrimental impacts to native biota and changes in ecosystem dynamics. We report the previously unpublished occurrence of P. antipodarum in thirteen fresh and brackish water systems adjacent to the Pacific coast of North America including a new northern range for P. antipodarum: Port Alberni, Vancouver Island, British …
