Securities Fraud, Recidivism, And Deterrence, Jayne W. Barnard Jun 2008

Securities Fraud, Recidivism, And Deterrence, Jayne W. Barnard

Dickinson Law Review (1908-2003)

Legal scholars have expended considerable energy on the study of high-level securities fraud violators-Ken Lay, Bernie Ebbers, Dennis Kozlowski, etc. There has been little attention, however, to the perpetrators of "retail" securities fraud-the con artists who sell bogus stock over the Internet, orchestrate elaborate pump-and-dump schemes, and create a never-ending array of purportedly "risk free" investment opportunities. Collectively, and in a cruel mockery of capitalism, these offenders extract hundreds of millions dollars from investors each year. In this article, Professor Barnard examines this group of offenders, focusing particularly on those who recidivate-often moving from state to state and scheme to …

On The (Legal) Study Methods Of Our Time: Vico Redux, Marianne Constable Jun 2008

On The (Legal) Study Methods Of Our Time: Vico Redux, Marianne Constable

Chicago-Kent Law Review

This essay draws on the form and spirit of Vico's On the Study Methods of Our Time to comment on intellectual and institutional approaches to U.S. legal studies today. It compares rhetoric to the many disciplines—philosophy, economics, sociology, political science, anthropology, poetry, and history—that take law as their subject matter. It argues that law is only partly understood by those who characterize it as command or as morality, as coercive system or as system of rules. It is only partly understood by those who reject law-on-the-books in favor of the empirical study of social behavior. It argues instead that attending …

Vico's Principle Of Sensus Communis And Forensic Eloquence, Thora Ilin Bayer Jun 2008

Vico's Principle Of Sensus Communis And Forensic Eloquence, Thora Ilin Bayer

Chicago-Kent Law Review

As professor of Latin eloquence at the University of Naples, Vico instructed young students in the principles of rhetoric joined with the principles of Roman jurisprudence. Vico understood the art of rhetoric as based in the art of topics and the art of memory. The places of memory reside in the sensus communis, which is the treasure-house of the images and meanings that underlie the life of all nations. Vico, like Shaftesbury, defines sensus communis as "communal sense," the shared sensibilities that exist among a given people, and ultimately among the whole human race. These common sensibilities are the …

Sublime Jurisprudence: On The Ethical Education Of The Legal Imagination In Our Time, Richard K. Sherwin Jun 2008

Sublime Jurisprudence: On The Ethical Education Of The Legal Imagination In Our Time, Richard K. Sherwin

Chicago-Kent Law Review

The broad dissemination of digital communication technologies is raising disturbing questions about the nature of truth as representation. This epistemological crisis shares an uncanny affinity with the crisis of representation that lay at the heart of the baroque era during the seventeenth century in Europe. The resolution of that crisis, through the work of Descartes and others, came on the heels of a philosophical shift from the image to the sign. However, as Vico presciently realized 300 years ago, Descartes' semiotic model, together with the totalizing rational method that accompanies it, are ill-suited to civic flourishing. Today, signifiers shorn of …

Editorial: Foreign Women In Prison, Biko Agozino Jun 2008

Editorial: Foreign Women In Prison, Biko Agozino

African Journal of Criminology and Justice Studies

The imprisonment of women worldwide has always been a controversial issue. This is partly because women do not end up in prison as frequently as men and so discussions of prison populations most often focus on the experiences of male prisoners. Therefore, any attempt to focus attention on the experiences of female prisoners raises questions in the minds of most scholars as to whether the conditions of women in prison are harsh enough compared to male prisons and whether we should not be focusing on the more severe conditions in male prisons? However, the rate of increase of female prisoners …

Assessing The Costs Of Sampling Methods In Active Learning For Annotation, James Carroll, Robbie Haertel, Peter Mcclanahan, Eric K. Ringger, Kevin Seppi Jun 2008

Assessing The Costs Of Sampling Methods In Active Learning For Annotation, James Carroll, Robbie Haertel, Peter Mcclanahan, Eric K. Ringger, Kevin Seppi

Faculty Publications

Traditional Active Learning (AL) techniques assume that the annotation of each datum costs the same. This is not the case when annotating sequences; some sequences will take longer than others. We show that the AL technique which performs best depends on how cost is measured. Applying an hourly cost model based on the results of an annotation user study, we approximate the amount of time necessary to annotate a given sentence. This model allows us to evaluate the effectiveness of AL sampling methods in terms of time spent in annotation. We acheive a 77% reduction in hours from a random …

Acoustic Characteristics Of English Lexical Stress Produced By Native Mandarin Speakers, Shawn L. Nissen, Yanhong Zhang, Alexander L. Francis Jun 2008

Acoustic Characteristics Of English Lexical Stress Produced By Native Mandarin Speakers, Shawn L. Nissen, Yanhong Zhang, Alexander L. Francis

Faculty Publications

Native speakers of Mandarin Chinese have difficulty producing native-like English stress contrasts. Acoustically, English lexical stress is multidimensional, involving manipulation of fundamental frequency (F0), duration, intensity and vowel quality. Errors in any or all of these correlates could interfere with perception of the stress contrast, but it is unknown which correlates are most problematic for Mandarin speakers. This study compares the use of these correlates in the production of lexical stress contrasts by 10 Mandarin and 10 native English speakers. Results showed that Mandarin speakers produced significantly less native-like stress patterns, although they did use all four acoustic correlates to …

Word Recognition Materials For Native Speakers Of Taiwan Mandarin, Shawn L. Nissen, Richard W. Harris, Alycia Dukes

Faculty Publications

Purpose: To select, digitally record, evaluate, and psychometrically equate word recognition materials that can be used to measure the speech perception abilities of native speakers of Taiwan Mandarin in quiet. Method: Frequently used bisyllabic words produced by male and female talkers of Taiwan Mandarin were digitally recorded and subsequently evaluated using 20 native listeners with normal hearing at 10 intensity levels (-5 to 40 dB HL) in increments of 5 dB. Results: Using logistic regression, 200 words with the steepest psychometric slopes were divided into 4 lists and 8 half-lists that were relatively equivalent in psychometric function slope. To increase …

The Architecture Of Instructional Theory, Andrew S. Gibbons, Clint P. Rogers Jun 2008

The Architecture Of Instructional Theory, Andrew S. Gibbons, Clint P. Rogers

Faculty Publications

This chapter joins a discussion of instructional theory that has been ongoing for nearly a century. It departs in some ways from prior discussions: (1) it considers instructional theory as a species of technological theory rather than as a type of scientific theory, a view expressed more fully elsewhere (Gibbons, 2003a), (2) it adopts the viewpoint articulated in earlier chapters of this book that there are multiple distinct bodies of technological theory that pertain to the work of instructional designers, (3) it attempts to articulate a particular view of the nature of two of those bodies of theory by describing …

Concrete Containment In Late Capitalism, Mysticism, The Marquis De Sade, And Phenomenological Anthropology, Apple Igrek Jun 2008

Concrete Containment In Late Capitalism, Mysticism, The Marquis De Sade, And Phenomenological Anthropology, Apple Igrek

All Faculty Scholarship for the College of Arts and Humanities

Georges Bataille is known for being complex and multifaceted: influenced by Christian mystics as well as Hegelians and Marxists, his work is also linked with that of the surrealists and existentialists of his own mid-20th century France as well as the post-structuralists - in particular the Tel Quel collaboraters - who followed in his wake. It would be astonishing, then, if Bataille's thinking were not conflated with precisely those movements and those ideas with which he has so much in common, despite the fact that we should refuse to expect this. Much of Bataille's work was devoted to the ambivalent …

Message In A Bottle: Lyrical Laments And Emotional Expression In Mandopop, Marc L. Moskowitz Jun 2008

Message In A Bottle: Lyrical Laments And Emotional Expression In Mandopop, Marc L. Moskowitz

Faculty Publications

This article explores the ubiquitous themes of loneliness, isolation and anomie in Mandopop (Mandarin Chinese language pop music). This is not to imply that people in the PRC and Taiwan are lonelier than people from other countries but, rather, that being human they experience these emotions. What is distinctive here is that Mandopop becomes a primary conduit to express feelings that are sanctioned in daily speech. The article addresses these concerns and uses in-depth interviews in Shanghai and Taipei to find out why Mandopop's themes of loneliness and isolation are so resonant to its fans.

What Do K-3 Children Know And Want To Know About China? A Comparative Study Of Chinese/Asian American Students And Their Peers, Ping Liu

International Education

A comparative study examined knowledge about and interest in China among Chinese/Asian-American students and peers. Participants were 261 K–3 students in a public school. Results suggested that significantly more similarities than differences existed between Chinese/Asian-American students and peers with regard to knowledge about China. In addition, results showed that students in both groups had almost identical interests in getting to know China. Suggestions based on the results are provided.

Initiating A New Information Systems Course: A Case Study In Educational Innovation, Michael Eccles, June Pym, Kevin Johnston

The African Journal of Information Systems

If South Africa is to transform its educational landscape, access to higher education is crucial. However, if equity of access is not coupled with equity of success, participation, and relevance, access can become problematic.

The Information Systems Department at the University of Cape Town, South Africa, has been concerned for a number of years about both the relevance and coherence of its first year Information Systems course. In 2007, the Department re-conceptualized this course. This case study looks at the background to the problems and motivation for the change and the proposed changes and course redesign, as well as the …

Performing Art: National Endowment For The Arts V. Finley, Randall P. Bezanson Jun 2008

Performing Art: National Endowment For The Arts V. Finley, Randall P. Bezanson

Federal Communications Law Journal

In this modified version of a chapter in his forthcoming book, ART AND FREEDOM OF SPEECH (Univ. of Illinois Press, 2008-09), Professor Bezanson begins to probe the nature of art and its relation to the first amendment free speech guarantee. The essay uses the Finley v. NEA case, and specifically its discussion of Finley's performance art, to critique the Supreme Court's very approach to the Finley case, and to view the issues from the perspective of art, artistic freedom, and the Supreme Court's role in fashioning constitutional protection for art as art, and not simply as cognitive speech.

A Risk Management Tool For The Reverse Supply Chain Network, Sheeva Banisalam Jun 2008

A Risk Management Tool For The Reverse Supply Chain Network, Sheeva Banisalam

Language, Law And Legitimacy In The Wto Agreement On Argiculture, Fiona Smith Jun 2008

Language, Law And Legitimacy In The Wto Agreement On Argiculture, Fiona Smith

Indian Journal of International Economic Law

Regulating international agricultural trade is the most difficult challenge the World Trade Organisation (WTO) faces. Despite the breakthrough in the WTOAgreement on Agriculture following years ofpiecemeal regulation under the General Agreement on Tariffs and Trade (GATT), agriculture remains problematic. Why is that? The traditional response to this question is that the existing rules in the WTO Agreement on Agriculture are inappropriate because they do not reduce restrictive barriers to trade; do not address developing countries' concerns sufficiently; or do not accommodate non-trade issues like human rights and the environment. Whilst all these assertions may be true, this article argues that …
