Are De Jure Labor Laws Absolute? Formal Manufacturing In India, Gurmeet Singh Ghumman Jan 2008

Are De Jure Labor Laws Absolute? Formal Manufacturing In India, Gurmeet Singh Ghumman

Dissertations and Theses Collection (Open Access)

We investigate the view that de facto labor market conditions are important in evaluating the effects of labor institutions in developing countries where enactment does not necessarily imply enforcement. Using India as a case study we empirically investigate the effects of labor markets on the organized manufacturing sector from 1970 to 1997. Recognizing that the state can intervene in the outcome of labor disputes we construct a measure to proxy the degree of the state legislature's prejudice towards pro-worker causes. We argue that leftist and communist political parties can interfere in the resolution of disputes in favor of workers through …

Stock Markets And Income Inequality: A Cross-Country Study, Elizabeth Mathew Jan 2008

Stock Markets And Income Inequality: A Cross-Country Study, Elizabeth Mathew

Dissertations and Theses Collection (Open Access)

This paper conducts a comprehensive analysis to understand how stock market ratios affect net income inequality. The study of how finance impacts income distribution is relevant as the income distribution of a nation influences savings decisions, resource allocation, innovation incentives and public policy and hence impacts the process of economic development. Using a cross-sectional data set of 68 countries and panel data set of 61 countries from 1975 to 2005, I apply cross-sectional OLS and panel regressions to look at how stock market size, liquidity, and activity impact income inequality. While stock market size is found to strongly impact income …

‘Slender Knowledge’: Sovereignty, Madness, And The Self In Shakespeare’S King Lear, A.G. Harmon Jan 2008

‘Slender Knowledge’: Sovereignty, Madness, And The Self In Shakespeare’S King Lear, A.G. Harmon

Scholarly Articles

In King Lear, the English law of madness, especially the aspects of testamentary devises, royal accession, waste, and plunder, is thematized in such a way that the conflict between civil order and savage nature is brought to the foreground. This dynamic overshadows, and to some extent disguises what truly lies at the heart of ancient Britain’s woes: a deficit of ontological self-inquiry on the part of the sovereign and his royal retainer, Gloucester, from which all of the other complications ensue.

Daniel Deronda: The Cultural Imperative Of Religion, Annemarie Frank Jan 2008

Daniel Deronda: The Cultural Imperative Of Religion, Annemarie Frank

The George Eliot Review Online, ISSN: 2831-5375

George Eliot's last novel Daniel Deronda differs strikingly from her earlier works in the presentation of its protagonists and her innovative use of the literary genres of realism and romanticism. In her earlier novels Eliot had espoused an idea of humanism that transcended social class by fictionalizing the small but significant contributions ordinary men and women make towards England's social and cultural progress. Eliot had created realistic heroes with human frailties on the principle that 'human deeds are made up of the most subtly intermixed good and evil'.1 Furthermore, she had attacked the ideal hero type, who was the favourite …

Naming A Place Nicodemus, Rosamond C. Rodman Jan 2008

Naming A Place Nicodemus, Rosamond C. Rodman

Great Plains Quarterly (through 2013)

Nicodemus, one of the first all-black settlements in Kansas, and the sole remaining western town founded by and for African Americans at the end of Reconstruction, has received a good deal of scholarly attention. Yet one basic matter about it remains unclear: how the town came by its unusual name. Most scholars now think that the name of the town derives from a legendary slave rather than the biblical character.

This essay challenges that consensus, contending the name Nicodemus indeed refers to the biblical character, and in doing so exemplifies the way that the dominated disguise their speech, making it …

Washington's Way Ii: The Burden Of Enforcing Growth Management In The Crucible Of The Courts And Hearings Boards, Henry W. Mcgee, Jr., Brock Howell

Seattle University Law Review

This Article continues the analysis and discussion of the conflicts and problems that beset a dispersed and decentralized growth management control system, as discussed in Washington's Way: Dispersed Enforcement of Growth Management Controls and the Crucial Role of NGOs. That article explained how Washington politicians, in an effort to combat urban sprawl, created a dispersed, "bottom-up" approach to growth management by enacting the Washington Growth Management Act (GMA). The enforcement mechanism provided under the GMA, however, was not mandated to a single government entity; rather, it was left to citizens and non-governmental organizations (NGOs) acting at the local level. …

Sustainable Trade In Pre-Colonial Asante, Karen Sanders

Senior Honors Theses and Projects

Practically, the entire area of modern day Ghana was once dominated by the Asante Empire. How did such a vast empire come into existence? This empire was able to consolidate the multiple ethnic groups within the region into one unified nation. Who were some of these ethnic groups and how were they brought into the empire? The strength of the Asante’s economy was extremely important to the longevity of their civilization. Their economic strength enabled them to procure funding which they utilized to build an army, to build trade networks, and to increase their reputation within the region. How did …

The Many Faces Of Fault In Contract Law: Or How To Do Economics Right, Without Really Trying, Richard A. Epstein Jan 2008

The Many Faces Of Fault In Contract Law: Or How To Do Economics Right, Without Really Trying, Richard A. Epstein

Articles

Modern law often rests on the assumption that a uniform cost-benefit formula is the proper way to determine fault in ordinary contract disputes. This Article disputes that vision by defending the view that different standards of fault are appropriate in different contexts. The central distinction is one that holds parties in gratuitous transactions only to the standard of care that they bring to their own affairs, while insisting on the higher objective standard of ordinary care in commercial transactions. That bifurcation leads to efficient searches. Persons who hold themselves out in particular lines of business in effect warrant their ability …

Demystifying The Right To Exclude: Of Property, Inviolability, And Automatic Injunctions, Shyam Balganesh Jan 2008

Demystifying The Right To Exclude: Of Property, Inviolability, And Automatic Injunctions, Shyam Balganesh

Articles

The right to exclude has long been considered a central component of property. In focusing on the element of exclusion, courts and scholars have paid little attention to what an owner's right to exclude means and the forms in which this right might manifest itself in actual property practice. For some time now, the right to exclude has come to be understood as nothing but an entitlement to injunctive relief- that whenever an owner successfully establishes title and an interference with the same, an injunction will automatically follow. Such a view attributes to the right a distinctively consequentialist meaning, which …

Flaws And Idiosyncrasies In Mathematicians: Food For The Classroom, Ted Eisenberg Jan 2008

Flaws And Idiosyncrasies In Mathematicians: Food For The Classroom, Ted Eisenberg

The Mathematics Enthusiast

This paper raises an ethical question: should aspects of a mathematician’s personality, political beliefs, physical handicaps, and the ironies surrounding their life be mentioned parenthetically or otherwise in our lessons? What about the political and social norms of the times in the countries in which they lived? There are no hard and fast guidelines on this other than to use good taste; but what is in good taste to one is often in bad taste to another. At the very least this paper presents tidbits of information and innuendo about mathematicians the reader might not know. But hopefully this paper …

GENERAL COURSE DESCRIPTION This course is a study of Genesis through Deuteronomy. It builds on the methodology of the first Inductive Biblical Studies course by further use of what has been previously learned and by emphasizing the study of books as wholes. Accordingly, there is special focus on the initial survey of books as wholes, the interpretation of parts of books in the context of the books as a whole and the synthesis of books. In addition, attention is given to thinking, valuing and living biblically by learning how to apply Scripture to life and ministry.

Commentary: The Trajectory Of Complex Business Contracting In Latin America, Claire Hill Jan 2008

Commentary: The Trajectory Of Complex Business Contracting In Latin America, Claire Hill

Articles

By some accounts, Latin American contract documentation increas- ingly resembles U.S. contract documentation.1 This is puzzling, given that the U.S. documentation has developed in a broader institutional context particular to the U.S. The context includes a particular type of legal train- ing, particular types of law firms, particular legal institutions, and so on. Why is this occurring, and what effect will it have on contracting practice in Latin America? This commentary briefly considers these issues; it con- siders as well some broader implications of international convergence in contracting practices.

Melvil Dewey And The Dewey Decimal Classification System, Gina Pauley Jan 2008

Melvil Dewey And The Dewey Decimal Classification System, Gina Pauley

Honors Capstones

Melvil Dewey had a great influence on the way libraries classify books. Much research and planning was involved with his Dewey Decimal Classification System. Most school libraries today still use his classification system. Therefore, students need to gain an understanding of this system in their school careers. Research was conducted on Melvil Dewey, in order to gain more understanding about his life, his classification system, his influences, and his ideas, which are still being used in libraries today. After learning about Melvil Dewey's life and his classification system, it will be easier to teach the concepts to the students. The …

The Shaky Foundation Of “Statutory Platforms”: A Comment On Baier V. Alberta, Robert E. Charney Jan 2008

The Shaky Foundation Of “Statutory Platforms”: A Comment On Baier V. Alberta, Robert E. Charney

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

In Baier v. Alberta the Supreme Court of Canada considered the validity of Alberta legislation, enacted in 2004, which established a province-wide restriction on school employees serving as school trustees on any Alberta school board. The majority of the Court upheld the validity of this statute, finding that while serving as a school trustee is an expressive activity, the province had no obligation to provide teachers with a “statutory platform for expression” and there was, the refore, no infringement of Charter section 2(b). This paper argues that the majority erred in seeing this as a freedom of expression case at …

Welcome to the School of Architecture. Short of spending an entire semester in the building, I think perusing this volume is the next best thing to being here. The work you will see of the students is representative of the best but the variety and quantity also attests to the depth of accomplishment - significant achievement is not found in just a few stars, but is evident across the entire student body. While the work should depict the broad range of issues, media and ideas underlying architectural thinking these days, I also think that a clear educational philosophy will be …

How Learning Mathematics Parallels Learning A Second Language And Implications For Teaching, Michael E. Matthews Jan 2008

How Learning Mathematics Parallels Learning A Second Language And Implications For Teaching, Michael E. Matthews

Essays in Education

This paper investigates the hypothesis that the language and symbols used to communicate mathematics (ML) can be considered a separate language from natural languages like English. Using definitions and characteristics found in natural languages, the paper investigates when and how these aspects show up in ML. ML is established as a separate language in most features. The paper continues by combining major findings in second language acquisition research with mathematics education research to develop suggestions to improve ML learning and thus improve mathematical learning.
